A top US anti-terror advisor said America's anti-terror campaign must go beyond "hot" battlefields in Afghanistan but legal curbs could constrain its action. John Brennan, President Barack Obama's top advisor for counterterrorism and homeland security, also criticized Friday attempts by some lawmakers to ensure that military, rather than civilian courts deal with terror suspects. Brennan's speech at Harvard Law School later Friday laid out the legal questions surrounding US counterterrorism operations, especially the widening geographical spread of US military strikes against extremists. "The United States does not view our authority to use military force against Al-Qaeda as being restricted solely to 'hot' battlefields like Afghanistan," Brennan said. "We reserve the right to take unilateral action if or when other governments are unwilling or unable to take the necessary actions themselves." However, Brennan added, "that does not mean we can use military force whenever we want, wherever we want. International legal principles, including respect for a state's sovereignty and the laws of war, impose important constraints on our ability to act unilaterally and on the way in which we can use force-in foreign territories."

The New York Times earlier quoted administration and congressional officials as saying that the Obama team was divided on the legal leeway the United States had in killing Islamist militants in Yemen and Somalia. The paper said the discussion, pivotal to the future course of the anti-terror fight, centered on the extent to which Washington could escalate drone strikes, cruise missiles or commando raids from current high value Al-Qaeda targets to target thousands of extremist "foot soldiers." Meanwhile, The Washington Post reported late Friday that the Obama administration had significantly increased the frequency of drone strikes and other air attacks against Al-Qaeda in Yemen. Some of the the strikes, carried out by the military's Joint Special Operations Command, have been focused in the southern part of the country, where insurgent forces have for the first time conquered and held territory, the paper said.

Unlike in Pakistan, where the CIA has presidential authorization to launch drone strikes at will, each US attack in Yemen and nearby Somalia requires White House approval, The Post said. In his speech, Brennan also took issue with administration critics on Capitol Hill who are seeking to mandate that all terror suspects are treated as enemy combatants and held in military custody rather than in the civilian court system. "I am deeply concerned that the alternative approach to counterterrorism being advocated in some quarters would represent a drastic departure from our values and the body of laws and principles that have always made this country a force for positive change in the world," Brennan said. "Such a departure would not only risk rejection by our courts and the American public, it would undermine the international cooperation that has been critical to the national security gains we have made. "Our counterterrorism professionals -- regardless of the administration in power -- need the flexibility to make well-informed decisions about where to prosecute terrorist suspects."

Today at a press conference in Chicago Barack Obama introduced his economic team. The market reacted by giving the president-elect a big kiss, with the Dow closing up about 400 points. The team shaping up behind the new president will reassure many; whereas the Republicans spent the final weeks of the campaign charging that Obama was a “Marxist” who would take the country far to the left, his team so far is pretty much exactly what Obama promised—drawn from the right-center of the Democratic Party. But just as importantly, Obama has drawn on players who offer solid brainpower and a wealth of experience. President Bush surrounded himself with “team players” who were hesitant to challenge even the most persistently wrong-headed of the president’s notions. A few, such as Paul O’Neill, resigned after figuring this out. Colin Powell will probably long regret his failure to make a timely exit. But it’s already clear that we won’t witness this same dynamic in the Obama Administration. His team may be fractious, but it won’t include any toadies.

In the coming week, Obama is likely to focus on his national security team. The leading player appears to be Hillary Clinton, and Robert Gates will likely stay on at least for a year in the Pentagon. But the post which is drawing the most critical attention right now is Director of Central Intelligence. A number of names are now being circulated for this appointment: John McLaughlin, Jim Steinberg, Richard Danzig, Tim Roemer, Jane Harman, and John Brennan. But of this group, Brennan’s name is now the most prominent and he’s being described by some as “likely” to emerge as Obama’s pick for the job. That would be a serious mistake.

A Brennan nomination would draw heavy fire from some of Obama’s most loyal supporters. Indeed, there might well be enough concentrated firepower there defeat the nomination in the Senate. The problem isn’t John Brennan’s lack of credentials. He was a career intelligence operative who gets consistently strong marks for his effectiveness and intelligence from people who have worked with him. But he has a critical shortcoming: his completely ambiguous and inconsistent views about the CIA’s use of torture and torture by proxy as techniques. As a company man, Brennan was quick to justify and support what was done. As an “independent” analyst for broadcast journalists, he also provided support and cover for practices from waterboarding to the use of psychotropic drugs. As an adviser to the Obama campaign, Brennan experienced an unconvincing epiphany and came to reject President Bush’s “program” along the same lines as his boss. The timing and circumstances of Brennan’s conversion suggest that it was dictated by political expedience and not ethics.

No one is saying that the CIA has to play by the Marquess of Queensbury rules–no one is even saying that CIA operations have to square with the law around the world. No intelligence service does that. But CIA operations do have to respect the law of the United States, and specifically they have to respect the legal prohibition on torture that the Bush Administration spun so feverishly to avoid. President Obama has promised to put an end to torture. In the political geography of the Bush Administration, real torture was relegated to the dark quarters of the CIA. If Obama wants to convince the world of his commitment to end this national nightmare, then he must appoint a Director of Central Intelligence who can believed when he says “we do not torture.” Both of the last two directors made this statement and lied through their teeth.

