Abbey was originally charged with the September 2010 murder of Rita Elias, a resident of West-Side Modesto and the mother of three children. Abbey and Elias became involved in an argument when Abbey attempted to evict Rita from her home, which Abbey's parents owned and managed. During the altercation, Abbey shot Elias several times, killing her. According to the judge, the killing was in self-defense: witnesses testified that Elias stated that she was going to get a firearm to protect herself, and when she returned from her home with a realistic looking BB gun, Abbey shot her to death. After the killing, Abbey's home was raided by the FBI and numerous marijuana plants were found, as well as weapons, steroids, counterfeit cash, and items stolen from the Hayward Police Department. She is also charged with embezzlement of funds from the Sheriff's Department itself. ... Thursday, December 8, 2011 Rage Boils at Police in Central Valley

Battalion Chief Hugo Patino said on his Twitter account: "Fire on Chrysler continues to burn. Structural collapse occurring. Fire crews doing a good job of protecting the exposures." UPDATE - 11:25 p.m. A sheriff's spokesman says investigators still don't know if a gunman holed up in a Modesto home is alive or dead. A huge fire was raging late tonight at the home on Chrysler Drive where earlier in the day a sheriff's deputy and another man were gunned down and killed. In an interview with KCRA TV, Sgt. Anthony Bejaran said officers were not sure what the status was on the gunman. "We're not sure at this point what actions he's taken and what he might be doing," Bejaran said. Authorities were making contingency plans for what they would do if the gunman were to come out of the home, he said. Meanwhile, Sheriff Adam Christianson told CBS 13 television that a deputy who was nearby when Deputy Robert Paris was gunned down was able to fire at the gunman. The sheriff told the TV station that he and Paris were friends and had served together as paramedics. Christianson said it was likely the fire was started by incendiary devices and gas canisters the SWAT teams used to try to force the gunman out. ---- UPDATE - 10:55 p.m. A huge fire has been burning for more than hour at a home on Chrysler Drive believed to be the one where the suspect in the fatal shootings of a sheriff's deputy and another man had holed up. No further details were available. Here's what Patino wrote: "The fire on the 2nd floor is at the Chrysler incident. It continues to be visible." ---- UPDATE - 9:55 p.m. SWAT team members did not enter the house but came closer as officers used a loudspeaker, telling the suspect to call 911 and surrender. They said they would guarantee his safety. ---- UPDATE - 9:15 p.m. At least six SWAT team members have entered the house. No further information was immediately available. ---- UPDATE - 7:30 p.m. About 7:30 p.m., just before sunset, reporters heard a loud bang and saw a flash coming from the area of the house that SWAT teams had surrounded. Reporters could not see what happened, but at least one robot had been brought to the scene earlier in the evening. There was no immediate word from authorities on what happened. Also, sheriff's officials declined to release the name of a second deputy who was near the home when Deputy Robert Paris and another man were killed. "Suspect" STILL not named!!!http://latimesblogs.latimes.com/lanow/2012/04/modesto-standoff-fire.htmlModesto gunman who killed deputy presumed dead in fireApril 13, 2012 | 8:09am A man who fatally shot a sheriff’s deputy and a civilian is presumed dead, and the raging fire that ignited during a standoff at his Modesto apartment was extinguished early Friday morning. Officials believe the gunman was killed sometime Thursday in the midst of a 12-hour standoff, which began when sheriff’s deputies attempted to serve an eviction notice, the Modesto Bee reports. At one point, the standoff involved more than 100 law enforcement officers, who broke the windows of the apartment with bean bags, then shot tear gas into the unit, the Bee reported. Flames were pouring from the top of the building around 10 p.m. Thursday, as seen in TV footage. Shortly before midnight, according to the Associated Press, fire officials saw signs the structure was collapsing. It was unclear as of 6 a.m. Friday how the fire started. The names of the gunman and the civilian were not released, but the Stanislaus County Sheriff’s Department identified the deputy as 16-year veteran Robert Paris. “One of my valued members of my team is dead,” Stanislaus County Sheriff Adam Christianson said Thursday, according to the Bee, his voice shaking. The standoff began around 11 a.m. Thursday and continued late into the night. Around 9 p.m., the Bee reported, six SWAT officers rushed the apartment while officers used loudspeakers to communicate with a man they called " Jimmy." By 9:45 p.m., officials reported that a fire had broken out on the second floor, though the suspect was believed to be on the first floor. By 10:20 p.m., video footage shows flames spewing into the air. Several calls from The Times to the sheriff’s department were not returned, but Christianson told local reporters that Thursday was a “tragic day for law enforcement and public safety." http://latimesblogs.latimes.com/lanow/2012/04/coroners-office-identifies-civilian-victim-in-modesto-shooting.htmlSecond