KMOV anchor Larry Conners, who claimed he was targeted by the IRS after he pressed President Obama on government spending during a 2012 interview, walked back his allegation on the St. Louis CBS affiliate’s 5 p.m. newscast Tuesday.

“First, I need to state those were my personal views, not those of KMOV-TV,” Conners said (video above). “Second, to be fair, I should disclose that my issues with the IRS preceded that interview by several years. As a journalist I understand the importance of keeping personal matters separate from my professional work — sometimes you have to do that retain your independence as a newsman. Those lines might have been unintentionally crossed yesterday by my [Facebook] post.”

The St. Louis Post-Dispatch reports Conners and his wife owe more than $85,000 in back taxes.

The woman who was in charge of a scandal-mired unit of the Internal Revenue Service at the time that it was targeting tea party groups is now running the IRS office responsible for health care legislation, ABC News is reporting.
 
Sarah Hall Ingram served as commissioner of the unit that deals with tax-exempt organizations between 2009 and 2012. It was revealed last week that the unit subjected conservative organizations to undue scrutiny as they were applying for tax-exempt status between 2010 and 2012.

Ingram's successor, Joseph Grant - who was appointed commissioner of the tax-exempt office a week ago - is taking the fall for the scandal. He announced Thursday that he would be resigning from his position June 3.

According to a testimony she gave in November of 2011, Ingram was working in both offices simultaneously for some time. She introduced herself in the testimony as the commissioner of tax-exempt organizations, then added that she also serves as the 'executive lead on the IRS' operational planning and implementation of the small employer tax credit and other tax law provisions of the Affordable Care Act.'

WASHINGTON, D.C. – A group of seven Senate Democrats urged the Internal Revenue Service on Monday to impose a strict cap on the amount of political spending by tax-exempt, nonprofit groups.

 The senators said the lack of clarity in the IRS rules has allowed political groups to improperly claim 501©4 status and may even be allowing donors to these groups to wrongly claim tax deductions for their contributions. The senators promised legislation if the IRS failed to act to fix these problems.

“We urge the IRS to take these steps immediately to prevent abuse of the tax code by political groups focused on federal election activities.  But if the IRS is unable to issue administrative guidance in this area then we plan to introduce legislation to accomplish these important changes,” the senators wrote.

The letter was signed by Senators Charles E. Schumer, Michael Bennet, Sheldon Whitehouse, Jeff Merkley, Tom Udall, Jeanne Shaheen and Al Franken. It follows an earlier letter, sent to the IRS by the same of group of senators last month, that also urged the IRS to better enforce rules pertaining to 501©4 organizations.

Federal law defines 501©4 groups as groups engaged exclusively in “social welfare” activities. The IRS, however, has allowed these 501©4 groups to venture into political activities as long as civic and charitable work remains their “primary purpose.” This loophole has caused a number of organizations heavily engaged in political work to organize themselves as 501©4 groups in order to gain tax-exempt status and shield their donors from the disclosure requirements that apply to more traditional political organizations.

The senators said the IRS should close this loophole by imposing a strict, percentage-based cap on the amount of a nonprofit group’s spending that can go towards political activities. Legal experts have proposed a cutoff of 49 percent to ensure that political activities never command more than half of a group’s total spending. But the senators said even this threshold would be too high and would permit more political work than any nonprofit group should be able to perform.

The senators also said that 501©4 groups should have to disclose upfront—on all written and online solicitations that get sent to potential donors—how much of their activities are political. The senators said this would make it clear to potential donors how much of a tax deduction, if any, they could claim on their tax returns. Currently, no such information is required to be disclosed and tax experts have expressed concern that many corporations contributing funds to these political groups may be counting those donations as a business expenses eligible for a full tax deduction.

