Doctors Sue Obama Administration for Forcing Them to Perform
 Gender Transition Procedures

Five states and a group of religiously-affiliated hospitals and physicians are suing the Obama administration over a federal mandate that forces doctors to perform gender transition procedures on adults and children against their medical judgment.

The lawsuit, filed Tuesday in a Texas federal court, attempts to roll back a rule imposed by the Department of Health and Human Services in May that expanded the interpretation of “sex” under the Affordable Care Act to include “gender identity.”

In doing so, the Obama administration added transgender people to the list of protected classes under the Affordable Care Act, which states that individuals can’t be denied certain federally-funded health benefits because of their “race, color, national origin, sex, age, or disability.”

The move was part of a broader push by President Barack Obama to further transgender rights in the U.S.

The implications of the HHS mandate are broad. By its own estimates, HHS said the rule would “likely cover almost all licensed physicians because they accept federal financial assistance.”

For example, HHS said a doctor “specializing in gynecological services that previously declined to provide a medically necessary hysterectomy for a transgender man would have to revise its policy to provide the procedure for transgender individuals in the same manner it provides the procedure for other individuals.”

“It’s a very rare moment in history when the government would force doctors to go against their conscience and their medical judgment and perform procedures that may be deeply harmful to patients,” said Luke Goodrich, a lawyer at the Becket Fund, which is representing Franciscan Alliance, a religious hospital network, and the Christian Medical and Dental Associations, two of the parties involved the lawsuit.

Also challenging the HHS mandate is Specialty Physicians of Illinois, along with the states of Texas, Wisconsin, Nebraska, Kentucky, and Kansas, which are all led by Republican governors.

Notably, the Obama administration does not require coverage of gender reassignment procedures under Medicare or Medicaid for children or adults because a government review of the clinical evidence available for gender reassignment surgery was inconclusive on whether it was helpful or harmful to patients with gender dysphoria.

“Based on a thorough review of the clinical evidence available at this time, there is not enough evidence to determine whether gender reassignment surgery improves health outcomes for Medicare beneficiaries with gender dysphoria,” a report from the Centers for Medicare and Medicaid Services stated.

Instead, decisions for transition-related surgeries under Medicaid are made individually on a case-by-case basis.

“So you have doctors reaching one conclusion, and then you have politically zealous bureaucrats in the Office of Civil Rights—a different branch of HHS—saying science be damned, every private health care provider in the country has to cover this stuff in their health insurance and the doctors have to perform it,” Goodrich told The Daily Signal.

“It’s deeply hypocritical.”

The lawsuit challenging the HHS mandate was filed in the U.S. District Court for the Northern District of Texas, which is the same court that temporarily blocked the Obama administration’s bathroom mandate on Sunday. In putting a halt to the policy that mandates public schools must open their restrooms, locker rooms, and showers to transgender students based on their gender identity instead of their biological sex, U.S. District Judge Reed O’Connor argued the administration overstepped its authority.

When HHS issued the new gender identity rule on May 18, the agency cited as authority the Obama administration’s bathroom mandate, whose legitimacy is now in question.

In the HHS mandate case, plaintiffs argue that the Obama administration curtailed the voice of the people in issuing such sweeping regulations, and didn’t follow standard rulemaking procedures under the Administrative Procedure Act and multiple other federal laws. This argument is similar to the one brought by the 13 states challenging the Obama administration’s bathroom mandate in the same Texas court.

Plaintiffs are also arguing that the HHS rules violate doctors’ ability to exercise their best medical judgement and their religiously-inspired desire to care for patients.

“The new mandate forces doctors to perform gender reassignment procedures on individuals including young children, even when those procedures may be physically and emotionally harmful and may violate the doctors’ faith and medical judgment,” Goodrich said. “These organizations care for transgender individuals all the time in lots of different respects but they cannot in good conscious or in their own medical judgment do procedures that would be harmful, so they felt like they had to get relief from the new regulation.”

Jillian Weiss, executive director of the Transgender Legal Defense and Education Fund, suggested the lawsuit against HHS was unnecessary in a statement to The Associated Press.

“The only thing a doctor is obliged to do is treat all patients, including trans patients, with dignity and respect and to make treatment decisions free from bias,” Weiss said. “If a doctor has a sound, evidence-based, medical reason to delay transition care for a specific patient, that would be respected under the regulations.”

