Historic Overreach: Obama Immigration Order Dwarfs Preceding Presidents’

Will impact more immigrants than all combined actions by every president since Eisenhower

Though the administration and the left-leaning media are frantically attempting to rewrite history (and the president’s own words) about the unprecedented and unconstitutional nature of his planned executive order granting around 5 million illegal immigrants amnesty, the facts demonstrate just how historic an overreach this will be.

Below is a breakdown of every action taken on immigration by every president since Eisenhower. As is clear from the numbers, the estimated 5 million that are going to be impacted by President Obama’s orders dwarfs anything enacted by any president before him. In fact, Obama’s planned order would affect over a million more immigrants than the total of the known number impacted by preceding presidents since Eisenhower.

WASHINGTON (Reuters) - The Department of Homeland Security will grant temporary protected status to people from the three West African countries most affected by Ebola who are currently residing in the United States, department officials said on Thursday.

People from Liberia, Guinea, and Sierra Leone in the United States as of Thursday may apply for protection from deportation, as well as for work permits, for 18 months, said a Department of Homeland Security official.

After 18 months, the Secretary of Homeland Security will assess whether the protection should be extended, based on the level of the Ebola epidemic in West Africa.

The move is a response to the Ebola epidemic, which has claimed more than 5,000 lives, mostly in the three West African countries.

In order to prevent a mass migration from West Africa to the United States, nationals from these countries who arrive after Thursday will not be eligible for protected status.

U.S. Citizenship and Immigration Services officials estimate that 8,000 people will be eligible to apply.

"The Ebola response in the United States has been front and center in the United States government at high levels," said a Department of Homeland Security official. "This designation has been part of that constant monitoring, reevaluation and reassessment of the appropriate response."

The United States reserves temporary protected status for people from countries experiencing conditions deemed too dangerous to return to, such as Haiti after the 2010 earthquake.

Unlike other recipients, protected people from West Africa will not be allowed to travel home and then return to the United States, in order to prevent the disease from spreading.

Nationals from the three countries must undergo a background check in order to receive protected status. Those with a criminal history will not be approved, said the Homeland Security official.

 Illegal Migration being but a % of this goal.
 They play on the hearstrings of the masses, this happened with Sandy Hook (children Killed ?)  for one- Gun Control in action.
 Immigration, family's separated etc. It hits on the heart doesn't it.......SURE IT DOES.. however that was their intention, avoidance of the outcome.

The Department of Homeland Security has just released new "Policies for the Apprehension, Detention, and Removal of Undocumented Immigrants." Designed to fill in the details after President Obama's announcement that at least four million currently illegal immigrants will be given work permits, Social Security numbers and protection from deportation, the DHS guidelines are instructions for the nation's immigration and border security officers as they administer the president's directive.

The new priorities are striking. On the tough side, the president wants U.S. immigration authorities to go after terrorists, felons, and new illegal border crossers. On the not-so-tough side, the administration views convicted drunk drivers, sex abusers, drug dealers, and gun offenders as second-level enforcement priorities. An illegal immigrant could spend up to a year in prison for a violent crime and still not be a top removal priority for the Obama administration.

I filed a lawsuit Thursday night against President Barack Obama on behalf of Maricopa County Sheriff Joe Arpaio, to oppose Obama’s unilateral grant of amnesty. The damaging impact of illegal immigration upon Sheriff Arpaio’s community and the burden on his law enforcement resources, as with other border states, have been extensively reported for years.

Everyone is asking what comes next. Well, we at Freedom Watch are asking for a court injunction to block implementation of Obama’s “executive action,” pending review. Right now, news reports of Obama’s speech throughout Mexico, Central America and South America are suggesting that anyone can illegally enter the United States and then get a job here. Not really understanding U.S. law, reporters will lose the details in translation. Sheriff Arpaio’s community will be swamped with a flood of new arrivals, regardless of whether or not they qualify.

Within hours of his speech, Obama sent out fundraising emails asking for $1,000 donations to his Organizing for Action PAC. At Obama’s direction, Secretary of Homeland Security Jeh Johnson issued memorandum orders that about 5 million illegal aliens be granted the right to stay and work legally in the United States. Johnson’s orders are posted at the agency’s website. These illegal aliens will now outrageously receive Employment Authorization Cards the same as legal immigrants.

Sheriff Arpaio explained: “This unconstitutional act by the president will have a serious detrimental impact on my carrying out the duties and responsibilities for which I am charged as sheriff. Specifically, it will severely strain our resources, both in manpower and financially, necessary to protect the citizens I was elected to serve.”

What Obama calls “executive action” is sparking a brushfire among other law enforcement officials as well. Sheriff Scott Jones of Sacramento County released a video statement highlighting the tragic murders of Sacramento Sheriff Deputy Danny Oliver and Placer County Sheriff Detective Michael Davis Jr. by an illegal immigrant suspect who had been removed from the U.S. and had returned repeatedly across the porous border. Other sheriffs issued warnings. Don Rosenberg, whose son Drew was killed by an illegal alien, asked with irony if Obama would issue an executive order to bring his son back to life. This helpful support by the other sheriffs aside, as usual, it was Sheriff Arpaio who had the courage and guts to fire the first legal shot. The man is a hero among heroes.

