Google's Racketeering Challenge

According to a recent civil lawsuit, a plaintiff is suing Google for violating the racketeering laws (aka ?RICO?).  (Attia et al v. Google et al, Cal. Sup. Ct. (Santa Clara) Case No. 1:14-cv-270143.)  I?ve been waiting for this since 2012 when it dawned on me one day that Google is running a criminal enterprise (see ?Google?s Guide to RICO?).  So what does this RICO business mean?

If you?re even occasionally exposed to contemporary crime movies you?ll have heard of ?RICO?.   The ?RICO? statute is the acronym for the Racketeer Influenced and Corrupt Organization Act which allows a criminal prosecution against the leaders of an ?ongoing criminal enterprise?, particularly where the leaders of that organization order others to commit crimes, often called ?RICO predicates?.  The loophole was that leader didn?t do the crime, but ordered or assisted others in committing it.  (Recall the Senate hearings in The Godfather II, and see the first major RICO criminal case, US v. Scotto, 641 F.2d 47 (1980) for those reading along.)  You know, that thing that happened with those guys down at that place we used to go back in the day.

Often overlooked is the civil cause of action that may be brought either by the government or by private citizens under both the federal RICO statute and the 33 or so state law versions of RICO.  This allows private citizens who have been harmed by corrupt organizations to sue for treble damages and attorneys fees.  The Department of Justice civil RICO manual is also instructive for government action under the statutes:

  I?m not a RICO expert, but the RICO portion of the complaint seems to be very well-pleaded and a systematic application of the law and facts.  It?s also important to remember that Eric Schmidt, Larry Page and Sergey Brin have absolute control over Google (and Alphabet, the holding company) through Google?s bizarre voting rules as explained by the Motley Fool:

Not only does the voting structure mean that insiders can block any shareholder revolt, it also means that insiders are totally responsible for any of the company?s bad acts.  That may explain why Eric Schmidt essentially ?took the 5th? under questioning by Senator John Cornyn about Google executives? narrow escape from criminal prosecution for violating and conspiring to violate the Controlled Substances Act. Schmidt later claimed neither he nor his legal team ?understood? the Senator?s questions and were ?confused.?

This is, of course, another reason why Google was sued by its stockholders after insiders authorized the payment of $500,000,000 of the stockholders? money as a fine for the bad behavior of insiders such as Larry Page.  In fact, the U.S. Attorney for Rhode Island told the Wall Street Journal that Larry Page was directly implicated in profiting from illegal drug advertising?which may have something to do with why the RICO claim refers to the $500,000,000 fine.

Where does it go?  Before you laugh it off, remember this:  If you had told a room full of MBAs in the mid 1980s that in a few years time Master of the Universe Michael Milken would be in prison and Drexel Burnham Lambert would be bankrupt, you would have been laughed out of the room as a quixotic buffoon.  But on March 29, 1989, Michael Milken was charged with 98 counts of racketeering and fraud and was facing life in prison.  That?s right?racketeering under the RICO Act.  Milken copped a plea to six lesser included crimes of securities and tax fraud, paid a $600 million fine and served 22 months in a federal pen on a 10 year sentence.

Over the years, Google has transformed into the new bad guy and the pressure is mounting in a way never witnessed before. The U.S. Copyright Office's request for comments into the efficacy of the DMCA's safe harbor provisions has resulted in a wave of condemnation for both Google search and the company's YouTube platform, with everyone from the major record labels to the MPAA and back again attacking the technology giant. Grammy award-winning musician Maria Schneider really ups the ante by stating that YouTube is guilty of the same criminal acts that Megaupload is currently accused of. "YouTube is guilty of criminal racketeering," Schneider wrote in an open letter to the platform. "YouTube has thoroughly twisted, contorted, and abused the original meaning of the outdated DMCA 'safe harbor' to create a massive income redistribution scheme, where income is continually transferred from the pockets of musicians and creators of all types, and siphoned directly into their own pockets."