victim in Modesto eviction shooting was a locksmith April 13, 2012 | 2:13pm ... Glendon Engert, 35, of Modesto was one of two men killed by a gunman who authorities say opened fire as authorities attempted to evict him. The deputy, 16-year veteran Robert Paris, was also fatally wounded. ... CBS13 in Sacramento reported Friday that Engert is a locksmith who was helping Paris carry out the eviction. Engert's family confirmed to the Associated Press that the man was an independent locksmith who had been called out to change the locks. ... Modesto police officer Chris Adams told the Bee that the damaged fourplex and four other buildings will continue to be blocked off Friday. Officials also told the paper that because no one has entered the structure, there was still no confirmation late Friday morning that the gunman's body was insidehttp://www.fox40.com/news/headlines/ktxl-investigators-still-attempting-to-enter-home-of-modesto-shooting-suspect-20120413,0,6227368.story... Several hours into the stand-off, there was a fire at the apartment. The Sheriff believes it was started by tear gas that officers had used to try to get the man out.Law enforcement had been monitoring the man's movement. There had been no opportunity for the man to leave, so officers believe that he is dead ... As of 10 a.m. Friday morning, the FBI, ATF, Modesto Police and the Modesto Fire Department were waiting for clearance to enter the building. They do not expect to be able to enter the house until Friday afternoon or evening. Once they have permission to enter, they hope to see if the body is in the building, identify it, and understand the motive behind the shooting

The "Suspect" renter is charred beyond recognition .... and still no name - it really was a Waco redux - we really don't know what transpired between the sheriff and the renter - he may have already been dead (killed by the sheriff or suicided or killed by the swat team) and the fire used to obscure the evidence of what happened - all done in the name of what? If the renter ambushed the police then that was wrong but we really don't know do we? http://sanfrancisco.cbslocal.com/2012/04/13/modesto-police-find-charred-body-in-fire-gutted-apartment-after-deputy-shooting/Modesto Police Find Charred Body In Fire-Gutted Apartment After Deputy ShootingApril 13, 2012 4:06 PM MODESTO (CBS/AP) — A body has been found inside the fire-gutted Modesto apartment where a suspect had barricaded himself after fatally shooting two people, including a sheriff’s deputy. The suspect is believed to be James Ferrario, according to FOX40 sources. http://www.modbee.com/2012/04/13/2157129/a-combative-recluse.htmlPortrait of Modesto gunman emerges: A combative recluseBy Marijke Rowland mrowland@modbee.comA snapshot of a reclusive, deeply paranoid and sometimes combative man emerged Friday as more was uncovered about the apparent suspect in the fatal shooting of a sheriff's deputy and locksmith a day earlier. Two Stanislaus county deputies and a locksmith arrived at the ground floor unit at 2141 Chrysler Drive about 11 a.m. Thursday to serve an eviction notice on a James Ferrario. Gunshots quickly rang out, leaving two men mortally wounded and the other deputy calling for reinforcements. ... Ferrario, 45, owned the property, according to legal documents. His father, James Henry Ferrario, was one of the original owners in the development formerly known as Prescott Estates when it was built in 1972.Family members, neighbors and friends said the younger Ferrario, who went by Jim or Jimmy, lived with his father until the latter's death in 2008, and continued to live there alone afterward.... Those who knew Ferrario describe a man with few resources who became increasingly isolated and was worried people were out to get him... Darlene Williams, who last saw Ferrario about a year ago, said he was in an accident shortly after his father's death that caused him to lose his job as a security guard. Court records show Ferrario had a reckless driving charge filed against him in August 2008. Jonathan Williams said Ferrario wanted to stay in the home where he grew up and shared with his father, but his two sisters wanted to sell it. "I don't know if that was paranoia or not, but he was afraid his sisters would lock him out of the house if he left," he said. http://abcnews.go.com/US/wireStory/feds-seek-evidence-fiery-calif-standoff-16138374... Other neighbors said Ferrario had handguns and rifles and security cameras around his house. One former resident, Anna Rivas, told the Bee she moved out after repeated confrontations with Ferrario, one in which he sprayed her husband and a friend with mace. State online records show Ferrario's security guard registration and firearms permit were canceled in 2009 with no disciplinary action indicated. The newspaper said the Ferrario property had fallen behind on payments on a $15,000 Bank of America mortgage taken out in 2003. The property owner also appears to have defaulted on $13,406 owed to the Whispering Woods Community Association. The association foreclosed on the condo last year, followed by a bank foreclosure in December, the newspaper reported. R&T Financial Inc. is now the property's legal owner, according to county records. The Associated Press could not find a phone listing for the company.

