I have a friend Wink who was busted for pot (cops found seeds & residue in an ashtray - $200 fine and no jail time) in 1969 and wants to buy a handgun and get a carry permit. He lives in PA and the bust happened in PA. The forms that you have to fill out at both the gun shop and the Sheriffs office ask about drug-related convictions.

Does anyone know if this will affect his ability to get either the gun or the permit?

I don't think it would if it was a drug conviction.

Best he just buy it from someone he knows.

Having small amt of pot is a misdemeanor and I believe felonies prevent you from legally owning a gun or voting.

However, it will be on paper and when they come for the guns, whomever has guns on paper will be sought after first.

Yes you can still get one. It is only for felonys or if you have a domestic violence conviction.

BUT - you will be in the database.

Buy one at a gun show from a private person or ask around with your friends / family to see if they have one they don't want.

I called the Sherrif's office. They said it *may* stop the permit, but *my friend* could appeal. I also called the local gun shop. They had not heard of a drug conviction stopping a gun purchase, but also said there were forms for filing an appeal.

I know this isn't hardcore . . . just info.

Actually...I believe the law asks if you've been convicted of a crime with a jail term of 1 year or more (not actually served, just potential)

PA is one of the few grand prison states where even misdemeanors can get you more than 1 year in jail...so the answer is "it depends".

If it was a Felony, his only hope is to try to get a fed judge to expunge it from his record.