First, Facebook blocked Salena Zito, CNN contributor and author of the groundbreaking book "The Great Revolt: Inside the Populist Coalition Reshaping American Politics." On Wednesday afternoon, Zito published a New York Post article explaining "why Trump?s supporters won?t care about Cohen and Manafort?s convictions."

A researcher from Vanderbilt University in Nashville, Tennessee, uncovered last week that Google had access to data for users opting to use the private browsing mode on the Google Chrome web browser. ?If you don?t want Google Chrome to remember your activity, you can browse the web privately in Incognito mode,? a Google Chrome help page reads. On Tuesday morning, President Trump lashed out at Google, with his remarks later broadening to include Twitter and Facebook, accusing it of "rigging" search results by presenting only results "from National Left-Wing Media" and accused "Google & others are suppressing voices of Conservatives and hiding information and news that is good."

According to a memo posted on Facebook's internal message board titled "We Have a Problem With Political Diversity", and which was published by the New York Times, senior Facebook engineer Brian Amerige confirmed Trump's allegation writing that "we are a political monoculture that?s intolerant of different views" and shockingly admitted that "we claim to welcome all perspectives, but are quick to attack ? often in mobs ? anyone who presents a view that appears to be in opposition to left-leaning ideology. We throw labels that end in *obe and *ist at each other, attacking each other?s character rather than their ideas."

The scathing indictment of Facebook's liberal "mono-culture" continues:

    We do this so consistently that employees are afraid to say anything when they disagree with what?s around them  politically.​ HR has told me that this is not a rare concern, and I?ve personally gotten over a hundred messages to that effect. Your colleagues are afraid because they know that they ? not their ideas ? will be attacked. They know that all the talk of ?openness to different perspectives? does not apply to causes of ?social justice,? immigration, ?diversity?, and ?equality.? On this issues, you can either keep quiet or sacrifice your reputation and career.

"These are not fears without cause" Amerige writes, and continues the stunning disclosure of the company's biased culture, "Because we tear down posters welcoming Trump supporters. We regularly propose removing Thiel from our board because he supported Trump. We?re quick to suggest firing people who turn out to be misunderstood, and even quicker to conclude our colleagues are bigots. We have made ?All Lives Matter? a fireable offense. We put Palmer Luckey through a witch hunt because he paid for anti-Hillary ads. We write each other ad-hoc feedback in the PSC tool for having ?offensive? ideas. We ask HR to investigate those who dare to criticize Islam?s human rights record for creating a ?non inclusive environment.? And they called me a transphobe when I called out our corporate art for being politically radical.

Those companies "better be careful because you can?t do that to people," Trump said later in the Oval Office. "I think that Google, and Twitter and Facebook, they are really treading on very, very troubled territory and they have to be careful. It is not fair to large portions of the population.?

Google immediately responded, condemning Trump's charge, and claiming that "Search is not used to set a political agenda and we don?t bias our results toward any political ideology."

And yet, as so often happens, in Trump's crude delivery, the politically incorrect truth was once again found.

We no longer accept the sales pitch for this type of algorithm so meekly.

In her 2016 book Weapons of Math Destruction, Cathy O'Neil, a former math prodigy who left Wall Street to teach and write and run the excellent mathbabe blog, demonstrated beyond question that, far from eradicating human biases, algorithms could magnify and entrench them.
After all, software is written by overwhelmingly affluent white and Asian men - and it will inevitably reflect their assumptions (Google 'racist soap dispenser' to see how this plays out in even mundane real-world situations). Bias doesn't require malice to become harm, and unlike a human being, we can't easily ask an algorithmic gatekeeper to explain its decision.

O'Neil called for 'algorithmic audits' of any systems directly affecting the public, a sensible idea that the tech industry will fight tooth and nail, because algorithms are what the companies sell; the last thing they will volunteer is transparency.

Sen. Orrin Hatch (R-UT) wrote to Federal Trade Commission (FTC) Chairman Joseph Simmons on Thursday, urging the agency to investigate Google?s anti-competitive practices.

