Misuse of the Patriot Act -- This is what you get if you don't submit to the allmighty DHS!


Tamera Jo Freeman lost custody of her children after an incident on a Frontier Airlines flight. "A woman spanking her child is not as great a threat to aviation as members of Al Qaeda with box cutters," says one expert.

--At least 200 passengers have been convicted of felonies under the Patriot Act, often for behavior involving raised voices and profanity. Some experts say airlines are misusing the law.

The incident aboard the Frontier flight ultimately led to Freeman's arrest and conviction for a federal felony defined as an act of terrorism under the Patriot Act, the controversial federal law enacted after the 2001 attacks in New York and Washington.

"I had no idea I was breaking the law," said Freeman, 40, who spent three months in jail before pleading guilty.


After three months in jail, Freeman agreed to plead guilty in exchange for being released on probation. A court-appointed attorney told her that a plea deal would be the fastest way to see her children, who had been taken back to Hawaii and put into foster care.

Her probation required her to stay in Oklahoma City, where she grew up, and prohibited her from flying. Meanwhile, legal proceedings in Hawaii have begun to allow the children's foster parents to adopt them.

Freeman has been denied permission to attend custody hearings in Maui over the last six months, court records show.

"I have cried. I have cried for my children every day," Freeman said. "I feel the system is failing me.

Notice they kept her in prison for three months until she plead 'guilty.'  She should of sat in there for as long as it took to make an example of the ridiculous system.

Imagine how the federal government would explain that she sat in prison for the same length of time as a Guantanamo Bay prisoner for simply spanking her child.

Or would anybody even care to do anything.

No she made a commotion on an aircraft while airborne, after 911, I personally hate to fly now. to much BS

This is the reason that she is slammed and cant see her kids.

An aircraft is NOT US SOIL - YOU DONT HAVE THE SAME RIGHTS - if you dont like it then you can drive

Aircraft is not on US Soil.  I guess so, it is in the air.  I think she was arrested when the aircraft was back on US soil though and was arrested by US Police.  Unless I am mistaken, they are supposed to abide by the Constitution.

Also, she was charged with terrorism.  I find this hard to believe that yelling profanities and throwing a can of tomato juice on the floor qualifies as terrorism. Call me crazy.

I have an answer for that..Travel other ways and let the Airlines go to hell!! None should support the airlines after all we know there was some involvement with them and 911 don't we?  Maybe not all airlines but... If all are doing these things as far as I am concerned they can all go bust! We can take trains or bus's if traveling in the USA!!!

Right Sane,

Just like you have now these 'free speech zones' an Aircraft is a special 'Federal Security Zone'.

So if the stewardess slammes the cart into your elbow and you spill your ginger ale on your lap. You just better not make a big fuss- you can be slammed and then be in custody for the next 25 years

Obviously people don't realize who close to the edge of disaster they really are.

The lady was having  "another"  bad day with her kids,  got drunk and went off on the help. She is now paying a very dear price for that indescretion. It is not like she was not familiar with the law and her particular situatuion (see below).

Passengers told the FBI that Freeman was drinking heavily before and during the flight. She spent the flight cursing, terrozing and neglecting her two-year-old son and four-year-old daughter because they wouldn’t let her watch a movie in peace.

Witnesses said Freeman hit the children on their legs, shoulders and knees, and appeared drunk and violent toward the kids before she boarded. They also said the children tried to hide on the floor to get away from their mom, and were scared and crying.

Passengers sitting near Freeman alerted the flight attendants and when one approached her, she began yelling, telling the flight attendant to mind her own business and get her some more booze. When she was told that she was cut off, Freeman threw a drink at the flight attendant.


The flight attendant asked a corrections officer who was on the plane to sit near Freeman. Then she grabbed a roll of duct tape and stood near the drunken mom to prevent her causing trouble. The captain radioed ahead to have police meet the plane.


Freeman was arrested when the plane landed in Denver, and is being held for investigation of interference with a flight crew and assault on children. She told authorities that she lost her temper and smacked her kids because they were fighting and spilling drinks.

Freeman faces up to 21 years in prison and fines up to $350,000 if convicted.  Terrorizing her kids, terrorizing the flight attendants. Why wasn’t this woman on the terrorist watch lists?

WAILUKU » A woman who had a tumultuous domestic past on Maui is being held by federal officials in Colorado after allegedly beating her two children on a flight to Denver and throwing a drink at a flight attendant.

Tamera Jo Freeman, 38, who now resides in San Francisco, was charged with two counts of assault and one count of interfering with a flight attendant.

Freeman, who had a detention hearing yesterday in U.S. District Court in Denver, is accused of slapping her 4-year-old daughter and 2-year-old son before the flight attendant intervened.

 
She was arrested July 16 after the flight arrived in Denver.

On Maui, Freeman was sentenced to 30 days in jail in October for failing to comply with conditions of her probation, after being convicted of domestic abuse.

The abuse charge stemmed from her failure to abide with a 24-hour cooling-off period with a Maui man who is her daughter's father.

She was convicted of violating a protective order against the same man on Feb. 28 and sentenced to 16 days in jail.

With credit for time served while in jail, she spent no further time incarcerated.

During her sentencing in February, her attorney told the court that she had completed an anger management program.

In 2005, Freeman's vehicle was used by Paul L.V. Campos, who was wanted on charges that he stabbed a man, county deputy prosecutors recalled.

Campos was wounded in the face and neck after he allegedly tried to elude police in an apartment parking lot in Kihei.

During the hearing in Denver, Freeman, whose long brown hair was knotted atop her head, sat in a red jail uniform conferring with her court-appointed lawyer, Martha Eskesen.

The prosecution had requested she remain in custody, citing a past "issue" with Freeman in Hawaii.

Magistrate Judge Craig Shaffer said he did not think Freeman had sufficient ties to Colorado to ensure she would return for trial. He also said Freeman has "medical issues that I find problematic."

Eskesen requested that sensitive details be withheld from the public record because of the "high media attention in this case."

Shaffer assured her he would protect Freeman's rights as a private citizen.

"There's a great deal of information in the pretrial services report which I frankly believe is private," Shaffer said.

Well she was a terrorist after all...a child terrorist. 

When I was a waitress, I refused to serve someone after watching them slap their kid in the face for dropping food on the floor.  It was really disturbing to see, especially knowing that kids are always messy...this is a fact of life!

Hopefully this mom will stop drinking and think about how to be nice to her kids after this incident and be strong enough to stop the vicious cycle of child abuse.
