We would also caution Kucinich and his team to closely inspect the chain of custody for the ballots in question, and what has happened to them, and the vulnerable op-scan memory cards, since the election two days ago, during the period that concern has been widely expressed about the seemingly anomalous results of Tuesday's election. It's important that the chain of custody be both secure, fully logged, and transparent.

This is exactly one of the big problems Bev Harris was discussing today on Alex' show.

However, I'm pretty confident that Kucinich, with his extensive knowledge on this subject, that he is well aware of the traps that will be laid to thwart an honest recount. I'm also sure he is in contact with people like Bev Harris, other experts, and lawyers in New Hampshire.

I have to hand it to Kucinich's courage.  I still have suspicions about the death of his brother, and here he is charging forward!

The election integrity community is abuzz with news that candidate Dennis Kucinich will ask for a recount in New Hampshire, and Ron Paul fans have been pushing him to recount as well. Careful.

NEW HAMPSHIRE ELECTION INTEGRITY ADVOCATE NANCY TOBI IS CORRECT:

"We have no control over the ballot chain of custody and we have learned the pain from the 2004 Nader recount, in which only 11 districts were counted, chosen by a highly questionable person, and then nothing showed up. Now all we hear is how the Nader recount validated the machines."

As Tobi says, "A candidate asking for a recount may well be a tool used to 'prove' everything was okay and then that candidate will be further discredited."

I'll go further than that. The only way a recount makes any sense at all in New Hampshire is AFTER an assessment is made of the chain of custody issues. If the chain of custody isn't intact the recount won't be worth a cup of warm spit.

TOBI:

"This is high stakes.

"You do not walk into a battle ground not knowing where the snipers are, just because you were invited. Strategically, going into something like this where you have NO CONTROL is foolishness.

"And I say this as one of the strongest recount proponents of former times. Things I have come to learn and understand have changed my mind. The recount is someone else's game, not ours.

"In the recount, we have no control, and we have already lost 48 long hours of ballot chain of custody oversight.

"We need citizen control and oversight. This is not going to come from the recount. If the election was rigged...don't you think the riggers would have a backup Plan B for a rigged recount, knowing how easy it is to get a recount in NH?

WHAT'S THE POINT OF A RECOUNT IF THE CANDIDATE DOESN'T EVEN KNOW...

2) The ballot ordering history for each location, especially those using computerized voting systems and the inventory records for the current contest.

3) The ballot chain of custody plan for each location and for the state of New Hampshire.

IMMEDIATE CONCERNS

- We don't have information on ballot inventory records.

- With ballots and recounts, it's all about blocking ballot substitution. To achieve substitution, you need extra ballots. If you get more ballots, someone might follow the money trail and ask you why you're sitting on 10,000 or so blank ballots. So you need some workarounds.

BALLOT CHAIN OF CUSTODY WAR STORIES

Patriot Richard Hayes Phillips, while writing his brilliant upcoming book "Witness to a Crime," uncovered evidence that an Ohio County took delivery on 10,000 off-the-books ballots in 2004.

Employees for the Diebold ballot printing plant slipped us financials showing that Diebold was printing 25% more ballots than ordered. This could be handy: If a governmental entity doesn't take official delivery on ballots, Plan B can sit at a print house somewhere, on private property and absent from either government bookkeeping or public records.

CONVICTED FELONS

The Diebold ballot printing plant at the time we got records on the overages, was being run by a convicted felon who had spent four years in prison on a narcotics trafficking charge. No, not New Hampshire's voting machine programming exec Ken Hajjar, who cut a plea deal in 1990 for his role in cocaine distribution. This was another convicted felon, John Elder, who ran the Diebold ballot printing plant; he's now an elections consultant.

We have so far been unable to learn whether New Hampshire has convicted felons printing their ballots; we've got a records request in on this. New Hampshire officials like to say "The state prints the ballots" but they sure aren't printed in Secretary of State Bill Gardner's office.

Frank S., one of the new breed of citizens jumping in to take back control of our elections, took the initiative on his own to help today by spending several hours trying to find the ballot printer in NH. It may be that convicted felons print the ballots: Frank turned up evidence that one state-paid printing vendor is NHCI - New Hampshire Correctional Industries, a prison-based printing outfit.

New Hampshire Correctional Industries is a job training program for inmates. After they get out of prison they have a skill! I'm not sure we want a bunch of ex-convicts running around in New Hampshire with ballot printing expertise, so I hope a different ballot printing vendor will show up.

Any candidate seeking a recount needs to know this stuff.

IDENTIFY NARROW SPOTS IN THE PIPELINE

What is the smallest number of people with access, and at what points does centralization of access occur?

WHERE HAVE THE BALLOTS BEEN DURING THE LAST 48 HOURS

If there's going to be a recount of this magnitude, we need to know whether checks and balances have been followed. Let me give you an example of what I mean: In San Mateo County, California, citizen Brent Turner asked for ballot chain of custody records for 2007; a six-week gap in the access logs was revealed in the documents.

SHOULD CANDIDATES RECOUNT NEW HAMPSHIRE?

In concept I love the idea, but as it currently stands, it makes me queasy. They're walking into this blind about the details that make or break the integrity of the process.

WHAT TO DO INSTEAD

Tobi calls for doing a real investigation in order to take corrective action by November. I'm not sure about that. New Hampshire had hearings on the hackable Diebold optical scan machines, and didn't take any action to mitigate the risks.

New Hampshire knew it was running elections on machines that can't be trusted. And today, thanks to the efforts of two more citizen volunteers, I learned that the New Hampshire Secretary of State knew about the narcotics trafficking conviction of Ken Hajjar, yet still authorized LHS to code every memory card in New Hampshire.

Harri Hursti himself testified in New Hampshire in Sept. 2007, urging them to disconnect the wiring allowing reprogramming of the memory card through the modem port. New Hampshire took no action.

New Hampshire didn't take even the half-step actions other states used to beef up voting machine security.

Maybe there are better ways to skin this cat.

THE IDEA OF A RECOUNT STILL INTRIGUES ME BUT...

At this moment I can't think of a way to offset the chain of custody unknowns. The last thing we want is a recount that doesn't answer our questions, or raises new suspicions that aren't answered.

There must be a way. It's been a long day. Let me think on that.

A U.S. presidential candidate has demanded a recount in the dramatic New Hampshire primary that saw Hillary Clinton make a stunning comeback after all polls suggested she would lose to Democratic rival Barack Obama.

"Comeback Kid" Clinton confounded predictions that her presidential campaign was over after defeat in the Iowa caucuses by taking New Hampshire, despite pollsters predicting Obama would take the state by as many as 13 points.

Democrat Dennis Kucinich, who won less than 2 per cent of the vote in the New Hampshire primary, said yesterday he wants a recount to ensure that all ballots in his party's contest were counted, the Toronto Star is reporting this morning.

The Ohio congressman cited "serious and credible reports, allegations and rumors" about the integrity of Tuesday results.

Deputy Secretary of State David Scanlan said Kucinich is entitled to a statewide recount. But, under New Hampshire law, Kucinich will have to pay for it. Scanlan said he had "every confidence" the results are accurate.

In a letter dated yesterday, Kucinich said he does not expect significant changes in his vote total, but wants assurance that "100 per cent of the voters had 100 per cent of their votes counted."

Kucinich alluded to online reports alleging disparities around the state between hand-counted ballots, which tended to favor Senator Barack Obama, and machine-counted ones that tended to favor Senator Hillary Rodham Clinton. He also noted the difference between pre-election polls, which indicated Obama would win, and Clinton's triumph by a 39 per cent to 37 per cent margin.

CIA Director Hayden's public statement yesterday, that some members of Congress were informed about the existence of videotaped interrogations of high value detainees, prompts me to respond.

In early 2003, in my capacity at Ranking Member of the House Intelligence Committee, I received a highly classified briefing on CIA interrogation practices from the agency’s General Counsel. The briefing raised a number of serious concerns and led me to send a letter to the General Counsel. Both the briefing and my letter are classified so I cannot reveal specifics, but I did caution against destruction of any videotapes.

Given the nature of the classification, I was not free to mention this subject publicly until Director Hayden disclosed it yesterday. To my knowledge, the Intelligence Committee was never informed that any videotapes had been destroyed. Surely I was not.

This matter must be promptly and fully investigated and I call for my letter of February 2003, which was never responded to and has been in the CIA’s files ever since, to be declassified.

So Harman had, in early 2003, at least generic knowledge of the tapes' existence and at least some indication that the CIA might have destroyed them. She felt restricted by classification from saying anything about this publicly, and now what she warned against has come to pass. There's every reason to suspect that the CIA has recorded more interrogations than we currently know of, and has destroyed even more evidence of such than we're presently aware.

Perhaps Harman can shed even more light here. The CIA may not look too kindly on her request to declassify the 2003 letter. As Matt Yglesias writes, it's time for Harman to start snitching. Dare the agency to seek prosecution.

Evidence surfacing in the widening scandal around Republican super-lobbyist Jack Abramoff indicates the cabal being lavishly funding in recent years though his efforts was originally supported through the infamous "off the books" Enterprise headed by Marine Lt. Colonel Oliver North, only partially exposed in the Iran Contra Scandal.


"Bayonets ready? Okay...Cue the stunt baby!"

Craig Fuller, the man responsible for the discredited 1991 propaganda about Iraqi soldiers bayoneting babies in Kuwaiti nurseries, for example, was also part involved in an operation in 1999 which included Abramoff associates in the Republican Party as well as members of the Sicilian Mafia, a joint push to establish a Cuban "beachhead" in anticipation of an "opening to Cuba" after the death of Fidel Castro.

This may explain why, while legal imbroglios consume Karl Rove, Scooter Libby, Dick Cheney, Bill Frist, David Safavian, chief of staff at the General Services Administration, and pest-exterminator- turned-‘Hammer’ Tom DeLay, according to published reports it’s Abramoff Republican strategists are most worried about.

"The one (scandal) that people are most worried about is Abramoff, because it seems to have such long tentacles," former congressman Vin Weber, a lobbyist with close ties to the White House, told the Los Angeles Times. "This seems to be something that could spread almost anywhere. That has a lot of people worried."

Abramoff is now under indictment, along with henchman Adam Kidan, for the SunCruz gambling cruise scandal, with a gangland-style murder attached offering a vivid example of the GOPMOB making someone an offer they couldn't refuse and then whacking them before they could squeal.

Abramoff is also the target of the indictment of David Safavian, and the reason as well for the newest scandal, which leads directly to George W. Bush, the obstruction of justice of a federal probe in Guam.

9. ABRAMOFF LINKED TO WHITE HOUSE SPY SCANDAL.

Through his representation in Washington of members of the political faction on the receiving end of purloined classified data, Casino Jack’ Abramoff is linked to the White House Spy scandal involving former Marine Leandro Aragoncillo, The MadCowMorningNews has learned.

This began to become clear several months ago in a move which received little attention at the time, when the federal grand jury investigating Abramoff subpoenaed Imelda Marcos, the former first lady of the Philippines. Observers had puzzled over what she could possibly have to do with Abramoff.

Imelda Marcos is an ally of Abramoff’s clients in Manila, one of two warring Philippine factions competing for ownership of a Guam-based telecommunications company, which—if Abramoff’s pals get their way—will be used as a home portal for worldwide Internet gambling in a venue (Guam) which offers more opportunities for money laundering than almost anywhere in the world.

Abramoff’s faction was alarmed over reports that the Governor of the nearby territory of the Mariana’s was expressing concerns that Abramoff client (and Tom DeLay host) Willie Tan, one of Hong Kong’s richest tycoons, was behind the telephone-based gambling and online lottery push in the islands.

We'll have more on this later. But, as you can imagine, intrigue ensued.

 

8. FIGURE INVOLVED IN ENTERPRISE’S ‘OPENING’ TO CUBA USED ‘BILL OF GOODS’ TO SELL FIRST IRAQ WAR

Washington-based PR firm Hill & Knowlton, under the leadership of George Bush Senior's former chief of staff Craig Fuller, devised a remarkable "hook" for the propaganda campaign which sold the first Iraq war to the American people: a heartrending story of invading Iraqi troops tearing newborn infants from hospital incubators, and leaving them to die.

"I volunteered at the al-Addan hospital," asserted a 15-year-old Kuwaiti girl identified only as "Nayirah" during a meeting of the Congressional Human Rights Caucus on October 10, 1990.

"While I was there, I saw the Iraqi soldiers come into the hospital with guns, and go into the room where…babies were in incubators. They took the babies out of the incubators, took the incubators, and left the babies on the cold floor to die."

Other "witnesses" coached by Hill & Knowlton offered similar accounts before the UN Security Council, and a video produced by the PR agency was shown to the Council.

The result was an Article Seven resolution against Iraq – the world body’s equivalent of a declaration of war, used by President Bush as the authority to attack Iraq.

Fuller, when he's not conjuring dead infants left on cold floors to die, participated in other "cabal ops" as well...

Several weeks ago we reported that Abramoff associate Adam Kidan was in business with a capo in the the Sicilian Mafia.

Republican “fund-raiser” Adam Kidan was a partner and general counsel for a hotel in the Caribbean owned by a member of the Sicilian Mafia, a man recently taken into custody in Italy as part of a major investigation into international arms trafficking.

“St. Maarten hotel owner arrested, linked to Mafia” was the headline of an Associated Press story about Kidan’s partner in St Maarten, Rosario Spadaro, 72.

Spadaro had other interests as well, according to a Miami Herald story on May 17, 1999 headlined “MAFIA HAS EYES ON CUBA,” which detailed his efforts on behalf of the Sicilian Mafia to set up shop in Cuba once President Fidel Castro had been removed from the scene, presumably through natural causes.

Odd, the secretive Naples, FL financier who owned the Venice FL flight school attended by terrorist ringleader Mohamed Atta was also engaged in an “opening to Cuba” at the same time the Miami Herald says the Sicilian Mafia was seeking to re-enter Cuba, passing out Presidential Rolexes (see photo) to top comandantes.

“Highly Unusual Coalition Has Eyes on Cuba" was the droll headline in a National Journal article.

