IRS admits targeting conservatives for tax scrutiny in 2012 election

The Internal Revenue Service on Friday apologized for targeting groups with “tea party” or “patriot” in their names, confirming long-standing accusations by some conservatives that their applications for tax-exempt status were being improperly delayed and scrutinized.

Lois G. Lerner, the IRS official who oversees tax-exempt groups, said the “absolutely inappropriate” actions by “front-line people” were not driven by partisan motives.

Rather, Lerner said, they were a misguided effort to come up with an efficient means of dealing with a flood of applications from organizations seeking ­tax-exempt status between 2010 and 2012.

During that period, about 75 groups were selected for extra inquiry — including burdensome questionnaires and, in some cases, improper requests for the names of their donors — simply because of the words in their names, she said in a conference call with reporters.

They constituted about one-quarter of the 300 groups who were flagged for additional analysis by employees of the IRS tax-exempt unit’s main office in Cincinnati.

It was not clear whether the IRS had anticipated the firestorm that it would ignite with its disclosure. Indeed, it appeared to have happened by chance when Lerner, appearing Friday at a conference held by the American Bar Association, responded to a question about the allegations by conservative groups.

The IRS’s subsequent conference call with reporters was clumsily handled. At one point, Lerner attempted to do arithmetic on the phone and blurted out: “I’m not good at math.” That admission was understandable, given that her training is as a lawyer, but it produced a quote that is likely to haunt the agency that handles the nation’s tax returns.

Nor did IRS officials appear to have prepared much for the questions they would get.

I think they did this to test if they could get low level government employee to be involved in a large conspiracy without leaking it and they were successful for nearly 2 years.

Wider Problems Found at IRS

The Internal Revenue Service's scrutiny of conservative groups went beyond those with "tea party" or "patriot" in their names—as the agency admitted Friday—to also include ones worried about government spending, debt or taxes, and even ones that lobbied to "make America a better place to live," according to new details of a government probe.

The investigation also revealed that a high-ranking IRS official knew as early as mid-2011 that conservative groups were being inappropriately targeted—nearly a year before then-IRS Commissioner Douglas Shulman told a congressional committee the agency wasn't targeting conservative groups.

The new disclosures are likely to inflame a widening controversy over IRS handling of dozens of applications by tea-party, patriot and other conservative groups for tax-exempt status.

The details emerged from disclosures to congressional investigators by the Treasury Inspector General for Tax Administration. The findings, which were reviewed by The Wall Street Journal, don't make clear who came up with the idea to give extra scrutiny to the conservative groups.

The inspector general's office has been conducting an audit of the IRS's handling of the applications process and is expected to release a report this week. The audit follows complaints last year by numerous tea-party and other conservative groups that they had been singled out and subjected to excessive and inappropriate questioning. Many groups say they were asked for lists of their donors and other sensitive information.

IRS officials in Washington were involved in targeting of conservative groups

Internal Revenue Service officials in Washington and at least two other offices were involved with investigating conservative groups seeking tax-exempt status, making clear that the effort reached well beyond the branch in Cincinnati that was initially blamed, according to documents obtained by The Washington Post.

IRS officials at the agency’s Washington headquarters sent queries to conservative groups asking about their donors and other aspects of their operations, while officials in the El Monte and Laguna Niguel offices in California sent similar questionnaires to tea-party-affiliated groups, the documents show.
 
IRS employees in Cincinnati told conservatives seeking the status of “social welfare” groups that a task force in Washington was overseeing their applications, according to interviews with the activists.

Lois G. Lerner, who oversees tax-exempt groups for the IRS, told reporters Friday that the “absolutely inappropriate” actions were undertaken by “front-line people” working in Cincinnati to target groups with “tea party,” “patriot” or “9/12” in their names.

In one instance, however, Ron Bell, an IRS employee, informed a lawyer representing a conservative group focused on voter fraud that the application was under review in Washington. On several other occasions, IRS officials in Washington and California sent conservative groups detailed questionnaires about their voter outreach and other activities, according to the documents.

“For the IRS to say it was some low-level group in Cincinnati is simply false,” said Cleta Mitchell, a partner in the law firm Foley & Lardner who sought to communicate with IRS headquarters about the delay in granting tax-exempt status to True the Vote.