About 200 of the nation’s leading psychologists have written President-Elect Obama protesting the possible nomination of John Brennan. The psychologists review Brennan’s public statements condoning or justifying torture and then they state:

In order to restore American credibility and the rule of law, our country needs a clear and decisive repudiation of the “dark side” at this crucial turning point in our history. We need officials to clearly and without ambivalence assert the rule of law. Mr. Brennan is not an appropriate choice to lead us in this direction. The country cannot afford to have him as director of our most important intelligence agencies.

As psychologists and other concerned Americans, we ask you to reject Mr. Brennan as Director of the CIA. His appointment would dishearten and alienate those who opposed torture under the Bush Administration. We ask you to appoint a Director who will truly represent “the change we need.”

The psychologists are right to be out front on this issue. They have seen the damage that torture brings—to the individuals subjected to it, to those who practice it, to the health care professionals drawn into it, and to our nation as a whole. John Brennan may find an important role serving in a new administration. But he is morally unfit to serve as the Director of Central Intelligence.

Marc Ambinder reported Thursday evening that former National Counterrorism Center head John Brennan is Barack Obama's "favorite to be nominated director of the Central Intelligence Agency." According to Ambinder's sources, Brennan has been vetted and even begun recruiting his team.

The news has alarmed Obama supporters who remember Brennan best for his role in both faulty pre-war intelligence and agreement with Vice President Dick Cheney on torture.

Glenn Greenwald writes, "I'm both entirely unsurprised and basically undisturbed by the fact that Obama's most significant appointments thus far are composed largely of standard Washington establishment figures and pro-Iraq-War hawks." But Brennan is "a different matter."
To appoint someone as CIA Director or Director of National Intelligence who was one of George Tenet's closest aides when The Dark Side of the last eight years was conceived and implemented, and who, to this day, continues to defend and support policies such as "enhanced interrogation techniques" and rendition (to say nothing of telecom immunity and warrantless eavesdropping), is to cross multiple lines that no Obama supporter should sanction. Truly turning a page on the grotesque abuses of the last eight years requires both symbolism (closing Guantanamo) and substantive policy changes (compelling adherence to the Army Field Manual, ensuring due process rights for all detainees, ending rendition, restoring safeguards on surveillance powers). Appointing John Brennan to a position of high authority would be to affirm and embrace, not repudiate, the darkest aspects of the last eight years.

Andrew Sullivan, in a post titled "No Way. No How. No Brennan," adds:

[T]he Republican, former chief-of-staff for George Tenet (who authorized war crimes as CIA head), admirer of Dick Cheney, CEO of the company one of whose contract employees improperly accessed Obama's and McCain's passports, and defender of renditions and "enhanced interrogations" is still Obama's front-runner pick to head the CIA. No, I'm not making this up. ... Brennan was complicit and naive in the run-up to the Iraq war. And Obama wants to reward him? Brennan is also a believer in Cheney's term "the dark side," wishing merely to have some limits within it. He clearly has a mindset that has far more in common with the war crimes of his former boss than with the clear, and indisputable beliefs of the Obama movement.  The least we know is that Brennan is ambivalent about [torture]. Ambivalence on this matter is unacceptable. We haven't fought for decency and reform and a return to American values for so long to be turned back now. We didn't work our butts off to elect Obama only to get Bush another four years at CIA. If Brennan emerges as the pick, those of us against the continuation of war crimes and the prosecution of war criminals will have to oppose him strenuously in the nomination process. We will, in fact, have to go to war with Obama before he even takes office.

Melvin Goodman, a retired CIA intelligence analyst, lambasted Obama in the Baltimore Sun for relying on "discredited cronies" like Brennan.

Blogger and lawyer Anonymous Liberal says he shares their concerns, but he doesn't think the possibility is quite so dire. He points out that Brennan's actual involvement in illegal Bush-era programs is unclear, and that intelligence agencies don't set policy.

Every illegal program and policy during the Bush administration emanated from the White House and was given legal imprimatur by the Justice Department. Regardless of what John Brennan personally thinks about surveillance, torture, rendition, etc., he will only be able to do what the White House and the DOJ authorize him to do. That's why Eric Holder's nomination is reassuring. And if Obama really wants to reassure people like myself, he'll appoint someone with Holder's expressed views (perhaps Marty Lederman?) to head up the OLC.

U.S. Will Hit Al-Qaeda Beyond ‘Hot Battlefields,’ Obama Aide Brennan Says

The U.S. has the right to strike terrorists in other sovereign countries beyond “hot battlefields” such as Afghanistan, said John Brennan, President Barack Obama’s top counterterrorism adviser.

“Because we are engaged in an armed conflict with al- Qaeda, the United States takes the legal position that, in accordance with international law, we have the authority to take action against al-Qaeda and its associated forces without doing a separate self-defense analysis each time,” Brennan said in prepared remarks delivered today to a conference at Harvard Law School in Cambridge, Massachusetts.

“We reserve the right to take unilateral action if or when other governments are unwilling or unable to take the necessary actions themselves,” he said.