Dear Commissioner Shulman:

We write to ask the Internal Revenue Service (“IRS”) to immediately change the administrative framework for enforcement of the tax code as it applies to groups designated as “social welfare” organizations. These groups receive tax and other advantages under section 501©(4) of the Internal Revenue Code (hereinafter, “IRC” or the “Code”), but some of them also are  engaged in a substantial amount of political campaign activity.  As you know, we sent a letter last month expressing concerns about the 501©(4) issue;  an investigation this week by the New York Times has uncovered new, specific problems on how c)4)s conduct  business. We wanted to address those new concerns in this letter.

IRS regulations have long maintained that political campaign activity by a 501©(4) entity must not be the “primary purpose” of the organization.  These regulations are intended to implement the statute, which requires that such organizations be operated exclusively for the public welfare.  But we think the existing IRS regulations run afoul of the law since they only require social welfare activities to be the 'primary purpose' of a nonprofit when the Code says this must be its 'exclusive' purpose. In recent years, this daylight between the law and the IRS regulations has been exploited by groups devoted chiefly to political election activities who operate behind a facade of charity work.

A related concern, raised in a March 7th New York Times article, concerns whether certain nonprofits may be soliciting corporate contributions that are then treated by the company as a business expense eligible for a tax deduction. The Times wrote:  “Under current law, there is little to no way to tell whether contributions are being deducted, especially because many of the most political companies are privately held.” This potential abuse distorts the objectives of vital revenue mechanisms and undermines the faith that we ask citizens to place in their electoral system.

We propose that the IRS make three administrative changes to curtail these questionable practices and bring IRS tax regulations back into alignment with the letter and spirit intended by those who crafted the Code:

First, we urge the IRS to adopt a bright line test in applying its “primary purpose” regulation that is consistent with the Code’s 501©(4) exclusivity language. The IRS currently only requires that the purpose of these non-profits be “primarily” related to social welfare activities, without defining what “primarily” means. This standard should be spelled out more fully by the IRS.  Some have suggested 51 percent as an appropriate threshold for establishing that a nonprofit is adhering to its mission, but even this number would seem to allow for more political election activity than should be permitted under the law.  In the absence of clarity in the administration of section 501©(4), organizations are tempted to abuse its vagueness, or worse, to organize under section 501©(4) so that they may avail themselves of its advantages even though they are not legitimate social welfare organizations. If the IRS does not adopt a bright line test, or if it adopts one that is inconsistent with the Code’s exclusivity language, then we plan to pursue legislation codifying such a test.

Second, such organizations should be further obligated to document in their 990 IRS form the exact percentage of their undertakings dedicated to “social welfare.” Organizations should be required to “show their math” to demonstrate that political election activities and other statutorily limited or prohibited activities do not violate the “primary purpose” regulation.

 Third, 501©(4) organizations should be required to state forthrightly to potential donors what percentage of a donation, if any, may be taken as a business expense deduction. As the New York Times reported in its March 7tharticle, some of these organizations do not currently inform donors whether a contribution is tax deductible as a business expense at all.

The IRS should already possess the authority to issue immediate guidance on this matter. We urge the IRS to take these steps immediately to prevent abuse of the tax code by political groups focused on federal election activities.  But if the IRS is unable to issue administrative guidance in this area then we plan to introduce legislation to accomplish these important changes.

And so, every few hours this week, the National Republican Senatorial Committee has hit out at the Democrats’ 2014 incumbents and candidates. In the past, many of these finks had criticized political-acting 501(c)(4)s.

“Why did the IRS target these people?” asked NRSC spokesman Brad Dayspring in a Thursday jeremiad typical of the genre. “Because [New Hampshire Sen.] Jeanne Shaheen and [New York Sen.] Chuck Schumer pressured them to. Today, Shaheen and Schumer pretend to be outraged by [their] OWN actions.”

Shaheen and Schumer never told the IRS to go after, say, the Kentucky 9/12 Project. They were panicking about groups like Crossroads Grassroots Policy Strategies. According to its mission statement, it was “a non-profit public policy advocacy organization that is dedicated to educating, equipping, and engaging American citizens to take action on important economic and legislative issues that will shape our nation's future.” According to observable reality, it and other Crossroads groups spent around $300 million to attack Democratic candidates.