The coalition is chaired by Craig Fuller of the U. S.-Cuba Trade Association, which seeks to strengthen contacts between U.S. companies and Cuba. "Economic sanctions applied for political reasons, simply, do not work," said Craig Fuller, former chief of staff under President Bush, and member of Americans For Humanitarian Trade With Cuba.

At the very same time, as if acting in concert, terror flight school owner Hilliard, the Sicilian Mafia, and the former chief of staff to the elder President Bush, Craig Fuller, were all looking to cut themselves into Cuba in anticipation of the resumption of normal diplomatic relations between Cuba and the United States.

Prosecuting attorneys get criminal conspiracy convictions on less all day long.

Fuller's group included David Rockefeller and Archer Daniels Midland Chairman Dwayne Andreas. The Sicilian Mafia, Mohamed Atta’s U.S. contact, and David Rockefeller... just a case of "great minds run in similar channels?

7.ABRAMOFF INDICTMENT FOR BOULIS MURDER LIKELY

When three Gambino Mob associates were charged in the Gus Boulis murder three weeks ago, authorities in Fort Lauderdale wouldn’t say what led investigators to the suspects.

What they did say was further arrests are anticipated.

"There are facts that will eventually come out publicly;I just can't talk about them at the moment," said assistant state attorney Brian Cavanaugh, who heads the prosecution team. "It is possible, as well as plausible that others were involved."

When the first murder indictments were handed down, lawyers representing Abramoff and his henchman Adam Kidan hurried to insist their that clients, both free on bail on fraud charges involving their purchase of SunCruz, had nothing at all to do with Mr. Boulis’s unfortunate demise.

Abramoff's Miami attorney, Neal Sonnett, told the Los Angeles Times, "Jack Abramoff has no knowledge of the facts of the murder," adding that his client has no connections to the underworld.

Adam Kidan's lawyer Martin Jaffe said there's no connection between the SunCruz fraud case and the Boulis murder allegations.

Alas for both men (not to mention the unfortunate Boulis)...nothing could be further from the truth.

As we've already reported, Boulis knew he was about to be “hit.”

Murmurs that Abramoff has 'exposure' in the assassination of Boulis have been growing. They will grow louder if, as expected, henchman Adam Kidan is indicted for murder.

His defense—a gambit pioneered by terror flight school owner and secretive Republican financier Wally Hilliard—will be that he was the innocent victim of unscrupulous employees.

Given that famous Republican attorney Roy Cohn is (at least reportedly) still dead, the chances of this defense flying before jurors hover somewhere between 'slim and none.'
 



6. ABRAMOFF’S SCANDAL PARTNERS INCLUDE BUSH PIONEERS, THE MOB, U.S. DEFENSE CONTRACTORS, AND "PROFESSIONAL CHRISTIANS"

The Gus Boulis murder was clearly designed to remove him as an obstacle. But an obstacle to what? Fortunately, Abramoff ‘boy wonder’ Adam Kidan spilled the beans to reporters in more innocent times...

“Recently, Kidan charted an aggressive, expansionist course toward exotic ports of call 10,000 miles away in the Pacific Ocean,” the Miami Daily Business Review reported on June 15, 2001.

“Kidan and other...SunCruz executives traveled to Saipan in December, and again in April to discuss with government officials plans to open a 150-foot casino ship equipped with 165 slot machines and 25 gaming tables,” according to the Saipan Tribune.

“We are continuously deploying floating casinos to areas where there are good potentials," Kidan was quoted as saying.

SunCruz was in the "final stages" of bringing casino ships to berths in Hong Kong and to the former Portuguese colony of Macao, and that SunCruz officials had visited Guam, where they also intended to start a floating casino, the paper reported.

"The Northern Marianas can be a casino hub in the Pacific region, especially with its proximity to Asia, where millions play cards and machines.”


The idea was to turn the tiny island of Tinian in the Mariana’s, a three-hour flight from most major Asian population centers, into a Mecca of glittering casinos and gambling cruise ships.

Until now, the island has been a mere footnote in world history: The Enola Gay took off in August, 1945 from Tinian's airfield to drop the first atomic bomb.

World almanacs mention that the US military leases northern Tinian, then refer to “Tinian's attempts to become the Monte Carlo of Micronesia.”

The Monte Carlo of Micronesia?  

It must be stated that the major players in Tinian’s gambling efforts do not appear to have wandered in off the street...

An outfit calling itself The Lone Star Casino Corp., we found, had been first with a foot in the door.

“Tinian, some three hours flying time from half the world's population, has been the Lone Star Casino Corp.'s great adventure,” read a company press release in 1995.

“Guam has an annual tourism base of more than a million people... a jaunt to Tinian beats a tiring trip to Las Vegas of 20-plus hours from South Korea, Hong Kong, Taiwan or Tokyo.”

The now-defunct Lone Star Casino Corp. was the first land-based casino company on Tinian. It had been owned by United Gaming, one of the nation's largest owners of video poker and other electronic gaming machines, a company controlled by a Texan named Richard Rainwater.

Who is Richard Rainwater?

 At least 60 percent of George W. Bush's income in the year he first ran for Texas Governor came from businesses he invested in with Fort Worth financier Richard E. Rainwater, records show.

Rainwater was the major investor behind George W. Bush’s purchase of the Texas Rangers. He was also one of Bush’s biggest campaign supporters.

This is no doubt just a freak coincidence.

Also involved in Lone Star was South African Lesley Greyling, a man who was also in business with Iran-Contra middleman Adnan Khashoggi in a casino in the Bahamas supported by weekly flights on terror flight school owner Wally Hilliard’s Lear jets.

"Khashoggi was among a number of prominent Arab businessmen, like Khalid Mahfouz, who agreed to continue what have been described by US intelligence officials as "protection payments" to bin Laden at a meeting in Paris in 1998, said London's Sunday Post October 7, 2001.

The airline that had been tapped by the group, and approved by local government officials to serve the island’s casinos, was Texas-based Pacific Island Aviation, a company partially funded by the Lockheed Martin Corporation.

Pacific Island Aviation was being used in support of some 'sensitive' international assignments. During the recent American expansion of influence in the oil-rich former Soviet Republics of Central Asia, for example, the company operated flights into and out of the Georgian capital of Tbilisi and the Azerbaijan capital Baku.

So we at least know they're discreet.
 


5.SAFAVIAN INDICTMENT NOT ABOUT HEBREW SCHOOL

Then there's the indictment of White House apparatchik David Safavian, the first government official in Washington charged in the corruption inquiry related to Abramoff's activities, which is most assuredly not about providing “surplus” government property for a Abramoff-funded Hebrew school.

When a telecommunications company on the tiny Mariana’s island of Tinian exchanged hands last year, the Mariana’s Governor expressed concern that one of the partners, Abramoff client Willie Tan, might use it to expand his push into telephone- and Internet–based gambling on the island.

Described in newspaper reports as the most powerful man in the Northern Mariana Islands, his Tan Holdings “has a vice-like grip onthe island economy as the biggest garment manufacturer in an industry that has come under Washington's scrutiny, as well as the owner of poker machines that stand in seedy dens on nearly every Saipan corner. Tan was so powerful on the Mariana’s main island of Saipan that some joked it should be renamed "Sai-Tan."
 

"Can we get away with a few discreet poker tables at the Hebrew School?"

Beginning with Casino Jack’s lobbying home run on behalf of the Internet gambling industry in 2000, when he stopped the Internet Gambling Prohibition Act in its tracks, Internet gambling has been a major motif in the Abramoff saga.

Unmentioned in articles about Abramoff's troubles, The Mariana island chain's main attraction to Abramoff’s group is as a platform from which to run worldwide internet gambling.

While this may violate Federal telecommunications laws, Jack Abramoff’s buddies have been working on it, the real reason behind the indictment of White House apparatchik David Safavian...

Safavian was also a passionate advocate of Internet gambling. His clients included the Interactive Gaming Council, a trade association for online betting houses. In 1999, he founded the Internet Consumer Choice Coalition, a nonprofit whose sole purpose was to fight a bill that would have made online gambling a federal crime.

While Safavian was charged with helping Abramoff try to acquire, for an Abramoff-sponsored Hebrew school, a plot of federally owned land managed by the GSA in Silver Spring, Maryland, and accused of making repeated false statements to government investigators about a congressional golf trip with Abramoff to Scotland in 2002,his attorney isn't fooled.

Suspecting something more was afoot, Barbara Van Gelder accused federal officials of "a creative use of the criminal code to secure his cooperation."  
 

4. GUAM PROBE INTO FEMA RIP-OFFS OBSTRUCTED BY OVAL OFFICE

Then there's the recent revelation that Abramoff was the subject of a Guam grand jury probe in 2002, thwarted by George W Bush his-ownself, who intervened to remove the supervising federal prosecutor.

Abramoff spokesman Andrew Blum said the lobbyist "has no recollection of his being investigated in Guam in 2002."

Remembering every SINGLE time he's investigated must be like Wilt Chamberlain trying to remember all of his reported 20,000 dalliances.

Somebody should ask him: does the name “Carl Gutierrez” ring a bell?

Before President Bush stepped in and put a stop to it, Gutierrez, Guam’s Governor, had seen virtually his entire top staff head off to minimum security prisons, in an orgy of looting, a feeding frenzy for land-based sharks.

His former chief of staff Gil Shinohara, to cite one of a dozen examples, was found guilty of conspiracy to commit money launderingand conspiracy to commit bank fraud.

Corruption was so widespread that even the Parks and Recreation Director got into it, convicted of bid-rigging, bribery, wire fraud and money laundering, as well as ripping off large sums of money from FEMA, and was sentenced to 10 years in jail—the longest antitrust-related jail sentence ever imposed.

No wonder Guam court officials were upset...Even Guam’s Governor was charged, with using government material and personnel to work on his ranch. So they paid Abramoff almost $400,000—of U.S. taxpayer money!—to get Abramoff to get the U.S. Attorney off their backs.

Abramoff delivered. Working with Representative Tom DeLay, the Texas Republican, the two men managed to get the legislation defeated in the House, using the argument that the Marianas represented low taxes and free enterprise and should be left alone.
 

"Water costs money. Maybe hold off for a while."

And speaking of ripping off FEMA, Abramoff wanted to lease some of “his” Sun Cruz cruise ships to the Federal Emergency Management Agency to house rescue workers off New York City after 9.11., and asked noted "professional Christian" Ralph Reed to find out who at the agency he should contact to make the proposal.

The White House, oddly enough, had recently-indicted David Safavian involved in hurricane relief until he was arrested... This may help explain why there wasn’t enough money left in the budget to pass out water to citizens at the Superdome in New Orleans...

Abramoff and DeLay are all about protecting free enterprise. And underworld gangs engaged in money laundering and drug running in the Mariana Islands and Guam, apparently. Although a US government report pleaded for U.S. legal intervention in Guam, "free market conservatives" Abramoff & DeLay were having none of it.

The result? Reduced U.S. Government interference in the criminal activities in the Mariana Islands and Guam of Chinese Triad gangs, the Japanese Yakuza, and the Russian Mafia.
 

3. CASINO JACK PART OF OLLIE NORTH’S “ENTERPRISE.”


Far from being an isolated miscreant blinded by greed, the proverbial “one bad apple” in an otherwise blameless barrel, Republican lobbyist ‘Casino Jack’ Abramoff is following in the footsteps of the people who showed the way by successfully skirting punishment in the unresolved American scandals (Iran Contra, BCCI, and the Savings and Loan Scandal) of the recent past.

Remember Iran Contra? "The “Enterprise?" The Enterprise Lives... Jack Abramoff is Oliver North in a $2000 suit.

The “guided” tours to the Abramoff scandals being conducted by the major media resemble nothing so much as a trip to a “Potemkin village,” named for Grigori Potemkin, who played Karl Rove to Russian Czarina’s Catherine the Great’s George W. Bush by ordering the creation of elaborate fake villages along her route, in places where turmoil and poverty reigned, to give her a false impression of peace and prosperity as she toured her far-flung empire.

Apparently, we are to believe that Jack Abramoff has carved out a vast Indian gambling empire and a cozy little Republican slave state set amid the coral reefs and azure seas of the small island chain of the Marianas 7,000 miles from the Californian coast... all by himself, with modest assistance from former pest exterminator Delay.

What’s being hidden from view is a graveyard filled with spirits from the major unresolved American scandals of the recent past.

The story being retailed to date about Abramoff bears frightening similarities to the official version of 9.11, a fable of two separate Dutch nationals—the Magic Dutch Boys—who just happen to purchase two flight schools in tiny Venice Florida at the same time which then just happen to begin training Al Qaeda operatives.

Missing from the official version of 9.11 is that the flight school where Mohamed Atta learned to fly just happened to be owned by a man whose planes were just then trafficking in quantities of heroin rarely seen... even in Florida.

Things equally important are being left out of accounts of Abramoff.
 

2. ‘ALL OUR SCANDALS ARE THE SAME.”

The SunCruz fraud case and the Boulis murder allegations are clearly linked, both to each other and to Abramoff and Delay’s Indian gambling scandal as well.

Within weeks of closing the original SunCruz sale with Boulis, Abramoff and Kidan began seeking to refinance the company. They gave copies of its financial statements to a battery of investment bankers, bond underwriters, and at least one Native American tribe with gaming interests—the Oklahoma-based Kiowa Indians.

They also were discussing possible land-based casino ventures with a branch of the Eastern Band of Cherokee Indians, and made inquiries into buying two more Long Island, N.Y.-based gambling ships.

Plans were afoot to diversify the Republican’s Mariana’s protectorate from its base in sweat shops, involuntary servitude and forced prostitution and into casino and internet gambling.

Attempts to decouple the various Abramoff scandals rely on arguments like the ones made in court by former Mob Boss John Gotti’s lawyer Bruce Cutler against the RICO indictments against his client.

Alleging a continuing criminal enterprise was utterly without merit because the various rackets engaged in by the Gambino Family have nothing whatever in common, said Cutler.

Loan sharking and murder, presumably, existed as independent franchises distinct from the Gambino Family’s trade in murder and mayhem. The argument didn’t fly.

