Anti-Sanctuary City Bill Filed by Texas State Senator

A Texas state senator has filed a bill to “eliminate Sanctuary Cities in the State of Texas.” The bill will require local governments and law enforcement agencies uphold current immigration laws.
The filing of SB 4 by Senator Charles Perry (R-Lubbock) on Tuesday follows the announcement by Texas Lt. Governor Dan Patrick that ending sanctuary cities in Texas would be a priority for the 85th Legislative Session which begins in January 2017.

“No city in Texas should be allowed to ignore the law,” Governor Patrick stated. “We will end this practice once and for all this session.”

“By electing a Republican president and Republican majorities in Congress, the American people made it clear that solving our illegal immigration crisis must be a priority,” Senator Charles Perry said in a statement obtained by Breitbart Texas. “That starts by eliminating sanctuary cities, securing our border, and enforcing the immigration laws we currently have on the books. We cannot sit idly by and allow local policies to undercut efforts made at the federal and state level.”

Sanctuary City Migrants Protest Trump Nationwide

Pro-illegal immigrant groups across the country protested in major sanctuary city hubs to decry President-Elect Donald Trump’s upcoming Inauguration Ceremony. The sanctuary cities carry out policies to shield illegal immigrants from federal immigration law enforcement officials.

Protesters holding signs reading “Immigrant Rights = Workers Rights = Human Rights” and “No Muslim Registry,” marched in cities such as Los Angeles, California, Chicago, Illinois and San Jose, as the Associated Press reported, all of which have existing sanctuary city policies in place.

Senator Chris Van Hollen (D-MD) told a crowd at an anti-Trump protest in Washington D.C., “We are not going to allow Donald Trump to bury the Statue of Liberty.”

During a town hall event last night, House Speaker Paul Ryan was asked about illegal immigration, and he seemed to deviate from President-elect Donald Trump's platform.

Ryan agreed with Trump that sanctuary cities violate the law and they should not receive federal assistance.

As for the deportation of illegal immigrants, however, Ryan said, "It’s not happening."

Katrina Pierson, former spokesperson for Trump, and immigration attorney Francisco Hernandez discussed Ryan's comments on "The O'Reilly Factor" tonight, and things got pretty heated.

The very idea of a "sanctuary city" is traitorous.    If nothing else, it divides and creates separateness.  It should not be funded and I want my money back that has been paid on this outrageous idea.

Universities and colleges have reacted to President Donald Trump’s election by declaring their campuses safe zones from immigration authorities. The funding battle over sanctuary cities and other jurisdictions has intensified and expanded to “sanctuary campuses.”

Representatives in the U.S. Congress are fighting back, and state governments are gearing up for fights. After the President’s election in November, colleges and universities started declaring their educational institutions to be “sanctuary campuses” and “safe spaces” for illegal aliens, and they have been issuing resolutions that would actually prohibit campus police from cooperating with Immigration Customs Enforcement (ICE) and the U.S. Customs and Border Protection (CBP). Students at Sanford University in November were one of the first to march and demand that the university be used as a shelter for illegal aliens facing deportation, reported Breitbart News.

Breitbart Texas reported on January 3rd that Representative Andy Harris (R-MD) introduced the “Federal Immigration Law Compliance Act of 2016” (FILCA). He did so along with co-sponsors “from California to New York, to Florida,” according to his website.

Harris’ bill prohibits any entity from receiving federal funding that “does not comply with a lawful request for information or detainment of an alien made by an officer or employee of the Federal government who is charged with enforcement of the immigration laws from receiving additional funding.”

UC BERKELEY Poll:
74 Percent of Californians Want to End Sanctuary Cities

The vast majority of residents living in California would like to see sanctuary cities barred, a state home to multiple jurisdictions which refuse to abide by federal immigration laws.

Roughly 74 percent of California residents want to see an end to sanctuary city policies, according to a poll by UC Berkeley.

The issue to end sanctuary cities in the state crosses racial and party lines, with 65 percent of Hispanics registering their agreement, while 70 percent of independents, 82 percent of Republicans, and 73 percent of Democrats feel the same.

During President Donald Trump’s term, sanctuary cities could see a cut in federal funding and pushback from the Department of Justice under likely Attorney General Jeff Sessions.

if it defies President Donald Trump and stubbornly remains a sanctuary city.


Jen Budoff, budget director for the D.C. City Council, tweeted out Wednesday that Washington, D.C., receives more than $1 billion in federal money every year allocated to art grants, refugee resettlement and senior nutrition, among other items.

All of those funds and programs could be in jeopardy if D.C. continues its policy of being a sanctuary city. And D.C. Mayor Muriel Bowser reaffirmed her intention Wednesday evening to do just that.