Democrats, awkwardly, have attempted to use the new IRS scandal to remind everyone of why they feared the new 501(c)(4)s. “These so-called social welfare organizations must make their goal social welfare and not politics,” said Nancy Pelosi on Thursday, at her weekly press conference. She made a pitch for the DISCLOSE Act, which withered in 2010, but would have (in a manner yet untested by courts) required tax-exempt groups engaging in politics to disclose their donors.

What’s the difference between the Leadership Institute training young politicos on the right and Media Matters training young politicos of the left? Nothing. There’s no difference. The campaign finance scolds were standing on solid ground, until in one week it shifted about 1,000 miles to the right.

You could see the shift on Thursday, when conservative Republicans (led by Rep. Michele Bachmann) gathered outside the Capitol with Tea Party leaders who’d been hassled by the IRS. Speaker after speaker decried the IRS for trampling on free speech—by holding back on tax-exempt “social welfare” status for groups that would eventually show up outside the Capitol, next to conservative Republicans.

Some Republicans still wrestled with the tax issue. Maybe it would make more sense to scrap the system—ideally, to dynamite the whole IRS—and let people engage in politics without worrying about for-profit status or nonprofit status or being accused of violating one or the other. “Once they force you into this funnel to have that legal status,” said Texas Rep. Louie Gohmert, “then you're hassled and abused.”

Planted question gambit backfires on IRS officials


Top tax officials tried an unusual strategy to break the news of their three-year-old policy of targeting Tea Party groups



WASHINGTON — It was an unusual way to deliver bad news, even in a town known for its selective leaks, Friday night news dumps and wag-the-dog distractions.

The Internal Revenue Service, apparently determined to get out ahead of an inspector general report critical of its handling of tax exemptions for Tea Party groups, came up with a plan: Lois Lerner, the official responsible for the tax-exempt division, would publicly apologize in response to a question at the American Bar Association conference in Washington.

Details of the now-infamous planted question emerged Friday after acting IRS commissioner Steven Miller admitted the gambit under questioning from members of the House Ways and Means Committee.

STORY: IRS chief denies politics drove Tea Party screening

It was the day after Lerner had testified to Congress last week, failing once again to disclose the extent of the Tea Party targeting even under direct questioning. The damning inspector general report would come out any day, and Lerner and Miller wanted to figure out a way to disclose the news publicly.

Miller testified about the thought process behind the release strategy Friday. "Now that the (inspector general) report was finalized, now that we knew all the facts, now that we had responded in writing and everything was done, did it make sense for us to start talking about this in public," he said.

The plan, he said, was to simultaneously notify Congress, but that never happened.

After talking to Miller, Lerner called Celia Roady, a Washington tax lawyer whose office is immediately across Pennsylvania Avenue from the IRS headquarters. She also serves on the IRS Advisory Committee on Tax-Exempt and Government Entities.

Roady released this written statement late Friday explaining her role:

"On May 9, I received a call from Lois Lerner, who told me that she wanted to address an issue after her prepared remarks at the ABA Tax Section's Exempt Organizations Committee Meeting, and asked if I would pose a question to her after her remarks. I agreed to do so, and she then gave me the question that I asked at the meeting the next day. We had no discussion thereafter on the topic of the question, nor had we spoken about any of this before I received her call. She did not tell me, and I did not know, how she would answer the question."

And so that's how it happened. Within minutes, the Associated Press reported her remarks with a one-line news alert: "WASHINGTON (AP) — IRS apologizes for inappropriately targeting conservative political groups in 2012 election."

In a conference call with reporters later that day, Lerner emphasized that her apology came in response to a question.

"I was asked a question at the ABA meeting to give a status update of things that have been in the press" about the agency's treatment of Tea Party groups, she said. .Asked why the IRS chose that day to make an apology that day, she said, "Someone asked me a question today, so I answered it."

Members of Congress in both parties criticized what they called a "scheme" and a "manipulation."

"I find it incredibly ironic. You know, on the one hand, you're arguing today that the IRS is not corrupt. But the subtext of that is you're saying, 'Look, we're just incompetent,' " said an exasperated Rep. Peter Roskam, R-Ill., after one line of questioning on Roady's involvement.