Obama is claiming legal authority based on prosecutorial discretion. That is, Congress has failed to give the Executive Branch the resources to fully enforce the law, so the government must prioritize which categories of illegal aliens it will deport. The focus is on deporting “felons, not families.”

Among the many problems with this: Sheriff Arpaio has arrested 4,000 illegal aliens for committing non-immigration crimes in Arizona. When Sheriff Joe asks Immigration and Customs Enforcement to come and get them, they often refuse. When ICE does take custody of illegal aliens, Arpaio has been forced to re-arrest over 36 percent for new crimes. The Obama administration is really not interested in enforcing immigration law at all. It helps Obama and his leftist-Democrat minions politically to pander to these illegal aliens.

A second problem is that Obama’s “executive action” is clearly legislating, because it sets up a system covering broad categories with detailed requirements. It confers benefits like the right to work. A decision not to prosecute applies to an “adjudication” of an individual defendant. Creating rules for broad categories is legislating. Prosecutorial discretion is adjudicatory, that is, deciding particular cases one by one.

Third, the Executive Branch has not asked Congress for more resources. Each year, the budget process legally compels government agencies to tell Congress what they will need.

The government has not used the other tools Congress provided. The government has not enforced the prohibition on employers hiring illegal aliens, even though fines would probably cover the costs of enforcement.

The Secure Fence Act of 2006 required an additional 700 miles of double-layer fence and operational control of the border within 18 months. Largely because of “designed to fail” bad planning, that hasn’t happened.

Obviously, a law must pass both houses of Congress before being presented to the president. Even the Department of Homeland Security’s website admits that Obama’s 2012 DACA was “unprecedented.”

The U.S. Supreme Court has struck down actions as unconstitutional because they violate the inherent structure of the Constitution. In INS v. Chadha, 462 U.S. 919 (1983), the high court found a legislative veto of Executive Branch actions unconstitutional. That offended the constitutional design that Congress enacts laws and then sends them to the president.

In Train v. City of New York, 420 U.S. 35 (1975), the Supreme Court ruled that President Nixon had to spend all of the money Congress appropriates in each budgetary category. The Court observed, “The president cannot frustrate the will of Congress by killing a program through impoundment.” The Court overturned a longstanding practice in which a president would “impound” (return to the Treasury) some of the funds Congress appropriated.

One can’t resist noting that on Oct. 2, 2014, we at Freedom Watch petitioned the Department of Homeland Security to deport Barack Hussein Obama, due to his use of falsified identity documents. Perhaps Obama has a personal soft spot for not wanting the United States to deport people not legally in the country. Latin America applauds Obama's immigration plan

MEXICO CITY (AP) — Mexican President Enrique Pena Nieto praised President Barack Obama on Friday for his executive orders granting new rights to millions of people living illegally in the United States, calling it "an act of justice."

Mexicans are believed to account for more than half of the roughly 11.2 million migrants living in the U.S. without authorization. Mexico had long pressed for better conditions for them.

Pena Nieto said in a speech that Obama's plan "is an act of justice that recognizes the large contributions that millions of Mexicans have made to the development of our neighbor."

"These measures represent relief for immigrants, especially Mexicans," he said. "Those who will benefit are Mexican migrants who have been living in the United States for years."

In Honduras, President Juan Orlando Hernandez issued a statement saying that "the decision benefits Honduras and tens of thousands of families."

"This decision makes the United States stronger and will send a powerful message of solidarity with Latin America," Hernandez said.

El Salvador's foreign minister, Hugo Martinez, said that because of Obama's actions "many of our countrymen will get temporary relief for their immigration status."

But the Salvadoran government also said it is preparing an information campaign warning its citizens about migrating in hopes of qualifying under Obama's orders.

"We are informing people that this is a transitional measure that only benefits those Salvadorans who arrived (in the United States) prior to Dec. 31, 2009. Any others won't qualify under this measure," said Liduvina Magarin, El Salvador's assistant minister for Salvadorans abroad.

Priority Two offenders, whose cases are less urgent than criminals in Priority One, include the following:

aliens convicted of a "significant misdemeanor," which for these purposes is an offense of domestic violence; sexual abuse or exploitation; burglary; unlawful possession or use of a firearm; drug distribution or trafficking; or driving under the influence; or if not an offense listed above, one for which the individual was sentenced to time in custody of 90 days or more (the sentence must involve time to be served in custody, and does not include a suspended sentence)

DHS further defines a "significant misdemeanor" as an offense for which the maximum term of imprisonment is one year or less, but greater than five days. In addition, the guidelines contain a possible out for illegal immigrants accused of domestic abuse. "Careful consideration should be given to whether the convicted alien was also the victim of domestic violence," the guidelines say. "If so, this should be a mitigating factor."