Moreover, details of the IRS’s efforts to target conservative groups reached the highest levels of the agency in May 2012, far earlier than has been disclosed, according to Republican congressional aides briefed by the IRS and the Treasury Inspector General for Tax Administration ­(TIGTA) on the details of their reviews.

IRS staffers had singled out conservative organizations with "tea party" or "patriots" in their name that were seeking tax-exempt nonprofit status, subjecting them to extra scrutiny to see if they were abusing the tax law as it relates to political activity. They grilled these conservative groups about their members, their donors, their public statements, and who they employed. And there is no evidence yet that the IRS systemically treated non-conservative groups with the same level of attention.

Speaking to a group of tax lawyers, the IRS official, Lois Lerner, who oversees the agency's exempt organizations division, publicly apologized for the IRS's actions. Ever since, Democratic and Republican politicians have been falling over themselves to condemn the IRS. President Obama said that, if the allegations are true, "there's no place" for such behavior. Members of Congress have pledged to investigate any potential wrongdoing and grill the agency's leaders. "Heads need to roll" if the IRS unfairly targeted tea partiers and other conservatives, said Rep. Adam Schiff (D-Calif.).

Newly obtained documents show the current IRS chief knew about the agency's targeting of Tea Party groups as early as May 2012 and other officials in Washington were clued in more than a year before that, as the scandal continued to spread.
 
The additional details were provided in a timeline from the office of Sen. Orrin Hatch, R-Utah, based on briefings by the inspector general's office investigating the case. Together, they challenged the agency's initial claims that the practice of flagging conservative groups for additional scrutiny was contained to low-level staffers at a Cincinnati office.
 
The timeline shows that Steven Miller, the acting IRS chief who at the time was a deputy commissioner, was briefed on the practice on May 3, 2012. Despite this briefing, Miller wrote letters to members of Congress at least twice to explain the process of reviewing applications for tax-exempt status without disclosing that Tea Party groups had been targeted. On July 25, 2012, Miller testified before the House Ways and Means oversight subcommittee, but again did not mention the additional scrutiny -- despite being asked about it.
 
House Ways and Means Committee Chairman Dave Camp, R-Mich., blasted Miller over the revelation.
 
"It is almost inconceivable to imagine that top officials at the IRS knew conservative groups were being targeted but chose to willfully mislead the Committee's investigation into this practice," he said in a statement.

Miller did not mention that in 2011, those materials included a list of words to watch for, such as "tea party" and "patriot." He also didn't disclose that in January 2012, the criteria for additional screening was updated to include references to the Constitution or the Bill of Rights.

IRS Asks for Reading List, Tea Party Group Sends Constitution

When Marion Bower decided to start her tea party organization in 2010, she didn’t know that it would take nearly two years for the Internal Revenue Service to approve her request for tax-exempt status.

The Ohio woman also did not expect that providing information about the books her group read would be part of the application process.

“I was trying to be very cordial, but they wanted copies of unbelievable things,” Bower told ABC News today. “They wanted to know what materials we had discussed at any of our book studies.”

She ultimately sent one of the books, “The Five Thousand Year Leap,” promoted frequently by Glenn Beck, to the IRS official handling her tax-exempt request in Cincinnati. She also sent a paperback copy of the Constitution.

The progressive-leaning investigative journalism group ProPublica says the Internal Revenue Service (IRS) office that targeted and harassed conservative tax-exempt groups during the 2012 election cycle gave the progressive group nine confidential applications of conservative groups whose tax-exempt status was pending.

IRS released confidential info on conservative groups to ProPublica

ProPublica on Monday reported that the same IRS division that targeted conservative groups for special scrutiny during the 2012 election cycle provided the investigative-reporting organization with confidential applications for tax-exempt status.

That revelation contradicts previous statements from the agency and may represent a violation of federal guidelines. Lois G. Lerner, who heads the IRS sector that reviews tax-exemption applications, told a congressional oversight committee in April 2012 that IRS code prohibited the agency from providing information about groups that had not yet been approved.