Communications professionals said it was a puzzling move that backfired and alienated members of Congress.

"It violates the golden rule of political crisis management — disclosing critical facts early," said Nu Wexler, a former Democratic Hill staffer and vice president of Rasky Baerlein Strategic Communications.

Lerner "had an opportunity to explain the full story in the May 8th hearing, and she passed. Members of Congress don't like being misled, and that's why two key House Democrats are now calling for her resignation," Wexler said.

WASHINGTON — Congressional Republicans, not resting with the Internal Revenue Service scandal, are moving to broaden the matter to an array of tax malfeasances and “intimidation tactics” they hope will ensnare the White House.


Republican charges range from clearly questionable actions to seemingly specious allegations, and they grow by the day. On Friday, lawmakers sought to tie the I.R.S. matter to the carrying out of President Obama’s health care law, which will rely heavily on the agency. Whether they succeed holds significant ramifications for Mr. Obama, who will soon know if he is dealing with a late spring thunderstorm that may soon blow over or a consuming squall that will leave lasting damage.

Representative Dave Camp, Republican of Michigan, the usually mild-mannered chairman of the House Ways and Means Committee, set the tone Friday at Congress’s first hearing on the targeting of conservative groups by the I.R.S., laying out details, from the alleged threatening of donors to conservative nonprofit groups to the leaking of confidential I.R.S. documents.

In that context, he said, the screening of Tea Party groups for special scrutiny was not the scandal itself but “just the latest example of a culture of cover-ups — and political intimidation — in this administration.”

“It seems like the truth is hidden from the American people just long enough to make it through an election,” Mr. Camp said.

WASHINGTON (AP) -- A top White House adviser insisted Sunday that President Barack Obama learned the Internal Revenue Service had targeted tea party groups only "when it came out in the news" while Republicans continued to press the administration for more answers.

Trying to move past a challenging week that put the White House on the defensive, senior adviser Dan Pfeiffer was scheduled to appear on five Sunday news shows to repeat the administration's position that no senior officials were involved in the decision to give tea party groups extra scrutiny. Pfeiffer's appearances were unlike to quiet GOP critics, who have seized on the revelations as proof that Obama used the IRS to go after his political enemies.

"The deputy secretary of the treasury was made aware of just the fact that the investigation was beginning last year," Pfeiffer said. "But no one in the White House was aware."

Meanwhile, Sen. Rand Paul, R-Ky., suggested there was a written policy to target conservative groups opposing the president, but when pressed could not provide details.

"I haven't seen a policy statement, but I think we need to see that," Paul said. "And when that comes forward, we need to know who wrote the policy and who approved the policy."


Regardless of when the president first learned of the investigations, Pfeiffer said the president wanted to ensure such activities were not repeated.

"The activity was outrageous and inexcusable, and it was stopped and it needs to be fixed to ensure it never happens again," Pfeiffer said.

A Treasury Department inspector's report said this week that conservative and small-government tea party groups that were critical of Obama received extra scrutiny. IRS agents did not flag similar progressive or liberal groups, according to the watchdog.

The report concluded that a regional IRS office in Ohio improperly singled out tea party and other conservative groups for more than 18 months and took no action on many of their applications for tax-exempt status for long periods of time - hindering their fundraising for the 2010 and 2012 elections.

The new acting IRS commissioner is in the midst of a 30-day top-to-bottom review while Republicans continue to demand answers of Obama and his allies in government.

That's not sufficient, said Sen. Rob Portman, R-Ohio.

"I think a special counsel is going to wind up being necessary," he added said.

That move is not needed, said Sen. Robert Menendez, D-N.J.

"I don't see the point," he said of a special counsel to investigate the scandal.

Rep. Tom Price, R-Ga., said the IRS had stepped so far over its mandate that it asked book groups for reading lists and church groups about their prayers before granting them tax-exempt standing. It's government over-reach, he said, and a reason why Republicans need to have their own investigation into the agency.

