PETA to Cite 13th Amendment in Suit Challenging Killer Whale Captivity; Prof Sees Standing Problems

People for the Ethical Treatment of Animals plans to file a lawsuit today in federal court in San Diego that lists five killer whales as plaintiffs.

The suit will contend the five orca whales are being held by SeaWorld in violation of the 13th Amendment’s ban on slavery, according to the Associated Press and the Los Angeles Times blog L.A. Now. The whales are represented in the suit by next friends that include PETA, orca experts and former SeaWorld trainers, according to a press release.

PETA general counsel Jeff Kerr tells AP he believes the suit will be the first to seek constitutional rights for an animal species. "By any definition, these orcas are slaves—kidnapped from their homes, kept confined, denied everything that's natural to them and forced to perform tricks for SeaWorld's profit," said Kerr. "The males have their sperm collected, the females are artificially inseminated and forced to bear young which are sometimes shipped away.”

Animal rights law professors contacted by AP didn’t give the suit much chance of success. Law professor David Favre of Michigan State University predicted an early dismissal. “The court will most likely not even get to the merits of the case, and find that the plaintiffs do not have standing to file the lawsuit at all," he wrote to the wire service in an email.

Favre has proposed giving animals more rights by creating a new legal category called “living property.”

SeaWorld officials maintain the suit is a publicity stunt. In a statement, the marine park said it sets high standards for care of its animals and follows the strictures of the Marine Mammals Protection Act.

How did I know this was coming...

And here we get to the... meat... of the issue.

Of course, there is no mention of heritage farms (like Polyface) because PETA would be hard-pressed to find anything to bitch about.  Well, perhaps the animals basically doing all the work would have them claiming "slavery!!" or something stupid like that.

I'm sorry, but sometimes it just seems like these people do shit like this because they really honestly have nothing better to do with their lives.  They're about as useless as 3/4's of the federal workforce.

WTF I just cannot believe people are that f**king NUTS. They do not even see their own rights being stripped away every day and then start this bullshit. and then actually get a lawsuit filed.Where the dumbness passes right on to the idiot lawyers and of course some dumb ass judge will hear the case.  Good Lord when will it end.

I believe this is a move in the direction wherein people are not allowed to rear chickens for eggs, etc.   I heard that the government says to shoot elk on sight "because they have some form of mad cow disease."  The true agenda there is for there to be no wild game to feed ourselves with.

Then, you move on to the patenting of intellectual material, including words in our language.  The agenda here is right out of 1984.  It paves the way to eliminate words from our language through not being able to use them.  Language is a living thing.  It absurdly starts with not being able to use the patented word Coca Cola & where does it end.  Incredible...

Why not give animals equal rights... after all Man has been classified as just another animal since 1906. isn't that reason enough to give animals equal status?

Section 6, Pure Food and Drug Act (1906) That the term “drug,” as used in this Act, shall include all medicines and preparations recognized in the United States Pharmacopoeia or National Formulary for internal or external use, and any substance or mixture of substances intended to be used for the cure, mitigation, or prevention of disease of either man or other animals. The term “food,” as used herein, shall include all articles used for food, drink, confectionery, or condiment by man or other animals, whether simple, mixed, or compound.

The turn of the 19th/20th signaled the fall of the bulk humanity from grace to merely animal stature; leaving the elite alone as a separate species, as gods if you will, having dominion over the earth and all that walks, crawl, flies, or swims upon it. They have been destroying our genes ever since through the wrong use of science, with industrial medicine, in our diet, our water,  and the air we breath...

It is to this end, total animal equality, that PETA founded in the first place.

It's really important that there is legislation terming us as "animals."   Consider the source & they do really consider us animals!

Along with the legislation, "consent is assumed."  This is the pathway for forced vaccines, chemtrailing, mind control, lack of fundamental rights in what we eat...and the list goes on.

To me, we need to change legislation wording wherever this is found.  We need to sign every petition indicating we "do not consent," and be aware of the religious objection defense.

Indeed, TPTB constantly harp on and influence society with "there is no God," "no Religion allowed."  Religion was abolished in communist Russia.  Religion and speaking of God does not happen in communist China. There is reason for this, and it isn't about one's beliefs in a Creator, or not.  TPTB do believe in a Creator God.

Getting the masses to believe there is no God and to have no religion has great purpose considering the legislation above.  If one believes in say, the Bible, man is definitely NOT considered to be an animal.  The distinction is made.  To have religious objection as a defense (ok to refuse a vaccine, ok to make colloidal silver, ok to eat what we want) requires having a religious belief or at least a belief in a Creator God.