Interesting the eviction "service", These people KNEW this man was strange and desperate and happened to arrive "late" for the eviction party.... Ironically named "Patriot" Evictions:http://www.patriotlegal.us/Modesto - Stockton - Merced Eviction Service Updated 2/12/2012 5:07PM Patriot Evictions is here for people who choose not to spend a lot of money on attorneys, when you know what you want. If your Unlawful Detainer gets to the point where you need or want an attorney we have a list of attorneys that you might choose from. We have very nice, private and secure office space for those of you that value a comfortable environment when conducting business http://www.news10.net/news/local/article/189586/2/Modesto-Police-say-gunman-was-prepared... "We went to the home countless times --- 10 to15 times," said Paul Tunison, owner of Patriot Evictions. "We needed to conclusively identify or try our best to identify who lived there. But we never conclusively identified who that was." Patriot Evictions said the occupant never answered the door. Tunison went out personally and saw hand-held camcorders sitting on the window sills facing out. Neighbors also told him the man inside owned several weapons. On Wednesday the Stanislaus County Sheriff's Office called Tunison to ask about the property. "I informed the young lady who works there that there had been comments from neighbors that weapons were on the premises and that the door was heavily fortified so much so that I said it was the most fortified door I had ever seen in my profession," said Tunison... [ They didn't know WHO they were evicting? ]Tunison said in his research, he believed the gunman to be a young man in his mid to late 20's. Tunison found what he thought was a Facebook account belonging to the man. "The pictures I saw on Facebook months ago were that of a young man in army fatigues," said Tunison. "But the mug shot picture I was given access to by law enforcement was a completely different person. So, I don't know who it wasTunison was running late to the Sheriff's Lockout of the property, but Deputy Robert Paris, his partner, and locksmith Glendon Engert were on time. Paris and Engert were shot and killed on the property by the gunman Thursday morning. Tunison said he can only speculate the circumstances surrounding the shooting "I've thought about it non-stop for 40 hours. There was nothing that could have been done differently. You could have gone to the door with 10 officers but this guy was out to kill. He was a predator, a stalker, and a cold blooded killer." http://www.modbee.com/2012/04/14/2158157/modesto-slayings-the-latest-tragedy.html... MODESTO -- Neighbors said James Ferrario was aggressive, angry and intimidating enough that more than one moved away from the Whispering Woods development rather than live near him. One man who had tried to serve eviction forms in the past noticed surveillance cameras in trees and heard unsettling warnings from neighbors that Ferrario kept a cache of weapons. But there was no way for deputy Bob Paris and locksmith Glendon Engert to know what awaited them [ really, No way of knowing??? ] behind the door of Unit 1 of 2141 Chrysler Drive at they approached on a blustery, wet Thursday morning. Paul Tunison with Patriot Eviction Services in Modesto was supposed to meet them there for a procedure called a "lockout." After a series of eviction notices, the resident is given a few days to get out before a team of two deputies, generally accompanied by a locksmith, is dispatched to change the locks. "I almost always attend lockouts," Tunison said. ... On Friday, authorities confirmed they found a body in the scorched remains of the unit. They haven't determined for sure if it is the suspect, nor whether the person died in the fire or beforehand. Christianson has said he doesn't think his deputies ever fired their weapons during the initial attack. Tunison said he and other process servers visited Ferrario's home at least 20 times as part of the foreclosure proceedings. He never saw Ferrario; nobody ever answered the door. Certified mail notifying Ferrario of the order to vacate went unclaimed at the post office. Warning conveyed Tunison said he spoke with neighbors who told him Ferrario had weapons, potentially including an assault gun and a hand grenade. He said he conveyed a warning to the deputies [ Did He - Did he really ] who would serve Ferrario on Thursday morning. But Tunison said the unusual isn't all that unusual in evictions. It's often emotional when someone loses his or her home. He's seen signs posted warning that stepping foot on property will result in a $100,000 fine, and he once held up a woman who collapsed in sobs in court over a foreclosure. [ I caught a couple of video interviews of Tunison and my take is that he was a NP/sociopath that enjoys his job of kicking people out of their homes and possibly a lying one in regards to warning the officers of the danger this man represented... ] Paul Tunison interrview: http://www.news10.net/news/article/189586/2/Modesto-Police-say-gunman-was-preparedhttp://www.modbee.com/2011/09/24/1875964/district-3-council-hopefuls-beset.htmlSaturday, Sep. 24, 2011 District 3 council hopefuls beset by own money woesBy Garth Stapley gstapley@modbee.com BART AH YOU/bahyou@modbee.com - District 3 Modesto City Council candidates prior to the beginning of the Q&A session sponsored by the League of Women Voters of Stanislaus County and Modesto Junior College Civic Engagement at the MJC Forum building, Tuesday evening. Why are they militarizing EMT's? Yes in an "emergency" over a hundred guys can show up in various outfits with automatic weapons and no one knows who they are.
