Once again you see how unprofessional, unstatesman and childish Obama really is. You can bet if this had been Ginsburg or one of his liberal benchwarmers he would have changed his plans and attended the funeral (or gave the eulogy) of a longstanding and excellent Justice on the high court. There is no excuse for him not being there, PERIOD! Very unpresidential!

The biggest issue here is that if O was a real President and real American with integrity, he would not be trying to appoint anyone this late in his term, and in an election year. Pure arrogance!

The Senate has many more important things to do than to rush Obama's lameduck appt (AND GLOBALIST AGENDAS) through a particularly important election year, especially when the country is falling apart (thanks guys for not doing your jobs. Your sense of priorities is shameful!).

Whether or not an alleged member of Opus Dei, like Justice Antonin Scalia, enjoys a touch of the lash on his prodigious derriere from time to time, is certainly no business of ours. However, the affiliation of a Justice on the highest court in the land to an organization that, for all appearances, is nothing more than a right-wing cult should arouse not only suspicion, but an investigation.

Opus Dei is a clandestine Catholic organization based in Chicago, Ill. In size, it is insignificant, a mere 85,000 members (only 3,000 members in the US) compared to the one billion Catholics worldwide. But, its membership boasts of some of the most powerful and wealthy people in the country. Several well-funded organizations — including the League of Women Voters and the NAACP — are fighting efforts to prevent non-citizens from voting illegally in the upcoming presidential election. And the United States Department of Justice, under the direction of Attorney General Loretta Lynch, is helping them.

However, the majority opinion in that case, written by Justice Antonin Scalia, stipulated that if the EAC refused Arizona’s request to accommodate the proof-of-citizenship requirement, the state could sue the EAC and establish in court that “a mere oath will not suffice to effectuate its citizenship requirement and that the EAC is therefore under a nondiscretionary duty to include Arizona’s concrete evidence requirement on the Federal Form.”

The Court went so far as to say that Arizona could also claim that a refusal by the EAC would be “arbitrary,” since the agency “has accepted a similar instruction requested by Louisiana.” Indeed, the Court noted, the EAC had ”recently approved a state-specific instruction for Louisiana requiring applicants who lack a Louisiana driver’s license, ID card, or Social Security number to attach additional documentation” to the federal voter-registration form.

A review of public records shows that some of the men who were with Scalia at the ranch are connected through the International Order of St. Hubertus, whose members gathered at least once before at the same ranch for a celebratory weekend.

Members of the worldwide, male-only society wear dark-green robes emblazoned with a large cross and the motto “Deum Diligite Animalia Diligentes,” which means “Honoring God by honoring His creatures,” according to the group’s website. Some hold titles, such as Grand Master, Prior and Knight Grand Officer. The Order’s name is in honor of Hubert, the patron saint of hunters and fishermen.

Senate Minority Leader Harry Reid  (D-Nev.) in an interview broadcast Sunday said Republicans will lose Senate seats over their plans to block President Obama’s Supreme Court nominee, Merrick Garland.

WASHINGTON — The Supreme Court handed organized labor a major victory on Tuesday, deadlocking 4 to 4 in a case that had threatened to cripple the ability of public-sector unions to collect fees from workers who chose not to join and did not want to pay for the unions’ collective bargaining activities.

It was the starkest illustration yet of how the sudden death of Justice Antonin Scalia last month has blocked the power of the court’s four remaining conservatives to move the law to the right.

A ruling allowing workers to refuse to pay the fees would have been the culmination of a decades-long campaign by a group of prominent conservative foundations aimed at weakening unions that represent teachers and other public employees. Tuesday’s deadlock denied them that victory, but it set no precedent and left the door open for further challenges once the Supreme Court is back at full strength.

The 4-3 ruling greenlights the limited use of affirmative action polices by schools.

"The Court's affirmance of the University's admissions policy today does not necessarily mean the University may rely on that same policy without refinement. It is the University's ongoing obligation to engage in constant deliberation and continued reflection regarding its admissions policies," Justice Anthony Kennedy wrote in the majority opinion.

The 4-3 split Justices Kennedy, Ginsburg, Sotomayor and Kennedy against the conservatives. Justice Clarence Thomas wrote his own dissent and Chief Justice John Roberts joined Alito's dissent.

Justice Antonin Scalia sat for oral arguments in the case but died before the decision came down. Justice Elena Kagan recused herself from the case, presumably because she dealt with it in her previous job as solicitor general.

I also think there's a growing gap between judges (including the Supreme Court justices) and the academy, which judges tend to think is increasingly distant from the actual practice of law, staffed as it increasingly is with refugees from other disciplines—the graduate students in classics, and history, and anthropology, and so on who upon discovering there were very few well-paying positions in such fields nowadays decided to go to law school and afterward had no time to practice law before getting a law-teaching job.

I see absolutely no value to a judge of spending decades, years, months, weeks, day, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation (across the centuries—well, just a little more than two centuries, and of course less for many of the amendments).

Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century. Which means that the original Constitution, the Bill of Rights, and the post–Civil War amendments (including the 14th), do not speak to today.

David Strauss is right: The Supreme Court treats the Constitution like it is authorizing the court to create a common law of constitutional law, based on current concerns, not what those 18th-century guys were worrying about.

