Those currently proposing forced vaccination laws point to a U.S. Supreme Court decision from 1905: Jacobson v. Massachusetts. In fact, the Supreme Court has not heard a compulsory vaccine case since the 1920s.

In the article presented here, Attorney Emord looks at the history of compulsory vaccination, and shows how it was Oliver Wendell Holmes, Jr. who stripped away Fourteenth Amendment rights in regards to compulsory vaccination, the very same judge who ruled in favor of forced sterilization which was supported by the “science” of that day, eugenics. Eugenics is the same “science” used by the Nazis in Germany to endorse eliminating “feeble-minded” people in favor of a “master race.”

Legislators in thirteen states have introduced bills that would severely constrict or eliminate exemptions from compulsory vaccination, with the intended aim of coercing, cajoling, or forcing those who have not been vaccinated to become so. Those states are California (SB 277); Illinois (SB 1410); Maine (LD 606); Maryland (HB 687); Minnesota (SF 380 and HF 393); New Jersey (S 1147 and A351); New Mexico (HB 522); Oregon (SB 442); Pennsylvania; Rhode Island (S381); Texas (SB 1114; SB 538; HB 2006); Vermont (H212; S87); and Washington (HB 2009).

Amidst hysteria arising from a relatively small number of cases of measles (some 600 last year and some 150 this year), law makers would take away everyone’s rights to liberty and personal autonomy.

Given the likelihood that at least some of these draconian measures will pass, it is wise to reflect upon our history to see from whence this peculiar deviation from ordinary protection for liberty rights comes. It is also wise to appreciate that the law favoring compulsory vaccination is now scientifically anachronistic and that modern understanding of immunology enables us to employ measures that reduce the risk of disease carriage and transmission without forcibly tying down children and adults and injecting them with substances they do not wish to have in their bodies.

It will surprise many to learn that the concept of compulsory vaccination has national socialist roots in our country that spring from the same drive for a “master race” that led the Nazis to embrace eugenics (including forced sterilization) and dysgenics (including execution of the Jews and others deemed “undesirable”). It will surprise many to learn that the person most responsible for eliminating constitutional protections against such intrusions (the Fourteenth Amendment) is one regarded as among America’s greatest jurists and legal scholars, Oliver Wendell Holmes, Jr. Holmes believed in eugenics and even dysgenics (execution of those whom he regarded as “feeble-minded,” “undesirable,” and “inadequate”).

Horrific to any reasonable person in any age, Holmes relished in the idea of creating a “pure” American bloodline through government mandated infanticide and sterilizations. It was therefore of little consequence to him that individuals be forcibly vaccinated, because in his view the science of eugenics and purification of the race were far more important to protect and advance than the individual’s right to liberty.

When the law gives sanction to compulsory vaccination on the theory that the public interest trumps the individual right of personal autonomy and liberty, precious little defense remains for individuals to dissent from all manner of government health-based impositions. If those in power can compel a person to receive an injection against his or her will to ward off diseases said to be communicable, than what is to stop the state from forcibly requiring that all Americans be tested for, say, heritable disease and sterilized if they are found genetically predisposed to pass on diseases that burden society like certain forms of breast cancer, Down syndrome, cystic fibrosis, Haemophilia, polycystic kidney disease, sickle-cell disease, or Tay-Sachs disease?

Setting aside whether these diseases are, in fact, heritable rather than the product of environment and whether they would arise even if people who have them were sterilized, it is the popular medical dogma (as it is with diseases for which vaccines have been created) that elimination of them can only be achieved by one sure method: eliminating the culprit genes from heritability.

There is in this compulsory thinking an elitist motive with strong ties to the notion that the power of the state should be marshaled against a minority of those resistant to the popular will in favor of vaccination, taking from them their freedom to ensure that they conform. Indeed, it is an elitest conception of conformity that drives both mandatory vaccination and mandatory sterilization.

