The California secretary of state should refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until President-elect Barack Obama verifies his eligibility to hold the office, alleges a California court petition filed on behalf of former presidential candidate Alan Keyes and others.

The legal action today is just the latest is a series of challenges, some of which have gone as high as the U.S. Supreme Court, over the issue of Obama's status as a "natural-born citizen," a requirement set by the U.S. Constitution.

WND senior reporter Jerome Corsi even traveled to Kenya and Hawaii prior to the election to investigate issues surrounding Obama's birth. But his research and discoveries only raised more questions.

The biggest question is why Obama, if a Hawaii birth certificate exists, simply hasn't ordered it made available to settle the rumors.

The governor's office in Hawaii said there is a valid certificate but rejected requests for access and left ambiguous its origin: Does the certificate on file with the Department of Health indicate a Hawaii birth or was it generated after the Obama family registered a Kenyan birth in Hawaii?

Obama's half-sister, Maya Soetoro, has named two different Hawaii hospitals where Obama could have been born, while a video posted on YouTube features Obama's Kenyan grandmother Sarah claiming to have witnessed Obama's birth in Kenya.

The California action was filed by Gary Kreep of the United States Justice Foundation on behalf of Alan Keyes, the presidential candidate of the American Independent Party, along with Wiley S. Drake and Markham Robinson, both California electors.

"Should Senator Obama be discovered, after he takes office, to be ineligible for the Office of President of the United States of America and, thereby, his election declared void, Petitioners, as well as other Americans, will suffer irreparable harm in that (a) usurper will be sitting as the President of the United States, and none of the treaties, laws, or executive orders signed by him will be valid or legal," the action challenges.

The petition is a request for the Superior Court of California in Sacramento County to issue a peremptory writ barring Secretary of State Debra Bowen "from both certifying to the governor the names of the California Electors, and from transmitting to each presidential Elector a Certificate of Election, until such documentary proof is produced and verified showing that Senator Obama is a 'natural born' citizen of the United States and does not hold citizenship of Indonesia, Kenya or Great Britain."

It continues with a request for a writ barring California's electors from signing the Certificate of Vote until documentary proof is produced.

An Obama spokesperson interviewed by WND described such lawsuits as "garbage."

The popular vote Nov. 4 favored Obama over Sen. John McCain by several percentage points. But because of the distribution of the votes, Obama is projected to take the Electoral College vote, when it is held in December, by a 2-to-1 margin.

Named as defendants in the action are Bowen, Obama, vice president elect Joe Biden and the long list of California party electors.

Citing the constitutional requirement that a president be a "natural born" citizen, the case discusses other state and federal court cases regarding "aspects of lost or dual citizenship concerning Senator Obama. Those challenges, in and of themselves, demonstrate Petitioners' argument that reasonable doubt exists as to the eligibility of the Democratic Party’s nominee for President," the case said.

"There is a reasonable and common expectation by the voters that to qualify for the ballot, the individuals running for office must meet minimum qualifications as outlined in the federal and state Constitutions and statutes, and that compliance with those minimum qualifications has been confirmed by the officials overseeing the election process," the complaint said, when in fact the only documentation currently required is a signed statement from the candidate attesting to those qualifications.

"Since [the Secretary of State] has, as its core, the mission of certifying and establishing the validity of the election process, this writ seeks a Court Order barring SOS from certifying the California Electors until documentary proof that Senator Obama is a 'natural born' citizen of the United States of America is received by her," the document said.

"This proof could include items such as his original birth certificate, showing the name of the hospital and the name and the signature of the doctor, all of his passports with immigration stamps, and verification from the governments where the candidate has resided, verifying that he did not, and does not, hold citizenship of these countries, and any other documents that certify an individual’s citizenship and/or qualification for office.

"To this date, in this regard, SOS has not carried out that fundamental duty."

The case said a simple attestation from the candidate or his party isn't sufficient.

