Report: Rosenstein OK’d FBI’s Cohen Raid

President Donald Trump is reportedly furious over the matter.

President Donald Trump’s advisers reportedly urged him to restrain himself after he learned Special Counsel Robert Mueller sought an FBI raid on his personal attorney’s offices in Manhattan, but now it appears he may have another target for his ire.

The New York Times broke the story Monday afternoon that FBI agents raided Michael Cohen’s office and seized documents covered by attorney-client privilege. Several legal analysts have observed the move required the demonstration that Cohen is a “menace to society,” and that he was likely to destroy the documents.

That flies in the face of what the public knows regarding Cohen’s cooperation with the Special Counsel’s Office.

The newspaper has also reported that Deputy Attorney General Rod Rosenstein personally signed off on the raid. This follows revelations that Rosenstein personally signed off on at least one FISA warrant that has fueled the entire “Russia Narrative” investigation.

The Times further reports:

“The episode has deeply unsettled White House aides, Justice Department officials and lawmakers from both parties, who believe the president may use it as a pretext to purge the team leading the investigation into Russia meddling in the 2016 election.

“Trump has long been mistrustful of Mr. Rosenstein, the Justice Department’s No. 2 official, who appointed the special counsel, Robert S. Mueller III, and now oversees his investigation into Mr. Trump’s campaign and possible obstruction of justice by the president.

“Trump is now again telling associates that he is frustrated with Rosenstein, according to one official familiar with the conversations.”

There are quickly emerging two factions within the White House over whether or not the president should shut the entire investigation down, with the majority apparently believing his effort to do so could result in the end of his presidency.

Pres. Trump Lawyers: Cohen Docs Protected

Attorneys representing President Donald Trump and his personal attorney, Michael Cohen, have argued to a federal judge that documents seized by the FBI in a raid were protected by attorney-client privilege.

U.S. law protects, and the Supreme Court has upheld the opinion that it is a broad protection, the right to refuse to disclose, and to prevent any other person from disclosing, confidential communications between an attorney and his or her client. This is known as attorney-client privilege.

Cohen is seeking a restraining order to prohibit the FBI or anyone else from using the seized materials. A hearing was held this morning at the Manhattan federal courthouse to discuss the request.

Attorneys working for Special Counsel Robert Mueller argued that a “taint team”—a supposedly impartial group of lawyers and FBI agents—should review all of the evidence seized during this week’s raid. This has been widely reported as “standard procedure” to determine “independently” what should be shielded under attorney-client privilege.

According to both CNN and Business Insider, Cohen had a propensity for recording all of his conversations with associates. This reportedly included conversations with Trump 2016 campaign staffers—which reportedly could be a major problem for those staffers, and a boon for the special counsel’s team of investigators.

U.S. District Judge Kimba Wood appeared keen to let that happen. In response, Cohen’s attorney asked for delay, saying she did not have enough time to fully prepare for the hearing. The judge relented, and scheduled a continuation until 2 p.m. EDT Monday.

Cohen is also now pointing to the raid as a reason to delay the civil lawsuit filed by porn star Stormy Daniels, which sought to undo her non-disclosure agreement over an alleged extramarital affair with the president 12 years ago.