If you do not see in this compulsion the hallmarks of national socialism, antithetical to our Constitution of Liberty, you must revisit world history from the age of Enlightenment to the end of Nazi Germany. In between, you will find that the same foul doctrine of authoritarian control over the individual existed in this country as in fascist Germany, Italy, and Japan, as in Communist China today. Indeed, that doctrine was given legal approval by Supreme Court Justice Oliver Wendell Holmes, Jr.

In Law Without Values: The Life, Work, and Legacy of Justice Holmes, University of Chicago Professor of Law Emeritus Albert W. Alschuler records Holmes reasons for favoring deprivation of individual liberty to serve the ends of medical science. To quote Holmes, he favored “substitut[ing] artificial selection for natural by putting to death the inadequate.” He professed “contempt” for “socialisms not prepared . . . to kill everyone below standard.” He envisioned “a future in which science shall have passed from the combative to the dogmatic stage, and shall have gained such catholic acceptance that it shall take control of life, and condemn at once with instant execution what now is left for nature to destroy.”

He thought it worth “whatever the cost” to achieve the goal of keeping “certain strains out of our blood.” He believed in “restricting propagation by the undesirables and putting to death infants that didn’t pass the examination, etc., etc.” He believed that we should “prevent continuance of the unfit.”

We see comparably repulsive favoritism for ending the lives of others with whom he harbored disdain in a decision by Holmes holding forced sterilization constitutional under the Fourteenth Amendment, the infamous 1927 decision of Buck v. Bell. In that decision, Holmes wrote that it was within the rightful power of the state to:

“prevent our being swamped with incompetence. It is better for all the world, if instead of waiting to execute degenerate offspring for crime, or to let them starve for their imbecility, society can prevent those who are manifestly unfit from continuing their kind.” He crudely added, “the principle that sustains compulsory vaccination is broad enough to cover cutting the Fallopian tubes. Jacobson v. Massachusetts . . . Three generations of imbeciles are enough.”

Holmes relished the opportunity to transform American law in ways that would elevate the power of the state over the individual such that medical procedures deemed to be for the good of society could trump the individual right to personal liberty and autonomy. His first foray into this realm as a jurist was the 1905 decision of Jacobson v. Massachusetts. In that case, a Massachusetts law permitted forcible vaccination whenever the board of health of a city or town determined it to be necessary “for the public health and safety.” Smallpox had appeared in Cambridge, Massachusetts, and the city adopted a regulation compelling vaccination of city inhabitants.

Jacobson did not want to experience any risks arising from the vaccine and had a Fourteenth Amendment liberty right to refuse. Broadly construing the state police power, Holmes argued that the liberty right of the Fourteenth Amendment was not absolute and that to protect the safety of members of society, the interests of “safety, health, peace, good order, and the morals of the community” could override liberty. Holmes therefore ruled that Massachusetts could compel Jacobson’s vaccination.

Decided in 1905, the Jacobson decision has become quite dated, scientifically. While still followed by state courts, the law has failed to keep pace with the evolution in the science of immunology. In 2015, the scientific and medical communities have a far better understanding of the nature of disease transmission and of the relative levels of risk associated with disease. There are numerous less restrictive alternatives to vaccination that provide as great, if not greater, protection against individuals becoming carriers of disease. For example, we now understand well those circumstances that must be present for a disease, like measles, to be transmitted.

Let us assume, for example, that there is an outbreak of measles in a public school in Newark, New Jersey, and your child who is not vaccinated attends school in Camden, New Jersey. Let us assume further that upon consultation with an expert in immunology and based on that consult, you insure that your child takes specific and extensive steps to avoid becoming a carrier of the disease. For example, among other risk reduction strategies, you have your child at school wear a face mask covering nose and mouth and hygienic gloves and avoid any interpersonal contact with other students during the time public authorities say there remains a risk of measles contagion. Because vaccines are not 100% effective, including the measles vaccine, there will be children who will become carriers and may transmit the disease to others even when vaccinated. It is the case, however, that your child, having observed these alternative steps will be at no greater risk of contracting the disease than a child who is vaccinated.