Priority Two also includes "aliens convicted of three or more misdemeanor offenses, other than minor traffic offenses or state or local offenses for which an essential element was the alien's immigration status." But there's an important footnote to that. The three offenses must arise out of three separate incidents. If an illegal immigrant committed a single act that resulted in multiple misdemeanor charges, it would count as one charge for DHS counting purposes

This new policy elevates the status of China, putting it on a level footing with major trading partners of the United States, such as Brazil, Argentina, Israel, France, the United Kingdom, and many other European countries. FACT SHEET:  Immigration Accountability Executive Action
The President’s Immigration Accountability Executive Actions will help secure the border, hold nearly 5 million undocumented immigrants accountable, and ensure that everyone plays by the same rules.  Acting within his legal authority, the President is taking an important step to fix our broken immigration system.

These executive actions crack down on illegal immigration at the border, prioritize deporting felons not families, and require certain undocumented immigrants to pass a criminal background check and pay their fair share of taxes as they register to temporarily stay in the U.S. without fear of deportation.

These are common sense steps, but only Congress can finish the job. As the President acts, he’ll continue to work with Congress on a comprehensive, bipartisan bill—like the one passed by the Senate more than a year ago—that can replace these actions and fix the whole system.

Three critical elements of the President’s executive actions are:

•Cracking Down on Illegal Immigration at the Border:  The President’s actions increase the chances that anyone attempting to cross the border illegally will be caught and sent back. Continuing the surge of resources that effectively reduced the number of unaccompanied children crossing the border illegally this summer, the President’s actions will also centralize border security command-and-control to continue to crack down on illegal immigration.
•Deporting Felons, Not Families: The President’s actions focus on the deportation of people who threaten national security and public safety. He has directed immigration enforcement to place anyone suspected of terrorism, violent criminals, gang members, and recent border crossers at the top of the deportation priority list.
•Accountability – Criminal Background Checks and Taxes: The President is also acting to hold accountable those undocumented immigrants who have lived in the US for more than five years and are parents of U.S. citizens or Lawful Permanent Residents.  By registering and passing criminal and national security background checks, millions of undocumented immigrants will start paying their fair share of taxes and temporarily stay in the U.S. without fear of deportation for three years at a time.
The President’s actions will also streamline legal immigration to boost our economy and will promote naturalization for those who qualify.

For more than a half century, every president—Democratic or Republican—has used his legal authority to act on immigration.  President Obama is now taking another commonsense step. As the Administration implements these executive actions, Congress should finish the job by passing a bill like the bipartisan Senate bill that: continues to strengthen border security by adding 20,000 more Border Patrol agents; cracks down on companies who hire undocumented workers; creates an earned path to citizenship for undocumented immigrants who pay a fine and taxes, pass a background check, learn English and go to  the back of the line; and boosts our economy and keeps families together by cutting red tape to simplify our legal immigration process.

CRACKING DOWN ON ILLEGAL IMMIGRATION AT THE BORDER

Under the Obama Administration, the resources that the Department of Homeland Security (DHS) dedicates to security at the Southwest border are at an all-time high.  Today, there are 3,000 additional Border Patrol agents along the Southwest Border and our border fencing, unmanned aircraft surveillance systems, and ground surveillance systems have more than doubled since 2008. Taken as a whole, the additional boots on the ground, technology, and resources provided in the last six years represent the most serious and sustained effort to secure our border in our Nation’s history, cutting illegal border crossings  by more than half.

And this effort is producing results. From 1990 to 2007, the population of undocumented individuals in the United States grew from 3.5 million to 11 million people.  Since then, the size of the undocumented population has stopped growing for the first time in decades. Border apprehensions—a key indicator of border security— are at their lowest level since the 1970s.  This past summer, the President and the entire Administration responded to the influx of unaccompanied children with an aggressive, coordinated Federal response focused on heightened deterrence, enhanced enforcement, stronger foreign cooperation, and greater capacity for Federal agencies to ensure that our border remains secure.  As a result, the number of unaccompanied children attempting to cross the Southwest border has declined precipitously, and the Administration continues to focus its resources to prevent a similar situation from developing in the future.

To build on these efforts and to ensure that our limited enforcement resources are used effectively, the President has announced the following actions:

•Shifting resources to the border and recent border crossers. Over the summer, DHS sent hundreds of Border Patrol agents and U.S. Immigration and Customs Enforcement (ICE) personnel to the Southwest border, and the Department of Justice (DOJ) reordered dockets in immigration courts to prioritize removal cases of recent border crossers.  This continued focus will help keep our borders safe and secure. In addition, Secretary Johnson is announcing a new Southern Border and Approaches Campaign Plan which will strengthen the efforts of the agencies who work to keep our border secure.  And by establishing clearer priorities for interior enforcement, DHS is increasing the likelihood that people attempting to cross the border illegally will be apprehended and sent back.
•Streamlining the immigration court process. DOJ is announcing a package of immigration court reforms that will address the backlog of pending cases by working with DHS to more quickly adjudicate cases of individuals who meet new DHS-wide enforcement priorities and close cases of individuals who are low priorities. DOJ will also pursue regulations that adopt best practices for court systems to use limited court hearing time as efficiently as possible.
•Protecting victims of crime and human trafficking as well as workers. The Department of Labor (DOL) is expanding and strengthening immigration options for victims of crimes (U visas) and trafficking (T visas) who cooperate in government investigations.  An interagency working group will also explore ways to ensure that workers can avail themselves of their labor and employment rights without fear of retaliation.
DEPORTING FELONS, NOT FAMILIES