Brennan’s address comes a little more than four months after U.S. forces killed al-Qaeda founder Osama bin Laden in Pakistan, and as experts inside and outside the Obama administration debate what limits the U.S. should have in killing lower-ranking al-Qaeda operatives in areas of the Middle East and North Africa. The U.S. has conducted strikes against al-Qaeda targets using drones from Pakistan to Yemen and Somalia.

“The United States does not view our authority to use military force against al-Qaeda as being restricted solely to ’hot’ battlefields like Afghanistan,” Brennan said.

The DNI flap has been fascinating in what it shows about Obama’s approach to intelligence. He wants facts, not commentary; he mistrusts aides such as Blair who let their personal opinions show, and he correspondingly values low-key colleagues such as Gates; he wants to oversee intelligence not from a separate fiefdom but from inside the White House, where former CIA official John Brennan serves as deputy national security adviser.

Sen. Dianne Feinstein (D-Calif.), read this column. Ignatius’s insightful observation indicates that your problem isn’t whether Clapper is an obstacle to a strong director of national intelligence. It’s whether John Brennan and President Obama are those obstacles. Institutional powers matter. They matter a lot. But unless the structure of the intelligence community changes radically, the strongest you can make the job is akin to a powerful congressional committee chair, not a cabinet secretary, to use the formulation of Defense Secretary Robert Gates, a former CIA director. More radical changes would require a presidential commitment, and clearly Obama would prefer intelligence to be ultimately answerable to John Brennan at the White House. Accordingly, that’s going to be the official to whom the leadership of the intelligence agencies look to for their cues, whether or not Clapper gets confirmed and no matter what Clapper tells Feinstein when they parley in the coming days.

Among the issues he addressed were the precedent set by the decision to employ drones, the decision-making process, and counterterrorism strategy since the death of Osama bin Laden. He also announced that some of the documents recovered from Osama bin Laden's compound in Pakistan a year earlier would be published online by the U.S. Military Academy's Terrorism Center. He responded to questions from the audience.

TAMPA (FOX 13) -  If you see some military aircraft swooping in from the skies this week, don't be alarmed. It's not an invasion, just a demonstration. It's all part of Special Forces Operations Week, which has drawn some of the world's top military minds and industry insiders for a conference at the Tampa Convention Center. Tuesday, the Air Force showed off their version of a V-22 Osprey. The unique gray aircraft made two runs from MacDill Air Force Base down the coast to Sarasota and back, turning heads along the way. "The aircraft is a tilt-rotor," explained Maj. Fernando Zapata. "It can take off like an airplane or take off like a helicopter, fly twice as fast as a helicopter, and then land as a helicopter in austere environments. So everything that a helicopter can do, we can do, except twice as fast." Wednesday, special operations forces from 10 different nations will stage a mock assault on the convention center area, using boats, ATVs, and helicopters to attack 'enemy' positions and rescue 'hostages.'

TAMPA — Two giant inflatable boats roared toward the Tampa Convention Center, and 14 members of special operations forces jumped ashore, engaging the "enemy" in a loud firefight and freeing the "hostage" — Mayor Bob Buckhorn.  Standing on the Harbour Island bridge, 10-year-old Brooke Volpi thought the loud rat-a-tat of blanks was real. But she wasn't scared.  "I knew I was safe because the Army doesn't shoot at innocent people," she said. Brooke and several of her friends went to the Special Operations Forces mock assault after a half-day at school Wednesday, joining thousands of onlookers who saw what forces from 12 countries can do with military helicopters, boats and Humvees. The exercise was part of the Special Operations Forces conference this week.

Ten-year-old Samantha Caglianone loved watching four special ops demonstrators rappel from a MH-47 Chinook into the water — and later climb back on, using a rope ladder.

"It looks kind of easy when they do it," she said.  And it did — because of their training, said a U.S. Marine Corps Sgt. Dan, who declined to give his last name.  He was one of the men who rappelled into Seddon Channel near the convention center. Joined by forces from Norway and Australia, the sergeant said working with military personnel from other countries was a great exercise, considering their different training backgrounds and languages.  "And doing this for the public is a very powerful thing," the sergeant said, "because it tells our common enemies if they mess with one of us, they mess with all of us."  The demonstration started with the entrance of a CV-22 Osprey, which can switch between front-facing airplane propellers to ones meant for a helicopter. It ended with a free fall from 6,000 feet.  In between, demonstrators rappelled from a Black Hawk helicopter onto a platform in the channel, engaging an "enemy" with fake gunfire. They carried out a mock ground assault using Humvees and all-terrain vehicles.  And though the demonstrators probably couldn't hear over the roar of propellers, the crowd cheered each time the "good guys" took off safely.

Counterterror chief John Brennan sets procedure on vetting targets

WASHINGTON —White House counterterrorism chief John Brennan has seized the lead in guiding the debate on which terrorist leaders will be targeted for drone attacks or raids, establishing a new procedure to vet military and CIA targets.

The move concentrates power over the use of lethal U.S. force outside war zones at the White House.

The process, about a month old, means Brennan's staff consults the Pentagon, the State Department and other agencies as to who should go on the list, making a previous military-run review process in place since 2009 less relevant, according to two current and three former U.S. officials aware of the evolution in how the government targets terrorists.