In short, the presence of obvious, less intrusive alternatives to vaccination in aid of reducing to zero or near zero the risk of disease transmission raises a new basis to reverse Jacobson and restore full Fourteenth Amendment protection to the liberty right of the individual who wishes not to be vaccinated. Even in Jacobson, Holmes saw fit to cite United States v. Kirby for the proposition that laws must be given a sensible construction and that “general terms should be so limited in their application as not to lead to injustice, oppression, or an absurd consequence.”

Compulsory vaccination statutes today are a throw back to a repulsive era in our own nation’s history from the dawn of the Twentieth Century to the end of World War II of national socialism, of eugenics, when the rights of man were made to take a back seat to the quest of nations to develop a master race, free of disease and of all “undesirables,” to quote Holmes. Oliver Wendell Holmes, Jr. was a strong advocate of this form of national socialism, believing wholeheartedly in the creation of an American master race in which forced vaccination, sterilization, and extermination of “undesirables” were lawful measures to advance the cause.

That repulsive view, even in the slightest application, has no place in a nation that defends liberty to its fullest rightful extent, as Thomas Jefferson understood it: “unobstructed action according to our will within limits drawn around us by the equal rights of others.”

In protecting the rights of all, we must especially protect the rights of the minority, because each of us will at some point be a part of a minority standing against the will of a majority with political power. To ensure adequate protection for individual rights, we must ensure that no measure of compulsion adopted by the state is allowed to trump Fourteenth Amendment and, in the case of free exercise of religion against vaccination, First Amendment grounds when there are obvious, less intrusive alternatives to the compulsion. In the case of vaccination, we have reached that point of scientific knowledge whereby it is no longer necessary to traumatize children who wish not to be vaccinated or parents for that matter, so long as they are willing to undertake reasonable alternative measures to reduce the risk of disease carriage and transmission.

        SB277 aims to remove a parent’s right to informed consent. The choice of what, when and how a child is to be vaccinated needs to remain between a family and their doctor. Where there is a risk of injury or death, no matter how small the perceived risk may be, there must be a choice. To mandate a medical procedure with known risks is unethical.

well there was a great push back today in Sacramento wow ...

Typically using the Delphi technique the "legislators" cell meeting will have to be rescheduled for "their" decision till next week .. I assume all the folks will just come back again ...'  - Also interesting is these folks are threatening to take their kids out of public schools entirely and find any alternatives ... This would mean lots of news in the commie/fascist/collectivist California press and possibly beyond to other states ... Lets not even talk about the Sacto fluoridation program for the "kids" (First5 ! )

SACRAMENTO -- A controversial bill to require vaccinations for all California school children ran into trouble Wednesday, when its author delayed a key Senate committee vote after enraged parents opposed to the legislation demanded lawmakers answer a central question: Don't all kids -- whether they are vaccinated or not -- have a right to a public education?

With bill co-author Sen. Richard Pan facing similar questions from fellow committee members, the Sacramento Democrat put the brakes on a scheduled vote in the Senate Education Committee, promising to return with answers in a week for another hearing.


The unexpected retreat seemed a promising turn of events for hundreds of opponents who again showed up in Sacramento to challenge lawmakers and insist the bill would deprive them of their right to choose not to vaccinate their children.

"It shows that legislators realize it's a bad bill," said Jean Munoz Keese, a spokeswoman for California Coalition for Health Choice, a group of parents and others who are fighting the bill. "They started looking closely at this bill and realized it is not what Sen. Pan wants people to believe. It essentially will deny children the right to access public education and there are no answers in the current bill to address that."

Senate Bill 277, which passed its first test a week ago in the Senate Health Committee, needs five votes to proceed out of the Senate Education Committee and then must pass through the Senate Judiciary Committee before heading to the Assembly and then to Gov. Jerry Brown's desk.

Oral health is an ongoing area of interest for First 5 LA. In 2006 with Board approval for the Oral Health & Nutrition Expansion & Enhancement Project, First 5 LA established oral health as a funding priority. Further, the Board revised the Next Five Strategic Plan to include Oral Health goals and objectives and allocated $10 million for a multi-strategy framework.