By setting priorities and focusing its enforcement resources, the Obama Administration has already increased the removal of criminals by more than 80%.  These actions build on that strong record by:

•Focusing on the removal of national security, border security, and public safety threats.  To better focus on the priorities that matter, Secretary Johnson is issuing a new DHS-wide memorandum that makes clear that the government’s enforcement activity should be focused on national security threats, serious criminals, and recent border crossers.  DHS will direct all of its enforcement resources at pursuing these highest priorities for removal.
•Implementing a new Priority Enforcement Program. Effectively identifying and removing criminals in state and local jails is a critical goal but it must be done in a way that sustains the community’s trust. To address concerns from Governors, Mayors, law enforcement and community leaders which have undermined cooperation with DHS, Secretary Johnson is replacing the existing Secure Communities program with a new Priority Enforcement Program (PEP) to remove those convicted of criminal offenses.  DHS will continue to rely on biometric data to verify individuals who are enforcement priorities, and they will also work with DOJ’s Bureau of Prisons to identify and remove federal criminals serving time as soon as possible.
ACCOUNTABILITY – CRIMINAL BACKGROUND CHECKS AND TAXES

Every Democratic and Republican president since Dwight Eisenhower has taken executive action on immigration.  Consistent with this long history, DHS will expand the existing Deferred Action for Childhood Arrivals (DACA) program to include more immigrants who came to the U.S. as children.  DHS will also create a new deferred action program for people who are parents of U.S. Citizens or Lawful Permanent Residents (LPRs) and have lived in the United States for five years or longer if they register, pass a background check and pay taxes.

The President is taking the following actions to hold accountable certain undocumented immigrants:

•Creating a mechanism that requires certain undocumented immigrants to pass a background check to make sure that they start paying their fair share in taxes. In order to promote public safety, DHS is establishing a new deferred action program for parents of U.S. Citizens or LPRs who are not enforcement priorities and have been in the country for more than 5 years.  Individuals will have the opportunity to request temporary relief from deportation and work authorization for three years at a time if they come forward and register, submit biometric data, pass background checks, pay fees, and show that their child was born before the date of this announcement. By providing individuals with an opportunity to come out of the shadows and work legally, we will also help crack down on companies who hired undocumented workers, which undermines the wages of all workers, and ensure that individuals are playing by the rules and paying their fair share of taxes.
•Expanding DACA to cover additional DREAMers. Under the initial DACA program, young people who had been in the U.S. for at least five years, came as children, and met specific education and public safety criteria were eligible for temporary relief from deportation so long as they were born after 1981 and entered the country before June 15, 2007.  DHS is expanding DACA so that individuals who were brought to this country as children can apply if they entered before January 1, 2010, regardless of how old they are today.  Going forward, DACA relief will also be granted for three years.
The President’s actions will also streamline legal immigration to boost our economy and promote naturalization by:

•Providing portable work authorization for high-skilled workers awaiting LPR status and their spouses.  Under the current system, employees with approved LPR applications often wait many years for their visa to become available.  DHS will make regulatory changes to allow these workers to move or change jobs more easily.  DHS is finalizing new rules to give certain H-1B spouses employment authorization as long as the H-1B spouse has an approved LPR application.
•Enhancing options for foreign entrepreneurs.  DHS will expand immigration options for foreign entrepreneurs who meet certain criteria for creating jobs, attracting investment, and generating revenue in the U.S., to ensure that our system encourages them to grow our economy.  The criteria will include income thresholds so that these individuals are not eligible for certain public benefits like welfare or tax credits under the Affordable Care Act.
•Strengthening and extending on-the-job training for STEM graduates of U.S universities. In order to strengthen educational experiences of foreign students studying science, technology, engineering, and mathematics (STEM) at U.S. universities, DHS will propose changes to expand and extend the use of the existing Optional Practical Training (OPT) program and require stronger ties between OPT students and their colleges and universities following graduation.
•Streamlining the process for foreign workers and their employers, while protecting American workers. DHS will clarify its guidance on temporary L-1 visas for foreign workers who transfer from a company’s foreign office to its U.S. office. DOL will take regulatory action to modernize the labor market test that is required of employers that sponsor foreign workers for immigrant visas while ensuring that American workers are protected.
•Reducing family separation for those waiting to obtain LPR status. Due to barriers in our system, U.S. citizens and LPRs are often separated for years from their immediate relatives, while they wait to obtain their LPR status. To reduce the time these individuals are separated, DHS will expand an existing program that allows certain individuals to apply for a provisional waiver for certain violations before departing the United States to attend visa interviews.
•Ensuring that individuals with lawful status can travel to their countries of origin. DHS will clarify its guidance to provide greater assurance to individuals with a pending LPR application or certain temporary status permission to travel abroad with advance permission (“parole”).
•Issuing a Presidential Memorandum on visa modernization. There are many ways in which our legal immigration system can be modernized to reduce government costs, eliminate redundant systems, reduce burdens on employers and families, and eliminate fraud. The President is issuing a Memorandum directing an interagency group to recommend areas for improvement.
•Creating a White House Task Force on New Americans. The President is creating a White House Task Force on New Americans to create a federal strategy on immigrant integration.
•Promoting Citizenship Public Awareness: DHS will launch a comprehensive citizenship awareness media campaign in the 10 states that are home to 75 percent of the overall LPR population. USCIS will also expand options for paying naturalization fees and explore additional measures to expand accessibility, including studying potential partial fee waiver for qualified individuals.
•Ensuring U.S. Citizens Can Serve: To further our military’s needs and support recruitment efforts, DHS will expand an existing policy to provide relief to spouses and children of U.S. citizens seeking to enlist in the military, consistent with a request made by the Department of Defense.