The Daily Signal sought comment from the Transgender Legal Defense and Education Fund, but they could not be reached.

The Daily Signal also contacted HHS, which refused to comment. HHS referred The Daily Signal to the Department of Justice, which also chose not to make a statement.

Here's a good anecdotal for you!  And...you can't make this stuff up!!
A 25 y.o. woman I know is covered on her parent's health insurance plan,
for their small business.   This 25 y.o. became pregnant only to find out
the health insurance plan does NOT cover pregnancy, delivery, anything
related to the "Baby" .   Insurance will pay nothing for any of the
Obstetrics visits, blood labs, delivery, Dr.'s  - not a dime, nothing is paid
and this woman is scrambling to get on a new health insurance plan ASAP
or she'll end up paying 100% out of pocket costs for all her maternity costs,
and delivery costs at the hospital. 

If it sounds like a good "affordable priced insurance plan"  you better
independently investigate everything for yourself!   Though my  husband
and I are getting royally screwed every month with $976 being docked out
of the paycheck   every month  and our high deductible of $6,850
per each of us,  the crap care plan we have is actually not that bad these days
compared to what people are getting on the exchange and we didn't have to
give up tons of personal, financial information and then risk all of our
identifying information gets hacked on the exchange.   Plus I don't have to
ask "Mother may I " to see specialists .  (I don't need a referral) and that
in itself can be life saving if one of us is really, really sick and needs to
see a specialist ASAP.   I just make an appointment with one and go!
That in itself is worth some money, rather then have to find a dr. in ones'
"network". 

This whole B.S. forced illegal health care has got to go!  If I posted the
out of pocket expenses we're racking up to "meet our deductible" why even
have friggin health insurance, the insurance companies have gamed it to
unless you end up in the emergency room... you'll never meet your deductible
in a calender year and you'll be so freaking broke all the time paying everything
out of pocket and RX's do not count towards ones' deductible,  you had better
be frugal and a minimalist because there is no money left in the budget for
the bare bone basics , let alone a new pair of socks....  !!!!!!!!!!!!!!!!!

Medical expenses or food,  I take food, medical expenses or rent/mortgage ( not me ) but I'd pay the latter, medical expenses or utility bill, yup, utility bill.    "But your credit blah blah"  I pay cash.            I got medicare that's it and probably  huge medical bills(forthcoming ) it'll be 10 bucks a month, if they nice. with a BIG period.            Any questions?

decemberfellow, make sure the hospital can't put a lien
on your house.  Even in personal bankruptcies , the hospital
is in "1st Position" over everyone to be paid.  Even if you
have to sign a  "quit claim deed" into your son's name, or
your wife's name to where it shows you own no tangible
property and do tons of research if this may be the case
in the future for you.    I'm talking at the keyboard here
and hope you don't get royally screwed at exorbitant
prices for the E.R. bill forthcoming.   I've gotten one of
those myself...

My husband will not let me drop myself off the plan and
take the illegal monetary penalty from the IRS.  I just
cut a check today for $1,183   and that total isn't even
scratching the surface to a medical place for my husband.
I'll be cutting lots and lots and lots of checks up until
November 10th of this year, then hopefully our nightmare
healthcare expenses will be over with.   And...as it would have
it the deductible annual period ends on 12-31-2016.

We just had bad news fall in our laps 3 weeks ago, but it's
nearing the end of this health nightmare for him and the
2 surgeries he has scheduled soon is mop up damage from
a so called specialist that almost killed him coming up a year ago.
Yeah, under the care of a specialist, by the time I got him to the
emergency room,  he was 48 hours from death.   No kidding.
We had no idea 3 weeks ago he needed one, let alone two surgeries.

I know what your wife is going through, the worry factor when
you had your health emergency.  Only the wives that truly love
their husbands worry and stress out.   I'm still stressed out, but I
can see the light at the end of the tunnel. 