Gotti spent the rest of his life in prison.

And, finally...The #1 THING YOU NEVER KNEW ABOUT THE ABRAMOFF SCANDALS:


1. NOTHING IS WHAT IT SEEMS.

Newspapers called Boulis’s killing a “gangland-style murder.”

But there is another word which more accurately describes it: “Assassination,” says Webster’s dictionary, is “murder which changes the world.”

What does a scandal involving Indian casinos, gambling boat “cruises to nowhere” & pay-for-play government officials have to do with the story of 19 hijackers planning a mass murder in supposed isolation in Florida?

Over three years ago—within a month of the 9.11 attack—British Prime Minister Tony Blair had presented the case against Bin Laden. He sketched out the Cliff Notes version of the evidence. It wasn’t much, but it was the only explanation we ever received.

“Al Qaeda is a terrorist organization with ties to a global network,” Blair said.

When NBC's Dateline did a story recently about sources of terrorist funding right here in the U.S., they announced “the emerging threat of a new alliance between al Qaeda and common criminals.”

It was hardly time to stop the presses.

“Some of the same names in the Abramoff scandal also surface in connection with Mohamed Atta’s,” we reported, in a June 21, 2005 story headlined “THE SECRET WORLD OF 9.11.”

“There remains a strong suspicion that Atta’s terrorist cadre—supposedly unknown and friendless and burrowing into the woodwork—was able to call on the assistance, when necessary, of a friendly global network.

Could it be that this network is the same one being probed so gingerly today by investigators looking into Jack Abramoff?

Far from being a rogue lobbyist who went just a few tens of millions of dollars too far, Jack Abramoff is an operative for an organization which has sold Americans a bill of goods as justification in at least three recent wars.

There are an amazing number of people described as ‘financial whizzes’ and ‘boy wonders of business’ involved in the story of Jack Abramoff.

But... are they really?

Capital Athletic Foundation, a charity run by disgraced lobbyist Jack Abramoff, who is now at the center of an influence-peddling investigation on Capitol Hill, told the IRS it gave away more than $330,000 in grants in 2002 to four other charities that say they never received the money.

The largest grant the foundation listed in its 2002 tax filing was for $300,000 to P'TACH of New York, a nonprofit that helps Jewish children with learning disabilities.

"We've never received a $300,000 gift, not in our 28 years," a surprised Rabbi Burton Jaffa, P'TACH's national director, told the Austin American-States- man. "It would have been gone by now. I guess I would have been able to pay some teachers on time."

Federal investigators have not contacted P'TACH about the grant, Jaffa said. Representa- tives of three other nonprofits that supposedly received Capital Athletic money also said they have not been contacted.

The grant-reporting discrepancy raises further questions about Abramoff's use of the foundation's finances as he built one of the most successful and well-connected lobbying practices in Washington. Abramoff's dealings already have led to the indictment of a Bush administration official, a subpoena for a GOP committee chairman and investigations by the Justice Department, Internal Revenue Service and U.S. Senate.

The discrepancy also follows e-mails between Abramoff and members of his lobbying team that say then-House Republican Leader Tom DeLay wanted to raise money through Capital Athletic for an unspecified purpose. In one of those e-mails, Abramoff announced a $200,000 fundraising goal.

DeLay does not recall making such a request, his lawyer, Richard Cullen, said Wednesday. Capital Athletic's tax return does not indicate whether Abramoff reached his $200,000 goal.

But around the time Capital Athletic's tax form was filed in fall 2003, listing the $300,000 donation P'TACH says it didn't get, a DeLay-created charity called Celebrations for Children was begun with $300,000 in seed money.

Celebrations for Children was a short-lived effort to raise money for children's charities by providing donors with special access to DeLay, plus yacht trips and other enticements, during the 2004 Republican National Convention in New York. Watchdog groups protested, claiming the fundraiser violated a new ban on accumulating unlimited "soft" money, and DeLay dropped it in May 2004.

E-mails and documents released so far in the ongoing investigations do not detail where Capital Athletic's elusive $300,000 went, or if it was money raised at DeLay's behest in possible violation of federal law.

Abramoff, who knows the answers, is not talking.

Abramoff spokesman Andrew Blum declined to comment on whether Capital Athletic donated to Celebrations for Children. Blum also refused to discuss the missing grants.

"No comment on your entire set of questions," he said. DeLay lawyer Cullen, asked Wednesday afternoon if Capital Athletic gave $300,000 to Celebrations for Children, said he could not reply, noting there was not enough time to track that information down.

The ultimate answers may be important for DeLay. Federal law prohibits members of Congress from requesting "anything of value" from anyone seeking official action from the House or doing business with the House. Lobbyists in particular should not be solicited, according to an ethics committee memo explaining the House Ethics Manual.

An exchange of e-mails in the summer of 2002 between Abramoff and lobbying partner Tony Rudy, DeLay's former chief of staff, demonstrate that the men were not shy about using DeLay's name to solicit money for Capital Athletic, particularly from Indian tribe clients that had proven lucrative to Abramoff's lobbying practice.

Capital Athletic's financial records also show that the foundation spent money on political endeavors unrelated to the foundation's stated mission of promoting sportsmanship.

In June 2002, Abramoff told Rudy in an e-mail that DeLay wanted Capital Athletic to raise some money for him, and Abramoff suggested hitting up one of the six casino-operating Indian tribes that enriched Abramoff and a partner with $82 million in lobbying fees.

"I recommend we hit everyone who cares about Tom's requests. I have another few to hit still, " Abramoff wrote. "I think that, if we can do $200K, that would be good."

Abramoff suggested that Rudy contact the Saginaw Chippewa Tribe of Michigan, saying, "it'll look better coming from you as a former DeLay (chief of staff). We'z gonna make a bundle here."

Rudy, however, made a mistake, passing off the task of approaching the tribe to Todd Boulanger, an Abramoff team lobbyist who was out of the loop.

Boulanger replied: "What is it? I've never heard of it."

Rudy: "It is something our friends are raising money for."

Boulanger: "I'm sensing shadiness. I'll stop asking."

Rudy: "If you have to say Leadership is asking, please do. I already have."

When the e-mail exchange was copied to Abramoff, he replied to Rudy with an expletive-punctuated tirade: "I did not want you to bring Todd into this!!! . . . You should have followed my request to get in touch with (the tribe) directly. Dammit. Now this is out."

Despite Abramoff's concern, the tribe did contribute $25,000.

Bernie Sprague, subchief for the Saginaw Chippewa Tribe, opposed the contribution. While the tribal council was told Capital Athletic was a worthy charity that helped needy children in the Washington area, "my response was we have our own kids that we need to take care of, we shouldn't be worrying about the kids in D.C.," he said.

The majority of tribal council members, however, agreed to the contribution, warming to the sales pitch that the organization "was supported by Tom DeLay and others, and they would appreciate the tribe's donation in the future if we had issues that had to go before them," Sprague said in an interview this week.

Capital Athletic's tax return also shows a $50,000 donation from the Alabama-Coushatta tribe of East Texas, but that money was solicited to pay for U.S. Rep. Bob Ney's golf outing to Scotland, said Fred Petti, a lawyer for the tribe.

That 2002 trip, financed by Capital Athletic, also included David Safavian, then chief of staff at the General Services Administration. Safavian has been charged with lying to federal investigators about his dealings with Abramoff and is scheduled to stand trial in April.

Ney, R-Ohio and chairman of the House Administration Committee, has said he has not been formally notified that he is a target of federal investigators, but a plea agreement entered last month by former Abramoff business partner Michael Scanlon asserts that Ney accepted meals and trips "in exchange for a series of official acts and influence."

P'TACH's $300,000 grant is the largest of four listed on the foundation's 2002 tax filing that representatives of nonprofit groups told the American-Statesman they had no records of receiving:

* $20,000 for Chabad Lubavitch, a Jewish center in Potomac, Md.

* $6,000 for the Waldorf School, a private school with fewer than 200 students in Atlanta

* $5,452 for Taylor University, an evangelical Christian college in Fort Wayne, Ind.

A $6,000 donation would have been big news at the Waldorf School, business manager Debra Kahn said.

"That's so weird. Why would (Abramoff) even know us?" Kahn said. "The interesting thing about it is if we had a grant it would have been an unsolicited one because we weren't writing grant proposals back then. We're in the process of getting accredited, so we really can't qualify for a lot of foundation grants anyway."

According to an archived version of Capital Athletic's Web site, it did not accept unsolicited grant proposals. Abramoff and his wife, Pamela, are the sole managing members of the charity, according to tax records.

For Craig Holman, campaign finance lobbyist with Public Citizen in Washington who also monitors nonprofits, the discrepancies raise troubling questions.

"Those charitable contributions have to show up (accurately) in IRS records. If they don't show up there, something terribly wrong has happened," he said.

IRS spokesman Phil Beasley in Dallas, while prohibited from discussing specific cases, said charities that misrepresent tax return information risk losing their nonprofit status.

"Depending on the intent and severity, an organization or individual could find themselves under criminal investigation by the IRS," Beasley said.

Other charities did receive the listed grants, including $14,500 for the Harry and Jeanette Weinberg Academy in Maryland, and $2,500 for a Washington film festival by the Voice Beyond, a faith-based media concern.

Capital Athletic reported making $2.3 million in charitable grants in 2002, including almost $1.9 million for Eshkol Academy, Abramoff's Jewish school for boys, and $97,000 for Kollel Ohel Tiferet in Israel to purchase military gear for an Orthodox Jewish settlement in the West Bank. There is no public listing for the Kollel group, and the town's mayor said he did not know of the organization, according to Newsweek magazine.

For 2002, Capital Athletic reported almost $2.6 million in revenue.

Jack Abramoff, under investigation by federal agencies and the Senate for his lobbying activities, created the nonprofit Capital Athletic Foundation in 1999 to promote "the ideals of sportsmanship." Most of the organization's money, however, has gone to an Abramoff-created Jewish school in Maryland. Capital Athletic also sponsored a Scotland golf outing for U.S. Rep. WASHINGTON -- Don Shein disagrees with President Bush on the environment. He disagrees with Bush on stem-cell research. And he disagrees with Bush on abortion.

But he's voting for Bush.

For Shein, a financial adviser from Baltimore, the 2004 presidential election is about only one thing: Israel. The loyal Democrat said he has been impressed by Bush's support for the Jewish state and even donated $500 to Bush's re-election campaign, despite his opposition to the president on many domestic issues.

"My sense is that Bush would stand up for Israel when no Democrat would," Shein said Sunday at the American Israel Public Affairs Committee annual policy conference.

Bush is something of a messiah to those attending the conference in Washington, many of whom traditionally vote Democratic. They are willing to overlook what they don't like about the president because of what they do like.

His address to the conference on Tuesday turned into a Bush rally.

Outgoing AIPAC President Amy Friedkin likened the president to Ruth, the non-Jewish biblical figure who told Naomi, "Your people is my people."

She commended Bush for his "moral authority" in isolating Palestinian Authority President Yasir Arafat. "You have walked the walk with our friend and ally Israel," Friedkin said. "Thank you Mr. President."

The crowd of about 5,000 crowding the cavernous Washington Convention Center launched into the first of what would be 23 standing ovations. A smattering of conference-goers shouted "Four more years!" and raised four fingers in the air.

Bush clearly understood the relationship between his support for Israel and the adulation he was earning in a week that his approval ratings were dipping dangerously.

"It's good to be with so many friends -- friends of mine and friends of Israel," he said. Even before Bush's appearance, the very mention of his name or the sight of his image on video screens prompted thunderous applause and standing ovations.

Bush's unprecedented support for Israeli claims in the West Bank and his rejection of any "right of return" to Israel for Palestinian refugees has made him a darling of many AIPAC members.

When Rep. Tom DeLay (R-Texas), the Republican leader in the US House of Representatives, called Bush "the greatest friend of Israel the world has ever had," he got a standing ovation.

Because of the threat Saddam Hussein's regime posed to Israel, many here also supported the administration's invasion of Iraq.

But the AIPAC crowd isn't necessarily representative of the American Jewish community at large. Many here consider themselves single-issue voters -- choosing a chief executive solely on the basis of support for Israel -- while many Jews consider a wider range of issues.

And loud applause for a pro-Israel president at a pro-Israel conference is no guarantee of a vote on Nov. 2. Among those standing up for ovations were top Democratic donors and organizers; one enthusiastic applauder for Bush even sported a "Throw Bush out of the White House" button.

Alex Freedman, a senior at Washington University in St. Louis, was buoyed by the enthusiasm for Bush.

"This is the first time I'm going to hear a president speak," he said.

But that didn't mean the president had his vote.

"I have yet to decide," Freedman said.

Freedman's dilemma was reflective of the larger debate facing many American Jewish voters: how to balance Bush's support for Israel with his domestic record, which they view as troubling.

Some said they would vote for Bush despite strong opposition to his positions on the economy, abortion and other domestic policy issues, because international policy was their main concern.

"I think international stuff is more prominent right now," said Yifat Hassiel, a lawyer from Los Angeles. "The domestic stuff can be changed with the local leadership."

Lana Krebs, a computer technical support project manager from Atlanta, said the economy is important to her, but Israel issues have to be her No. 1 priority. She said she feels almost guilty backing a politician who opposes abortion and stricter gun controls.

"It does bother me, but I don't see a better option," she said.

Those who are voting for Sen. John Kerry (D-Mass.), the presumptive Democratic nominee, hastened to add reasons for their support.

"Kerry's record is still really pro-Israel, and I consider other issues," said Stephanie Bloom, a pediatrician from Boston. "The Jewish community has influence over whoever is in office, and we would do fine with Kerry."

Many people say they have not heard enough from Kerry about Israel and international terrorism, or don't trust what he has said.

"What he says doesn't seem to change what I feel his position would be," Krebs said. "I don't think he would be tough enough."

Some have suggested that Kerry did not properly enunciate his pro-Israel credentials in his recent speech to the Anti-Defamation League and needs to do more to show that a Kerry administration would back Israel to the same extent that Bush's has.