Hatch wrote in his letter to the FTC:

    In the past, Google has offered arguments that its conduct is procompetitive. And Google does have a long track record of providing valuable services and making important, innovative contributions. But much has changed since the FTC last looked at Google?s conduct regarding search and digital advertising.

Hatch also noted that Google has ?decided to remove from its platforms legal businesses that the company apparently does not agree with.?

Sen. Hatch said that many of his Senate colleagues wrote to Alphabet, Google?s parent company, regarding its data collection surrounding Google?s Android mobile operating system and privacy practices for Gmail users? data, which Google has given a third-party access to the actual content of emails.

The senior Utah senator said that although many of these reports concern various parts of Google?s business, many of the most  concerning  relate to the Google?s ?dominant position in search and accumulating vast amounts of personal data.?

,..     March 2015, the Wall Street Journal revealed some details of an FTC Bureau of Competition staff report from August 2012 (before the then-Commissioners of the FTC concluded the investigation into Google). That staff report recommended that the FTC pursue an antitrust action against Google because of some of its search practices. The report found that it was a ?close question? as to whether Google violated Section 2 of the Sherman Act by ?preferencing? its own ?vertical content over that of rivals, while simultaneously demoting rival vertical websites.? Ultimately, the staff recommended against pursuing a complaint on that point. The report did, however, recommend action against Google on other issues that the report found to be anticompetitive. Google resolved the issue by promising in a December 27, 2012 letter that it would take certain actions for five years to address those concerns. That time period has now passed.

Sen. Hatch has led Republicans towards investigating monopolies in tech since the last ?90s. In 1998, Hatch chaired a Senate Judiciary Committee hearing investigating whether Microsoft established a monopoly in the computer software industry.

It?s certainly enough to pay his employees well. But he doesn?t. A huge number of Amazon workers are so poorly paid, they qualify for federal welfare benefits. According to data from the nonprofit group New Food Economy, nearly one in three Amazon employees in Arizona, for example, was on food stamps last year. Jeff Bezos isn?t paying his workers enough to eat, so you made up the difference with your tax dollars. Next time you see Bezos, make sure he says thank you.

    Same with the Waltons. The Walton family founded Walmart. Collectively they?re worth about $175 billion. That?s more than the entire gross domestic product of Qatar, the oil-rich Gulf state. The Waltons could certainly afford to be generous with their workers. Instead, they count on you to take up the slack. In 2013, taxpayers sent more than $6 billion to Walmart?s workers, for food stamps, Medicaid, and housing assistance.

    And if you think that?s shocking, meet Travis Kalanick. He?s the youthful founder of Uber. His personal fortune is close to $5 billion. His drivers, by contrast, often make less than minimum wage. One recent study showed that many Uber drivers lose money working for the company. That?s not a sustainable business model. The only reason it continues is because of your generosity. Because you?re paying the welfare benefits for Uber?s impoverished drivers, child billionaires like Travis get to keep buying bigger houses and more airplanes. He?s someone else who definitely owes you a thank you note.

    If you can think of a less fair system than that, send us an email. We?d love to hear it. It?s indefensible. Yet almost nobody ever complains about it. How come? Conservatives, like us, support the free market, and for good reason. Free markets work. But there?s nothing free about this market. A lot of these companies operate as monopolies. They hate markets. They use government regulation to crush competition. There?s nothing conservative about that, just as there?s nothing conservative about most big corporations. Just the opposite. They?re the backbone of the left. Pick a leftwing cause that you think is hurting the country. Check the donor list, and you?ll find the name of some corporation. Often many corporations.     There is one person in Washington who?s offended by this arrangement, and we?re sorry to say he?s wrong on pretty much everything else. But this is a weird moment, so you take allies where you can find them. Bernie Sanders, of all people, is trying to get your money back from Jeff Bezos. This is especially amazing since Bezos is on Bernie?s side on most things. They?re both leftwing activists. But on this question, Bernie?s right. He?s planning legislation that would force big corporations to return the taxpayer-funded welfare benefits you?ve paid to their workers. It?s not a perfect solution, and it probably won?t pass. No matter what they claim in public, liberals in Congress would never support something like that. Their loyalty isn?t to you. It?s to Uber and Jeff Bezos. But at the very least it might awaken a sleepy population to the new reality of activist corporate America. And that?s a good thing.