Over the past four years, immigration officials have largely without notice freed more than 8,500 detainees convicted of murder, rape, and other crimes, according to ICE’s own statistics, mainly because their home countries would not take them back.

Deporting illegal immigrants requires more than simply putting them on an airplane to their own country. People being deported need travel papers — such as a passport — like anyone else who travels abroad.

If their native country refuses to issue the necessary papers , the United States cannot send deportees there. And the Supreme Court has said ICE cannot hold the immigrants forever; if immigration officials cannot deport them after six months, the court said, they should generally set the immigrants free.

The entire implementing authority involves a memorandum published by DHS Secretary Jeh Johnson that changes the immigration law, directing federal money to be spent that has not been appropriated by Congress,” he said.

“In my view, there is a serious question whether Jeh Johnson should be impeached for taking this action, and a criminal investigation should be initiated to determine how and why federal funds are being misappropriated,” he declared.

Fitton said DHS “is being hijacked to implement actions Congress has neither authorized nor appropriated funds to accomplish.”

The Federal Register lists 26 executive orders President Obama has signed this year, with the most recent being “Improving the Security of Consumer Financial Transactions,” signed Oct. 17 and published in the Federal Register Oct. 23.

The last item DHS filed in the Federal Register relevant to DACA was a form revision filed April 4 that had nothing to do with the actions Obama announced Nov. 20.

President Barack Obama’s immigration deputies released 30,862 foreign criminals into the United States’ cities and neighborhoods, according to a federal document.

LOS ANGELES (AP) -- In small-town community centers, schools, churches and a vast city convention center, immigrant advocates are spreading the word about President Barack Obama's plan to give millions of immigrants living in the U.S. illegally a temporary reprieve.

The November announcement promising work permits and protection from deportation made a splash, but lawyers say the events are crucial to dispel rumors about eligibility, ward off fraud, and help immigrants determine what they might need to apply.

In Los Angeles, advocates are hosting an information session for as many as 10,000 people at the city's convention center Sunday.

"After this big forum, we're going to have daily orientations. That is what we have to do in order to deal with the demand," said Angelica Salas, executive director of the Coalition for Humane Immigrant Rights of Los Angeles.

Immigrants are eager to see if they qualify for Obama's executive actions to spare nearly 5 million people from deportation and to refocus enforcement efforts on criminals.

The U.S. Department of Commerce informs us that “today’s typical 18- to 34-year-old earns about $2,000 less per year (adjusted for inflation) than their counterpart in 1980.” That is a sharp and painful wage decline for young Americans. What has happened in the labor market since 1980?

Data from the U.S. Census Bureau offers this insight: “From 1930 to 1950, the foreign-born population of the United States declined from 14.2 million to 10.3 million…[but] Since 1970, the foreign-born population of the United States has increased rapidly due to large-scale immigration.” Census Bureau statistics report that in 1980, the foreign-born population stood at 14.1 million.

From 1980 through 2013, the immigrant population tripled from 14 million to more than 41 million.

This large increase in the size of the immigrant population is the direct product of policies in Washington.
Legal immigration during the 80’s averaged around 600,000 a year. But since 1990 through today it has averaged about 1 million annually – meaning the annual rate almost doubled. The sustained large-scale flow of legal immigration – overwhelmingly lower-wage and lower-skilled – has placed substantial downward pressure on wages.

We have, right now, a very slack labor market with more jobseekers than jobs.

From 1980 through 2013, the immigrant population tripled from 14 million to more than 41 million.

Immigration into the United States will continue at a historic pace for the next several decades, bringing the total number of foreign-born citizens to 78 million by 2060, according to the Census Bureau.

In a new series of new projections released this month, the Census said that the growth of immigrants in the United States will surge 81 percent from the current 43 million.

That will feed the massive growth of the nation overall. Census projected that the United States will have a population of 416 million by 2060, a massive 30 percent growth spurt.

According to the population control group Negative Population Growth, Census projects an increase of 97 million people, one third from other countries.

By these projections, America will grow by an average of over: 2.1 million people per year, 175,000 per month, 5,800 per day, for the next 46 years,” said the group’s president, Donald Mann.

Mexico’s president told President Obama Tuesday that his government will supply the documents necessary for millions of illegal Mexican immigrants to prove they’ve been living in the U.S. prior to 2010, a move that will help them qualify for Mr. Obama’s recently announced deportation amnesty.

