Obama signs anti-protest Trespass Bill

Only days after clearing Congress, US President Barack Obama signed his name to H.R. 347 on Thursday, officially making it a federal offense to cause a disturbance at certain political events — essentially criminalizing protest in the States.

RT broke the news last month that H.R. 347, the Federal Restricted Buildings and Grounds Improvement Act of 2011, had overwhelmingly passed the US House of Representatives after only three lawmakers voted against it. On Thursday this week, President Obama inked his name to the legislation and authorized the government to start enforcing a law that has many Americans concerned over how the bill could bury the rights to assemble and protest as guaranteed in the US Constitution.

Under H.R. 347, which has more commonly been labeled the Trespass Bill by Congress, knowingly entering a restricted area that is under the jurisdiction of Secret Service protection can garner an arrest. The law is actually only a slight change to earlier legislation that made it an offense to knowingly and willfully commit such a crime. Under the Trespass Bill’s latest language chance, however, someone could end up in law enforcement custody for entering an area that they don’t realize is Secret Service protected and “engages in disorderly or disruptive conduct” or “impede(s) or disrupt(s) the orderly conduct of Government business or official functions.”

The Secret Service serves as the police that protects not just current and former American presidents, but are also dispatched to monitor special events of national significance, a category with a broad cast of qualifiers. In the past, sporting events, state funerals, inaugural addresses and NATO and G-8 Summits have been designated as such by the US Department of Homeland Security, the division that decides when and where the Secret Service are needed outside of their normal coverage.

Liberty Lost: H.R. 347 Threatens First Amendment Freedoms

Last week the United States Congress passed dangerous legislation that would make free speech a felony and seriously restrict political protest. The legislation will give federal agents sweeping powers to arrest and bring felony criminal charges against citizens engaged in political protests anywhere in the U.S.

H.R. 347, The Federal Restricted Buildings and Grounds Improvement Act of 2011, threatens the right to protest and assemble in government buildings or on public or private grounds where events of “national significance” are taking place.

Critics claim the legislation is aimed at curbing forms of protest associated with the Occupy Wall Street movement, as well as deterring any future protests at the G-8 Summit scheduled for this spring.

The legislation passed with little fanfare last week, and enjoyed overwhelming support in both the House and Senate. In the House of Representatives, only three House members voted against the bill: Paul Broun (R-GA), Justin Amash (R-MI), and Ron Paul (R-TX). While in the Senate the legislation was passed by “unanimous consent,” thus no record is available of which Senators approved or disapproved of this potentially draconian legislation.

The legislation makes it a federal offense to disrupt or protest at any place or event attended by any person with secret service protection. The bill would make it a criminal offense to trespass on any “restricted buildings and grounds,” and would seriously hamper any future political protests near the White House, or anywhere else high ranking government officials meriting secret service protection may be. Those found in violation would face 1-10 years imprisonment.

Newt Gingrich got Secret Service protection Wednesday. Mitt Romney has had a Secret Service detail since Feb. 1, while Rick Santorum got protection last week, NBC reports. Ron Paul is now the only Republican candidate without Secret Service protection.

The President, the Vice President (or other officer next in the order of succession to the Office of President, should the vice presidency be vacant), the President-elect, and the Vice President-elect
The immediate families of the above individuals
Former Presidents and their spouses for their lifetimes except when the spouse divorces or remarries. In 1997, legislation became effective limiting Secret Service protection to former Presidents and their spouses for a period of not more than 10 years from the date the former President leaves office making Bill and Hillary Clinton the last to receive lifetime protection
The widow or widower of a former President who dies in office or dies within a year of leaving office for a period of 1 year after the President's death (the Secretary of Homeland Security can extend the protection time)
Children of former Presidents until age 16 or 10 years after the presidency.
Former Vice Presidents, their spouses, and their children under age 16 for a period of not more than 6 months from the date the former Vice President leaves office (the Secretary of Homeland Security can extend the protection time)
Visiting heads of states or governments and their spouses traveling with them, other distinguished foreign visitors to the United States, and official representatives of the United States performing special missions abroad whom the president deems important enough for protection outside the Diplomatic Security Service
Major presidential and vice presidential candidates
The spouses of major presidential and vice presidential candidates (within 120 days of a general presidential election)
Other individuals as designated per executive order of the President
National Special Security Events, when designated as such by the Secretary of Homeland Security