This forced illegal health care and the high prices that medical places,
labs, hospitals, dr.'s , RX's are charging is almost like it's trying to cull
the herd on people who can't afford to see a dr. and it's almost like
they want to get everyone so broke they go on the system.   Our
preps are seeing us through right now, I won't be walking into a
grocery store anytime soon.    Preps have always seen us through :)

Windy  Thanks we are pretty covered against any grab,(names on titles) etc. and pa law as of now:  an honest attempt at meeting obligations for any expense is held up as hardship payment as long as no payment missed. If it went that far would probably cost me 100 a month at most.( of course based on income)and mine is very little ;) barterer benefit?

The Obama administration is bragging that we are now down to 29 million uninsured because of ObamaCare. On September 9, 2009, President Obama was citing the need for ObamaCare by saying there were 30 million who couldn’t get coverage. The highest number I ever saw was 48 million (which included illegal immigrants), so the highest number of people helped could be around 19 million or 6% of the population. Why would anyone write an over 2,000-page law with 20,000 pages of regulations and over 20 new taxes that took away choice for 100% of us to help a small percentage of the population?

By inflating the initial number of uninsured the Obama Administration, Democrats and the media get to pretend they helped a lot of people.

I also looked up Medicaid and found that 51 million were on Medicaid in 2009 and there are over 70 million on Medicaid today, so arithmetically any people helped just went to Medicaid.
Instead of punishing 100% of us they should have just expanded Medicaid and the high-risk pools. They should obviously repeal the whole law and make a couple changes to what existed prior to ObamaCare and then we would again get to keep our own doctor and insurance as we were promised.

We have seen people that like the President’s agenda cook the books before. NASA, NOAA and scientists have manipulated previous temperature data to pretend that temperatures rise more than they do. Yesterday, just a couple months prior to the election, all of a sudden in 2015 median family income shot up and poverty rates moved down significantly. Those numbers seem extremely odd considering that Federal Income tax revenues are slowing, the federal deficit is rising, the labor participation rate is at a 38 year low, home ownership rates are at a 51 year record low, interest income on savings, retirement accounts and CD’s is extremely low and has been falling for eight years, car sales and retail sales are slowing and studies show that over 60% of people don’t have $1,000 for an emergency.

Social Security recipients are receiving a 3/10’s percent increase for 2017 after a zero increase in 2016. Fifteen million more people are on food stamps today than in 2009 and 20 million more on Medicaid.

Does it make any sense that all of a sudden median income shot up over 5% and poverty all of a sudden dropped, along with the above statistics? Of course the media just repeat the numbers without doing actual research. It is easy to manipulate numbers when they are all based on sampling with adjustments. It would be nice if the media did actual research instead of reporting talking points supporting a specific party and agenda. Otherwise reporters are worthless. Our freedom is at stake.

I did read the best description I have seen on ObamaCare so far: We remember when Nancy Pelosi said “we have to pass it to see what’s in it.” A physician called into a radio show and said, “that’s a definition of a stool sample.”

That forces them to raise rates, driving away healthy, profitable customers.

Facing more losses, they raise rates again, causing more healthy people to leave, and so on -- until all that’s left are high premiums and a small pool of the unwell.

New IRS disclosures from the 2014 tax year reveal the specifics of how the so-called “Affordable Care Act” helped to facilitate Obama’s desire to, as he famously told “Joe the Plumber”, “spread the wealth around.”  To be precise, in 2014, Obamacare spread $11.2BN of wealth around, in the form of healthcare premium tax credits, with nearly 80% going to taxpayers reporting less that $35,000 of adjusted gross income.  Moreover, the average tax filer received $3,600 of healthcare premium support with those in the lowest tax bracket receiving over $5,500 per person.

Equally disturbing is the fact that 8.1mm tax filers, those who elected to forgo health insurance, were hit with $1.7BN in Obamacare penalties…call it the “young and healthy tax”.  Ironically, 40% of the penalties fell upon people making less than $35,000 per year…the very same people that Obama apparently intended to “help”.

Here’s how the subsidies and penalties broke down by tax bracket (the original IRS table can be found here)




Of course, the real tragedy of Obamacare is that even if those 8.1mn young and healthy people wanted to buy health insurance, many of them have now likely been priced out of the market as premiums have soared and coverage “options” have vanished as insurers have pulled out of exchanges all over the country (something we discussed at length in a post entitled “Obamacare On “Verge Of Collapse” As Premiums Set To Soar Again In 2017“).  In essence, while the bill has seemingly “helped” the 3.1mm people receiving subsidies in the chart above it has trapped the 8.1mm young and health people with a permanent tax increase as they are now even less likely to buy health insurance after Obamacare has driven up the rates astronomically.