On May 17, 2007, at the request of Chair Yarovslavsky, a panel of experts in the field of dental disease prevention,
specifically community water fluoridation, provided a presentation on the history of fluoridation, legislative mandates, models of water fluoridation throughout California, current activities in Los Angeles County, and the need for additional support. Following this presentation, the Board directed staff to prepare information addressing a range of questions and concerns that arose
during the discussion as well as options that build upon the October 2006 Oral Health & Nutrition Expansion & Enhancement Project for the Board to consider in 2007.

The Marin Municipal Water District serves about 190,000 people between Sausalito and San Rafael. The North Marin Water District, which provides water to Novato and West Marin, doesn't fluoridate its water and the issue has never come to a public vote.

When they do get pregnant, and produce their own version of HCG, it triggers the production of antibodies that cause a miscarriage.


“We knew that the last time this vaccination with five injections has been used was in Mexico in 1993 and Nicaragua and the Philippines in 1994,” said Dr. Ngare. “It didn’t cause miscarriages till three years later,” which is why, he added, the counterclaims that women who got the vaccination recently and then got pregnant are meaningless.

Ngare said WHO tried to bring the same anti-fertility program into Kenya in the 1990s. “We alerted the government and it stopped the vaccination. But this time they haven’t done so.”

SACRAMENTO, Calif. (AP) - State senators are taking up a controversial bill aimed at increasing California’s school immunization rates.

Democratic senators Ben Allen of Santa Monica and Richard Pan of Sacramento say they will seek approval of their SB277 in the Senate on Thursday.

The bill would prohibit parents from seeking vaccine exemptions for their children because of religious or personal beliefs.

Medical waivers would be available only for children who have health problems, forcing unvaccinated children to be homeschooled.

California would join Mississippi and West Virginia as the only states with such strict requirements if the bill becomes law.

The bill first needs to pass the Senate and Assembly and win approval from Gov. Jerry Brown.

Hundreds of parents who oppose the vaccine mandate have flooded the Capitol to protest in recent weeks.

Unlike past rallies before Senate committee hearings on the bill -- SB 277 has already passed the Senate health, education and judicial committees -- this time, anti-vaccine protesters got public support at the rally from some legislators who are siding with them.

In remarks delivered to the crowd -- many waving placards with slogans like "Parents Call The Shots'' and "I (heart) My Education,'' Assemblyman Jim Patterson, R-Fresno, said unvaccinated children who must be home-schooled might feel like they're in internment camps.

On Monday, efforts such as SB 277 got a boost after the American Medical Association announced during its annual meeting that it supports tighter limits on immunization opt outs. Under a new policy adopted by the physicians' group, the AMA will seek more stringent state immunization requirements to allow exemptions only for medical reasons.

Other legislation has a more direct bearing on the industry, and it is an active political player. Pharmaceutical companies and their trade groups gave more than $2 million to current members of the Legislature in 2013-2014, about 2 percent of the total raised, records show. Nine of the top 20 recipients are either legislative leaders or serve on either the Assembly or Senate health committees. Receiving more than $95,000, the top recipient of industry campaign cash is Sen. Richard Pan, a Sacramento Democrat and doctor who is carrying the vaccine bill.

In addition, the industry donated more than $500,000 to outside campaign spending groups that helped elect some current members last year.

Leading pharmaceutical companies also spent nearly $3 million more during the 2013-2014 legislative session lobbying the Legislature, the governor, the state pharmacists’ board and other agencies, according to state filings.

A leader of the Nation of Islam has warned African American lawmakers of political repercussions if they support a bill that would require many more children to be vaccinated. A coalition of other black organizations on Monday countered that message with support for the measure.

Nation of Islam Western Regional Minister Tony Muhammad has told members of the California Legislative Black Caucus that they will face a backlash from their community if they support the bill, which may come up for a vote in the Assembly on Thursday.