In describing Brennan's arrangement, the officials provided the first detailed description of the military's previous review process that set a schedule for killing or capturing terrorist leaders around the Arab world and beyond. They spoke on condition of anonymity because U.S. officials are not allowed to publicly describe the classified targeting program.

One senior administration official argues that Brennan's move adds another layer of review that augments, rather than detracts from, the Pentagon's role. The official says that in fact there will be more people at the table making the decisions, including representatives from every agency involved in counterterrorism, before they are reviewed by senior officials and ultimately the president.

The CIA's process remains unchanged but never included the large number of interagency players the Pentagon brought to the table for its debates.

And the move gives Brennan greater input earlier in the process, before senior officials make the final recommendation to the president. Officials outside the White House expressed concern that drawing more of the decision-making process to Brennan's office could turn it into a pseudo-military headquarters, entrusting the fate of al-Qaeda targets to a small number of senior officials.

WASHINGTON — Agonizing "minutes passed like days," after Barack Obama made what a top aide dubbed the "gutsiest" presidential call in years, and followed in real time as special forces swooped on Osama bin Laden. Obama's gruff anti-terror advisor John Brennan, who hunted the Al-Qaeda mastermind for 15 years, offered tantalizing details Monday of the high-stakes operation in the Pakistani city of Abbottabad in which bin Laden died. "It was probably one of the most anxiety-filled periods of time, I think, in the lives of the people who were assembled here yesterday," Brennan told reporters in a colorful White House briefing. "The minutes passed like days, and the president was very concerned about the security of our personnel. "That was what was on his mind throughout, and we wanted to make sure that we were able to get through this and accomplish the mission." Brennan would not say exactly how Obama and his top advisors were able to follow Sunday's 40-minute Navy SEAL operation unfolding in real time -- but the suspicion was that some kind of sophisticated communications technology was available to them. "It was clearly very tense, a lot of people holding their breath," Brennan said. "And there was a fair degree of silence as it progressed as we would get the updates. "When we finally were informed that those individuals who were able to go in that compound and found an individual that they believed was bin Laden, there was a tremendous sigh of relief." Brennan was also asked several times whether the national security team had been able to hear exchanges of fire in the compound where bin Laden was sheltering but demurred.

"We were able to monitor the situation in real time," was all he would say. Had the sophisticated helicopter-borne operation gone wrong, the stakes for Obama would have been huge, and the operation could have dealt him a political blow from which he would not recover as he seeks reelection next year. Given the downside risk, Obama faced the kind of lonely decision that only the presidents who have made such perilous calls before can understand. "The president had to evaluate the strength of that information and then made what I believe was one of the most gutsiest calls of any president in recent memory," Brennan, a former senior CIA officer, said. Brennan said the most anxious moment of the operation came when one of the helicopters carrying Navy SEALS special forces developed technical problems after flying into the compound. "When that helicopter was seen to be unable to move, all of a sudden, you had to go into Plan B. And they did it flawlessly," said Brennan, describing the moment when another helicopter was called into the breach.

Brennan also revealed that the United States did not inform the Pakistanis of the operation until its helicopters had exited Pakistani air space, and of fears that Islamabad would scramble fighters to intercept the mission. And he even raised suspicions that US forces might have been prepared to take action against any Pakistani effort to intercept their helicopters, saying the US was "clearly" concerned the Pakistanis might decide to scramble jets. "So we were watching and making sure that our people and our aircraft were able to get out of the Pakistani airspace, and thankfully there was no engagement with Pakistani forces," Brennan said. "Thankfully no Pakistani forces were engaged, and there were no other, you know, individuals who were killed aside from those on the compound." Brennan also related how the realization dawned gradually that US special forces had killed bin Laden and were able to get out alive along with his remains. "It was more of a growing sense of confidence and a growing sense of accomplishment," he said. Asked for Obama's reaction, Brennan replied: "'We got him.'"

John Brennan

A longtime CIA official and former head of the National Counterterrorism Center, Brennan is one of the coordinators of Obama’s intelligence transition team and a top contender for either CIA Director or Director of National Intelligence. He was also recently described by Glenn Greenwald as “an ardent supporter of torture and one of the most emphatic advocates of FISA expansions and telecom immunity.” While claiming to oppose waterboarding, labeling it “inconsistent with American values” and “something that should be prohibited,” Brennan has simultaneously praised the results achieved by “enhanced interrogation” techniques. “There has been a lot of information that has come out from these interrogation procedures that the agency has, in fact, used against the real hard-core terrorists,” Brennan said in a 2007 interview. “It has saved lives. And let’s not forget, these are hardened terrorists who have been responsible for 9/11, who have shown no remorse at all for the death of 3,000 innocents.”

Brennan has described the CIA’s extraordinary rendition program — the government-run kidnap-and-torture program enacted under Clinton — as an absolutely vital tool. “I have been intimately familiar now over the past decade with the cases of rendition that the U.S. Government has been involved in,” he said in a December 2005 interview. “And I can say without a doubt that it has been very successful as far as producing intelligence that has saved lives.”