AIPAC has touted this election as a "win-win" proposition, noting Bush's strong support for Israel and Kerry's 100% pro-Israel voting record in the Senate.

AIPAC officials also recently met with the Democratic candidate. Democratic surrogates with strong pro-Israel credentials made the case for Kerry at the conference.

"Whatever the outcome of the elections in November, on January 20 of next year Israel will have a friend in the Oval Office of the White House," Sen. Joseph Lieberman (D-Conn.) told the AIPAC conference Sunday.

Republicans, targeting Jewish votes and money in battleground states, want to add nuance to that perception: Kerry may be a friend, the Republican subtext suggests, but Bush is the better friend.

Vice President Dick Cheney appealed directly to Jewish voters last Friday, speaking to the Jewish Federation of South Palm Beach, Fla. In addition to the regular pro-Israel sentiments, Cheney tried to connect support for Israel and the Iraq war.

"We believe that the removal of Saddam Hussein and the rise of a free Iraq will, in time, help create the conditions in which a lasting peace between Israelis and their Palestinian neighbors is more likely," he said.

Bush's speech to AIPAC was only his second to a Jewish organization since he became president. Kerry was not invited to address the conference because of a tradition that limits invitations to incumbent candidates.

Democrats -- like Lieberman and Rep. Steny Hoyer (D-Md.) -- received warm welcomes. AIPAC prides itself on good relations with both parties in Congress, and the Democrats have no intention of ceding the pro-Israel vote to Bush, especially in critical states like Florida.

"There will be a concerted effort to make sure Jewish voters know the real record of the Bush administration on Israeli security matters," Rep. Peter Deutsch (D-Fla.) told JTA. "Democrats will match the Bush administration's campaign rhetoric with the hard facts."

But some attendees say there's almost nothing Kerry could say that would outweigh Bush's actions over the past three years. Danny Kohn, a Chicago native who also is a senior at Washington University in St. Louis, says it has been hard for him to convince other AIPAC students to support Kerry.

"Everybody's made up their minds that Bush is pro-Israel, and even if John Kerry is pro-Israel, it's not good enough,'' Kohn said.

With John Roberts seemingly a shoo-in for the Supreme Court, Republicans can hardly be blamed for their excitement on the legal front, which was fervently—and sometimes angrily—demonstrated at the August 14 Justice Sunday II extravaganza, the second installment of a religious-right rally aimed at attacking—in James Dobson’s words—an “unelected, unaccountable, and arrogant” judiciary and championing conservative social causes. Taking center stage at the event, Rep. Tom Delay lambasted “activist courts” for imposing “state-sanctioned same-sex marriage” and “ridding the public square of any mention of our nation’s religious heritage.” The event also served as a rally in support of Roberts, who conservatives hope will help put the court in the hands of the “moral majority.”

Despite the White House’s continued stonewalling over the release of documents detailing some of Roberts’ past work, it is clear what his ideological leanings are and the potential impact they will have on court rulings. Although he is perhaps “no crazed ideologue intent on overturning precedents willy-nilly,” as the Los Angeles Times opined in a recent editorial, Roberts will tilt the bench definitively in a conservative direction on social issues, including abortion. Also, according to observers quoted in a Los Angeles Times report (August 14, 2005), Roberts has a track record of supporting broad executive powers, which could potentially impact everything from the treatment of “enemy combatants” to the president’s authority to use military force without congressional authorization. With the nation confronting a seemingly endless war on terror, the issue of executive powers could turn out to be the most “important issue on the court’s docket over the next few years,” as Neil Kinkopf, a law professor at Georgia State University, told the Times.

But a successful Roberts’ nomination won’t stem the tide of legal woes afflicting a passel of high-profile conservatives and hard-liners with close ties to the Bush administration and powerful Republicans in Congress. Together with the potentially ground-shaking fallout from the ongoing PlameGate saga, the recent indictments of Republican lobbyist Jack Abramoff and two former analysts from the American Israeli Public Affairs Committee with ties to neoconservatives in the administration have put the house that Bush built on increasingly rocky terrain.
Abramoff and Friends

Abramoff and business partner Adam Kidan were indicted by a federal grand jury in Fort Lauderdale on August 11 on several counts of wire fraud and conspiracy related to their purchase of a Florida-based gambling boats business. Already at the center of a growing controversy over money he received while representing Indian casino interests, Abramoff’s latest legal troubles involve allegedly fraudulent wire transfers he and Kidan used to purchase the SunCruz gambling business from Florida businessman Konstantinos Boulis. Boulis, who made millions on a chain of Florida sandwich shops, was shot to death in February 2001, shortly after his relations with Kidan and Abramoff soured. According to the Washington Post (August 12, 2005), Kidan hired Anthony Moscatiello, an associate of the Gambino crime family, in late 2000, just a few months before Boulis was shot three times in the chest with hollow-point bullets.

To help seal the SunCruz deal, reports the Post, Abramoff “leveraged his connections with members of Congress,” including Rep. Tom Delay (R-Texas), who reportedly gave Boulis a flag that had once flown over the Capitol. Abramoff also took his lead financier for the deal to a Delay fundraising event, listed Rep. Dana Rohrabacher (R-CA) as a reference on his loan application, and wined and dined Delay aides on SunCruz jets and gambling boats. Also chipping in was Rep. Robert Ney who, at the urging of Abramoff associate Michael Scanlon, criticized Boulis and praised Kidan in the Congressional Record.

Both Ney and Delay—as well Senators David Vitters and Conrad Burns—have been mentioned in connection with the Abramoff-Indian casinos scandal, which is the focus of congressional and federal investigations. Abramoff (along with erstwhile partner Scanlon, a former Delay aide) is accused of misusing tens of millions of dollars in lobbying fees from Indian clients, who Abramoff once described as “morons” and “monkeys.”

Although the Abramoff scandals don’t appear to touch administration insiders, his shady dealings have brought unwanted attention to a number of influential Bush supporters and Christian conservatives. Reported the Boston Globe in early June: “Among the prominent figures who have come under the scrutiny of Senate and federal investigators are [Grover] Norquist, whose organization received $1.5 million from tribes and fought a tax on Indian casinos [and] Ralph Reed, the former director of the Christian Coalition who allegedly used some money from Indian gaming tribes to fund his efforts to close down rival casinos and lotteries.”
L’Affaire AIPAC

On August 9, the Justice Department announced the indictment of two former AIPAC analysts, Steven Rosen and Keith Weissman, in connection with the investigation of Larry Franklin, the Pentagon official accused of disclosing classified information about U.S. forces in Iraq. According to the indictment, the two AIPAC analysts received and passed on to a foreign power (meaning Israel, though the indictment doesn’t specify) and to reporters classified “national defense information.”

At the center of the AIPAC case is the effort by Franklin, a rapidly anti-Iran Pentagon analyst, to push the United States to take a stronger stance against the Islamic Republic. To do this, Franklin passed classified information about U.S. policies and supposed threats in the region to the AIPAC experts, who in turn informed Israeli officials and a Washington Post reporter. Franklin apparently hoped that AIPAC could use its weight both in Israel and in the Beltway to get the administration to adopt a hardline.

Rosen and Weissman, according to the indictment, had been under investigation since as early as 1999 for attempting to influence U.S. government officials and use their contacts to acquire sensitive information. The indictment mentions a second U.S. government official, referred to as “USGO-2,” who is alleged to have given classified information to Rosen in 2002. According to the Washington Post (August 18, 2005), people familiar with the investigation have identified this official as David Satterfield, currently the second-highest ranking diplomat at the U.S. Embassy in Baghdad. The indictment does not say whether charges are to be brought against Satterfield. Two other U.S. officials, “USGO-1” and “DOD-B,” are alleged in the indictment to have given information to the AIPAC analysts, though their identities remain unknown as of this writing.

Franklin, who worked under former Under Secretary of Defense for Policy Douglas Feith, was close to a number of influential neoconservatives in and outside the administration, including Richard Rhodes, head of the Pentagon’s Office of Net Assessment, and Michael Ledeen, an American Enterprise Institute scholar who arranged a meeting between Franklin, several Iranian dissidents, and the Iranian arms merchant Manucher Ghorbanifar. During the meeting, which took place in Rome in 2001 and included both Rhodes and Ledeen, the dissidents apparently gave information to Franklin about Iranian threats to U.S. troops.

Although Franklin’s neoconservative associates are apparently not under investigation, the indictment seems to leave open the possibility that more charges will be brought in the future. Some leftist pundits, like Robert Dreyfuss, who has closely followed the neoconservatives, think that the FBI could eventually broaden the scope of its investigation to include several others members of Franklin’s “network.” Wrote Dreyfuss in his Tompaine.com blog: “It is clear that by probing the details of the case, the FBI has got hold of a dangerous loose end of a much larger story. By pulling on that string hard enough, the FBI and the Justice Department might just unravel that larger story, which is beginning to look more and more like it involves the same nexus of Pentagon civilians, White House functionaries, and American Enterprise Institute officials who thumped the drums of war in Iraq in 2001-2003 and who are now trying to whip up an anti-Iranian frenzy.”
PlameGate redux

Listening to the TV pundits, one would think that the alleged effort by administration figures, in particular Karl Rove and I. Lewis Libby, to disclose the identity of Valerie Plame—the CIA agent whose husband, Joseph Wilson, refuted Bush administration claims that Iraq tried to buy uranium from Niger—did not reach the level of criminal offense. But according to a widely circulated analysis published last week on the TomDispatch blog, a careful review of the 1982 Intelligence Identities Protections Act shows how practicable it would be to bring up charges against Rove. The author of the analysis, Elizabeth de la Vega, a retired federal prosecutor, highlights Rove’s now infamous July 2003 conversation with reporter Matt Cooper, during which Rove is alleged to have identified Plame.

Contrary to widespread belief, writes de la Vega, prosecutions under this law are not “nearly impossible.” More importantly, she says, based on the little evidence publicly known about the case, Rove’s actions arguably satisfy all of the elements set forth in the law, including that he had authorized access to classified information identifying a covert agent, he “intentionally disclosed” this information to someone not authorized to receive it, he knew that the information he was disclosing was sufficient to identify the agent, and he was aware that the government was taking action to conceal the agent’s intelligence position.

She concludes: “ Whether charges will be brought under the Intelligence Identities Protection Act or, if they were, what a jury would decide, we cannot possibly know. But we do know that it is not a law under which guilt is nearly impossible to prove—as the pundits, citing each other, have led us to believe. It also bears mentioning that experienced prosecutors never underestimate juries. Most juries are like the special grand jury described by Matt Cooper: thorough, highly-engaged people who are absolutely committed to applying the law only to the evidence they have heard in court as they are instructed to do. They are not easily fooled. They have common sense. And they are firmly rooted in the reality-based community.”

As with the AIPAC case, some commentators speculate that the Plame affair could turn into a much more widespread scandal, one that could at the very least reveal the extent to which administration figures were willing to go to mislead the public in their drive toward war. As commentator Jim Lobe wrote in a mid-July editorial: “The case may … prove to be one more string—albeit a very central one—that, if pulled with sufficient determination, could well unravel a very tangled ball of yarn, and one that would confirm recent revelations in the British press—the so-called Downing Street memo—that the Bush administration was ‘fixing the facts’ about the alleged threat posed by Iraqi President Saddam Hussein in order to grease the rails to war.”

Of all the pending controversies in Washington, few may be as perilous for the Republican majority as the one swirling around former powerhouse lobbyist Jack Abramoff.

At issue: Did he bilk, with partner Michael Scanlon, six Indian tribes of at least $80 million, evade taxes, and violate lobbyist disclosure rules? Mr. Abramoff has been indicted on fraud charges in Florida in a case related to his $147.5 million purchase of a gambling casino. He also faces probes by two Senate panels and a federal grand jury, which may yield criminal charges.
 

But what gives this scandal so much scope is the number of members of Congress, federal officials, and top conservative activists it potentially involves. More than just the saga of a rogue lobbyist, it opens a window on a high-stakes, high-fee lobbyist culture that is transforming Beltway business.

"We don't know yet how big a genuine scandal it may be. But with more indictments [expected] in six to eight months, it creates a perfect storm for the Bush administration. Endemic corruption plus public unhappiness over other policies: It's a very combustible combination," says Norman Ornstein, senior fellow at the American Enterprise Institute, a generally conservative think tank in Washington.

According to e-mails and congressional testimony, Mr. Abramoff used his contacts with top Republicans like former House majority leader Tom DeLay to extract huge fees from clients, especially Indian tribes involved with casino gambling. He contributed vast sums to friends in politics and charities, and served as a conduit for money to GOP candidates.

But until recent investigations, first launched by the Senate Indian Affairs Committee, few knew the scale of the Abramoff operation, which could draw members of Congress and former Bush administration officials into criminal probes related to dealings with Abramoff.

"The story is alarming in its depth and breadth of potential wrongdoing," said Sen. John McCain (R) of Ariz., who chairs the Indian Affairs panel.

On Thursday, the committee will question Italia Federici, a former aide to Interior Secretary Gale Norton, on her ties to Abramoff. According to testimony and e-mails, Ms. Federici, the president of the Council of Republicans for Environmental Advocacy (CREA), helped Abramoff make contacts within the Interior Department on behalf of tribal clients, who later donated some $250,000 to CREA.

"There has been no evidence to suggest that Secretary Norton knew of, much less sanctioned, Mr. Abramoff or anyone else using her name in seeking fees and donations from native Americans," said Senator McCain at the Nov. 2 hearing.

Still, even the hint of an Abramoff connection is creating problems for members of Congress. Earlier this month, the Justice Department subpoenaed documents from GOP Rep. Bob Ney, whom Abramoff tapped to help an Indian tribe open a gambling casino. Mr. Ney's spokesman says that the Ohio lawmaker has not been told that he is a target of the investigation.

Earlier this year, David Safavian, former chief of staff of the General Services Administration, was charged with making false statements and obstructing justice in connection with a golf trip that Abramoff organized for lawmakers, including Representatives DeLay and Ney, in 2002. Mr. Safavian has pleaded not guilty.