In an Oval Office meeting, President Enrique Pena Nieto praised Mr. Obama’s executive action on amnesty as “very intelligent and audacious,” and said his government will do everything in its power to ensure that Mexicans who want to stay in the U.S. can do so.

The move has proven far more controversial in Washington, where Republican critics say the president’s unilateral move was unwise and unconstitutional.

SANTA ANA, Calif. -- California on Friday will start taking driver's license applications from the nation's largest population of immigrants in the country illegally.

California is one of 10 states that now provide licenses to immigrants in the country illegally. The licenses issued to immigrants without legal status will include a distinctive marking and are not considered a valid form of federal identification.

Advocates have encouraged immigrants to seek the license. But they are warning those with deportation orders or criminal records to first seek legal advice since law enforcement can access DMV data.

Applicants must submit proof of identity and state residency and pass written and road tests. Those who don't possess foreign government-issued identification on a list of approved documents can be interviewed by a DMV investigator to see if they qualify.

For the driving test, "license" (or to register the a car!!!) they need to show proof of liability insurance for the car that they are driving ...  After that all bets are off!!!   The CHP and the judges just let these guys off for everything ... they flee to other states , get other ID or move ... It's the biggest joke ... It makes me sad for the future ...
We are talking millions of these jokers in this state ...

A heartbreaking and tragic story took place in Mesa, Arizona, Thursday evening as a hard-working convenience store clerk was shot to death by an illegal alien.

QuickTrip (QT) employee Grant Ronnebeck, only age 21, was working the graveyard shift when an angry illegal alien demanded cigarettes after dumping some change on the checkout counter.  He had worked for QT since he was 16.

According to Mesa Police spokesman Detective Steve Berry, Ronnebeck told the 29-year old  suspect, Apolinar Altamirano, “I can’t give you the cigarettes until I count the money.” Berry said that although Ronnebeck did give the cigarettes to Altamirano, it wasn’t enough to save his life. The suspect then proceeded to shoot Ronnebeck anyway.

AZ Central  reports that Altamirano had previously pleaded guilty to a 2012 burglary charge, but had his sentence reduced to two years of probation after the charge was amended to “facilitation to commit burglary.” Court documents show that Altamirano was born in Mexico, was in the United States illegally [ since he was 14 !!! ], and a judge had previously notified U.S. immigration officials of his status.


Altamirano was arrested on suspicion of first-degree murder, burglary, armed robbery, unlawful flight and misconduct involving weapons since he is a prohibited possessor, after a high-speed chase that ended with an officer intentionally ramming into the car driven by Altamirano in Phoenix.

A presentence report in the 2012 burglary case said Altamirano was born in Mexico and came to the U.S. when he was 14 years old. It said he had been married to the co-defendant in the burglary for nine years and they had two children. It also said Altamirano never attended school in the U.S. and the highest grade he completed in school was fifth. He had been working as a landscaper prior to his arrest.

A probation officer recommended supervised probation but not jail time, even though she expressed concern about Altamirano's "possible involvement with drug sales."

She wrote, "He is also in the United States illegally and he is involved in criminal activity."

Eighteen states, led by Texas, filed a lawsuit today with the U.S. District Court in the Southern District of Texas challenging President Obama's executive action on immigration. The suit claims that the White House overstepped its authority by granting amnesty and work permits for 5 million illegal aliens.

After filing the federal suit, Texas Attorney General and Governor-elect Greg Abbott wrote in a statement that President Obama's executive amnesty "tramples the U.S. Constitution's Take Care Clause and federal law."

Also included in Attorney General Abbott's statement were the states' legal challenges to President Obama's executive action:
•The executive action on immigration conflicts with the President’s constitutional duty to “take Care that the Laws be faithfully executed.” The Take Care Clause limits the scope of presidential power and ensures that the chief executive will uphold and enforce Congress’s laws – not unilaterally rewrite them under the cover of “prosecutorial discretion.”
•The DHS Directive failed to comply with the Administrative Procedure Act’s required notice and comment rulemaking process before providing that legal benefits like federal work permits, Medicare, and Social Security be awarded to individuals who are openly violating immigration laws.
•The executive action to dispense with federal immigration law will exacerbate the humanitarian crisis along the southern border, which will affect increased state investment in law enforcement, health care and education.

The other states involved in the suit include: Alabama, Georgia, Idaho, Indiana, Kansas, Louisiana, Maine, Mississippi, Montana, Nebraska, North Carolina, South Carolina, South Dakota, Utah, West Virginia and Wisconsin.

UPDATE: Arizona has joined the lawsuit. In a statement, Arizona Governor Jan Brewer said, "Obama has exceeded his power as clearly defined in the United States Constitution and federal law and deliberately ignored the will of the American people. Such federal overreach cannot stand."

Florida has joined the lawsuit. In a statement, Florida Attorney General Pam Bondi said, "The President repeatedly said he would not violate the law, then decided to do just that. The powers granted to the President are expressly laid out in the United States Constitution, yet President Obama has decided to ignore those parameters."

As of December 10, Arkansas, Michigan, North Dakota, Ohio and Oklahoma have also joined the lawsuit.