Brennan is currently the head of Analysis Corporation, a private intelligence company that was recently implicated in the breach of Obama and Sen. John McCain’s passport records. He is also the current chairman of the Intelligence and National Security Alliance (INSA), a trade association of private intelligence contractors who have dramatically increased their role in sensitive U.S. national security operations. Counterterrorism adviser John Brennan spoke at the Woodrow Wilson International Center in Washington DC on April 30 to mark the one-year anniversary of the killing of Osama bin Laden. It was the first time a high level member of the Obama Administration spoke at length about the U.S. drone strikes that the CIA and the Joint Special Operations Command have been carrying out in Pakistan, Yemen and Somalia.

“President Obama has instructed us to be more open with the American people about these efforts,” Brennan explained.

I had just co-organized a Drone Summit over the weekend, where Pakistani lawyer Shahzad Akbar told us heart-wrenching stories about the hundreds of innocent victims of our drone attacks. We saw horrific photos of people whose bodies were blown apart by Hellfire missiles, with only a hand or a slab of flesh remaining. We saw poor children on the receiving end of our attacks—maimed for life, with no legs, no eyes, no future. And for all these innocents, there was no apology, no compensation, not even an acknowledgement of their losses. Nothing.

The U.S. government refuses to disclose who has been killed, for what reason, and with what collateral consequences. It deems the entire world a war zone, where it can operate at will, beyond the confines of international law.

So there I was at the Wilson Center, listening to Brennan describe our policies as ethical, “wise,” and in compliance with international law. He spoke as if the only people we kill with our drone strikes are militants bent on killing Americans. “It is unfortunate that to save innocent lives we are sometimes obliged to take lives – the lives of terrorists who seek to murder our fellow citizens.” The only mention of taking innocent lives referred to Al Qaeda. “Al Qaeda’s killing of innocent civilians, mostly Muslim men, women and children, has badly tarnished its image and appeal in the eyes of Muslims around the world.” This is true, but the same must be said of U.S. policies that fuel anti-American sentiments in the eyes of Muslims around the world.

So I stood up and in a calm voice, spoke out.

“Excuse me, Mr. Brennan, will you speak out about the innocents killed by the United States in our drone strikes? What about the hundreds of innocent people we are killing with drone strikes in the Philippines, in Yemen, in Somalia? I speak out on behalf of those innocent victims. They deserve an apology from you, Mr. Brennan. How many people are you willing to sacrifice? Why are you lying to the American people and not saying how many innocents have been killed?”

My heart was racing as a female security guard and then a burly Federal Protection Service policeman started pulling me out, but I kept talking.

“I speak out on behalf of Tariq Aziz, a 16-year-old in Pakistan who was killed simply because he wanted to document the drone strikes. I speak out on behalf of Abdulrahman Al-Awlaki, a 16-year-old born in Denver, killed in Yemen just because his father was someone we don’t like. I speak out on behalf of the Constitution and the rule of law.” My parting words as they dragged me out the door were, “I love the rule of law and I love my country. You are making us less safe by killing so many innocent people. Shame on you, John Brennan.”

I was handcuffed and taken to the basement of the building, where I was questioned about my background and motives. To their credit, it seems the Wilson Center thought it would not be good to have someone arrested for exercising their right to free speech, so I was released.

Brennan’s speech came the day after another U.S. drone strike in Pakistan, one that  killed three alleged militants. After the strike, the Pakistani government voiced its strongest and most public condemnation yet, accusing the United States of violating Pakistani sovereignty, calling the campaign “a total contravention of international law and established norms of interstate relations.” Earlier in April the Pakistani Parliament unanimously condemned drone strikes and established a new set of guidelines for rebuilding the country’s frayed relationship with the United States, which included the immediate cessation of all drone strikes in Pakistani territory.

The attacks in Pakistan, carried out by the CIA, started in 2004. Since then, there have been over 300 strikes. The areas where the strikes take place have been sealed off by the Pakistani security forces, so it has been difficult to get accurate reports about deaths and damages. John Brennan has denied that innocents have even been killed. Speaking in June 2011 about the preceding year, he said “there hasn’t been a single collateral death because of the exceptional proficiency, precision of the capabilities we’ve been able to develop.” Mr. Brennan later adjusted his statement somewhat, saying, “Fortunately, for more than a year, due to our discretion and precision, the U.S. government has not found credible evidence of collateral deaths resulting from U.S. counterterrorism operations outside of Afghanistan or Iraq.”

This is just not true. The UK-based Bureau of Investigative Journalism is the group that keeps the best count of casualties from U.S. drone strikes in Pakistan, Yemen and Somalia. According to its figures, since 2004, U.S. has killed between about 2,500-3,000 people in Pakistan. Of those, between 479 and 811 were civilians, 174 of them children.

Shahzad Akbar, a Pakistani lawyer who has been representing drone victims and who started the group Foundation for Fundamental Rights, disputes even these figures and claims that the vast majority of those killed are ordinary civilians. “I have a problem with this word ‘militant.’ Most of the victims who are labeled militants might be Taliban sympathizers but they are not involved in any criminal or terrorist acts, and certainly not against the United States,” he claimed. He said the Americans often assumes that if someone wears a turban, has a beard and carries a weapon, he is a combatant. “That is a description of all the men in that region of Pakistan. It is part of their culture.” Shahzad believes that only those people who the Americans label “high-value targets”, which would be less than 200, should be considered militants; all others should be considered civilian victims.