    America has changed enormously in the last 20 years. A lot of people you thought were your allies are in fact working against your interests. They have contempt for you and your family, your customs and your faith. Included in this group, I?m sorry to say, are a lot of big corporations. They have no use for you or the country you grew up in. Stand in their way, and they?ll crush you. It?s all shocking enough that I recently wrote a book about it. It?s called ?Ship of Fools,? and it explains what happened and who did it. The book is out in a month, the first week of October, but you can preorder a copy now, and I hope you will.

(Bloomberg) -- For the past year, select Google advertisers have had access to a potent new tool to track whether the ads they ran online led to a sale at a physical store in the U.S. That insight came thanks in part to a stockpile of Mastercard transactions that Google paid for.

But most of the two billion Mastercard holders aren?t aware of this behind-the-scenes tracking. That?s because the companies never told the public about the arrangement.

Alphabet Inc.?s Google and Mastercard Inc. brokered a business partnership during about four years of negotiations, according to four people with knowledge of the deal, three of whom worked on it directly. The alliance gave Google an unprecedented asset for measuring retail spending, part of the search giant?s strategy to fortify its primary business against onslaughts from Amazon.com Inc. and others.

But the deal, which has not been previously reported, could raise broader privacy concerns about how much consumer data technology companies like Google quietly absorb.

Google paid Mastercard millions of dollars for the data, according to two people who worked on the deal, and the companies discussed sharing a portion of the ad revenue, according to one of the people. Last year, when Google announced the service, called "Store Sales Measurement," the company just said it had access to "approximately 70 percent" of U.S. credit and debit cards through partners, without naming them.

That 70 percent could mean that the company has deals with other credit card companies, totaling 70 percent of the people who use credit and debit cards. Or it could mean that the company has deals with companies that include all card users, and 70 percent of those are logged into Google accounts like Gmail when they click on a Google search ad.

Google?s ad business, which hit $95.4 billion in 2017 sales, has maintained an astounding growth rate of about 20 percent a year. But investors have worried how long that can last. Twitter CEO Jack Dorsey and Facebook COO Sheryl Sandberg are set to tell lawmakers Wednesday that their companies have taken measures to combat foreign interference in future elections.

At 9:30AM EST, Sandberg and Dorsey will appear together in front of the Senate Intelligence Committee, while Dorsey will sit down with the House Energy and Commerce Committee at 1:30PM ET.

"Our adversaries are determined, creative and well-funded," Sandberg plans to say, according to her prepared remarks. "But we are even more determined ? and we will continue to fight back."

Dorsey said in tweets ahead of the hearing: "We realize Twitter is used by many as a public square, and our singular objective as a company is to help increase the health and integrity of conversations found within."

According to a an early draft of an Executive Order (EO), the White House will instruct federal law enforcement and antitrust agencies to launch investigations into the business practices of Facebook, Google and other social media companies, according to Bloomberg which says it has seen the draft.

While not specifically calling out companies by name, the document orders US antitrust officials to "thoroughly investigate whether any online platform has acted in violation of the antitrust laws," while instructing other agencies to return recommendations within a month of Trump signing the EO which could potentially "protect competition among online platforms and address online platform bias."

Senior executives from these companies, plus Twitter and Charter Communications, offered a show of industry support for a federal privacy bill with weaker consumer protections during a Senate hearing Wednesday.

Such a bill would block states like California from enacting stronger privacy protections. The executives argued that a patchwork of different state laws would make it tough for companies to operate and would threaten innovation. The takeaway from news outlet Axios: "Tech companies want privacy rules, but on their own terms."

The testimony on Capitol Hill came one day after the Department of Commerce recommended new regulations on how companies handle consumers' personal information that were similar to the ones being proposed by the tech and telecom industries.