In response, GOP lawmakers say Abramoff overstated his clout with them in a bid to win big fees. "Abramoff is taking credit for things he did not accomplish, and suddenly everyone is taking what he has written in e-mail as gospel," says Don Stewart, a spokesman for Sen. John Cornyn (R) of Texas.

On Saturday, the Dallas Morning News published e-mails between Abramoff and former Christian Coalition leader Ralph Reed, who reportedly was paid at least $4 million to block casino proposals that would have competed with casinos owned by Abramoff's tribal clients.

The e-mails, dating from 2001, discuss getting Mr. Cornyn, then Texas attorney general, to block a competing casino. But by then, Senator Cornyn had already filed a lawsuit to block the casino and "didn't need any help" from Abramoff and Reed," says Mr. Stewart.

The appearance of ties to Abramoff is derailing careers. Timothy Flanigan, a senior lawyer at Tyco International, a former lobbying client of Abramoff, withdrew his nomination as deputy attorney general last month.

Newly-disclosed e-mails from the Minority Chair of the House Government Reform Committee Henry Waxman http://www.democrats.reform.house.gov/abramoff/index.as... provide new areas of insight into Jack Abramoff's closeness to the Bush administration. Most shocking of all (at least of those I've been able to read so far) is that Abramoff off-handedly mentions "the upcoming war in Iraq." The date--March, 2002.

Conclusion--this is yet another piece of evidence that the invasion of Iraq was long-before conceived as absolutely inevitable and necessary by the Bush administration.

Did you know that Jack Abramoff and Karl Rove shared an executive assistant?

In 2001, Karl Rove needed a Gal Friday, someone to help oversee the "strategic planning, political affairs, public liaison, and intergovernmental affairs efforts of the White House."

He chose Susan Ralston, who came highly recommended from a friend: Jack Abramoff. Ralston performed similar duties for the Don of K Street -- that is until Abramoff realized she'd be far more useful embedded in the West Wing. (Ralston had also previous worked for Abramoff and Rove's fellow College Republican crony Ralph Reed.)

Installing his top assistant as Rove's gatekeeper appeared to pay dividends. In 2003, Abramoff was hired by scandal-ridden Tyco to help the corporation secure lucrative federal contracts despite its being incorporated -- for tax-evasion purposes -- in Bermuda. According to the Washington Post, Abramoff later bragged that he'd been able to lobby Rove directly on the issue. The article targets Ralston as the only likely conduit.

Of course, such Abramoffian entanglements are now radioactive. According to Time, Bush has ordered his aides to round up all pictures of him and Abramoff to head off any bad press. Perhaps Bush should instruct them to widen the search to include photos like this buddy-buddy pic of him with Ralston.

Republican lobbyist Jack Abramoff bragged two years ago that he was in contact with White House political aide Karl Rove on behalf of a large, Bermuda-based corporation that wanted to avoid incurring some taxes and continue receiving federal contracts, according to a written statement by President Bush's nominee to be deputy attorney general.

Timothy E. Flanigan, general counsel for conglomerate Tyco International Ltd., said in a statement to the Senate Judiciary Committee last week that Abramoff's lobbying firm initially boasted that Abramoff could help Tyco fend off a special liability tax because he "had good relationships with members of Congress," including House Majority Leader Tom DeLay (R-Tex.).   

Abramoff later said "he had contact with Mr. Karl Rove" about the issue, according to the statement by Flanigan, who oversaw Tyco's dealings with Abramoff and his firm and received reports from Abramoff about progress in the lobbying campaign. Flanigan's statement is the latest indication that Abramoff promoted himself as having ready access to senior officials in the Bush administration.

A White House spokeswoman, Erin Healy, said Rove "has no recollection" of being contacted by Abramoff about Tyco's concerns.

Abramoff was indicted last month on unrelated wire fraud and conspiracy charges and has lost his high-stakes lobbying clients. He was hired in 2003 by Tyco when the company was in turmoil. Abramoff's firm, Greenberg Traurig, promoted him as Tyco's savior on the tax issue, according to Flanigan's statement and others familiar with the process.

Tyco -- whose executive L. Dennis Kozlowski had just departed under an ethics cloud -- was worried that the Bush administration might embrace legislation promoted by Democrats that would impose higher taxes on domestic-centered companies that had moved offshore to cut their tax bills. The legislation was motivated by popular anger over such offshore moves, and carried the additional penalty of barring such firms from receiving federal contracts.

Lobbying disclosure statements filed by Abramoff listing his work for Tyco cite the "Executive Office of the President" as one of his lobbying targets on the tax and contracts issues. Others were the Department of Commerce, the General Services Administration and Congress. Greenberg Traurig records submitted to Tyco describe specific contacts with the White House legislative office, a source familiar with the matter said yesterday.

Rove's personal assistant at the time, Susan Ralston, formerly worked as Abramoff's secretary. It could not be learned yesterday whether she was among those contacted by any of the 14-person Greenberg team recorded as working on the Tyco account.

The Bush administration was never enthusiastic about the tax penalty, but both the House and Senate approved language in 2002 denying federal contracts to companies largely based in the United States but incorporated in tax havens.

Tyco was among a raft of companies, including Ingersoll-Rand and Noble Corp., that hired an army of lobbyists to stall the legislation and ultimately kill most of it. House Republican leaders argued that corporate flight was merely a symptom of a much broader problem with the U.S. tax code that should be treated in a larger tax reform package.

Abramoff remains the focus of a lengthy investigation by a task force led by prosecutors at the Justice Department and including investigators at the Internal Revenue Service, the Interior Department and General Services Administration. The probe was initially focused on whether he bilked Native American tribes that paid him tens of millions of dollars in lobbying and other fees, but has since widened to include other matters.

Flanigan, who is still at Tyco while awaiting a committee vote on his nomination, said in his Sept. 15 written statement that he would "consult with DOJ ethics officials . . . and apply normal recusal standards" about the Justice Department's investigation of Abramoff.

Flanigan said he would recuse himself from any Abramoff investigation involving Tyco. Portions of his statement were first reported in the Los Angeles Times.

The ties between Tyco and Greenberg Traurig have already been investigated by a special counsel appointed by Greenberg to examine Abramoff's activities at the firm. According to knowledgeable sources and Flanigan's written statement, Greenberg has promised to repay three-quarters of a $2 million fee that Tyco paid, at Abramoff's direction, to a firm called Grassroots Interactive.

The fee was supposed to finance a letter-writing campaign by Tyco suppliers against the offshore tax bill, but Greenberg concluded that $1.5 million of it was "diverted to entities controlled by Mr. Abramoff" and misspent, according to Flanigan's statement.

Andrew Blum, a spokesman for Abramoff's law firm, declined to comment, as did Jill Perry, a spokeswoman for Greenberg Traurig.

Giuliani No Lobbyist? Depends on What You Mean by "Lobbying"

Rudy Giuliani and his cohorts at Giuliani Partners have insisted he's no lobbyist. But there's mounting evidence to the contrary. Maybe he's so averse to the term because his firm lobbied illegally.

Exhibit A is today's Time story, which for the first time reveals details about just what Hank Asher, Giuliani's troubled buddy, paid him so much money to do.

As we laid out in a series of posts last week, Giuliani struck a pretty sweet deal with Asher during his first year of business. Asher's Seisint was hocking its data-mining software, code-named MATRIX, to the government. Rudy's job was to serve as a kind of front man for the company, in part so that Asher's drug-running past wouldn't be an issue. The contract, for a previously untold amount of money, was based on a $2 million yearly fee, commissions, and stock options. A stock holder in the company was so alarmed by the giveaway that he sued Seisint; the case was settled.


Today, Time puts a price tag on all that: $30 million, $24 million of that from stock options. And what did Rudy do for the money? It turns out, plenty.

Well, first and foremost, he lobbied. A shareholder in Seisint tells Time that "nobody knew us; everybody knew him," and that with Giuliani, "the doors were wide open. It was almost a flood of business opportunities." The company's in-house lobbyist says that Giuliani set up a meeting at the Department of Homeland Security.

The White House looks like another one of those doors that Giuliani opened. In January of 2003, just a month after Seisint hired Giuliani, Asher gave a presentation to Vice President Dick Cheney, FBI director Robert Mueller, Homeland Security director Tom Ridge, and Gov. Jeb Bush (R-FL) in the Roosevelt Room at the White House on MATRIX, according to documents obtained by the ACLU back in 2004. (The ACLU doggedly opposed MATRIX; Asher responded by once joking that the ACLU "is probably funded" by Al Qaeda. I'm sure he and Cheney got along fine.)

Yesterday we told you about Rudy Giuliani's business partner Hank Asher's well-timed gift to the wife of indicted Orange County Sheriff Mike Carona. One of the remarkable things about the story is how thoroughly it hits the high points of what we've come to expect from Giuliani muck.

Sure, it's got bribery allegations, as with Giuliani's chum Bernie Kerik. But it's also got the flagrant misuse of taxpayer money on "security" matters that we've come to expect from the Giuliani brand.

Setting aside the hundreds of thousands in gifts and bribes outlined in the indictment, Carona was notorious in California for traveling with "a team of detectives as bodyguards." When The Los Angeles Times asked him about "the extravagance" in 2004, sheriff officials replied, "without offering specifics," that "Carona has received death threats and is a potential target because he serves on a federal homeland security committee and has become a recognizable figure with appearances on national TV news programs." The Times noted that other California sheriffs didn't seem to need the same amount of attention.

An Orange County Register piece from earlier this year suggests that at least part of the inspiration for rolling with such a posse came from Giuliani himself:
According to grand jury testimony, [Carona's deputy sheriff George] Jaramillo ordered underlings to run his personal errands, had secretaries juggle calls from his wife and girlfriends, and said he needed an entourage because he was tired of being treated like "the gardener."

Carona got the same star treatment, using bodyguards and being chauffeured by deputies to events. After a visit to New York and a meeting with then-Mayor Rudy Giuliani, Jaramillo and Carona decided they wanted the same kind of deputy detail and ordered it done.

Carona, of course, has endorsed Giuliani. It's unclear whether the security detail was also dispatched to secure his longtime mistress.

Were $15K Watches Part of Rudy Buddy's Lobbying Effort?

Rudy Giuliani has argued that his buddy Hank Asher put his lawbreaking past behind him. But it looks like he may have fallen off the wagon.

We noted earlier today that Asher pops up in the indictment of Orange County Sheriff Mike Carona. And although Asher is not accused of a crime, the facts do not look good: Less than three weeks after Carona was selected to advise the President's Homeland Security task force, Asher gave Carona's wife a $15,000 watch. Asher was lobbying for the federal government to buy his data mining software at the time. That same month, he hired Giuliani under a contract worth more than $4 million to head that effort.

Carona was one of 14 officials named as advisors to the task force in December of 2002, the month before the newly formed DHS officially began operations. The panel was guiding development of the Department at the time. Carona remained as an advisor until he was forced to resign last month due to his indictment on corruption charges.

According to the indictment, Asher gave "yellow gold and diamond" Cartier watches to both Carona's wife and the wife of his deputy when they visited New York in December 2002. ABC reported that Asher was bombastic during the meeting at the restaurant, handing out $100 bills and comping other diners' meals and drinks to "pay for any inconvenience his boisterous party caused the other guests."

Carona was certainly aware of Asher's product, code-named MATRIX. A 2004 City Journal piece reported that Carona said that if he'd had MATRIX in 2002, "he could have prevented the murder of five-year-old Samantha Runnion, abducted from outside her home in July 2002, and found, raped, along a mountain road the next day." In 2002, when he was nominated to the DHS advisory spot, he told The Los Angeles Times that he intended to push for "strong coordination between the federal and local fight against terrorism," precisely the strength of MATRIX, which compiles law enforcement databases and public records.

Asher's support of Carona continued in 2006, when he and his family and associates made $6,000 in contributions to Carona's reelection campaign, according to county records.

Asher could not be reached for comment, and an assistant at his company Jari Research said that it was unlikely he'd respond, since this was a "hard time" for him. Asher's sister died last month of cancer.

As for Giuliani's camp, they responded to ABC's story yesterday about Asher's appearance in Carona's indictment with something of a non-answer:
"This would seem to be another case of trying to find a story where there isn't one. Over the course of his career, Mayor Giuliani has worked with numerous well-respected and highly regarded individuals as a member of the Reagan Department of Justice, US Attorney, Mayor of New York and private practice," said Maria Comella, a spokesperson for Giuliani.

Money for Nothing?

What if I told you that you could make millions of dollars doing it's-not-clear-what? Well, Rudy Giuliani has lived the dream.

We introduced you earlier to Hank Asher, Giuliani's friend and two-time business associate, who's recently cropped up in a public corruption indictment. The Giuliani-Asher relationship is a tale to tell on its own, though.

The two met when Asher demonstrated his Matrix database software for Giuliani in 2002. The ex-mayor has said that he immediately became an enthusiast: "this was a technology that would have been very helpful to us even when I was the mayor and putting together programs for reducing crime to help us find serial killers, abductors of children, and of course terrorists." Something else might have explained his enthusiasm: Asher and Giuliani inked a deal in December 2002 for Giuliani Partners to represent Asher's company, Seisint.

The deal, first reported by The Washington Post this spring, was remarkably sweet: $2 million per year, a commission on sales of Seisint products, and 800,000 warrants to buy company stock. How much that added up to is unclear. The Post reported that Giuliani Partners got "most" of the promised compensation and that the stock warrants proved most valuable, since Seisint was sold to LexisNexis in 2004 for $775 million.

In return for all that, Asher got . . . well, it's not clear. In fact, the Post reported, a Seisint shareholder sued the company in 2004 over the contract, arguing that it was a "waste of corporation assets" to enter into a contract for which the company received "no benefit." The lawsuit was later settled.

There was at least a rationale for the deal.

They're hard to keep straight, the various and sundry friends and business associates of Rudy Giuliani with legal problems. But here's one worth keeping an eye on: Hank Asher. ABC reports that Asher, a former drug-runner, as well as a business partner and "close friend" of Giuliani's, makes an appearance in the recent indictment of Orange County Sheriff Michael Carona on bribery charges.