While President Obama is gearing up for an election campaign and using his drone-strike killing spree to as a sign of his tough stance on national security, people from across the United States and around the world are organizing to rein in the drones.

Gathering in Washington DC on April 28-29, they came up with a new campaign to educate the American public about civilian deaths in Pakistan, Yemen, Somalia and elsewhere as a result of the use of drones for illegal killing and to pressure members of Congress, President Obama, federal agencies, and state and local governments to restrict the use of drones for illegal killing and surveillance. The tactics include court challenges, delegations to the affected regions, direct action at U.S. bases from where the drones are operated, student campaigns to divest from companies involved in the production of killer drones and outreach to faith-based communities.

Corporate news blackout as Obama appoints John Brennan as the sole person in charge of designating people to be assassinated.

John Brennan, Obama’s chief counterterrorism advisor was a name that you did not see on the Mainstream media today as they continue to run stories that serve to distract the masses from stories that matter.

Most recently he publicly spoke about the drone program calling it moral and ethical and just.

According to reports from the Associated Press, John Brennan has now seized the lead in choosing who will be targeted for drone attacks and raids after Obama delegated him as the sole authority to designate people for assassination under the United States top-secret assassination program.

Yes, if it such a secret program then why is the Associated Press running a story on it? Because it is only a “top-secret” matter of National Insecurity when the public and organizations such as the ACLU request more details on it than is revealed int the propagandized reports the public is fed through the corporate media.

While this story deserves to have been put before the eyeballs of every U.S. citizens it was merely a side note ran by the Associate Press that didn’t make corporate news headlines anywhere.

According to the AP, under the new plan, Brennan’s staff compiles the potential target list and runs the names past agencies such as the State Department at a weekly White House meeting.

At the same time ACLU lawsuits and requests for information about the decision-making process behind the government’s assassination program repeatedly get denied with the government claiming the programs are so top-secret that they can neither confirm nor deny the programs even exist.

John O. Brennan, president and CEO of the Analysis Corp., advises the Illinois Democrat on foreign policy and intelligence issues, the source said.

Brennan was former CIA official and the interim director of National Counterterrorism Center under Bush. Brennan's firm got all the information that Barack Obama is associated with many terrorist projects (Weather Underground, Africa, Pakistan, etc. based on timings of his travels revealed in the passport records and analyzing other CIA terrorists' records like those of Bill Ayers). Brennan murders his employee that found the info and works a deal with Obama to manage all information about Obama's terrorist connections to Bill Ayers and other CIA terrorists from becoming too compromising as long as Brennan gets to kill anyone he wants. Breitbart comes out with the same information that Brennan did along with videos, etc. Brennan no longer has monopoly control over the precious information. Brennan murders Breitbart to secure his monopoly. He then murders Breitbart's coroner that does not go along with the bullshit findings to cover up the Breitbart murder. Summary

The Analysis Corporation (TAC) specializes in providing counterterrorism analysis and watchlists to U.S. government agencies. It is best known for its connection to John O. Brennan, its former CEO, a 35-year veteran of the CIA and currently President Obama’s chief counterterrorism adviser. Brennan, the first director of the National Counterterrorism Center (NCTC), retired from government in November 2005 and immediately joined TAC.

TAC employees are integrated into intelligence, law enforcement, defense, and homeland security work units, serve in Government operations centers, and play a critical role in watchlisting efforts. …TAC staff consists of subject matter experts with extensive expertise in a wide range of disciplines. CorpWatch Analysis

During the 1990s, TAC developed the U.S. government’s first terrorist database,“Tipoff,” on behalf of the State Department. The database was initially conceived as a tool to help U.S. consular officials and customs inspectors determine if foreigners trying to enter the United States were known or suspected terrorists. In 2003, management of the database—which received information collected by a large number of agencies including the CIA, NSA, and FBI—was transferred to the CIA’s Terrorist Threat Integration Center (TTIC) and, later, to the National Counterterrorism Center. In 2005, Tipoff was expanded and renamed the Terrorist Identities Datamart Environment, or TIDES, and fingerprint and facial recognition software was added to help identify suspects as they crossed U.S. borders.

TAC remains an important NCTC contractor: In 2005, it won a $2.3 million contract in a partnership with CACI International to integrate information from the Defense Intelligence Agency into the TIDES database. TIDES is now “the wellspring for watch lists distributed to airlines, law enforcement, border posts, and U.S. consulates.” With nearly half a million names in its database, TIDES is also the first intelligence database to include both foreigners and U.S. citizens, according to the Washington Post. The Post also reported that TIDES has created significant concerns about secrecy and privacy, with innocent civilians frequently mistaken for terrorist sympathizers, and some individuals remaining on the list long after their own governments have cleared them.

TAC has become a critical private sector player in the nation’s counterterrorism efforts. In the five years after 9/11, its income quintupled, from less than $5 million in 2001 to $24 million in 2006. In 2006, TAC increased its visibility in the intelligence community by creating a “senior advisory board” that included three heavy hitters from the CIA: former Director George J. Tenet, former Chief Information Officer Alan Wade, and former senior analyst John P. Young.