"Historically, California Secretaries of State have exercised their due diligence by reviewing necessary background documents, verifying that the candidates that were submitted by the respective political parties as eligible for the ballot were indeed eligible. In 1968, the Peace and Freedom Party submitted the name of Eldridge Cleaver as a qualified candidate for President of the United States. The then SOS, Mr. Frank Jordan, found that, according to Mr. Cleaver's birth certificate, he was only 34 years old, one year shy of the 35 years of age needed to be on the ballot as a candidate for President. Using his administrative powers, Mr. Jordan removed Mr. Cleaver from the ballot. Mr. Cleaver unsuccessfully challenged this decision to the Supreme Court of the State of California, and, later, to the Supreme Court of the United States."

Similarly, in 1984, the Peace and Freedom Party candidate Larry Holmes was removed from the ballot.

The "certificate of live birth" posted by the Obama campaign cannot be viewed as authoritative, the case alleges.

"Hawaii Revised Statute 338-178 allows registration of birth in Hawaii for a child that was born outside of Hawaii to parents who, for a year preceding the child’s birth, claimed Hawaii as their place of residence," the document said. "The only way to know where Senator Obama was actually born is to view Senator Obama's original birth certificate from 1961 that shows the name of the hospital and the name and signature of the doctor that delivered him."

The case also raises the circumstances of Obama's time during his youth in Indonesia, where he was listed as having Indonesian citizenship. Indonesia does not allow dual citizenship, raising the possibility of Obama's mother having given up his U.S. citizenship.

Any subsequent U.S. citizenship then, the case claims, would be "naturalized," not "natural-born."

"Based on all of the above, it is the duty of the SOS to obtain proper documentation of Senator Obama's citizenship to confirm his eligibility for the office or the President of the United States," the case said.

Just this week, WND has reported on more than half a dozen other legal challenges have been filed in federal and state courts demanding Obama's decertification from ballots or seeking to halt elector meetings, claiming he has failed to prove his U.S. citizenship status.

Among the states where cases are being tracked are Ohio, Connecticut, Washington, New Jersey, Pennsylvania, Georgia and Hawaii, and there were reports of other cases being developed in Utah, Wyoming, Florida, New York, North Carolina, Texas, California and Virginia.

The United States is in a Constitutional and political crisis without precedent.

"What can ordinary Americans do when a large number of politicians are corrupt and an even larger portion of the national political leadership is complicit in a cover-up of that corruption?

Do we petition those leaders to investigate and punish themselves?

George Will, for whom I have great respect as a commentator, recently wrote a scholarly, but an unintentionally satirical article entitled “Is Obama above the law?” about his violation of the War Powers Act in regard to the Libyan War.

Mr. Will ended his commentary with what must have been deliberate satire:

“‘No president,’ says Sen. John McCain, ‘has ever recognized the constitutionality of the War Powers Act, and neither do I. So I don’t feel bound by any deadline.’ Oh? No law is actually a law if presidents and senators do not “recognize” it? Now, there is an interesting alternative to judicial review, and an indicator of how executive aggrandizement and legislative dereliction of duty degrade the rule of law.”

The evident bewilderment displayed by Will is prima facie evidence of the depth of denial now prevalent in Washington, D.C.

It is an equivalent to writing an article after the Pearl Harbor attack entitled “The Japanese might not like us.”

The arrogance of the permanent political class is both shocking and out of control.

Having been born in Panama and not eligible to run for the Presidency, McCain obviously doesn’t recognize the Constitution either.

For me, the uncertainty about McCain’s ineligibility was resolved by the bogus, non-binding Senate Resolution 511, co-sponsored by Obama, which declared McCain a “natural born citizen” and, therefore, eligible for the Presidency.

The fact that Congress has no authority to do such a thing was apparently completely irrelevant to that majestic body. Maybe I’m a cynic, but it sounds to me like just another crooked, backroom deal.

If McCain and Obama both didn’t need the “cover”, why go through that elaborate Senate charade?

Andrew Napolitano once asked South Carolina Congressman James Clyburn, the third-ranking Democrat in the House of Representatives, where in the Constitution it authorizes the federal government to regulate the delivery of health care.