The IRS is an ideal means of selective persecution. Over and over again its crimes are discovered and published. And yet, almost every time, the latest scandal is reported as an anomaly—as if the IRS has ever behaved in any other way. Even apart from the issue of whether or not income tax is a good thing, the IRS should be abolished as the means of collecting such taxes.

Top IRS official didn't reveal tea party targeting

Congress was not told tea party groups were being inappropriately targeted by the Internal Revenue Service, even after acting agency Chief Steven Miller had been briefed on the matter.

Miller was first informed on May, 3, 2012, that applications for tax-exempt status by tea party groups were inappropriately singled out for extra scrutiny, the IRS said Monday.

At least twice after the briefing, Miller wrote letters to members of Congress to explain the process of reviewing applications for tax-exempt status without disclosing that tea party groups had been targeted. On July 25, 2012, Miller testified before the House Ways and Means oversight subcommittee, but again did not mention the additional scrutiny - despite being asked about it.

At the hearing, Rep. Kenny Marchant, R-Texas, told Miller that some politically active tax-exempt groups in his district had complained about being harassed. Marchant did not explicitly ask if tea party groups were being targeted. But he did ask how applications were handled.

Miller responded, "We did group those organizations together to ensure consistency, to ensure quality. We continue to work those cases," according to a transcript on the committee's website.

On June 29, 2011, Lois G. Lerner, who heads the IRS division that oversees tax-exempt organizations, learned at a meeting that groups were being targeted, according to a draft of the report by the Treasury inspector general for tax administration.

At the meeting, Lerner was told that groups with "Tea Party," ''Patriot" or "9/12 Project" in their names were being flagged for additional and often burdensome scrutiny, the report says. Lerner instructed agents to change the criteria for flagging groups "immediately."

However, when Lerner responded to inquiries from the House oversight committee, she didn't mention the fact that tea party groups had ever been targeted. Her responses included 45-page letters in May 2012 to Rep. Darrell Issa, R-Calif., who chairs the committee, and Rep. Jim Jordan, R-Ohio, who chairs a subcommittee.

WASHINGTON, D.C. – Amid reports that the Acting Commissioner of the Internal Revenue Service (IRS) Steven Miller knew about the agency’s outrageous and unwarranted targeting of conservative groups as early as May 2012,

Interesting date on this article.  And its essentially the same information that's 'breaking'.

The IRS targeting Patriot groups is not new, but it makes a great foil for Benghazigate that threatens to expose the entire torture, gun running, al Qaeda op aimed at Syria and Iran.

"Tossing out a brick to get a jade gem."  Give your opponent something of little value while making it seem of great value in order to claim something of great value for youself.

In the 1970s, Richard Nixon had an enemies list.  Nixon asked the IRS to investigate tax returns of those on the list.  Liberals were outraged.  To be on Nixon’s list became a liberal badge of honor.

In the 1990’s Bill Clinton had an enemies list too.  The Clinton administration targeted for IRS audit the National Rifle Association, the Heritage Foundation, the National Review, the American Spectator, Citizens Against Government Waste, Citizens for Honest Government, Concerned Women for America and the San Diego Chapter of Christian Coalition.

Today, Obama has an enemies list.  The IRS is investigating conservative political groups including the Tea Party who oppose Obama’s agenda.
 
Tea Party groups in many states applied to the IRS for recognition as non-profit organizations under Internal Revenue Code section 501(c)(4) which allows the organization to engage in political debate but does not allow a tax deduction to donors for donations made to the group.
 
Tens of thousands of such political non-profit organizations exist across the political spectrum, including ACORN, and one much in the news these days: Media Matters, the liberal clearing house for reporters and columnists eager to echo the liberal line of the day.
 
Just since the first of this year, Tea Party groups in Hawaii, Texas, Ohio, California, Kentucky, and Virginia report receiving inquiries from the IRS challenging their claim to non-profit status.

Up to 80 conservative/constitutionalist groups, including 9/12 Project groups around the country have reportedly received these letters.  The IRS letters all come from a single office of the IRS in Cincinnati, Ohio.
 
The letters contain lengthy questionnaires asking for information well beyond the facts necessary under the IRC to establish the legal parameters of the 501(c)(4) designation.
 