"This is about trust," Price said.

But he stopped short of calling for a special counsel.

Rep. Charlie Rangel, D-N.Y., said Republicans were using the incidents to embarrass the president.

"There is no Republican agenda other than to stop the president of the United States," h

Syndicated columnist Charles Krauthammer on Friday said the Internal Revenue Service’s targeting of conservative organizations could be “fatal” for the Obama administration if it turns out that anyone in the White House was aware of it.

Appearing on Fox News’ “Hannity,” Krauthammer called the IRS situation “the one scandal that people have a visceral sense about” — it’s the one U.S. institution, besides the military, that can do very serious harm.

Going after conservative groups based on their politics is “a violation that everybody — left or right– understands,” he added.

Krauthammer urged that there’s no suggestion that Obama knew what was happening, “but if there’s any indication that there were people in the White House who knew, who orchestrated, who encouraged or whatever, then it can be a fatal problem.”

Obama ducked a direct question on Thursday about whether he or anyone else in the White House had known what was happening.

Krauthammer said he wasn’t comparing the current situation to Watergate, but pointed out that the second article of impeachment against Richard Nixon was abuse of the IRS.

President Obama has now had his Nixonian "I'm not a crook" moment, taking to the airwaves to feign angry indignation about the Internal Revenue Service targeting his enemies while denying any knowledge whatsoever of what his administration had been up to.

I am not surprised that Obama is pretending - in careful language - not to know about the worst abuse of power by a presidential administration in a generation.

Why do I believe that Obama knew exactly what his IRS was up to (besides it being in the news for the last two years)? Because of the record of Steven T. Miller - the man Obama first hired and has now fired as acting commissioner of the IRS.

Make no mistake about it. When Obama appointed Miller, the president should have known what he was getting. Before becoming acting commissioner of the IRS, he was commissioner of the Tax Exempt and Government Entities Division, where, according to the IRS's faux-folksy website, "Steve oversaw the administration of tax law relating to employee plans, tax-exempt organizations and various government entities."

Perhaps the description should more accurately have read "oversaw and undermined the administration of tax law relating to ... tax exempt organizations." At Judicial Watch, we know this well because, very early on, we were one of the many conservative organizations and Clinton critics that Miller's tax exempt branch subjected to politically-inspired audits.

As The Washington Examiner's Paul Bedard reported recently in his "Washington Secrets" column, "Steven T. Miller, the acting IRS commissioner who managed the division that has admitted targeting anti-Obama Tea Party groups, was one of several agents who investigated anti-Clinton organizations, including Judicial Watch during that Democrat's administration, according to court documents and interviews."

As I relate in my book, "The Corruption Chronicles," when Judicial Watch complained about the audit and its political nature, an IRS official told us "What do you expect when you sue the president?"

Miller was one of the IRS officials who oversaw the invasive audit of Judicial Watch even while conceding that the audit "had created at least the appearance of a problem." It seemed every time we complained about the audit, Miller's bureaucrats expanded its scope until it covered seven years' worth of records!

So, now we find that Miller, despite this record of being a top official partly responsible for the last wave of IRS abuse during the Clinton years, was rewarded by Obama with the top position at the IRS. Given our well-publicized experience with him, it is no surprise to me that Miller was content to allow this illegal IRS harassment of Obama's enemies list - and the subsequent cover-up.

Republicans Informed of IRS Investigation LAST YEAR

Much has been made of the fact that senior Treasury Department officials were told about the investigation into the treatment of tea party groups in June 2012 - months before last year's the Presidential election. Republicans who requested the investigation were also told about it at approximately the same time.

In a letter dated July 11, 2012, the man who conducted the investigation - IRS inspector general J. Russell George - wrote to Rep. Darrell Issa, the chairman of the House Committee on Oversight and Government Reform, telling him that he was investigating the issue and offering to keep him updated as the investigation progressed.

"The Oversight Committee knew about the audit because it requested it," an Issa aide told ABC News. Issa released the letter, along with his own letter dated June 28, 2012 requesting the investigation, last week.