Carona himself was once a rising star in the GOP, often mentioned as a potential candidate for lieutenant governor of California. Dubbed "America's Sheriff" by Larry King for how he handled the 2002 hunt for 5-year-old Samantha Runnion's kidnapper, he naturally endorsed America's Mayor Rudy Giuliani for president. According to news accounts, he's met Giuliani at least twice. He's also chums with Bernie Kerik.

The indictment alleges that Carona and five associates, including his wife (Deborah) and mistress (named Debra), accepted bribes and generally did what they could to get rich off Carona's position ($700,000 in bribes and kickbacks). Among the dozens of illicit gifts enumerated in the indictment is this one:
On or about December 19, 2002, defendant Deborah Carona and co-conspirator Jaramillo's wife [that's Carona's assistant Sheriff George Jaramillo] accepted as gifts from H.A., a businessman who owned a data mining software company, yellow gold and diamond Ladies Cartier Watches worth approximately $15,000 each.

"H.A.", according to ABC, is Hank Asher, who did indeed own a data mining software company called Seisint at the time (more about that later). Asher himself is worth "north of $700 million," based mostly on his success selling his data mining product, which is called Matrix (he's since sold it to LexisNexis). And yes, he did smuggle cocaine from Colombia to Florida aboard his private jet for eight months in 1980 and 1981. But he says he paid his dues by cooperating with federal agents to stop other runners.

But it sounds like Asher still likes to live large. During that same dinner meeting with the two wives at Carmine's here in New York, he apparently got a bit rambunctious:
When Hank Asher reached into the bag and pulled out the two $15,000 gold Cartier watches, the holiday crowd at Carmine's restaurant on 44th Street in Manhattan noticed, patrons recalled....

During the Carmine's dinner, when Asher's voice began to boom across the room, patrons recall him handing his black American Express card to the restaurant to pay for any inconvenience his boisterous party caused the other guests. He told the staff to buy everyone's dinners and drinks and then peeled off a few $100 bills to tip strolling carolers in the restaurant.

As ABC notes, Asher isn't named as a co-conspirator in the case, and "there is no allegation in the document that he attempted to influence any purchases or other decisions by the county." Maybe it was just a nice Christmas gift. But the timing is enough to raise eyebrows. Because that's when Asher was making a big push for law enforcement agencies to buy his product. Carona, famous as he was for tracking down child predators, would have been an asset to Asher, who was hawking a product designed to help authorities identify suspects by searching billions of public records. Carona and Asher would later serve together on the Board of Directors for the National Center for Missing & Exploited Children.

Certainly Asher had a broad strategy for selling his system. To help him sell to the federal government, his secret weapon was Rudy Giuliani, whom he'd hired for a staggering sum of money -- under a contract that the two of them kept secret for years. More about that in a bit.

Blog: Doolittle Won't Seek Reelection

Say it ain't so, John!

The California Majority Report reports that Rep. John Doolittle (R-CA), one of the long-time subjects of the Jack Abramoff investigation, "will announce that he will not seek re-election." That could come as soon as this week, reports John Bresnahan of The Politico. Back in September, Doolittle proclaimed "I am running again. Period."

Ever since Doolittle refused to plead guilty, the Justice Department has evidently been building a bribery case against him. Doolittle, meanwhile, has made quite a pastime of demanding that the DoJ fish or cut bait. All that tough talk hasn't helped his fundraising, and his campaign has increasingly been drained by payments to his wife for her purported fundraising work. Things just aren't like they used to be during the glory days before Abramoff's downfall.

Justice Dept. Says Ex-Sen Burns is Off The Hook

It came about a year too late to do him any good, but the Justice Department has notified ex-Sen. Conrad Burns (R-MT) that he's no longer under investigation for his ties to Jack Abramoff. Burns, you may remember, lost very narrowly to Jon Tester (D) last November, with Burns' Abramoff problem a huge issue in the election.

The feds had been investigating whether Burns helped Abramoff's tribal clients in exchange for tens of thousands in campaign contributions and other goodies. Abramoff himself said that he got whatever he wanted from Burns and that his staffers "pratically" used Abramoff's D.C. restaurant Signatures "as their cafeteria."

Abramoff continues to busily cooperate with investigators from prison. But whatever prosecutors came up with on Burns, they apparently didn't think it would stick in court -- bribery cases, of course, are notoriously hard to make.

Burns, who spent around $300,000 in campaign contributions on defense lawyers, fittingly got a lobbying gig after his forced retirement. And how does he feel about not being under investigation for the first time in more than two years? He says that he feels "so great that it's unbelievable." I'll bet he's "ready to go get knee-walking drunk."

Update: Don't forget that Rep. John Doolittle (R-CA) and ex-Rep. Tom DeLay (R-TX) are still very much on the hook.

TPM´s Great List of Scandalized Administration Officials

Boy, was it time for an update.

Late last year we decided to take stock of all the Bush Administration officials who'd been accused of corruption and/or resigned in the face of scandal. Although we had fun doing it, we altruistically started the project in order to help our friends at Powerline, who professed an inability to think of any Bush officials beset by scandal.

This year´s result, which built on Justin Rood´s original gem, is, like our catalog of the administration´s efforts to disappear information, a staggering monument to the Bush Administration. And it wouldn't have been possible without TPM's research hounds, Adrianne Jeffries, Andrew Berger, and Peter Sheehy.

A quick note on methodology. Since a complete catalog of administration officials who've been accused of some form of corruption or abuse of power would be endless, we tried to maintain a high standard for inclusion. Most of those below were the subjects of criminal probes, but we also included officials who were credibly accused of acts that, if not criminal, were a corruption of office (like the U.S. attorney scandal). And even then, such officials were only included if their accusers had them dead to rights (which is why Karl Rove didn't make the cut). We also limited ourselves to officials who were either political appointees or whose actions were so political that they were effectively political appointees (like John Tanner).

Doolittle: Catch Me if You Can

Take heart, California's Fourth Congressional District. Rep. John Doolittle (R-CA) may be under federal investigation for taking bribes from Jack Abramoff, but he's got due process on his side. And he says he's going to litigate his way to at least one more term:
Rep. John Doolittle disclosed Wednesday that his attorney is fighting subpoenas issued to him for office records and that he believes the investigation of him will be on hiatus for one to two years while the constitutionality of the subpoena is fought out in the courts....

In a telephone news conference Wednesday, Doolittle said the legal battle is delaying the federal investigation.

"My attorney tells me that this issue alone – the constitutional issue presented by those subpoenas, which as you know is also being litigated against the Justice Department by the U.S. House of Representatives – is going to take one to two years to resolve," Doolittle said.

He was asked: "Do you see your case stretching one to two years down the road then?"

"Since the subpoenas involve me and my office, that's what I am saying – one to two years on this issue alone," he said.

Senator and presidential contender Chris Dodd's (D-CT) threat to filibuster a bill giving immunity to telecom companies that helped the government surveil Americans prevailed Monday, as Senate Majority Leader Harry Reid decided to postpone the vote on the measure until after the winter recess. The bill would have freed telecoms like AT&T and Verizon from 40-odd lawsuits pending against them in federal court. (Washington Post)

Mike Huckabee, author of the 1988 book Kids Who Kill: Confronting Our Culture of Violence, is facing new scrutiny over allegations that one of his sons was “involved in the hanging of a stray dog at a Boy Scout camp in 1998.” At the time, many people called for an investigation of the incident but the director of Arkansas's state police told Newsweek that then Governor Huckabee's chief of staff and personal lawyer pressured him to write a letter officially denying the local prosecutor's request. During his leadership of Bain Capital, Mitt Romney helped investors utilize shell companies in two offshore tax havens to avoid paying their share of U.S. taxes. While the candidate received no personal tax benefits, his tax scheme, which included opening a company in Bermuda that had no office or staff, helped attract billions more investment dollars and increased his personal profits. Judge to White House: Nice Try

The White House may have lost a battle, but they have not lost the war.

For nearly two years, D.C. watchdogs Judicial Watch and Citizens for Ethics and Responsibility in Washington have been battling in court for Secret Service records of visits to the Bush White House and the Vice President's Office. The first request was for Jack Abramoff's visits, but they also set out to discover how often his associates and various conservative religious leaders had visited. Did they know what they were in for?

Over time, the White House has tried various legal theories to block the release. There was the imposing "mosaic theory," whereby seemingly innocuous information, such as visits to the White House, could prove a national security threat when combined with other seemingly innocuous information. And there was the Vice President's secret agreement with the Secret Service that even though the Secret Service makes and keeps the visitor records, they're not really Secret Service records (even though they'd been treated that way in the past), they're White House records, and thus not subject to FOIA. Oh, and there was the Vice President's order to destroy the records. And on and on.

Today, CREW had a good day in court, with a federal judge deciding that the secret agreement was bunk and that the Secret Service records really were public records. And there was also a partial victory. The judge denied CREW's motion to declare that the Secret Service could not destroy its White House visitor records once it had transferred copies to the White House; but because the judge said the records are public records, the White House now cannot destroy them without the say-so of the National Archives and Records Administration. And when you want to destroy documents, you really don't want any red tape, do you?

Griles' Ex-Gal Pal Gets No Jail Time

If there's one thing that the Abramoff scandal has taught us, it's that it pays to snitch.

From the AP:
An environmental advocate who provided Jack Abramoff's entree into the Interior Department was sentenced Friday to two months in a halfway house and four years probation.

Italia Federici, who pleaded guilty in June to tax evasion and obstructing a Senate investigation, was spared prison only because she has become a key witness in the Justice Department's ongoing corruption investigation.

(I would be remiss if I didn't amusedly note the AP's description of Federici as an "environmental advocate." She did indeed head a group called Council of Republicans for Environmental Advocacy (CREA), so the word "environmental" was in her group's title. But her advocacy was definitely against the environmental movement, not with it.)

Federici was key in helping the feds bag Steven Griles, formerly the deputy secretary of the Interior Department (and formerly her boyfriend). Griles was sentenced to 10 months in prison back in June. And for that, she's been rewarded.

The scheme went this way: Jack Abramoff's tribal clients gave CREA at least $500,000 in contributions, providing practically the entire operating budget for the group. In return, Federici used her close connections to Secretary of the Interior Gale Norton (for whom she used to work) and the #2 Steven Griles (whom she was dating) to make sure that Abramoff's concerns were addressed. Aide to Ex-Rep. Pleads Guilty to Conspiracy Charges

It's been a long time since we've had the opportunity to write about Ex-Rep. Curt Weldon (R-PA) after his ignominious defeat last November (he asked voters for "the benefit of the doubt" and they didn't give it to him). But unfortunately for Weldon, he's back in the news:
Former representative Curt Weldon's chief of staff has agreed to plead guilty to conspiracy charges for allegedly helping a consulting firm that Weldon championed obtain federal funds and for concealing money the firm paid him and his wife, according to court papers unsealed today.

According to the court document, Russell James Caso and a top official at the unnamed consulting firm met repeatedly with Weldon to seek the Pennsylvania Republican's help in obtaining federal funds for the organization's defense projects....

The court papers make no accusations against Weldon. But they say Caso "intentionally" concealed payments of $19,000 from the firm to his wife by failing to report them in congressional disclosure forms "even though he knew he was required to do so."

Although the papers make no direct charges against him, Weldon appears in the charging document as "Representative A," which is mighty bad news. It's a pattern that prosecutors have followed repeatedly in the Jack Abramoff scandal -- getting guilty pleas from former staffers and cutting cooperation deals with them in order to build cases against their former boss. Look out, Curt! It's amazing that the left-wing conspiracy to bring him down has persisted even after his forced retirement.

Television evangelist Jerry Falwell couldn't resist bragging and finally admitting the truth: he and former Israeli Prime Minister Benjamin "Bibi" Netanyahu did conspire--at a critical time--to trip up President Bill Clinton and specifically use the pressure of the Monica Lewinsky sex scandal to force Clinton to abandon pressure on Israel to withdraw from the occupied West Bank.

Falwell's confession didn't make national news--as it should have. Instead, the preacher's confession came buried in a lengthy story in the December 2005 issue of Vanity Fair. Entitled "American Rapture" the article (by Craig Unger) described the long-standing and still-flourishing love affair between American dispensationalist evangelicals such as Falwell and the hardline Jewish extremist forces in Israel then under the leadership of Binyamin "Bibi" Netanyahu.

The admission by Falwell confirms precisely what this author first revealed in a story published in The Spotlight on February 9, 1998 and later recounted in a lecture before the Arab League's official think tank, the Zayed Centre in Abu Dhabi, in March of 2003.

Although, following the lecture at the Zayed Centre, the Anti-Defamation League (ADL) of B'nai B'rith, a lobby for Israel, denounced as a "bizarre conspiracy theory" the assertion by Falwell that the public unveiling of the Lewinsky affair forced Clinton to pull back on pressuring Israel confirmed exactly what was reported in documented detail in The Spotlight in an international exclusive.

Regarding Falwell's recounting of how he worked with Netanyahu in undermining Clinton's pressure on Israel, Vanity Fair reported:

On a visit to Washington, D.C. in 1998, Netanyahu hooked up with Jerry Falwell at the Mayflower Hotel the night before [Netanyahu's] scheduled meeting with Clinton. "I put together 1,000 people or so to meet with Bibi [Netanyahu] and he spoke to us that night," recalls Falwell. "It was all planned by Netanyahu as an affront to Mr. Clinton." . . . The next day, Netanyahu met with Clinton at the White House. "Bibi told me later," Falwell recalls, "that the next morning Bill Clinton said, ‘I know where you were last night." The pressure was really on Netanyahu to give away the farm in Israel. It was during the Monica Lewinsky scandal . . . . Clinton had to save himself, so he terminated the demands [to relinquish West Bank territory] that would have been forthcoming during that meeting, and would have been very bad for Israel." What Falwell did not mention--at least as reported by Vanity Fair--is that his meeting with the Israeli leader took place on the very evening before the mass media in America broke open the Monica Lewinsky scandal with much fanfare. Nor did Falwell mention--as this author pointed out at the time-- was that one of Netanyahu's leading American media publicists, neo-conservative power broker, William Kristol, the first American media figure to publicly hint (in the days before the scandal was officially unveiled) that there were forthcoming revelations regarding a White House sex scandal that was about to be unleashed.