But, of course, the Obamacare penalties will only get even worse from here.  According to The Washington Free Beacon, in 2014, uninsured individuals were required to pay the greater of either a flat penalty of $95 for each uninsured adult or 1% of their household’s adjusted gross income.  That said, the penalties are set to increase in 2016 to the greater of a flat fee of $695 or 2.5% of AGI.  According to the Congressional Budget Office, taxpayers are expected to pay penalties of $4BN in 2016 and $5BN annually from 2017 through 2024.

Senator Tom Cotton (R-Arkansas), also pointed out the irony in the fact that Obamacare is now penalizing many taxpayers who can no longer afford healthcare simply because Obamacare itself has driven up premiums to such an extent they’ve been rendered completely unaffordable.

    “It’s not surprising that the Obamacare mandate numbers are worse than the administration first claimed,” said Sen. Tom Cotton (R., Ark.). “Obamacare penalizes taxpayers who can no longer afford insurance that Obamacare made unaffordable.”

    “As Obamacare continues to unravel, things will only get worse,” Cotton said. “The legacy of Obamacare is skyrocketing premiums, unaffordable deductibles, the destruction of the individual insurance market, and tax penalties on Obamacare’s victims.”

An architect of the federal healthcare law said last year that a “lack of transparency” and the “stupidity of the American voter” helped Congress approve ObamaCare.

He suggested that many lawmakers and voters didn’t know what was in the law or how its financing worked, and that this helped it win approval.

Obamacare is now such an obvious failure and disaster, even some of its staunchest Democratic supporters can longer deny reality.

The Star Tribune reports:

    ST. PAUL, Minn. — Minnesota’s Democratic governor said Wednesday that the Affordable Care Act is “no longer affordable” for many, a stinging critique from a state leader who strongly embraced the law and proudly proclaimed health reform was working in Minnesota just a few years ago.

    Gov. Mark Dayton made the comments while addressing questions about Minnesota’s fragile health insurance market, where individual plans are facing double-digit increases after all insurers threatened to exit the market entirely in 2017. He’s the only Democratic governor to publicly suggest the law isn’t working as intended.

    “The reality is the Affordable Care Act is no longer affordable for increasing numbers of people,” Dayton said, calling on Congress to fix the law to address rising costs and market stability.

    Few states have embraced the health care law more strongly than Minnesota under Dayton. Lawmakers created a state-run online market exchange for people who aren’t covered by employers or public programs to buy individual coverage. When those policies first went on sale in 2013, Dayton and state officials touted the lowest health insurance rates in the nation.

    But after several years of steadily increasing premiums, top state regulators said this fall that Minnesota’s individual market is in “a state of emergency.” The state scrambled to stop all seven companies that sell insurance directly to consumers or through the state exchange, MNsure, from fleeing for 2017, but the state’s largest insurer, Blue Cross Blue Shield of Minnesota, is still exiting.

    Health care insurance shoppers will see premium increases that range from 50 percent to 67 percent on their plans for next year.

    Across the nation, insurers have sought double-digit premium increases while major companies — including Aetna and UnitedHealth — have pulled out of many state-based exchanges for 2017 after forecasting heavy financial losses. The Obama administration portrays the premium increases as a one-year market correction that can be absorbed or offset by larger financial help through tax credits.

Of course, the disastrous U.S. healthcare system hit very close to home for me recently, something I discussed in the post, Thanks Obama – My Healthcare Plan Was Just Canceled. In it, I noted:

    As much as I didn’t like my healthcare plan, I was planning on keeping it. Until I received a letter telling me I couldn’t from United Healthcare. Indeed, they weren’t too subtle about the entire thing, making it perfectly clear what was about to happen.



    Not exactly the best way to start your week. As I proceeded to flip though the 10 page letter, I was directed to what United Healthcare deemed to be a comparable plan for me in 2017. Here’s how that plan compares to my current plan.

    Premium payments: +30%
    Per person deductible: +160%
    Per person out of pocket maximum: +4.5%
    Primary physician copay: +85%
    Specialist copay: +115%