"We would be happy to provide a status update to the Subcommittee staff and provide a copy of our interim and final reports on the matter when they are issued," George wrote in the letter to Issa. An identical letter was also sent the Rep. Jim Jordan, who, like Issa had raised the issue with the IRS.

The letter notes that it was Issa who had written him about "questionnaires that the IRS has issued which may exceed appropriate scrutiny and a potential lack of balance in the use of criteria for reviewing organizations that are applying for tax-exempt status." George offers no confusions but says, "our Office of Audit recently began work on this issue."

According the Issa aide, the committee received an email update from George in December saying, "We are leaving no stone unturned as part of our due diligence. As such, we won't be able to provide a detailed, substantive briefing until late April/early May."

On Friday, in his testimony before the House Ways & Means Committee, George said he had notified top Treasury officials - including Deputy Secretary Neal Wolin - about his investigation in June 2012, part of a routine briefing on the issues he was looking into.

Republicans pounced on that revelation as evidence top Administration officials knew about the targeting of conservative groups well before the 2012 election. It is now clear that at least some key Republicans knew about the investigation as well.

While George informed Treasury officials about the fact he was conducting the investigation in 2012, the Treasury Department says he did not go into detail about his investigation or tell them about his conclusion that IRS had improperly targeted conservative groups. Similarly, the letter to Issa says the investigation had begun but does not say that it had uncovered any wrongdoing.

Doubtful, but that wouldn't unravel the lie, either.

This "scandal" pales in comparison to what Dave Champion calls the "largest financial crime in history".  The Bureau of Internal Revenue was created in 1862 and didn't get its named changed to the Internal Revenue Service until 1953... just in time for the 1954 revised publication of the Internal Revenue Code (Title 26 of the United States Code) where a lot "redundant language" was removed (read: language that made the truth very obvious to anyone).  It wasn't until after which it engaged in a campaign of disinformation by sending letters and pamphlets to every domestic business it could find an address for across the United States.  Prior to this, these businesses had never dealt with the federal government... no W2's, 1099's, K2's, etc.

It's not like the IRS was created when then Federal Reserve Act came into being.  Even if it suffered a massive slap on the wrist, the revenue laws of the United States will still need to be enforced by some agency.  I'm all for an overhaul that corrects the lie, though.  Anything short of that will just be an exercise in futility... little more than mental masturbation.

The Founding Fathers had rejected income taxes (or any other direct taxes) unless they were apportioned to each state according to population. Nevertheless, an income tax was levied during the Civil War and upheld by the Supreme Court on somewhat tenuous reasoning. When another income tax was enacted in 1893, the Supreme Court found it unconstitutional. In connection with the two Pollock cases reviewed in 1895, the Court declared that the act violated Article I, section 9 of the Constitution.

Shock wanted to know if that was an appropriate question for the IRS to ask.

What does this have to do with anything?  The 16th deals with income derived from property (rents, profits, dividends, etc)... not income as property (such as with labor remuneration).  Properly ratified or not, it has nothing to do with 99% of Americans.

The article is nonsense.  The very first sentence implies that the income tax is a direct tax... a notion rejected by not only the law itself, but the Supreme Court.  Not only that, the 16th did not give the federal Congress the power to impose an income tax... the Constitution itself did in Article I Section 8.  Hint: The income tax is an excise (aka a privilege tax).

The 16th Amendment merely removed the occasion where the income derived from property (rents, profits, dividends, etc) within Congress' jurisdiction to tax was argued to be akin to property itself and thereby exempt from Congress' excise taxing power.  It is no mystery that virtually all of the landmark cases following its ratification (valid or otherwise) deal with these types of income and not one deals with the agreed remuneration received by trading one's labor... why, because the Supreme Court stated before and since that to do so is a right which cannot be taxed.

So no, the 16th and its history are not relevant by any stretch of the imagination to this thread (concerning increased scrutiny of certain parties for political purposes) nor any thread regarding the income tax as it is maliciously applied to the vast majority of Americans.