The total amount remains unclear, as federal money can be filtered through state governments or granted directly to social-service organizations or other groups. The numbers do not include federal money for law enforcement, which was excluded in the executive order, and programs like Medicaid, which are administered by state governments.

Sally Hernandez (along with most of the city council) sickens me...I hope Abbot destroys her sorry butt...most likely the council will rally behind her, Abbot will cut funding, taxes will go up, and I'll be given a very good reason to move to Dripping Springs (which hopefully still has a majority of natives as opposed to rich Kalifornia liberals)

President Trump this week signed an executive order declaring war on so-called sanctuary cities. Agencies within the United States Government will begin withholding federal grant funds from those cities, and additional actions to enforce federal immigration law will be taken soon.

Unlike Obama, President Trump is not trying to making new laws by executive decree. In his Executive Order, the president is only reminding mayors and governors of existing federal law dating to 1996:

A thicket of U.S. Supreme Court rulings could limit the reach of the executive order issued by President Donald Trump last week meant to prod “sanctuary cities” into helping the federal government enforce immigration law.

Some local and state officials, including in New York, have promised to fight the order, which says cities that fail to turn over information about illegal immigrants “are not eligible to receive federal grants.”

Legal experts said the Supreme Court has given them many tools for resistance.

The court has ruled that the U.S. Constitution bars the federal government from commandeering state officials or using federal funds to “coerce” states into doing the bidding of Washington.

Texas Governor Deprives Sanctuary County Of $1.5 Million Grant

Texas Republican Gov. Greg Abbott cut off state funds to a county that provides sanctuary to illegal immigrants Wednesday, following through on an earlier pledge to punish such sanctuary cities and localities.

Travis County will no longer have access to $1.8 million in state criminal justice grants, Abbott announced in a letter to county officials, because of a new sanctuary policy implemented by the county sheriff. The policy at issue instructs staff at the sheriff’s department to release illegal immigrants booked in the local jail rather than assist the federal government in deporting them, unless they have been charged with murder, aggravated sexual assault or human smuggling.

Stiffer penalties coming soon,”
Abbott added in a tweet Wednesday.

Texas Sheriff Releases 39 Criminal Aliens in
First Two Days of Sanctuary Policy

Despite the loss of state law enforcement grants, Travis County
Sheriff Sally Hernandez followed through and released 39 criminal
aliens
during the first two days of her sanctuary policy.


Records obtained by Breitbart Texas from the Travis County Sheriff’s Office revealed that “Sanctuary Sally” released 37 criminal aliens from custody on February 1. Two more criminal aliens were released on the following day. The sheriff’s office stated that Sheriff Hernandez declined 191 immigration detainers that were received by her office before February 1. Eight more immigration detainers received after February 1 were also declined. The sheriff also declined four requests from immigration officials to be notified of the pending release of the criminal aliens in her custody.

Sheriff Hernandez did not refuse all requests from U.S. Immigration and Customs Enforcement officials. Thirty immigration detainers that were received by her office before the February 1 change in policy were honored by the office. The sheriff accepted three immigration detainers that were received after her policy went into effect on February 1. She also accepted two requests for notification of pending release.

Immigration attorneys and activists around the city expressed concerns
today (Feb. 2) about the potential of an “active” U.S. Immigration and
Customs Enforcement (ICE) operation in Travis County.


The threat of increased enforcement follows an immigration ban executive order issued last Friday by President Donald Trump and growing tensions over discordant “sanctuary city” policies between Travis County Sheriff Sally Hernandez and Texas Gov. Greg Abbott. Hernandez pledged to not comply with noncriminal ICE requests, with some exceptions, a policy that went into effect on Wednesday, Feb. 1. In a vindictive display of political payback, Abbott cut off funding of a $1.5 million criminal justice grant to Travis County.

According to the Immigrant Services Network of Austin, which published a news bulletin on Wednesday about the rumored raid, ICE has reportedly deployed four teams of five to 10 officers in Travis County. The federal agency is allegedly lodging detainers for any foreign-born individual in a county jail, and are detaining and arresting people who have criminal warrants or outstanding orders of removal. (DACA, deferred action, pending U visas, and stays of removal aren’t being targeted at this point, though that could change.) “Be careful,” warned the local network.

I would like to see it be a federal criminal offense for politicians, government authorities, or individuals to knowingly harbor illegal aliens.  “Punishment” for the cities in the form of fines really doesn’t mean anything to the folks who are implementing “sanctuary city” policies.  Fines do though mean that those of us who object to such policies get our taxes raised, or services cut, for something we objected to anyway.

