Arizona Sheriff Joe Arpaio to Appeal Judge's Finding His Department Engaged in Racial Profiling
By ALYSSA NEWCOMB (@alyssanewcomb)
May 25, 2013

Sheriff Joe Arpaio's attorneys said today they plan to appeal a federal judge's finding that the Maricopa County Sheriff's Office, helmed by Arpaio, racially profiled Latinos while on immigration patrols.
...
Casey said the Maricopa County Sheriff's Office would appeal the judge's ruling in the next 30 days.

The lawsuit was brought against the department by a group of Latinos who alleged they were racially profiled by Arpaio's deputies for the purpose of immigration status checks.

The group did not seek monetary damages in the lawsuit and instead asked for a judge to declare the Maricopa County Sheriff's Office had engaged in racial profiling and to order policy changes.

"We were looking for a declaration from the court that these are unconstitutional practices as an important first step in stopping those practices," said Don Pochoda, legal director for the American Civil Liberties Union, which has championed the case.
...
U.S. District Court Judge G. Murray Snow wrote that "the evidence introduced at trial establishes that, in the past, the MCSO has aggressively protected its right to engage in immigration and immigration-related enforcement operations even when it had no accurate legal basis for doing so."

Sheriff Joe Arpaio in court over profiling case in Arizona
Associated Press
By JACQUES BILLEAUD

PHOENIX (AP) — A hearing began Tuesday to decide whether an Arizona sheriff should be held in contempt of court for violating a judge's orders in a racial profiling lawsuit that stemmed from his aggressive immigration patrols in Hispanic neighborhoods in metro Phoenix.

The four-day civil proceedings got underway in a packed courtroom that included immigrant rights activists and critics who have tangled with Maricopa County Sheriff Joe Arpaio in the past

...

The hearing marks the boldest attempt yet to hold Arpaio personally responsible for his actions, and it could lead to fines and other sanctions against his office. Snow also has said he intends to launch a criminal contempt case that could expose the sheriff to jail time.

The normally defiant Arpaio has acknowledged disobeying the judge's order that found his deputies racially profiled Latinos. He also has accepted responsibility for his agency's failure to turn over traffic-stop videos in the profiling case and bungling a plan to gather such recordings from deputies once some videos were discovered.

The sheriff's lawyer, Michele Iafrate, emphasized that the violations were not willful or intentional. "It's a culture we are attempting to fix," she said.

Arpaio has proposed offering a public apology and making a $100,000 donation to a civil rights organization from his own pocket to call off the hearing, but the judge rejected the request because it didn't resolve the contempt case.

It's unclear whether Arpaio's legal troubles are signaling an end to his 22-year political career. His political strength has been gradually declining over the past four election cycles, but his base of devoted supporters and impressive fundraising help him pull out wins.
...
State Sen. John Kavanagh, a friend and supporter of Arpaio, questioned whether the contempt hearings would make Arpaio politically vulnerable.

"I am disappointed," Kavanagh said, "that one of the few law enforcement officials who went after illegal immigrants is being penalized for it."

In a verdict filed Monday morning, U.S. District Judge Susan Bolton said evidence demonstrated Arpaio’s “flagrant disregard” for another federal judge’s order that halted his signature immigration round-ups.

What goes around comes around I guess. The guy took pride in feeding his police dogs better then inmates not even convicted yet.
Some people who sat in jail for a year, being fed worse than dogs, wearing a pink jumpsuit, and probably held outside for a considerable amount of time, over a felony marijuana case for one stem on the floor of their car, are laughing their a***s off. Unconstitutional actions by the courts? Maybe. But don't feel any sympathy for this sick son of a b***h.

They wore pink underwear, not jumpsuits.  Even their worst food was a lot better than normal prison food.  If they didn't eat it, they must not have been very hungry.

It's my understanding that ex-inmates wore pink in honor of him and the change in their lives.

Their terms were for a year or less in the tent camp.  The tents were actually very nice.

WHITE HOUSE PREPARES ARPAIO PARDON FOR TRUMP’S SIGNATURE - Will Trump travel to Phoenix rally on Tuesday without pardoning Arpaio?

Quote
On July 31, U.S. District Judge Susan R. Bolton found Arpaio guilty of misdemeanor criminal contempt in an opinion she could have written her opinion before the trial even started – an opinion that made clear her prejudice from the start that Arpaio was guilty of misdemeanor civil contempt guilty conviction.

It makes me so happy about Joe Arpaio!  It's really a treat I thank Alex for, to have Joe Arpaio on right after the rally :)

Indeed, it would be good if Trump had Roger Stone & Joe Arpaio around to break the wall that is surrounding him.  At least he would have some honest viewpoint without an agenda except Trump's own agenda.

Three cheers for Trump!  What a fantastic rally in Phoenix.  He really came through once he got going.  His true self shows and I trust him.  Even with Afghanistan, at this point, I still trust.  Time will tell.

In the meantime we have a President who does the right thing! wow

PLOT UNCOVERED TO DERAIL ARPAIO PARDON BY SLOWING TRUMP DOWN -Why Trump needs to pardon Arpaio now

https://www.infowars.com/plot-uncovered-to-derail-arpaio-pardon/

Quote
The problem is that according to federal pardon rules and regulations, if Bolton is allowed to hold the sentencing hearing, Arpaio would have to wait five years before being eligible for a presidential pardon.

Moreover, sources close to Sheriff Arpaio, including his legal team, have advised Sheriff Arpaio that Judge Bolton, aware now that President Trump want to pardon Arpaio, has nothing to lose by imposing a jail sentence and demanding that Arpaio begin serving the jail sentence immediately.

All this ignores the abundant evidence that Arpaio is the victim of an Obama Department “revenge prosecution” because he attempted to enforce immigration laws the Trump administration wants enforced.