“That is a traitorous act,” he said of black lawmakers voting for the bill, which already passed the state Senate. “They will not be welcome in the black community if they vote like that.”

In 2012, then California Assemblyman Dr. Richard Pan (D-Sacramento)1 assured Californians that a bill he sponsored (AB2107) to increase child vaccination rates in the state would not remove parental rights to make vaccine choices for their children.

Now a state Senator, he's singing a different tune. This year he worked with attorney Senator Ben Allen (D-Santa Monica) to fast track a bill (SB277) through the state legislature

The bill would make it virtually impossible for California children to attend daycare or get a school education without receiving more than 40 doses of 10 federally recommended vaccines or filing a medical vaccine exemption granted by a medical doctor.

If the bill is made law, parents and their children will pay a hefty price. As Dr. Pan stated on his Facebook page2 on June 9:


"it is time for all state legislatures to step in... Yes, parents have the right to refuse vaccination for their children, but to protect other parents' and children's rights, these families must then accept the consequences of their decision: no admittance to public preschool, school, college, or workplace. [Emphasis mine]

That's right; unless you vaccinate your child, he or she will be denied a school education from preschool through college. You'll have no option but to homeschool.

And, it sounds like Dr. Pan is not going to be content with preventing children from getting an education but is also going to lobby to deny employment to adults unwilling to comply with federal vaccine recommendations.

How can this occur in America, "land of the free"? It is with a shudder I realize that my satirical April Fool's article, "US Government Rolls Out Mandatory Adult Vaccination and Tracking Program", is becoming more frighteningly real with each passing day.

Many of my readers were outraged after reading that satire piece. They didn't realize it was a joke until they read my disclaimer at the end of the article because it hit so close to the truth.

That really says something about the growing discomfort with and deteriorating faith in oppressive and ineffective public health policies and laws.

Threat of Forced Vaccinations May Unleash a New Wave of Activism

If SB277 passes, I believe California will experience a traumatic backlash, as parents will have no recourse but to shrug and comply, or flee like refugees to states where some semblance of medical choice and parental rights still exist.

The governor's staff has said Brown "believes that vaccinations are profoundly important and a major public health benefit and any bill that reaches his desk will be closely considered."

But it's unknown whether or not Brown would allow the religious exemption to be dropped from the current bill.

California vaccine bill clears major legislative hurdle

Dear The Ones Who Fight,

I am a mother of 2 children, a boy age 7 and age 3. I work a full time job as a single mother. My ex-husband and I remain on good terms and he helps equally throughout the trying journey which is raising two children.

As parents, we know we aren’t perfect, if you don’t know that as a parent, you likely aren’t doing the thing right. We all make mistakes, we just hope that the harm in our mistakes is nominal and that we learn from them, and evolve to new heights


I, like so many of you, have spent hours upon hours researching information about being a parent. My boy was vaccinated on the normal schedule, but after some issues occurred (of which I’d rather not go into great detail over as the debate it spawns serves mostly to hurt me), I chose not to vaccinate my girl.

Of all the regrets I have as a parent, my greatest regret at this moment is that I don’t feel like I’ve helped enough in the cause to fight what I see as an extreme loss in parental rights. SB277 is as disturbing as it is depressing. I want to thank all the parents who have walked in protest in their cities and I want to thank those parents who have created websites, posted all over forums to spread information and written senators and assemblymen. I want to thank those who have litigated for rights of all of our children.

The truth is, I’ve been busy, but the deeper truth is, ever since my son’s incident, I’ve been hopeless. When I turn on the news only to read that accepted truths are forced vaccinations and parents having their children taken from them because they walked home from school, I feel a deep sense of gloom. When my family tells me I’m acting with malice for not vaccinating my daughter, I feel exposed and distraught and lifeless. When other parents label me a witch, I feel destitute.

But what have I learned?

It isn’t all about me. That’s what I’ve learned. The center of the world isn’t me. That’s what I know. Those of you who march and write and protest and make videos, you go through all the same trials and tribulations that I do. But yet you still get it done. You don’t just lay there and take it, you fight. You believe you can be the change which you want to see in the world.