“We will want to tap into their expertise, they are part of the brain trust here,” Brennan told the Washington Post (Tenet, in a statement released by TAC, said he would help the company “address critical needs as government and industry work together to fight terrorism.”) According to a former contractor familiar with TAC, Brennan is one of Tenet’s closest friends and confidantes, and hired Tenet primarily as a “rainmaker” – someone who brings new business and contracts to a firm. A former CIA officer who served in the Middle East said Brennan’s close ties with Tenet go back to the early 1990s, when Brennan was the chief of station in Riyadh, Saudi Arabia, a country that Tenet visited frequently as director of Central Intelligence (DCI).

Recent Contracts/Events

In March 2008, TAC was one of two State Department contractors charged with illegally accessing passport records of presidential contenders Barack Obama, Hillary Clinton, and John McCain. In response, TAC issued a statement on March 21: “Late this morning, representatives of the Department of State informed The Analysis Corporation (TAC) for the first time that one of the individuals who had been detected inappropriately accessing passport files of prominent political figures was a TAC employee. The individual was working on contract at the Department of State. This individual's actions were taken without the knowledge or direction of anyone at TAC and are wholly inconsistent with our professional and ethical standards. TAC has an exemplary record of supporting the Department of State and other elements of the U.S. Government for close to two decades. We are fully cooperating with the Department of State in its investigation. Specifically, we have honored the Department's request to delay taking any administrative action related to the employment of the individual in order to give the Department's Office of the Inspector General the opportunity to conduct its investigation. We deeply regret that the incident occurred and believe it is an isolated incident.” Ironically, TAC’s CEO at the time, John Brennan, was an adviser to the Obama campaign (see CNN).

In November 2007, TAC CEO John Brennan resigned from the company and from his position as chairman of the Intelligence National Security Alliance to take a position in the Obama transition team (see the company’s announcement). Brennan, who served during the presidential campaign as Obama’s chief intelligence adviser, was a top candidate for the job of CIA director, but was passed over after several national security bloggers reported that he was a key part of the CIA team that reportedly engaged in torture and enhanced interrogations of Guantanamo detainees. Update On NDAA And Drones Flying Over The US

In a stunning upset for the Obama administration and big-government zealots in general, a federal judge in New York has issued an injunction against the citizen detention portion of the National Defense Authorization Act (NDAA). Bob Unruh at World Net Daily has the story.

“A district-court judge has suspended enforcement of a law that could strip U.S. citizens of their civil rights and allow indefinite detention of individuals President Obama believes to be in support of terror.

“The Obama administration has refused to ensure that the First Amendment rights of authors and writers who express contrary positions or report on terror group activities are protected under his new National Defense Authorization Act.

“Targeted in the stunning ruling from U.S. District Judge Katherine B. Forrest of New York was Paragraph 1021 of the NDAA, which Obama signed into law last Dec. 31. The vague provision appears to allow for the suspension of civil rights for, and indefinite detention of, those individuals targeted by the president as being in support of terror.

“Virginia already has passed a law that states it will not cooperate with such detentions, and several local jurisdictions have done the same. Arizona, Rhode Island, Maryland, Oklahoma, Tennessee and Washington also have reviewed such plans.

“The case was before Forrest on a request for a temporary restraining order. The case was brought on behalf of Christopher Hedges, Daniel Ellsberg, Jennifer Bolen, Noam Chomsky, Alex O’Brien, Kai Warg All, Brigitta Jonsottir and the group U.S. Day of Rage. Many of the plaintiffs are authors or reporters who stated that the threat of indefinite detention by the U.S. military already had altered their activities.

“Constitutional expert Herb Titus filed a friend-of-the-court brief on behalf of the sponsor of the Virginia law, Delegate Bob Marshall, and others.

“Titus, an attorney with William J. Olson, P.C., told WND that the judge’s decision to grant a preliminary injunction halting enforcement of paragraph 1021 ‘affirms the constitutional position taken by Delegate Marshall is correct.’

“The impact is that ‘the statute does not have sufficient constitutional guidelines to govern the discretion of the president in making a decision whether to hold someone in indefinite military detention,’ Titus said.

“The judge noted that the law doesn’t have a requirement that there be any knowledge that an act is prohibited before a detention, he said. The judge also said the law is vague, and she appeared to be disturbed that the administration lawyers refused to answer her questions.

“The opinion underscores ‘the arrogance of the current regime, in that they will not answer questions that they ought to answer to a judge because they don’t think they have to,’ Titus said.”

Unruh went on to say, “The brief was on behalf of Marshall and other individuals and organizations including the United States Justice Foundation, Downsize DC Foundation, Institute on the Constitution, Gun Owners of America, Western Center for Journalism, the Tenth Amendment Center and Pastor Chuck Baldwin [yours truly].”