For example, the Kentucky 9/12 Project applied for a non-profit designation in December 2010.  The IRS return letter stated that there would be a determination within 90 days. The Kentucky group next heard from the IRS on February 14, 2012 in a letter containing 30 main questions with a total of 88 separate inquiries.
 
The IRS letter demanded the schedule and contact of every event sponsored by the group, speaker’s names and what the speaker said, and every written communication associated with the event.  The letter demanded the names and personal information of every member and volunteer.
 
Other questions in the letter demand the names of donors and ask for the names of “board members or officers who have run or will run for office (including relatives)”
 
The letters give the groups two weeks to reply.
 
This wave of letters closely follows a letter from six liberal U.S. Senators to the Commissioner of the IRS.  Senators Bennett, Schumer, Franken, Udall, Shaheen, Whitehouse and Merkley requesting the IRS investigate political activity by these conservative groups.
 
Why the sudden focus now by Obama and the Democrats on the grassroots citizen groups who changed the 2010 election by raising public awareness of the dangers of Obama’s out of control federal deficit spending, the bailout of Wall Street, the phony “Stimulus”, and the folly of ObamaCare?
 
I believe the answer is ObamaCare.
 
The ongoing implementation of the government takeover of American health care and health insurance is running into increasing public opposition.  Every poll on the subject indicates growing awareness that health insurance costs are going up, not down as Obama promised.

Worse, more Americans than ever are without coverage as employers cancel insurance rather than pay increasing premiums.
 
The uncertainty of the cost of mandated coverage (the mandates change with the publication of each new regulation) is one factor restraining businesses large and small from hiring, making the recovery from recession that much slower.
 
Recently, resistance to ObamaCare spread to a Church that had previously supported it.

The tidal wave of micromanaged health insurance coverage requirements hit a First Amendment wall when the Department of Health and Human Services issued a ruling that Catholic institutions must cover the cost of  “morning after” abortion pills, and contraceptives for their employees in contradiction to Church teaching.
 
The New York Times editorialized Obama’s exemption for employees of the actual House of Worship should be enough to satisfy the First Amendment.

The Catholic Church also runs over 600 hospitals in the U.S. and treats 1 of 6 hospital patients, many of these charity cases which receive free care.  The Church runs hundreds of schools and colleges, all offering aid to poorer students. By comparison, Obama is a newcomer to the business of helping the poor.

Liberals have struck back.

In testimony to Congress this week, Sandra Fluke, a Georgetown University law student testified that lack of free contraceptives in the health care coverage available at that Catholic institution would be an unfair financial burden.  She testified that women students pay $3000 for contraceptives over the three years of law school.

One columnist, using the average cost of these contraceptives, estimated that these students must be having sex an average of 2.74 times a day.
 
But back to the Obama enemies list.
 
Tea Party and other grassroots patriot groups are intimidated by the IRS letters, whatever bluster to the contrary you read on their websites.  The purpose of these IRS letters is plainly to silence the opposition voices as the ObamaCare regulations roll out.

Who in these groups is really ready to stand up to an IRS audit as the price of speaking out in opposition to ObamaCare?  Even if the audit finds nothing amiss, the cost of defending against it could bankrupt an individual or small business.
 
Compliance with ObamaCare is policed by the IRS.  Last month, Obama’s proposed federal budget added $1.1 Billion to the IRS budget to hire over 5000 new IRS agents to oversee the implementation of ObamaCare.
 
These new unionized IRS agents are the front wave of suppression of opposition to ObamaCare.  If ObamaCare were repealed, they would be out of a job.
 
Ronald Reagan warned that a government agency is the nearest thing on earth to eternal life. Before this gargantuan new government bureaucracy is established beyond citizen control, and before we are all on the enemies list, ObamaCare must be repealed.

(Big Government) – In January and February of this year, the Internal Revenue Service began sending out letters to various local Tea Parties across the country. Mailed from the same Cincinnati, Ohio IRS office, these letters have reached Tea Parties in Virginia, Hawaii, Ohio, and Texas (we are hearing of more daily). There are several common threads to these letters: all are requesting more information from these independent Tea Parties in regard to their nonprofit 501(c)(4) applications (for this type of nonprofit, donations are not deductible). While some of the requests are reasonable, much of them are strikingly onerous and, dare I say, Orwellian in nature.