Tennessee Attorney General Herb Slatery announced his state has joined the lawsuit filed by attorneys general and governors challenging the constitutionality of President Obama’s executive amnesty.

As of January 26, Nevada has joined the suit, bringing the total number of states to 26.

“Our immigration system is broken and clearly needs to be fixed,” said Nevada Attorney General Adam Laxalt, who vowed to fight the president’s executive action shortly after it was announced in November. “The solution must be a permanent, legal result that includes, not ignores, the other branches of government and their constitutional roles.”

  26 states.  Cool.  Just hope it doesn't get to the SCOTUS.  Obama has a lot of friends up there including Chief Justice Roberts who voted for making Obamacare a tax.

Report: 5.5 million Additional Work Permits Issued Since 2009 In ‘Shadow’ Authorization System

The Obama administration has been issuing millions of work permits over the limits set by Congress, according to a new report from the Center for Immigration Studies.

In the report released Monday, the anti-amnesty group explains data it obtained from U.S. Citizen and Immigration Services (USCIS) via a Freedom of Information Request.

Federal records show, the CIS finds, that from 2009-2014 the agency issued 5,461,568 new work permits to immigrants, beyond the 1.1 million legal immigrants and 700,000 guest workers admitted to the U.S. each year.

CIS laid out three categories of immigrants who received work authorization under what the group is calling a “shadow” system:


Approximately 1.8 million new work permits were issued to aliens with temporary visas or who entered under the visa waiver program. Of these, about 1.2 million (67%) had a visa status for which employment is not authorized by law, such as foreign students and independents of guest workers.



About 982,000 new work permits issued to illegal aliens or aliens unqualified for admission. Of these, 957,000 were aliens who crossed the border illegally (Entered Without Inspection). Inexplicably, 1,200 new work permits were issued to aliens who were denied asylum, were suspected of using fraudulent documents, were stowaways, or were refused at a port of entry.



About 1.7 million, were issued to aliens whose status was unknown, not recorded by the adjudicator, or not disclosed by U.S. Citizenship and Immigration Services (USCIS), the agency that processes the applications.


“I was astonished at the huge number of work permits that are being issued by the Obama administration outside the legal immigration system through executive discretion, especially at a time of high unemployment and stagnant wages,” Jessica Vaughan, CIS’ director of policy studies, said Monday. “Besides the effect on the American worker, it encourages and rewards more illegal immigration.”

The executive branch is operating a huge parallel work-authorization system outside the bounds of the [immigration] laws and limits written by Congress [and which] inevitably reduces job opportunities for Americans,” said Jessica Vaughan, the policy director at the Center for Immigration Studies, while filed the FOIA request.

 
“The true magnitude of how often he has evaded the limits set by Congress on foreign workers has never been known until now,” she told The Daily Caller.

But Obama’s quiet award of five million work permits, plus his November amnesty, will have added roughly 10 million foreign workers to the economy by the end of 2015. The influx adds to the normal inflow of 1 million immigrants per year and the standing population of 2 million white-collar and blue-collar guest workers.

 
So 18 million foreign students and workers — including many university-trained workers — have jumped into the U.S. economy since Obama was inaugurated in 2009.

The 18 million is almost level with the roughly 24 million young Americans who have turned 18 and joined the work force in the six years since 2009. In effect, Obama has given employers the option to hire a government subsidized foreigner in place of roughly one-in-two Americans who have graduated since 2009.

That’s a great deal for employers, because the foreign workers are indirectly subsidized by the government. The subsidy is the government’s promise of citizenship to many workers if they gain and hold jobs sought by Americans, plus the many aid and welfare programs that are provided to all low-income workers.

Of all the unwise and foolish things our U.S. Congress has imposed on the American people in the past 40 years, the late Teddy Kennedy's 1965 Immigration Reform Act will prove the most dangerous piece of legislation for the continuance of the United States.


While George Washington enjoys the moniker as "Father of our country", Kennedy may become known as the "Father of the destruction of our country."


Not only did his bill ram an added 100 million immigrants into the United States in the past 40 years, it will cram another 100 million into this country by 2035-a scant 24 years from now.


Beyond the environmental overload as to ecological footprint, carbon footprint, water, energy and resources-we face another more ominous and deadly overload of incompatible cultures and religions. The wise philosopher Kant said, "Religion and language are the two great dividers."


While benign religions like Buddhism settle into any civilization without antagonisms, the fastest growing religion in the world aggressively moves from its third world roots into first world countries with astounding speed. It has ransacked Europe's tranquility. In France, police, firemen and citizens will not enter 750 "no go" zones now dominated by Muslims.


Islam advocates for barbaric martyrdom with suicide bombers, female genital mutilation, arranged marriages, female subjugation, honor killings at over 5,000 annually inside the Middle East, stonings, beheadings, acid throwing into women's faces and no rights for women.


While it doesn't advocate aggressively within a Western country at first, as its numbers grow, it demands more and more impregnation of Sharia Law. That law creates an entirely new economic, social and religious paradigm inside the host country. Muslims do not remain timid for long!


