What the courts have decided

In June 2016, the Supreme Court ruled 4-4 in a case that challenged Obama’s DACA program. The court remained deadlocked due to the Senate’s refusal to have confirmation hearings for Obama’s Supreme Court Justice nominee, Judge Merrick Garland.

With Trump-nominated Justice Neil Gorsuch, a staunch conservative, now on the court, it is unlikely DACA would survive a Supreme Court challenge—not to mention the question of whether the Trump administration would even defend the program.

California's attorney general says a separate lawsuit he plans to file over the Trump administration's plan to end protections for young immigrants will mirror the legal arguments made in a suit already filed by 15 states and the District of Columbia.

Attorney General Xavier Becerra, a Democrat, said Wednesday he is going ahead with his own lawsuit because one in four participants in the Deferred Action for Childhood Arrivals program lives in California and the state will suffer the greatest harm from its termination. He says he'll file the suit soon.

However, these individuals were unable to legally obtain Social Security numbers for their pre-DACA employment, which means that they used fraudulently obtained Social Security numbers that all-too-often belong to American citizens, including American children.

The use of unlawfully obtained Social Security numbers by individuals eligible for DACA status is so pervasive that the Obama administration instructed applicants not to disclose their illegally obtained numbers. That ensured that Americans who are the victims of DACA identity theft were left with destroyed credit, arrest records attached to their names, unpaid tax liabilities, and corrupted medical records while the DACA recipients walked away scot-free from multiple felonies — forgery, Social Security fraud, perjury on I-9 forms, and identity theft.

1  The 3.6 million is about 1.1% with the American population at 327 million.  It seems like there are a lot more.  But, when the police in NV do sweeps at the workplace, they are tipped off by hispanic police, and stay home.

2   Trump has said all along, people can come back in the correct way, so this is not the tragedy it is portrayed to be.  Also, "landscaper" is a euphemism for a yard man who mows the lawn and trims bushes.  Landscaper as the title brings to mind a person with a degree.  Nothing wrong with it either way.

ON APRIL 24th, Donald Trump suffered a third setback to his effort to undo Deferred Action for Childhood Arrivals (DACA). The programme, introduced by Barack Obama in 2012, shields undocumented immigrants brought to America as children from deportation. Twice in recent months, federal judges in California and New York have concluded that Mr Trump’s decision in September 2017 to ditch DACA was illegal. Both rulings effectively wiped out the end-date of March 5th the Trump administration set in the autumn.

The decision this week from Judge John Bates goes further than either of the previous injunctions. As well as requiring Mr Trump to process renewals of existing DACA enrollees, Judge Bates orders the president to invite and approve first-time applications from so-called Dreamers who have yet to register for the programme.

This is a silver lining for the Trump administration. Yes, Judge Bates criticised the rollback as “virtually unexplained” and obliquely scolded the Trump administration for being callous. But in delaying the implementation of his order, he suggested one example of how DACA could be legitimately ended.

“The multi-state coalition lawsuit we filed today is about the rule of law, not the wisdom of any particular immigration policy,” Paxton said at a press conference.

According to Paxton, the suit faults activist judges for preventing the Trump administration from phasing out DACA as promised.

“That means that unelected federal judges are forcing the Trump administration to leave an unlawful program in place indefinitely as legal challenges drag on,” Paxton said.

“President Trump has a duty under the Constitution to take care that the law be faithfully executed.”

Other states joining the lawsuit include Alabama, Arkansas, Louisiana, Nebraska, South Carolina and West Virginia.

Trump alleged that his policies have ?made them richer? and that they ?want to protect their companies outside the U.S. from being taxed,? while he supports the American worker. In another tweet Trump called them: ?Two nice guys with bad ideas.?

Trump?s comments followed a Bloomberg report that the Koch donor network sought to distance itself from Trump and the Republican Party at a weekend gathering in Colorado where, among other concerns were also raised that his trade policies could fuel a recession.

    Charles and David Koch have been a force in American politics for decades, channeling billions of dollars into conservative causes. But the billionaire industrialist pair didn?t support Trump in the 2016 campaign, even though their network has since praised his administration?s efforts to cut taxes and regulations. More recently, it has criticized his actions on trade issues.

Trump's latest outburst is especially troubling because keeping the Koch donor network happy is important to Republicans, especially in election years.

    It plans to spend about $400 million on state and federal policy and politics during the two-year cycle that culminates with November?s balloting, a 60 percent increase over 2015-16. Besides trying to influence electoral politics, the organization also works on education, criminal justice, workforce and poverty issues.

The Koch network?s decision Monday not to support Representative Kevin Cramer against Democratic Senator Heidi Heitkamp in North Dakota was cast as a warning to other Republicans who might be tempted to stray from the free-market, fiscally restrained approach backed by the Kochs and their followers. As Bloomberg noted, the decision not to back Cramer, as the network sought to put on a more bipartisan face, was announced at a briefing for more than 500 donors gathered for a three-day meeting at a luxury resort in Colorado Springs, Colorado.

    ?We can?t support him at this time,? said Tim Phillips, president of Americans for Prosperity, the network?s flagship political organization.

COLORADO SPRINGS — U.S. House Speaker Paul Ryan outlined what he suggested is an optimistic, policy-driven platform for the Republican Party at an exclusive retreat for conservative donors Monday, showcasing a competing vision to the darker campaign of Donald Trump.

The Wisconsin lawmaker said Republicans face a “fight for the soul of our party” as he spoke on the final day of a seminar hosted by billionaire brothers Charles and David Koch that drew 400-plus to The Broadmoor Resort in Colorado Springs.

If Republicans retain control in the House, Ryan said the agenda will focus on six main points: reducing poverty, strengthening national security, eliminating regulations, reducing the size of government, replacing Obamacare and reforming the tax code.

The three-day event drew major Colorado political names, including Coffman; U.S. Sen. Cory Gardner, whom the network helped elect in 2014; and Larry Mizel, a wealthy developer and chairman of Trump’s finance team in Colorado.

Despite the well-heeled location and wealthy guests, the event focused on income inequity and the lack of upward mobility in society. Charles Koch, a billionaire industrialist, made remarks that decried the “two-tiered society” between the rich and poor.

The Catholic University of America accepts more money from Charles Koch Foundation

On Thursday, The Catholic University of America's School of Business announced it had accepted a $3 million grant to "bolster the school's goal of advancing the study and practice of principled entrepreneurship."
 
The Charles Koch Foundation is funding $1.75 million of the grant.

Texas Federal Judge Rules DACA Illegal, But Will Not End It Before Appeal

A Texas federal judge ruled on Friday that the Deferred Action on Childhood Arrivals (DACA) amnesty program for illegal aliens violates federal law, but declined the request of Texas Attorney General Ken Paxton and other states to issue an injunction blocking the program immediately, and instead certified his order for immediate appeal, fast-tracking this case for quick resolution.

In a 117 page opinion, Judge Andrew Hanen of U.S. District Court for the Southern District of Texas agreed that the attorneys general, led by Paxton, were correct in their interpretation of the law ? that the Obama administration?s controversial 2012 executive action violates the Administrative Procedure Act (APA) and impermissibly orders the federal government to ignore American immigration laws.