In addition, this author pointed out that at least six days before the first news of the Lewinsky scandal began breaking in the media at midnight on Tuesday, January 20, 1998, an advertisement appeared in the January 15 edition of the distinguished Washington Jewish Week newspaper accusing President Clinton of having "turned his back on Israel."

What made the advertisement so striking was that it used a rear view of President Clinton (first captured on video in 1996) that had never been published but which, in the wake of the Lewinsky scandal, became very familiar. It was a view of the president, his back to the camera, clearly taken from the video in which he was seen hugging the soon-to-be infamous Miss Lewinsky when she was in a receiving line at the White House some two years before. This was an image that Miss Lewinsky had bragged about among her associates prior to the time that the scandal broke. So clearly, Clinton's critics among the hard-line pro-Netanyahu forces in the United States--who sponsored the advertisement in question--were already tuned in to the fact of the Lewinsky-Clinton liaison and of the fact that it was soon to be unleashed against the president to undermine him.

This author can now reveal, for the first time, that two figures at the very highest level of the Clinton White House were personally given copies of The Spotlight's articles regarding these matters and that, at the time, they quietly acknowledged that the articles were "probably right."

The fact that Jerry Falwell's acknowledgment of how the Lewinsky affair was used as a club against Clinton--in tandem with "Bibi" Netanyahu's appearance at the White House, following the meeting with Falwell--was published in Vanity Fair is interesting in and of itself. That magazine is owned by the far-flung publishing empire of the billionaire Newhouse brothers ("Si" and Donald) whom Forbes dubbed the 25th richest family in America and who are known to be generous contributors to the Anti-Defamation League and other elements of the pro-Israel lobby.

FAA memo says Flight 11 passenger was shot who happened to be a multi-millionaire elite Israeli military commando who understands Arabic and who happened to be sitting directly in front of one of the alleged hijackers.

On the morning of 9/11, Sen. Bob Graham (D-FL) and Rep. Porter Goss (R-FL) -- the chairmen of the Senate and House Intelligence Committees -- along with Sen. A Pentagon rescuer mentions how "eerie" it was that the Pentagon's MASCAL emergency plane crash plan that he had trained twice for was "very similar to what actually happened".

Personnel from the Walter Reed Army Medical Center who helped the rescuing efforts at the Pentagon also say that it was "eerie" how an emergency situation they went through just two weeks before the attack helped prepare them for the Pentagon crash.

A group of young men were witnessed on top of a white van celebrating while they were filming themselves with the burning WTC in the background in which they were later arrested and identified as Israeli citizens -- some later found to be Israeli spies -- with one saying upon being arrested, "We are Israeli. We are not your problem. Your problems are our problems. The Palestinians are the problem." They were found with large amounts of cash, a box cutter, multiple foreign passports, maps linking them to the blasts, and a bomb-sniffing dogs reacted as if detecting explosives in their van.

Within minutes of the explosion at the Pentagon, the FBI confiscates security videos that had captured the crash from a nearby gas station and hotel.

9/11 (10:31 am) - The commander of NORAD says he didn't receive the presidential order to shoot down any of the hijacked planes until after Flight 93 crashed and the 9/11 Commission report confirms NORAD didn't get this order until 28 minutes after the crash.

Video coverage shows Palestinians rejoicing over news of the 9/11 attacks, but later the celebrations were found out to have been staged.

While social engineering can be carried out by any organization - whether large or small, public or private - the most comprehensive (and often the most effective) campaigns of social engineering are those initiated by powerful central governments.

Extremely intensive social engineering campaigns occurred in countries with authoritarian governments. In the 1920s, the revolutionary government of the Soviet Union embarked on a campaign to fundamentally alter the behavior and ideals of Soviet citizens, to replace the old social frameworks of Tsarist Russia with a new Soviet culture, to create the New Soviet man. The Soviets used newspapers, books, film, mass relocations, and even architectural design tactics to serve as "social condenser" and change personal values and private relationships. Similar examples are the Chinese "Great Leap Forward" and "Cultural Revolution" program and the Khmer Rouge's plan of deurbanization of Cambodia.

Non-authoritarian regimes tend to rely on more sustained social engineering campaigns that create more gradual, but ultimately as far-reaching, change. Examples include the "War on Drugs" in the United States, the increasing reach of intellectual property rights and copyright, and the promotion of elections as a political tool. The campaign for promoting elections, which is by far the most successful of the three examples, has been in place for over two centuries.

Social theorists of the Frankfurt School in Weimar Germany like Theodor Adorno had also observed the new phenomenon of mass culture and commented on its new manipulative power, when the rise of the Nazis drove them out of the country around 1930 (many of them became connected with the Institute for Social Research in the United States). The Nazi propaganda machine under Joseph Goebbels was a synchronized, sophisticated and effective tool for creating public opinion.

How ironic then that the persecuted have become the persecutors, using the tactics of their former oppressors to destroy those they wish to control and/or exterminate. 9/11 was their Reichstag Fire (a near-perfect False Flag Operation - but for the "Dancing Israelis"), the pretext to launch their plan – rooted in revenge and greed. We've been seeing this story repeated countless times right here in these threads.

It was likely as a direct result of those continued efforts that Keith Olbermann featured it as part of his "Worst Person In The world" segment a week ago - which has subsequently led Rove to try to knock the story down now before it gathers more steam.

The fact is that the purported Bin Laden Confession video sited in this article is itself a blatant forgery. The FBI fails to confirm its authenticity.

The Post knows this to be the case, but intentionally used false information to dissuade further investigation into the fact that BIN LADEN WAS NOT INVOLVED IN 9/11.

The Post knows that there is an actual Bin Laden statement that was issued in the aftermath of 9/11 during which Bin Laden stated emphatically that he had nothing to do with 9/11.

The most critical computer and communication networks used by the U.S. government and military are secured by encryption software written by an Israeli "code breaker" tied to an Israeli state-run scientific institution.

The National Security Agency (NSA), the U.S. intelligence agency with the mandate to protect government and military computer networks and provide secure communications for all branches of the U.S. government uses security software written by an Israeli code breaker whose home office is located at the Weizmann Institute in Israel.

A Bedford, Massachusetts-based company called RSA Security, Inc. issued a press release on March 28, 2006, which revealed that the NSA would be using its security software:

"U.S. Department of Defense Agency Selects RSA Security Encryption Software" was the headline of the company's press release which announced that the National Security Agency had selected its encryption software to be used in the agency's "classified communications project.

RSA stands for the names of the founders of the company: Ronald L. Rivest, Adi Shamir, and Leonard M. Adleman. Adi Shamir, the lead theoretician, is an Israeli citizen and a professor at the Weizmann Institute, a scientific institution tied to the Israeli defense establishment.

"My main area of research is cryptography – making and breaking codes," Shamir's webpage at the Weizmann Institute says. "It is motivated by the explosive growth of computer networks and wireless communication. Without cryptographic protection, confidential information can be exposed to eavesdroppers, modified by hackers, or forged by criminals."

The NSA/Central Security Service defines itself as America's cryptologic organization, which "coordinates, directs, and performs highly specialized activities to protect U.S. government information systems and produce foreign signals intelligence information."

The fact that the federal intelligence agency responsible for protecting the most critical computer systems and communications networks used by all branches of the U.S. government and military is using Israeli-made encryption software should come as no surprise. The RSA press release is just the icing on the cake; the keys to the most critical computer networks in the United States have long been held in Israeli hands.

AFP inquired with the NSA about its use of Israeli-made security software for classified communications projects and asked why such outsourcing was not seen as a national security threat. Why is "America's cryptologic organization" using Israeli encryption codes?

NSA spokesman Ken White said that the agency is "researching" the matter and would respond in the coming week.

American Free Press has previously revealed that scores of "security software" companies – spawned and funded by the Mossad, the Israeli military intelligence agency – have proliferated in the United States.

The "security" software products of many of these usually short-lived Israeli-run companies have been integrated into the computer products which are provided to the U.S. government by leading suppliers such as Unisys.

Unisys integrated Israeli security software, provided by the Israel-based Check Point Software Technologies and Eurekify, into its own software, so that Israeli software, written by Mossad-linked companies, now "secures" the most sensitive computers in the U.S. government and commercial sector.

The Mossad-spawned computer security firms typically have a main office based in the U.S. while their research and development is done in Israel.

The Mossad start-up firms usually have short lives before they are acquired for exaggerated sums of money by a larger company, enriching their Israeli owners in the process and integrating the Israeli directors and their Mossad-produced software into the parent company.

RSA, for example, an older security software company, acquired an Israeli-run security software company, named Cyota, at the end of 2005 for $145 million.

In January 2005, Cyota, "the leading provider of online security and anti-fraud solutions for financial institutions" had announced that "security expert" Amit Yoran, had joined the company's board of directors.

Prior to becoming a director at Cyota, Yoran, a 34-year old Israeli, had already been the national "Cyber Czar," having served as director of the Department of Homeland Security's National Cyber Security Division.

Yoran had been appointed "Cyber Czar" at age 32 by President George W. Bush in September 2003.

Before joining DHS, Yoran had been vice president for worldwide managed security services at Symantec. Prior to that, he had been the founder, president and CEO of Riptech, Inc., an information security management and monitoring firm, which Symantec acquired in 2002 for $145 million.

Yoran and his brother Naftali Elad Yoran are graduates of the U.S. Military Academy at Westpoint. Elad graduated in 1991 and Amit in 1993. Along with their brother Dov, the Yoran brothers are key players in the security software market. Amit has also held critical positions in the U.S. government overseeing computer security for the very systems that apparently failed on 9/11.

Before founding Riptech in 1998, Yoran directed the vulnerability- assessment program within the computer emergency response team at the US Department of Defense.

Yoran previously served as an officer in the United States Air Force as the Director of Vulnerability Programs for the Department of Defense's Computer Emergency Response Team and in support of the Assistant Secretary of Defense's Office.

In June 2005, Yoran joined the board of directors of Guardium, Inc., another Mossad-spawned "provider of database security solutions" based in Waltham, Massachusetts.

Guardium is linked with Ptech, an apparent Mossad "cut out" computer security company linked with the 9/11 attacks.

Ptech, a computer software company in Quincy, Mass., was supposedly a small start-up company founded by a Lebanese Muslim and funded by a Saudi millionaire.

Yet Ptech's clients included all the key federal governmental agencies, including the U.S. Army, the U.S. Air Force, the U.S. Naval Air Command, Congress, the Department of Energy, the Federal Aviation Administration, the Internal Revenue Service, NATO, the Federal Bureau of Investigation, the Secret Service and even the White House.

The marketing manager at Ptech, Inc. when the company started in the mid-1990s, however, was not a Muslim or an Arab, but an American Jewish lawyer named Michael S. Goff who had suddenly quit his law firm for no apparent reason and joined the Arab-run start-up company.

Goff was the company's information systems manager and had single-handedly managed the company's marketing and "all procurement" of software, systems and peripherals. He also trained the employees. Goff was obviously the key person at Ptech.

In the wake of 9/11, during the Citizens' Commission hearings in New York, Indira Singh, a consultant who had worked on a Defense Advanced Research Project, pointed to Ptech and MITRE Corp. being involved in computer "interoperability issues" between the FAA and NORAD.

At this time Ptech's ties to Arabs was the focus, and Goff was out of the picture.

"Ptech was with MITRE Corporation in the basement of the FAA for two years prior to 9/11," Singh said. "Their specific job is to look at interoperability issues the FAA had with NORAD and the Air Force in the case of an emergency. If anyone was in a position to know that the FAA – that there was a window of opportunity or to insert software or to change anything – it would have been Ptech along with MITRE."

The Mossad-run Guardium company is linked with Ptech through Goff Communications, the Holliston, Mass.-based public relations firm previously run by Michael S. Goff and his wife Marcia, which represents Guardium. Since being exposed in AFP in 2005, however, Michael's name no longer appears on the company website.

Although he and his brother reportedly grew up in Pound Ridge, New York during the 1970s and 1980s, the heads of the Jewish community told AFP that they had never heard of him. One said that she had conducted a survey of the Jews living in the small village of Pound Ridge in the 1970s and she would have remembered if a wealthy Israeli family named Yoran had been found.

Why did the locals in Pound Ridge NOT remember the Yorans?

Probably because they were NOT in Pound Ridge - but in Israel. The Pound Ridge address was used to give the appearance that the Yorans were Americans. I spoke with Elad and he has a distinctive Israeli accent - not what you would expect for a guy who grew up in a posh Yankee village.

So who are the Yorans? Who are their parents and why did they come to the United States? To raise a couple high-level moles to infiltrate the most sensitive U.S. computer networks? How could they have lived for 20 years in Pound Ridge and NOT be remembered.

Israeli Chief of CIA's Investment Group Mysteriously Resigns - AGAIN!

The new chief of the CIA's venture capital organization, In-Q-Tel, has resigned after just four months on the job. [!!!]

I didn't know the CIA had a venture capital group.

Amit Yoran, who was the government's cybersecurity chief until he left that job in 2004, said Monday he stepped down for personal reasons.

The role of In-Q-Tel's chief executive requires significant travel, and Yoran and his wife - a U.S. government lawyer - have three young daughters.

Yeah, right. And no one told him before he started that this was part of the job description? Maybe he and his wife just recently adopted their daughters wholesale. Or maybe, just maybe, something more sinister is going on.

The man making sure US computer networks are safe and secure has resigned after only a year in his post.

Amit Yoran was director of the National Cyber Security Division within the US Department of Homeland Security created following the 9/11 attacks.

The division was tasked with improving US defences against malicious hackers, viruses and other net-based threats.

Reports suggest he left because his division was not given enough clout within the larger organisation.

[His] division was charged with thinking up and carrying out action to make US networks more impervious to attack and disruption by the viruses, worms and hack attacks that have become commonplace.

In the last 12 months Mr Yoran oversaw the creation of a cyber alert system that sends out warnings about big hitting viruses and net attacks as they occur.