In 1990, less than 100,000 Muslims lived within the United States. In 2011, they boast over seven million. At 100,000 Muslims added to the USA annually, they will add one million every decade. But with their birthrates, they can expect to add five million Muslims within 20 to 30 years. At present, they have built 1,208 mosques across the USA. No women can walk inside the front doors. They must go to the side. No women can share worship with any men. No women can walk into a mosque with their faces showing.


As seen in the United Kingdom, with a scant 2.5 million, they are already instituting Sharia Law by forcing democratic law out of Islamic dominated areas of London.


In an oped at Investers.com, they published a piece "Beheading ourselves over Islam."


"What can the U.S. do to quell the violent spasms of Islam? Promote Islam, naturally. At least that's the thinking of this administration. It's now official foreign policy," opined Investers. "President Obama's top Muslim envoy has been overseas encouraging devotion to Islam, including in terror hot spots like Afghanistan. In fact, Rashad Hussain, U.S. special envoy to the Organization of the Islamic Conference, just returned from Afghanistan, where he told locals the antidote to Islamic violence "is Islam itself."


"I am of the opinion that one of the strongest tools that you can use to counter radicalization and violent extremism is Islam itself, because Islam rejects violent extremism," Hussain said during a speech in Kabul.


"Afghans responded to his message by slaughtering a dozen innocent United Nations workers in the name of Islam," wrote Investers. "Stirred by mosque sermons, a mob of thousands overran a U.N. compound in northern Afghanistan following Friday prayers. They sawed off the heads of two guards before killing the others, including Norwegian and Swedish nationals, inside. It was Afghanistan's deadliest attack on U.N. personnel. The worshippers also burned American flags and effigies of Obama all to defend the honor of a single, paperback copy of a Quran torched by a quack U.S. preacher thousands of miles away in Florida. So far, more than 20 have died in the rioting."


Islamic law is absolute


"Islamic law calls for vengeance against anybody who insults Islam, its prophet or its holy book. Islamic law is enshrined in the post-Taliban Afghan constitution. Yet Rashad, a devout Muslim, says the Muslim faith is "key" to the administration's strategy to turn Muslims away from violence," reported Investers.


"We see that as one of the key elements of a strategy to address this type of violence," he said. By "we," he means the Obama administration. So it's now official policy to try to douse the Islamic fire of jihad by pouring more fuel on it. This is breathtaking.


"It found that Islam was catalyzing terrorists abroad and inside America's Muslim community. And it scolded U.S. leaders for pretending otherwise. Still, Hussain insists: "When it comes to the problem of violent extremism, Islam is not the problem."


If Americans expect to survive the 21st century with this nation intact, we need to shut down all Muslim immigration into this country. Any person can see that Islam has done to France, UK, Norway, Holland, Belgium, Sweden, Austria and Spain.


Do we want the constant confrontation of competing ethnic tribes, especially when America's dominate white/black/Hispanic tribes do not possess the kind of religious zeal of Islam? Do we want to see our democratic laws degraded into Sharia Law? Do we want to see women's rights flushed down the toilet? Do we want to see free speech and thought shut down? Do we want to see our free society morphed into a dictatorial society run by Islam that features its first tenet as: "Convert or kill all non-believers." Koran


So far, as we immigrate millions of Muslims into America, we are choosing to lose America by our inaction, inability or apathy to speak up.

Sen. Jeff Sessions (R-AL) is calling for an investigation into the recently exposed “shadow” work authorization system, in which the Obama administration has allowed millions more immigrants than Congress mandated to obtain work permits.

“This massive increase in the labor supply has occurred simultaneously with a steep drop in family incomes and a sharp rise in the number of Americans pushed out of the workforce,” Sessions said in a statement Monday. “All jobs gains since the recession have gone to foreign workers, while the slack labor market has depressed median family incomes almost $5,000 in that time.”

Sessions was reacting to new data revealed in a Center for Immigration report, showing that since 2009 the Obama administration has issued 5.5 million new work permits, more than the 1.1 million legal immigrants and 700,000 guest workers allowed into the to the U.S. annually.

CIS obtained the data via a Freedom of Information Act and, according to Sessions, the “shadow immigration system” should be investigated.

Senate conservatives have prodded the House on border bills. Now the tables have been turned.

Speaker John Boehner and House Republicans are hoping to kill two birds with one stone.

Before the Senate voted Tuesday against proceeding on a House-passed Homeland Security Department funding bill, Boehner called on Senate conservative firebrands to help pass the measure, loaded with provisions blocking President Obama's immigration policy. At the same time, he and his lieutenants took aim at vulnerable Senate Democrats, daring them to vote "no."

"It's time for Senator Cruz and Senator Sessions, and Senate Republicans and Senate Democrats to stand together with the American people and block the president's actions," Boehner told reporters Tuesday morning.

Boehner's pleas appear to have fallen on deaf Democratic ears: Only 51 senators -- all Republicans -- voted to invoke cloture Tuesday on the House bill, well short of the needed 60 votes.

Rep. John Carter, chairman of the Homeland Security Appropriations Subcommittee, said it is possible the House could ask for an injunction on the executive action, although he noted that the chamber will have a high hurdle to prove standing in the case.

"It will be an interesting challenge for everybody if the injunctive relief is granted," he said. "It is supposed to be a priority of the court."