In the 1990’s Bill Clinton had an enemies list too.  The Clinton administration targeted for IRS audit the National Rifle Association, the Heritage Foundation, the National Review, the American Spectator, Citizens Against Government Waste, Citizens for Honest Government, Concerned Women for America and the San Diego Chapter of Christian Coalition.

Today, Obama has an enemies list.  The IRS is investigating conservative political groups including the Tea Party who oppose Obama’s agenda.

This is true to an extent.  However, Obama isn't as hot headed as Nixon and won't give himself up.  It's just speculation.  Obama is the closest thing to a dictator since Roosevelt.

Obama is pretty bad, but they seem to keep getting worse.  Eachone building on the horrific powers attained by their prior.  The classical progressive unitary execuative that always ends in dictatorships with king-priests while the worst of the worst behaviors become the norm.

About FDR, honestly, considering what the banks had done to the economy inorder to crush early organized labor, FDR's greatest sin might be that he didn't prosecute the villans when he had them up against the wall after the failed Banker's Plot.  He was afraid of fear itself, and might have ended if not just exposed the inner kabal of our ongoing banker/globalist's plot.  That would have been a great help to free humanity.

It appears that in a new book about the first year of his presidency, "The Promise: President Obama Year One" by Jonathon Alter, President Obama referred to Tea Party protesters as "Tea Baggers," a term derived from an act of oral sex.
According to Jake Tapper at ABC News. "President Obama is quoted in an interview saying that the unanimous vote of House Republicans vote against the stimulus bills 'set the tenor for the whole year ... That helped to create the tea-baggers and empowered that whole wing of the Republican Party to where it now controls the agenda for the Republicans.'"

Most Tea Party protesters regard "Tea Bagger" as the rough equivalent of calling an African American the "N word." It is therefore fascinating that President Obama should be indulging in that kind of labeling.

Congress was not told tea party groups were being inappropriately targeted by the Internal Revenue Service, even after acting agency Chief Steven Miller had been briefed on the matter.

Conservative lawmakers and tea party advocates Thursday sought to link the IRS scandal to efforts to repeal Obamacare, even acknowledging the potential of impeachment.

Rep. Michele Bachmann (R-Minn.) made the leap from Benghazi to the IRS scandal to Obamacare, a progression she said was all related. At a packed press conference, she argued that the IRS will now be able to access individual’s health records because they are tasked with overseeing compliance with the new law.

Bachmann stopped short of saying that Obama should be impeached, but when asked said that option shouldn’t be dismissed.

“As I have been home in my district, the 6th District of Minnesota, there isn’t a weekend that hasn’t gone by that someone says to me, ‘Michele, what in the world are you all waiting for in Congress? Why aren’t you impeaching the president? He’s been making unconstitutional actions since he came into office,’” Bachmann said.

Sen. Rand Paul (R-Ky.) also used the IRS scandal to shed doubt on implementation to the health care law.

“I’m a physician. I’m quite worried about the privacy of medical records,” he said. “I’m quite worried that your medical records now will be evaluated by the IRS.”

Tea party groups plan to sue IRS

WASHINGTON — The Ohio Liberty Coalition and 16 other tea party groups could file a civil suit against the Internal Revenue Service as soon as next week, according to an attorney representing 27 tea party organizations from around the nation.
 
Jordan Sekulow, executive director of the American Center for Law and Justice, is representing the organizations on a pro bono basis. He said it’s unclear if the organizations will file as a class action or individually in the 17 different states they encompass.
 
Sekulow said the case is made more unusual by the fact that the IRS essentially admitted to targeting the groups when it apologized for its actions on Friday. He said damages could include the cost of complying with IRS demands and the loss of donors reluctant to give to an organization without tax-exempt status.
 
But Sekulow, speaking at a press conference organized by Rep. Michele Bachmann, R-Minn., this morning, said the IRS may face more than civil litigation as a result of the decision to give extra scrutiny to Tea Party groups. The threat of criminal charges, he said, “is real and serious.”