Clyburn replied: “There’s nothing in the Constitution that says that the federal government has anything to do with most of the stuff we do.” Then he shot back: “How about [you] show me where in the Constitution it prohibits the federal government from doing this?”

Rep. Clyburn, like many in Congress, has conveniently forgotten that, according to the Constitution, the federal government has only specific enumerated powers.

As Mr. Napolitano correctly noted, Congress has gone from upholding the Constitution to evading it.

Basically, the permanent political class is saying to the American people: “we’ll do whatever we want and you prove that we can’t do it.”

That is exactly how Barack Obama has been operating and why no one in Washington, D.C. will challenge him.

Our political royals want the option of evading the Constitution or any law they deem inconvenient, like, most recently, what appears to be Congressional insider stock trading and the distribution of Obamacare waivers as political favors.

If the people at the highest levels of government believe that they can, whenever they wish, commit law evasion, what can ordinary citizens do?

We can hope that the cover-up surrounding Obama’s alleged crimes begins to unravel and honest, courageous and patriotic leaders step forward to root out those complicit, eliminate the endemic corruption and guide the country back on the right course.

Otherwise, left with no alternatives, open dissent will grow and chaos will ensue.

Barack Hussein Obama is going down, and with him much of the political establishment and the mainstream media (MSM). It is just a matter of time until someone cops a plea and a tidal wave of revelations destroys any credibility that might remain.

The election of Obama is prima facie evidence that the US government is broken.  
Many of our politicians and government officials were so intimidated by political correctness that they were too cowardly to challenge Obama regarding his eligibility or competence to hold the office of President.

Other politicians and government officials appeared to have actively colluded to undermine the Constitution. They are traitors to their oaths of office. So, the cover-up by the culpable continues. They stall and deny in order to save themselves. They are unconcerned about the rule of law, the condition of the country or the will of the people they pledged to serve.

Yes, it’s all about them, the personal power and privilege of a permanent political class.

"Since the controversy began over Barack Obama's failure to conclusively demonstrate his eligibility to serve as president, legislators in at least 15 states have attempted to pass bills that would clarify how a candidate must prove his constitutional eligibility to occupy the Oval Office, and all but one have been stalled, vetoed or shot down.

As WND has reported, there exists virtually no mechanism in the U.S. for investigating whether or not a presidential candidate meets the Constitution's Article 2, Section 1, "natural-born citizen" requirement.

Last year, New Hampshire became the only state to successfully sign into law a bill clarifying eligibility requirements.

But New Hampshire's H.B. 1245, signed into law by Democratic Governor John Lynch, merely requires a statement under penalty of perjury that a candidate meets the qualification requirements of the U.S. Constitution, similar to what the political parties already send to states regarding their candidates.

Most of the efforts of at least 14 other states were launched in January, only to be tabled, ignored or killed by March. Montana's bill, which requires a candidate for president or vice president to submit a certified copy of his or her birth certificate to Montana's secretary of state, was ruled dead in committee on April 28 – the day after Obama produced his purported long-form birth certificate.

But Jerome Corsi, author of "Where's the Birth Certificate? The Case that Barack Obama Is Not Eligible to be President," says Americans shouldn't view Obama's release as the end of the issue.

"State legislators are being hoodwinked by the White House to think that just because Obama has released a long-form birth certificate, the question of his eligibility to be president is over," Corsi told WND.

"Debate continues to rage over whether the birth certificate released on April 27 is a forgery," Corsi continued. "To date, the 'best evidence' of that document in a legal sense – namely, the original, 1961 long-form paper certificate – remains under lock and key in the vault of the Hawaii Department of Health. The U.S. should demand the original Obama birth certificate document submit to independent forensic testing before the question of its authenticity is put to bed.

"All it would take is one state to pass a tough eligibility law, and the continuing cover-up over the Obama birth records could be brought to an end," he concluded. "Failure to do so will simply convince millions of Americans that our state legislators lack the resolve to defend the Constitution."
