Prosecutor Seeks to Drop Charges Against Soldier

MIDLAND, Texas—Prosecutors have filed a motion to dismiss charges against a soldier accused of trying to bring military-grade explosives on a cross-country flight from Texas to North Carolina.

The U.S. attorney's office said Friday it didn't find evidence that Sgt. 1st Class Trey Scott Atwater knew he was carrying C4 aboard his carry-on bag Dec. 31 at the Midland airport.

The 30-year-old was charged with trying to bring explosives onto an airplane.

Mr. Atwater has told the FBI he's a demolitions expert and had returned from his third tour in Afghanistan in April. He said his Army special forces team always carried C4 and that he didn't know it was in his bag when he returned from his most recent deployment.

A message left with Mr. Atwater's attorney wasn't immediately returned.

  This is strange, this guy is a SF, did 3 tours and was well aware of the C4 effect.
He must have had some heavy backup to get out of this one, well its sketchy to say the least, he didn't know it was in his bag. He packed up his duffle and forgot he tucked in some C4.
  Possible 01%, but in the end questionable.