Daniel Horowitz, a senior editor at Conservative Review and policy analyst specializing in immigration, blasted conservative triumphalism after the Supreme Court refused to rescue President Barack Obama’s unilateral mass amnesty program. Indeed, Horowitz warned conservatives not to underestimate how closely they came to absolute disaster.

“We are facing a ‘blue firewall’ of four post-Constitution judges on the Supreme Court,” Horowitz told WND. “And some of the others aren’t much better. Justice Anthony Kennedy is unreliable. Chief Justice Roberts is unreliable. And the lower circuit courts are mostly worse than the Supreme Court.”

Why Scalia was killed?  No US POTUS is allowed to be a foreigner  ( ie the native born clause)

In a move certain to fuel the debate over Obama’s qualifications for the presidency, the group “Americans for Freedom of Information” has Released copies of President Obama’s college transcripts from Occidental College … Released today, the transcript school indicates that Obama, under the name Barry Soetoro, received financial aid as a foreign student from Indonesia as an undergraduate.

The transcript was released by Occidental College in compliance with a court order in a suit brought by the group in the Superior Court of California. The transcript shows that Obama (Soetoro) applied for financial aid and was awarded a fellowship for foreign students from the Fulbright Foundation Scholarship program. To qualify, for the scholarship, a student must claim foreign citizenship.

This document would seem to provide the smoking gun that many of Obama’s detractors have been seeking. Along with the evidence that he was first born in Kenya and there is no record of him ever applying for US citizenship, this is looking pretty grim. The news has created a firestorm at the White House as the release casts increasing doubt about Obama’s legitimacy and qualification to serve as President article titled, “Obama Eligibility Questioned,” leading some to speculate that the story may overshadow economic issues on Obama’s first official visit to the U.K. In a related matter, under growing pressure from several groups,

Justice Antonin Scalia announced that the Supreme Court agreed on Tuesday to hear arguments concerning Obama’s legal eligibility to serve as President in a case brought by Leo Donofrio of New Jersey . This lawsuit claims Obama’s dual citizenship disqualified him from serving as president.. Donofrio’s case is just one of 18 suits brought by citizens demanding proof of Obama’s citizenship or qualification to serve as president.

Subject: RE: Issue of Passport?

While I’ve little interest in getting in the middle of the Obama birth issue, Paul Hollrah over at FSM did so yesterday and believes the issue can be resolved by Obama answering one simple question: What passport did he use when he was shuttling between New York , Jakarta , and Karachi ?

So how did a young man who arrived in New York in early June 1981, without the price of a hotel room in his pocket, suddenly come up with the price of a round-the-world trip just a month later? And once he was on a plane, shuttling between New York , Jakarta , and Karachi , what passport was he offering when he passed through Customs and Immigration?

The American people not only deserve to have answers to these questions, they must have answers. It makes the debate over Obama’s citizenship a rather short and simple one Q: Did he travel to Pakistan in 1981, at age 20? A : Yes, by his own admission. Q: What passport did he travel under? A: There are only three possibilities.
1) He traveled with a U.S. … Passport,
2) He traveled with a British passport, or
3) He traveled with an Indonesia passport. Q: Is it possible that Obama traveled with a U.S. Passport in 1981? A: No. It is not possible. Pakistan was on the U.S. . State Department’s “no travel” list in 1981.

Conclusion: When Obama went to Pakistan in 1981 he was traveling either with a British passport or an Indonesian passport. If he were traveling with a British passport that would provide proof that he was born in Kenya on August 4, 1961, not in Hawaii as he claims.. And if he were traveling with an Indonesian passport that would tend to prove that he relinquished whatever previous citizenship he held, British or American, prior to being adopted by his Indonesian step-father in 1967.


Whatever the truth of the matter, the American people need to know how he managed to become a “natural born” American citizen between 1981 and 2008. Given the destructive nature of his plans for America, as illustrated by his speech before Congress and the disastrous spending plan he has presented to Congress, the sooner we learn the truth of all this, the better
.
 If you Don’t care that Your President is not a natural born Citizen and in Violation of the Constitution, then Delete this, and then lower your American Flag to half-staff, because the U.S. Constitution is already on life-support, and won’t survive much longer.
 If you do care then Forward this to as many patriotic Americans as you can, because our country is being looted and ransacked!.

In a world where political symbols matter, President Barack Obama chose a worthy subject for the first executive order of his new administration.

His first executive order, entitled “Presidential Records,” revokes Executive Order 13,233, President George W. Bush’s constitutionally lunatic procedure for enabling former Presidents and Vice Presidents to limit public access to their records. The obscurity of the subject does not diminish the importance of what the new President is signaling.

A statute called the Presidential Records Act (PRA) gives an executive branch official, the National Archivist, custody of a former President’s records upon the conclusion of the President’s term of office. The PRA requires the Archivist, within specific procedural guidelines, to make presidential records “available to the public as rapidly and completely as possible.”

The key procedural guidelines are two-fold.

First, a President is entitled to restrict access for up to 12 years to any of his records that fall within certain specified categories.

Second, whenever a presidential record becomes available for disclosure - either because no President has restricted access or because the time for restricted access has expired - the Archivist is to handle requests to view such records as largely as if they were requests under the Freedom of Information Act, thus creating a legal presumption in favor of its disclosure.