From this moment on, I now vow to get it done. I promise to be more vigilant in the fight and to see that the only true hopelessness is not fighting. I promise to pick myself up when I feel down because I see that as the only option. I promise to fight for a better world for not only my children, but your children just as well. I promise to be a part of the movement for parental rights.

I’m sorry for all that I haven’t done. Last night I watched videos of people protesting and it brought me to tears, but that was just what I needed. I needed to feel that emotion. I needed to wake up. I know I may not live in an area that allows me to walk the streets, but there is still so much that I can do. And this letter, as insignificant as it may be, as little read as it may turn out, is my start.

The "doctors' trial" was the first of the war crimes trials; one of its outcomes was the famous Nuremberg Code, a set of ethical guidelines for human experimentation.

The first tenet of the code is very clear: "The voluntary consent of the human subject is absolutely essential."

Today, the Nuremberg Code is the most important influence on US law governing human medical research. Even so, marginalised groups have frequently been coerced into studies that violate their right to consent. A recent review of the bioethics of human research in the US offers little prospect for change.

In 2012, many California residents traveled to Sacramento to protest a law introduced by a pediatrician legislator to make it harder for parents to file a personal belief vaccine exemption for their children to attend school. They responded to Action Alerts we issued through the online NVIC Advocacy Portal and lined the halls of the state Capitol building, many with their children, and waited for hours and hours to testify at several public hearings.

Mother after mother and father after father, grandparents, nurses, doctors and students of chiropractic, came to the public microphone. Some talked about how vaccine reactions left their children sick and disabled but they can’t find a doctor to write a medical exemption so their children can attend school; others talked about how their babies died after vaccination; and others simply opposed restriction of the legal right for parents to make medical decisions for their minor children.

It was a remarkable public witnessing by articulate, courageous citizens pleading with their elected representatives to do the right thing.

The right thing would have been for lawmakers to vote to leave the personal belief vaccine exemption alone so parents could continue to make vaccine decisions for their minor children without being forced to beg a hostile doctor or government official for permission to do that. 

That didn’t happen. 56 Today, parents in California are forced to pay a pediatrician or other state-approved health worker to sign a personal belief vaccine exemption and the doctor can refuse to sign and parents are reporting many pediatricians ARE refusing to sign.

But opponents who have rallied against the bill at the state Capitol, saying the legislation violates their parental rights, vowed both to sue the state and take their case to California voters.

"We are going to have a referendum to ask the public to put a hold on the law,'' said Palo Alto resident Christina Hildebrand, president and co-founder of A Voice For Choice. "We will continue to fight this -- we are not going away,'' said the mother of two unvaccinated children.

Under the new law, vaccinations would be required of children first entering school, or when they enter seventh grade, after July 1, 2016.

The controversy around the elimination of the "personal belief exemption" started in California after a measles outbreak started last December at Disneyland.

The Health Choice/Canary Party faction, despite MASSIVE SUSPICIOUS funding from outside sources, is steadily losing support from the twenty thousand California activists on the ground.  Why?  Their controlled message does not resonate, neither with the ground troops on the "No on SB277" effort - and certainly not with the Democratic Party controlled legislature.  They have lost every battle.

And, some of us think that was/is intentional - as in "Controlled Opposition".  Why?  It is the same thing that happened  at the November 29th, 2012 US Congressional Oversight and Government Committee which was supposed to examine the fake CDC studies that, allegedly, prove no relationship between vaccines and autism.  Once Health Choice/Canary Party leadership hired their own lobbyist the Committee was diverted, and hung over HC/CP Chairman Mark Blaxill couldn't say the "V" word in his worthless testimony.  And, suddenly,  a whole lot of us became VERY suspicious.