TRUMP NEEDS TO DO THIS NOW!

Such great news!  It was the right thing to do -- unlike the persecutory, unconstitutionally-operating court.  Shame on those courts & judges.  Arizona needs to see them go right away.

I wonder if Trump has looked into the Bundy case both in Nevada & Oregon.

President Trump pardons former Sheriff Joe Arpaio

President Trump on Friday pardoned former Maricopa County, Arizona, sheriff Joe Arpaio.

“Sheriff Joe Arpaio is now eighty-five years old, and after more than fifty years of admirable service to our Nation, he is [a] worthy candidate for a Presidential pardon,” the White House said in part in a press release.

At a speech at the Phoenix Convention Center Tuesday night, Trump suggested he would consider pardoning Arpaio in the near future, and received overwhelming support from the crowd.

Joe Arpaio, 85, was convicted earlier this month of misdemeanor contempt of court for disregarding a court’s 2011 decision to make it illegal to conduct traffic patrols based on immigration and ethnicity alone, in a case he called a “witch hunt.”

Earlier this week, Arpaio spoke to a local news outlet, who tweeted out that the former sheriff was honored to have the public support of the president.

“#JoeArpaio just told me he’s humbled by @realDonaldTrump words.
He did not know it was coming but he had a feeling,”
tweeted Fox 10 Phoenix Reporter John Hook.

Known as the “toughest sheriff in America,” Arpaio became a flashpoint in the immigration debate, as activists on the left made him the poster man for policies that were accused of being bigoted and discriminatory.

Ok, this is really going back US AG Jeff Sessions; why oh why is there anyone in the DOJ that supports Obama and his criminal gang, he can fire all these attorneys and this Judge is a hack and needs to have some repercussion rain on her.
But just to say again Sessions is the Elmer Fud of the Trump administration, what a waste, he more interested in putting people in jail for pot than treason.

The city manager and the police chief of Phoenix met with leaders of the ACLU and the
organization’s anti-Trump grassroots activist group People Power before the Arizona capital
became a sanctuary city for illegal aliens last month.

The Phoenix Police Department confirmed to WND the conclusion of the watchdog group Judicial Watch that records it obtained from the department document the influence of the ACLU and People Power on the relatively abrupt change in policy.

A police spokesman downplayed the importance of their role.

“Many community groups and individuals were consulted and provided perspective during the revision of our operations orders. This is common to ensure we are hearing the expectations of our community,” Sgt. Jonathan Howard wrote in an email reply to WND.

Asked in a follow-up whether or not ACLU and People Power were leaders in the effort, as they boasted in a tweet, Howard repeated his statement: “Many community groups and individuals were consulted and provided perspective during the revision of our operations orders.”

Important changes to the policy include:

√ Officers are now prohibited from asking victims and witnesses of crime about their immigration status;
√ Officers are now barred from asking students about their immigration status and from calling U.S. Immigration and Customs Enforcement (ICE) while on school grounds;
√ Officers are prohibited from holding a person for longer than it takes to address the purpose of the stop (e.g., speeding) in order to verify immigration status;
√ Officers are now required to receive approval from a sergeant before contacting ICE; and
√ The Phoenix Police Department is finally required to keep records and data on all contact with ICE.

Just weeks before the July 24 policy change, a closed-door session between Phoenix Police Chief Jeri Williams and Will Goana, policy director for the American Civil Liberties Union of Arizona, took place, according to the records. The meeting was followed by sessions with People Power representatives.

The surprise decision from U.S. District Judge Arthur Schwab found the executive action violates the Constitution’s separation of powers and the Constitution’s requirement that the president “take care that the laws be faithfully executed.”

The executive action, announced in November, allows about 4 million people living in the U.S. illegally a path to avoid deportation.

People who only listen to soundbites from the lying media will never know the truth!

If the mainstream media would do its job in an honorable manner, the public would not be so uninformed! Since the media refuses to tell both sides, or show any honor, that requires us to do much research to find the truth.

Look into Obamas lawlessness when it comes to the illegal problems. He, and his pathetic failed party, enabled the lawlessness. He even bused illegals to communities all over USA without even telling Governers, then expected taxpayers to fund them. Inexcuseble!

The illegal immigrant problem belongs at the feet of the lawless President Obama and crew. Thats who gets the blame!

According to the DOJʼs Civil Rights Division, from 2009 to 2012, it opened 15 policing investigations, issued eight letters of misconduct, and reached 10 agreements for comprehensive reform of police departments.

Its best-known case involves the Maricopa County, Ariz., Sheriffʼs Office. That investigation was from 2009 to 2012.

Were these two Sheriffs the only ones who stood like men? Did the other 13 being investigated cave to DOJ  pressure?

TRUMP DID THE RIGHT THING. HE KNEW THIS WAS A PURELY POLITICAL MOVE AND THIS PROVES IT!

McCain: Presidential Pardon of Sheriff Arpaio ‘Undermines’ Trump’s ‘Respect for Rule of Law’ (John shows his globalist colors once again)

Both Arizona Senators, John and his minion Flake, are for open borders just like Dems. Oh and you saw Mccain vote with Democrats against repeal of Obamacare. They need to lose their jobs. Arizona needs to smarten up.

An Overview of the Presidential Pardoning Power

https://fas.org/sgp/crs/misc/RS20829.pdf

Quote
... the President's authority to grant pardons is essentially unfettered.3 For instance, a pardon may be bestowed at any time after the commission of an offense, irrespective of whether charges have actually been pressed. Also, a pardon may be issued subsequent to conviction and during the service of sentence. Additionally, a pardon may be granted after a sentence has been served, in order to restore the civil rights of the individual in question.4