An internal company briefing produced by Google and leaked exclusively to Breitbart News argues that due to a variety of factors, including the election of President Trump, the ?American tradition? of free speech on the internet is no longer viable.
Despite leaked video footage showing top executives declaring their intention to ensure that the rise of Trump and the populist movement is just a ?blip? in history, Google has repeatedly denied that the political bias of its employees filter into its products.


But the 85-page briefing, titled ?The Good Censor,? admits that Google and other tech platforms now ?control the majority of online conversations? and have undertaken a ?shift towards censorship? in response to unwelcome political events around the world.

Examples cited in the document include the 2016 election and the rise of Alternative for Deutschland (AfD) in Germany.

Responding to the leak, an official Google source said the document should be considered internal research, and not an official company position.

The Seattle Times called it ?the just thing.? ?Good for them,? said President Trump?s chief economic adviser Larry Kudlow. ?I?m in favor of higher wages.? Bloomberg called it proof that ?an even higher minimum wage is probably safe for big, productive cities.? Senator Bernie Sanders, a chief Bezos antagonist, called it ?enormously important.? ?Unequivocally good news,? said The Washington Post.

The latter is owned by Jeff Bezos, an all-too-easily forgotten point these days. Because for all the questions to follow this announcement ? Why now? What is Amazon eliminating to pay for this? President Trump's 2020 campaign manager Brad Parscale renewed his criticism of social media companies on Monday for silencing conservative voices across several platforms, reports CNBC.

Despite unwarranted comparisons to US financial credit scores, ?social credit? scoring in China is used by the government and para-statal entities, not just private companies, and not just for financial decision-making.

One of the NPR stories as well as a report last month by the Australian Broadcasting Co. include interviews with people who discovered they were barred by the Chinese government from travel on high-speed trains as a result of ?social credit? scores, regardless of their ability to pay for tickets.

?It can?t happen here?? No.

It already happens here, every day, to everyone who travels by airline or engages in bank or credit card transactions.

You may not realize it until you are mysteriously unable to obtain a boarding pass or complete a financial transaction, but each of these activities is already subject to secret, permission-based, extrajudicial prior restraint by the US government.

The default is ?no?.  Since a little over 10 years ago, US Federal regulations have forbidden any airline from issuing a boarding pass unless and until it has sent the would-be traveler?s itinerary and identifying information to the DHS and has received back an individualized, per-passenger, per-flight, permission-to-travel message from the DHS. The DHS generates a secret ?risk score? for each passenger, which determines how closely they are searched and questioned, whether the airline is instructed to call the police when they try to check in, and other aspects of how they are treated.

Even before airlines or banks get to the point of consulting the government, ?carrier sanctions? and similar sanctions against financial institutions give them a financial incentive to err on the side of saying ?no?, not ?yes?.

Apple plans to build a 133-acre campus in Austin, Texas, that will cost $1 billion and employ 5,000 new workers, the company announced Thursday. The company says the move is expected to make it the largest private employer in Austin.

Apple already employs more people in that city, some 6,200 workers, than it does in any other city outside of its headquarters in Cupertino, Calif. The company now plans to add substantially to that figure.

Its current main site in Austin is an office park roughly 12 miles north of downtown. The new campus will also be in North Austin, less than a mile from the current facilities. And it will have room to grow to 15,000 workers, the company says.

"Apple is proud to bring new investment, jobs and opportunity to cities across the United States and to significantly deepen our quarter-century partnership with the city and people of Austin," CEO Tim Cook, said in a news release about the plan.

Big Brother is an emerging reality in China. Yet in the West, at least, the threat of government surveillance systems being integrated with the existing corporate surveillance capacities of big-data companies like Facebook, Google, Microsoft, and Amazon into one gigantic all-seeing eye appears to trouble very few people?even as countries like Venezuela have been quick to copy the Chinese model.

Still, it can?t happen here, right? We are iPhone owners and Amazon Prime members, not vassals of a one-party state. We are canny consumers who know that Facebook is tracking our interactions and Google is selling us stuff.