I am not convinced that this was NOT some kind of setup. That poor sheriff and locksmith must not of had any idea they were confronting an ARMED reclusive suicidal individual "citizen". Yet the police say they had no idea this guy was possibly dangerous. Give me a break.
I could go on and on... A emergency mobilization responce test? Some interesting info for review: http://newsfeedresearcher.com/data/articles_n16/ferrario-apartments-police.html

Strangely related Manhunt / freeway shutdown / full swat mobilization / suspect cornered / fire / death of suspect :http://sacramento.cbslocal.com/2012/04/20/police-investigating-shooting-at-west-sacramento-repair-shop/West Sacramento Suspect Leads Police On 14-Hour ManhuntApril 20, 2012 8:20 PM WEST SACRAMENTO (CBS13) – It was a manhunt that spanned two counties, involved three stolen vehicles, a shutdown interstate, officers dodging fire, and finally, ended with a fatal standoff. The incident began just before 6 a.m. Friday morning., when West Sacramento police responded to B&R Head and Block Repair in the 400 block of Harbor Boulevard after receiving several calls of a shooting. Employees of the machine repair shop arrived to open the business and interrupted a burglary in progress, police said. Shots were fired but no one was hit. The believed suspect, 38-year-old Jimmy Graves, fled the scene and stole a white pickup truck. The first carjacking victim, Steve Welch, spoke with CBS13 over the phone and said it was his white Ford F-150 that was stolen and then crashed on the causeway. “Yes, he ran up to me with his gun and took my truck at gunpoint,” said Welch. “All of a sudden the guy runs around the corner and he’s got a backpack in one hand and a revolver in the other. And he ran right up to me and said ‘Get out, get out!’ Truthfully, I couldn’t move fast enough. I’m glad he didn’t shot me.” Both directions of Interstate 80 were shut down between West Sacramento and Davis for six hours as police searched for Graves, clogging freeways throughout the region. Then Graves assaulted Woodland Pastor William Gunter on County Road 123 and Old River Road in West Sacramento. According to his wife Loretta, Gunter reported walking his dog Dusty along the Yolo Causeway, as he often does, when he saw the suspect standing next to a tractor. She says the man told Gunter that he was waiting for someone to open a yellow gate, but when he turned he was hit by an unknown object and knocked out. Leaving him bloodied, Graves stole Gunter’s truck, which was found 12 miles away in North Sacramento. Friday evening Sacramento Sheriff’s Deputy cornered the suspect in an apartment complex in the 1900 block of Ethan Way in the Arden Arcade area. He barricaded himself inside an apartment and started a fire. After refusing to surrender, deputies shot the suspect to allow firefighters to extinguish the rapidly growing fire. Graves was fatally wounded, ending a 14-hour manhunt. The damage caused to the building due to the fire has prevented residents from returning to their homes, and will not be able to return until the complex is deemed safe once again. | - - - - - Following last Friday's bizarre crime spree by Jimmy Lee Graves, KFBK's Tim Lantz spoke to the man's uncle, Ed Graves, of Red Bluff. Here now is the full, unedited interview giving you an insight into the Graves family. You will also hear possible reasons for why Jimmy Graves allegedly became involved in a botched West Sacramento burglary, fired his gun at police and members of the public, stole three cars and shutdown I-80 after crashing one of them, and end up in a deadly shootout with police in an Arden Arcade area apartment. Family members of 38-year-old Jimmy Lee Graves told the Sacramento Bee ( http://bit.ly/I12PKG ) that his marriage was failing and that he was awaiting trial on felony robbery charges. Graves' uncle, Ed Graves, said his nephew had trouble holding down a job, and had struggled with a painkiller addiction. His brother-in-law Mario Albornoz said Graves had a 5-year-old son, but that his marriage to the mother was dissolving. The former smog-check technician was fatally shot Friday at an apartment in Arden Arcade after police said he went on a carjacking spree, one of which ended in a crash on Interstate 80.