Police Power
The first state law mandating vaccination was enacted in Massachusetts in 1809; in 1855, Massachusetts became the first state to enact a school vaccination requirement. The constitutional basis of vaccination requirements rests in the police power of the state. Nearly 100 years ago, the U.S. Supreme Court issued its landmark ruling in Jacobson v. Massachusetts,33 upholding the right of states to compel vaccination. The Court held that a health regulation requiring smallpox vaccination was a reasonable exercise of the state’s police power that did not violate the liberty rights of individuals under the Fourteenth Amendment to the U.S. Constitution. The police power is the authority reserved to the states by the Constitution and embraces “such reasonable regulations established directly by legislative enactment as will protect the public health and the public safety”a (197 U.S. at 25, 25 S.Ct. at 361).

School Vaccination Laws
The Supreme Court in 1922 addressed the constitutionality of childhood vaccination requirements in Zucht v. King.34 The Court denied a due process Fourteenth Amendment challenge to the constitutionality of city ordinances that excluded children from school attendance for failure to present a certificate of vaccination holding that “these ordinances confer not arbitrary power, but only that broad discretion required for the protection of the public health”c (260 U.S. at 177, 43 S.Ct. at 25).

More recently, in the face of a measles epidemic in Maricopa County, Arizona, the Arizona Court of Appeals rejected the argument that an individual’s right to education would trump the state’s need to protect against the spread of infectious diseases short of confirmed cases of measles in the particular school. Given the nature of the spread of measles and the lag time in getting laboratory confirmation of cases, the court in Maricopa County Health Department v. Harmon35 was satisfied that it is prudent to take action to combat disease by excluding unvaccinated children from school when there is a reasonably perceived, but unconfirmed, risk for the spread of measles (156 Ariz. at 166, 750 P.2d at 1369). Although the court considered the right to education under Arizona’s constitution, the decision is instructive in showing the reach of the police power to ensure the public health. The court in Maricopa specifically noted that Jacobson did not require that epidemic conditions exist to compel vaccination (156 Ariz. at 166, 750 P.2d at 1369).

Parens Patriae
Further authority to compel vaccination of children comes under the doctrine of parens patriae in which the state asserts authority over child welfare. In the 1944 case of Prince v. Massachusetts,36 which involved child labor under an asserted right of religious freedom, the U.S. Supreme Court summarized the doctrine, noting that Neither rights of religion nor rights of parenthood are beyond limitation. Acting to guard the general interest in youth’s well being, the state as parens patriae may restrict the parent’s control by requiring school attendance, regulating or prohibiting the child’s labor, and in many other ways. Its authority is not nullified merely because the parent grounds his claim to control the child’s course of conduct on religion or conscience. Thus, he cannot claim freedom from compulsory vaccination for the child more than for himself on religious grounds.

The right to practice religion freely does not include liberty to expose the community or the child to expose the community or the child to communicable disease or the latter to ill health or death.d (321 U.S. at 166–7, 64 S.Ct. at 442)


Although vaccines are safe and effective, they are neither perfectly safe nor perfectly effective. Some persons who receive vaccines will have an adverse reaction, and some will not be protected. In developing vaccines, the challenge is to minimize the likelihood of adverse effect while maximizing effectiveness. Some people have medical conditions that increase the risk for adverse effect, and therefore they should not receive vaccines. Recognizing this fact, all state vaccination laws provide for exemptions for persons with contraindicating conditions.

All anti vax parents have heard this one before: your unvaccinated child is putting my vaccinated kid at risk! Because supposedly the less people who are vaccinated the more the whole of society is at risk, right? The “herd immunity theory” claims that 90% of the population MUST be immunized to ensure protective immunity for the entire herd. (btw vaccination rates in the US exceed that standard by 5-7% and we still have outbreaks of vaccinated diseases, which according to the herd immunity theory should be impossible).

Continuing… although herd immunity is based on how cattle interact, and is in general total baloney since vaccinations were designed to protect the individual anyway (they don’t spray vaccine mist on us like crops, they inject it into our bloodstreams), an easy way to disprove this is through documentation of outbreaks and epidemics occurring in populations exceeding herd immunity standards.