Yet it seems to me there is little reason to imagine that the people who run large technology companies have any vested interest in allowing pre-digital folkways to interfere with their 21st-century engineering and business models, any more than 19th-century robber barons showed any particular regard for laws or people that got in the way of their railroads and steel trusts.

Nor is there much reason to imagine that the technologists who run our giant consumer-data monopolies have any better idea of the future they're building than the rest of us do.

Facebook, Google, and other big-data monopolists already hoover up behavioral markers and cues on a scale and with a frequency that few of us understand. They then analyze, package, and sell that data to their partners.

A glimpse into the inner workings of the global trade in personal data was provided in early December in a 250-page report released by a British parliamentary committee that included hundreds of emails between high-level Facebook executives. Among other things, it showed how the company engineered sneaky ways to obtain continually updated SMS and call data from Android phones. In response, Facebook claimed that users must "opt-in" for the company to gain access to their texts and calls.

But documents recently revealed show that since 2012, management has worried about where it can find more warm bodies to sign on. Fake accounts have been keeping the company that Columbia professor Tim Wu has called an "attention merchant" afloat.

Why is that?

Gregory Wrightstone, a geologist with more than three decades of experience, told The Daily Signal in an interview that he has his own opinion about what may have transpired inside Apple.

Wrightstone is the author of a book ?Inconvenient Facts: The Science That Al Gore Doesn?t Want You to Know,? which served as the basis for the information available from the app.

He notes that former Vice President Al Gore, a leading proponent of the view that mankind?s activities propel dangerous climate change, is a board member of Apple.

    But I suppose they have the political narrative right. Compared to these, our app is the gold standard. I made sure we had charts and links and references to the source for our data. This is all right in the palm of your hand.

A total of 60 facts in Wrightstone?s book are available through the Inconvenient Facts app to Android users. Complete with data, charts, and videos, they challenge the premise of alarmist theories about climate change that link man-made emissions to dangerous levels of global warming.

Gore?s ongoing campaign to convince the public that rising levels of carbon dioxide emissions could trigger catastrophic global warming was the subject of the 2006 documentary ?An Inconvenient Truth? and the 2017 follow-up, ?An Inconvenient Sequel: Truth to Power.?

Facebook announced Wednesday that it intends to ban content that glorifies white nationalism and separatism, a major policy shift that will begin next week.

"It's clear that these concepts are deeply linked to organized hate groups and have no place on our services," the company said in a statement.

Facebook had already banned white supremacy but it left a loophole which civil rights groups said promoted racism and hate. The company said it had allowed expressions of white nationalism and separatism "because we were thinking about broader concepts of nationalism and separatism ? things like American pride."

But that thinking changed after discussions with civil society groups and race relations experts over the last three months, the company says.

Facebook says next week users who search for terms related to white supremacy will be directed to Life After Hate, a Chicago-based organization founded by former extremists who strive to help people "leave the violent far-right."

The issue can only be resolved on Mozilla's end. The organization needs to renew the certificate or create a new one to resolve the issue. I'd expect Mozilla to do that soon as the issue is widespread and affecting lots of Firefox users.

Users should not remove affected extensions from their installations; the issue will resolve itself once Mozilla fixes it.

Some Firefox users started to notice that installed browser extensions were all disabled in the web browser suddenly. Extensions would display "could not be verified for use in Firefox and has been disabled" messages in the add-ons manager of the browser. Firefox would display "One or more installed add-ons cannot be verified and have been disabled" at the top as a notification next to that.

Affected extensions include LastPass, Ghostery, Download Manager (S3), Dark Mode, Honey, uBlock Origin, Greasemonkey, NoScript, and others.

Update: Mozilla started to roll out a fix for Release, Beta, and Nightly versions of Firefox.
The fix uses Mozilla Studies, and you need to make sure that this is enabled to get it. Mozilla notes that you may disable Studies again after the fix is applied and add-ons have been re-enabled. You need to make sure that "Allow Firefox to install and run studies" is checked on about:preferences#privacy.