As an aside, was I the only pastor in America to be included as an amici in this brief? Let me challenge readers, the next time you go to church, ask your pastor what he is doing or what he would do to prevent military personnel from taking you off to a military prison without an arrest warrant, without issuing Miranda, without telling you why you are being seized, without allowing you access to an attorney, without recognizing that you have any constitutional rights, without any requirement to release you, or even without any requirement to keep you in the United States of America for a trial or judicial proceeding. I challenge you: ask him! And if his answer is something like, “The Lord will take care of you,” or “That could never happen in the United States,” what in the name of liberty are you doing attending that church?

Now, I wonder how many of these pseudo-conservative talking heads at FOX News, as well as the myriads of local reporters and journalists throughout the country, will at least be honest enough to admit that there was substantial reason to be concerned about the citizen detention provision of the NDAA? Ever since NDAA was signed into law, these phony guardians of liberty have been pooh-poohing the warnings that many of us columnists and independent journalists have been issuing. Now, a federal judge has also recognized the threat posed to our constitutional liberties by this provision of the NDAA, and has issued an injunction against it.

That’s the good news. The bad news is the US House of Representatives defeated an amendment that would have repealed the indefinite detention provision of the NDAA. The Tenth Amendment Center covers the story.

“In a shameful display of disregard for the Constitution and for liberty, on Friday, the House of Representatives voted to perpetuate the president’s power to indefinitely detain American citizens.

“By a vote of 238-182, members of Congress rejected the amendment offered by Representatives Adam Smith (D-Washington) and Justin Amash (R-Michigan) that would have repealed the indefinite detention provision passed overwhelmingly last year as part of the National Defense Authorization Act (NDAA) of 2012.

“The Fiscal Year 2013 NDAA retains the indefinite detention provisions, as well as the section permitting prisoners to be transferred from civilian jurisdiction to the custody of the military.

“‘The frightening thing here is that the government is claiming the power under the Afghanistan authorization for use of military force as a justification for entering American homes to grab people, indefinitely detain them and not give them a charge or trial,’ Representative Amash said during House debate.”

The report goes on to say, “Each of these freedom-phobes [the congressmen who voted to keep the indefinite detention provision of the NDAA] invoked the specter of terror (in one way or another: ‘terrorist,’ ‘al-Qaeda,’ ‘enemies’) to justify the abolition of constitutionally guaranteed civil liberties.

“Seemingly, those promoting these provisions would offer Americans as sacrifices on the altar of safety, the fires of which are fed by the kindling of the Constitution.”

Hear! Hear!

The report astutely includes this warning from “The Father of The US Constitution,” James Madison: “It is a universal truth that the loss of liberty at home is to be charged to the provisions against danger, real or pretended, from abroad.”

Oh! Take a guess as to who was the only candidate for President who supported the Smith-Amash amendment to repeal the indefinite detention provision of the NDAA? You got it: Congressman Ron Paul.

This goes to prove that sometimes our enemies are not the courts; sometimes our enemies are the legislatures of this country. This was the case in the aforementioned actions. So, now we have a federal court and the US Congress (allied by the White House) in conflict. It’s going to get very interesting!

“The comments from Krauthammer, who won the Pulitzer Prize for commentary in 1987 after serving as a speechwriter for Vice President Walter Mondale and then beginning his journalism career at The New Republic, were on ‘Special Report’ with Bret Baier.

“‘I would predict, I am not encouraging, but I predict the first guy who uses a Second Amendment weapon to bring a drone down that’s been hovering over his house is going to be a folk hero in this country,’ Krauthammer said.

“The conversation arose as the federal government announced it is beginning to allow public safety agencies to fly unmanned aircraft–drones–with fewer and fewer restrictions.

“According to yesterday’s report from Bloomberg, police, fire and other government agencies now are being allowed to fly drones weighing as much as 25 pounds without special approvals previously needed.

“The Federal Aviation Administration said on its website that the move was an interim step until the agency finishes rules that will open the door for commercial operation of drones, as well as those uses for government purposes.

“Congress has adopted the position of encouraging more drone flights, with the ‘goal of adapting technology used by the military in Iraq and Afghanistan.’”

There you have it, folks. Your federal government–along with numerous local and State police agencies–is preparing to use instruments of war against the citizens of the United States. And numerous local and State police agencies are standing in line to participate. I ask you, do the US Congress, the FAA, and our local and State authorities plan to arm these drones with more than surveillance cameras (as if that’s not bad enough)? Should we expect that the drones that will be flying over our neighborhoods would be armed with machine guns and missiles? That’s the “technology used by the military in Iraq and Afghanistan,” after all.

What is wrong with the American people? What is wrong with our representatives? What is wrong with our State legislators? What is wrong with our local and State police agencies? What is wrong with our pastors and churches? What is wrong with our reporters and journalists? Are they THAT blind? Do they want a paycheck THAT badly? Are they THAT willing to allow this free republic to be thrown into the trash bin of history, only to be replaced with a giant Police State? Are we THAT ignorant of history? Is THAT really where we are?

Ladies and gentlemen, the emerging police state is the foremost issue confronting the people of the United States today! And on this issue, the labels Democrat and Republican mean absolutely nothing! Nothing! If the voters of this country do not awaken quickly to what is going on in front of their very eyes, it won’t matter to a tinker’s dam which party or which candidate is put into office. If we do not have the right to live in privacy and peace, all of the other rights we talk about mean absolutely nothing!