The warnings also contained information about how firms and organisations could protect themselves against these attacks.

The Cyber Security Division also audited US government networks to discover exactly what was sitting on which network.

The next step was to be the creation of a scanning system to identify vulnerabilities that made federal networks and machines susceptible to attack by malicious hackers and virus writers.

Mr Yoran's division was also doing work to identify the networks and machines that had been broken into by cyber criminals.

Despite this success Mr Yoran left his post abruptly at the end of last week, reportedly only giving one day's notice to bosses at the Department of Homeland Security.

ONE DAY'S NOTICE?!! And he subsequently gets appointed CHIEF of the CIA's capital venture group?!! That's insane!

Even now, after twice bailing on the government, Yoran remains on the payroll.

Yoran said he agreed with In-Q-Tel's board to continue working as a consultant and adviser.

In-Q-Tel - named for "Q," the fictional inventor of spy tools and toys for James Bond - makes about a dozen such investments annually with roughly $60 million it receives from the CIA's Directorate of Science and Technology, the Defense Intelligence Agency, the FBI and the National Geospatial-Intelligence Agency.

Something's VERY fishy about this.

Perhaps, this has something to do with the recent effort to hand an intelligence security contract to an Israeli company.

Or maybe, the Mrs. 'senses' that something's about to happen in the Justice Department.

The 45-day investigation into the Israeli deal still under way is only the 26th ever conducted in 1,600 business transactions reviewed by the Committee on Foreign Investments in the United States.

[A] former senior U.S. official who participated in reviews under President Clinton, said the Israeli sale involves more dire security issues than the administration's recent approval for a Dubai-owned company to take over significant operations at six major American ports.

"This raises a lot more important issues," said Reinsch, a former Commerce Department undersecretary. "The most important case is where we're making an irrevocable technology transfer to a foreign party. Port operations raise security issues, but the ports are still in the United States."

Check Point and Sourcefire declined to comment. Officials at the Defense Department, FBI and Justice Department also declined to comment.

Hillary Diane Rodham already had covered a great deal of ideological territory when she sat down to assess Alinsky's tactics.

Saul David Alinsky would have thought that tame stuff. The old Jewish radical was famous as a community organizer from Chicago's Back of the Yards, the home of stockyard workers made famous by Upton Sinclair's "The Jungle." From the late 1930s until his death in 1972, Alinsky crisscrossed the country, stirring the have-nots — poor whites and blacks — to demand power from the haves.

The hell-raiser's witty provocations were famous. One of his threatened “actions,” to unsettle the upper-crust audience at the Rochester symphony, was to have protesters buy 300 to 400 tickets, but first to gather for a big baked-bean dinner. He called the idea a "fart-in." It never happened, according to biographer Sanford D. Horwitt, though Alinsky loved to tell the story as if it had.

But Alinsky was no mere showman. He was a sometimes brutal seeker of power for others, schooling radicals with maxims such as "Pick the target, freeze it, personalize it and polarize it."

When news broke that the CIA had kept videotapes showing torture of detainees secret and then secretly destroyed them, Sen. Joe Biden (D-DE) was fast out of the gate: the scandal "leads right into the White House," he said, and the need for a special prosecutor was clear.

But that was about it. Senate Intelligence Committee Chairman Jay Rockefeller (D-WV) was quick to dismiss the need for one, saying that Congressional inquiries were enough. And the hard-charging investigation led by the House intelligence committee seemed to indicate that might be true. When Rep. Rush Holt (D-NJ), a member of the House intelligence committee, wrote Attorney General Michael Mukasey to formally request the appointment of a special prosecutor, expectations were low.

As expected, Mukasey said no. Or as he put it in a letter to Congress Friday, "I am aware of no facts at present to suggest that Department attorneys cannot conduct this inquiry in an impartial manner."

But with the Department rebuffing Congressional inquiries, Rockefeller's rationale has been turned on its head. The momentum seems to have shifted.

On Friday, House Judiciary Committee Chairman John Conyers (D-MI) said in a statement that Mukasey's "disturbing" refusal to answer Congressional questions about the tapes' destruction "calls into question whether the Department of Justice is best able to investigate these matters.”

And the same day, Sen. Ted Kennedy (D-MA) echoed Sen. Biden's comments from the week before.

Put all that together and you now have the chairman of the House Judiciary Committee and two prominent members of the Senate Judiciary Committee leaning towards a special prosecutor. Whether that momentum builds any more depends largely on how successful the House intelligence committee is in defying the Justice Department's attempt to stifle its investigation. Senate Majority Leader Harry Reid (D-NV) has said that he would call for a special prosecutor if the committee's don't get cooperation.

How Do Classified Letters Get Classified?

Attempts to find out what Congress actually knew about the 2002 torture of detainees held by the CIA are running right into the brick wall of classification. Only this time, it's not just CIA stonewalling that's keeping the facts concealed. Members of Congress are quick to put the classification muzzle on themselves.

In February 2003, Rep. Jane Harman (D-CA) wrote a letter to the CIA cautioning "against destruction of any videotapes" of al-Qaeda interrogations. It's not clear whether she objected to any actual interrogation techniques in the letter, and she says that because the letter is classified, she was "not free to mention this subject publicly until Director Hayden disclosed it yesterday." Harman is seeking to have the CIA declassify the letter.

Similarly, Jay Rockefeller said he wrote to the CIA in May and September 2005 to seek clarification about interrogation techniques. Unfortunately, those letters are also classified, and neither Harman nor Rockefeller appear inclined to release them.
 


But wait: neither Harman nor Rockefeller are CIA employees. How could letters they send to the CIA be classified? When would they become classified? If Harman and Rockefeller kept the letters in a drawer and never mailed them, would they still be classified?

I asked the country's preeminent classification expert, Steve Aftergood of the Federation of American Scientists, to enlighten me on this. Whenever an official receives information known to be classified -- as Harman and Rockefeller did through their perches on the intelligence committees -- "they are obliged to protect that document and to treat it as classified," Aftergood says. "Even if it is never circulated."

Add this to our list of legislators who knew about the CIA's recording of interrogations of al-Qaeda detainees: in September 2002 and again in 2003, the leaders of the House and Senate intelligence committees were briefed on what goes on in those interrogations. That means ex-Sen. Bob Graham (D-FL), Sen. Pat Roberts (R-KS), Sen. Richard Shelby, Sen. Jay Rockefeller (D-WV), Rep. Nancy Pelosi (D-CA), Rep. Jane Harman (D-CA), and ex-Rep. Porter Goss (R-FL) knew about waterboarding prisoners like Abu Zubaydah, leader of al-Qaeda's military committee. Publicly, The Washington Post reports, they said nothing, because privately, they didn't object -- until waterboarding became public knowledge, and some of the lawmakers expressed outrage. But some are disputing that account, though they're not giving specifics. From the Post:
Individual lawmakers' recollections of the early briefings varied dramatically, but officials present during the meetings described the reaction as mostly quiet acquiescence, if not outright support. "Among those being briefed, there was a pretty full understanding of what the CIA was doing," said Goss, who chaired the House intelligence committee from 1997 to 2004 and then served as CIA director from 2004 to 2006. "And the reaction in the room was not just approval, but encouragement."

Congressional officials say the groups' ability to challenge the practices was hampered by strict rules of secrecy that prohibited them from being able to take notes or consult legal experts or members of their own staffs. And while various officials have described the briefings as detailed and graphic, it is unclear precisely what members were told about waterboarding and how it is conducted. Several officials familiar with the briefings also recalled that the meetings were marked by an atmosphere of deep concern about the possibility of an imminent terrorist attack.

"In fairness, the environment was different then because we were closer to Sept. 11 and people were still in a panic," said one U.S. official present during the early briefings. "But there was no objecting, no hand-wringing. The attitude was, 'We don't care what you do to those guys as long as you get the information you need to protect the American people.' "

That U.S. official is clearly engaging in pushback. The revelation that the CIA videotaped interrogations in 2002 and then destroyed their recordings in 2005 threatens to lead to the agency's nightmare scenario: prosecution for potential war crimes. On Saturday, the Justice Department, along with the CIA's inspector general, opened an investigation into the destruction. The agency wants to make clear that it thought it had legal cover from the White House and Justice Department in 2002 to torture detainees -- and political cover from the relevant leaders of the intelligence committees in Congress. On the former point, President Bush, Vice President Cheney, then-White House Counsel Alberto Gonzales and then-Justice Department official John Yoo made sure of it. And on that latter point, it's clear from the Washington Post story that Congress did indeed sign on. As the investigations proceed, the agency will argue that they were not in this alone.

Bob Graham, who left the Senate in 2005, has said he has no recollection of the briefings. So that's one denial. Porter Goss, who became CIA Director in 2004, says all involved knew about the interrogations. Jay Rockefeller's story is complicated -- he began public objection to waterboarding in 2005 -- and is liable to change. Jane Harman says she won't discuss anything classified: a cynic might say that at least she's consistent. Pat Roberts didn't return my Friday phone call.

Take two! Senate intelligence committee chairman Jay Rockefeller (D-WV) had said yesterday that the CIA told him about its destruction of videotaped interrogations in "November 2006." But oops -- in a new statement just released to the press, he says he spoke too soon. It turns out he knew about the tapes' existence in 2003, but only found out about their destruction yesterday. Rocky:
"Last night, the CIA informed me that it believes that the leadership of the Senate Intelligence Committee was told of the decision to destroy the tapes in February 2003 but was not told of their actual destruction until a closed committee hearing held in November 2006.

"The committee has located no record of either being informed of the 2003 CIA decision or being notified late last year of the tapes having being destroyed. A review of the November 2006 hearing transcript finds no mention of tapes being destroyed.

"While the existence of the videotapes was known to me in 2003 in my capacity as then-Vice Chairman of the committee, I was not told of the CIA’s decision to destroy the tapes and I was not aware of their destruction until yesterday’s press reports."

The CIA shares so much information with Rockefeller, he must have just been confused. Who can keep it straight? In any event, Rockefeller knew since 2003 that some interrogations were videotaped, and he kept his mouth shut. Here's what he said he did.
"In May 2005, I wrote the CIA Inspector General requesting over a hundred documents referenced in or pertaining to his May 2004 report on the CIA’s detention and interrogation activities. Included in my letter was a request for the CIA to provide to the Senate Intelligence Committee the CIA’s Office of General Counsel report on the examination of the videotapes and whether they were in compliance with the August 2002 Department of Justice legal opinion concerning interrogation. The CIA refused to provide this and the other detention and interrogation documents to the committee as requested, despite a second written request to CIA Director Goss in September 2005."

Let's see the release of these letters. And more than that: Rockefeller is pledging a full investigation in the Senate intelligence committee. Once again, Matt has it right. Rockefeller needs to start snitching.

What did Congress know about the CIA's 2002 torture tapes and their 2005 destruction of same? Senate intelligence committee chairman Jay Rockefeller (D-WV):
While we were provided with very limited information about the existence of the tapes, we were not consulted on their usage nor the decision to destroy the tapes. And, we did not learn until much later, November 2006 -- 2 months after the full committee was briefed on the program -- that the tapes had in fact been destroyed in 2005.

Rep. Jane Harman (D-CA), then-ranking Democrat on the House intelligence committee, isn't clear about what or when she knew of either the tapes or their destruction. But she says she warned CIA against getting rid of the evidence.
Rep. Jane Harman of California, then the senior Democrat on the House Intelligence Committee, was one of only four members of Congress in 2003 informed of the tapes' existence and the CIA's intention to ultimately destroy them.

"I told the CIA that destroying videotapes of interrogations was a bad idea and urged them in writing not to do it," Harman said. While key lawmakers were briefed on the CIA's intention to destroy the tapes, they were not notified two years later when the spy agency actually carried out the plan. Senate Intelligence Committee Chairman Jay Rockefeller, D-W.Va., said the committee only learned of the tapes' destruction in November 2006.

It seems as if the "four" congressional leaders Harman refers to as knowing about the tapes were the chairs and ranking members of the intelligence committees: Sen. Pat Roberts (R-KS), Sen. Jay Rockefeller (D-WV), Rep. Porter Goss (R-FL), and Rep. Jane Harman (D-CA). Rep. Pete Hoekstra (R-MI) took Goss' spot as chairman of the House intelligence committee that year when Goss became CIA director. Hoekstra told the AP that he didn't know a thing about either the tapes or their destruction. I'm calling Harman to ask her for her letter to the CIA about the tapes, and will bring it to you if and when I have it.

CONCORD, N.H. — Democrat Dennis Kucinich, who won less than 2 percent of the vote in the New Hampshire primary, on Thursday called for a recount to ensure that all ballots in his party’s contest were counted.

He cites “serious and credible reports, allegations and rumors” about the integrity of Tuesday results.

Kucinich alluded to online reports alleging disparities around the state between hand-counted ballots, which tended to favor Barack Obama, and machine-counted ones that tended to favor Hillary Clinton. He also noted the difference between pre-election polls, which indicated Obama would win, and Clinton’s triumph by a 39 percent to 37 percent margin.

Deputy Secretary of State David Scanlan responded that Kucinich is entitled to a statewide recount, but under New Hampshire law Kucinich will have to pay for it. Scanlan said he had “every confidence” the results are accurate.

--Senator Expresses Concern that CIA Continues to Withhold Key Information -- 

“In the last 24 hours, we have taken a close look at any relevant correspondence related to the tapes.  The news that the tapes were destroyed was extremely disturbing to me and the CIA’s description of notifying Congress is inconsistent with our records.  As we learn more, it is only raising new questions and concerns.   

“I have been pushing for a full investigation of CIA detention and interrogation programs for years. Along with this ongoing oversight, the committee has now asked for a complete and accurate chronology of events related to the tapes, including how the tapes were used, when and why they were destroyed, who was notified of their destruction and when, and any communication about them that was provided to the courts and Congress.

“We do not know if there was intent to obstruct justice, an attempt to prevent congressional scrutiny, or whether they were simply destroyed out of concern they could be leaked – whatever the intent, we must get to the bottom of it.  This is a very serious matter with very serious consequences. 

“Based on a preliminary review, here’s what we know.