In a new Rasmussen poll, only 35 percent of Americans said they would like to live in a community that declared itself a “sanctuary city” while 52 percent would not. Some 14 percent were on the fence.

    New York City: 525,000.

    Boston: 35,000.

Miami-Dade County ended their sanctuary city policy shortly after Trump's inauguration. Some cities, such as San Diego, have claimed they never were sanctuary cities, but the Center for Immigration Studies states otherwise.

Only 11 of the 20 metropolitan areas listed had the data available to determine the number of illegal immigrants in each individual city.

Approximately 61 percent of illegal immigrants in the country reside in the 20 metropolitan areas listed by Pew, highlighting the danger of sanctuary cities, since there is a crime problem stemming from illegal immigration.

Attorney General Jeff Sessions urged sanctuary jurisdictions to reverse their policies Monday as the Department of Justice will begin to “claw back” federal grants from places that ignore immigration detainers.

Sessions highlighted a recent report from the Department of Homeland Security that showed more than 200 instances of jurisdictions failing to honor detainers in the span of just one week.
The DHS also identified sanctuary jurisdictions in the report, which included New York City and all of Rhode Island’s state prisons.

The report detailed illegal immigrants who had been charged with sex crimes and murder that local jurisdictions failed to turn over to Immigration and Customs Enforcement. “The American people are not happy with these results,” Sessions said while speaking at the White House.

Over 100 jurisdictions, from Manhattan to Malibu, refuse to assist federal law enforcement in their immigration law enforcement duties, especially as to criminal aliens arrested for crimes here in the United States but released before federal law enforcement can detain and deport.

These governments labeled themselves “sanctuary” cities,
but a better label would be secessionist cities.

The legal argument the “sanctuary” cities rely upon bears merit, but they misuse and abuse the doctrine behind it. The “anti-commandeering” doctrine found one of its most articulate voices in Justice Scalia. The doctrine best distilled is this: “even where Congress has the authority under the Constitution to pass laws requiring or prohibiting certain acts, it lacks the power directly to compel the States to require or prohibit those acts.” The feds cannot shift enforcement to local government. That same doctrine makes the current path of defunding sanctuary cities a legally rocky road, especially in the current judiciary environment.

Where did the Second Circuit look for precluding lawless, secessionist minded municipal government going rogue against appropriate federal law and respect of federal elections? Brown v. Board of Education, the most famous and celebrated case in Supreme Court history.

As the Second Circuit properly summarized: the sanctuary city argument “asks us to turn the Tenth Amendment’s shield against the federal government’s using state and local government to enact and administer federal programs into a sword allowing states and localities to engage in passive resistance that frustrate federal programs,” including those programs of unique federal provenance and priority, such as immigration. Such actions could cause federal programs to “fail or fall short of their goals,” force the federal government to “restore to legal processes in every routine or trivial matter,” and invite “a refusal by local government to cooperate until a court order to do so.”

As the Second Circuit further noted: “A system of dual sovereignties cannot work without informed, extensive and cooperative interaction of a voluntary nature between sovereign systems for the mutual benefit of each system. The operation of dual sovereigns thus involves mutual dependencies” that can hardly survive as separate, antagonistic sovereigns. “Without the Constitution, each sovereign could, to a free, hold the other hostage by selectively withholding voluntary cooperations as to a particular program.” That is why the Supremacy Clause “bars states from taking actions that frustrate federal laws” in those areas of law the Constitution empowers the federal branches of government, like immigration. As the Second Circuit concluded almost two decades ago in undisturbed law: “states do not retain under the Tenth Amendment an untrammeled right to forbid all voluntary cooperation by state or local officials with particular federal programs.”

This opens the door to a complimentary, alternative option: formally funding cities, counties, and states that assist with enforcement of immigration laws against criminal and potentially dangerous aliens, a power all courts recognize Congress and the President enjoy. This parallel strategy employs the carrot rather than the stick, but avoids the traps of the deep state allies and their secessionist city friends in the federal courts, much as federal funding of integrated schools acted as a deterrent to less-funded segregated classrooms.

Seattle Files Lawsuit Over ‘Sanctuary Cities’ Funding Threat

The city of Seattle on Wednesday announced a federal lawsuit over the Trump administration's threat to withhold federal grants to so-called "sanctuary cities," citing the 10th Amendment that deals with states' rights.

"Apparently the Trump administration, their war on facts, has now become a war on cities," Seattle Mayor Ed Murray said.

He said the goal of the suit is to have a
judge declare the order unconstitutional.

On Monday, Attorney General Jeff Sessions said the Justice Department would require cities seeking some of $4.1 billion available in grant money to verify that they are in compliance with a section of federal law that allows information sharing with immigration officials.
