WHITE PLAINS, N.Y. (CN) - Five Westchester residents and the Second Amendment Foundation cannot relax a law forcing citizens to demonstrate proper cause before they pack heat on public streets, a federal judge ruled.

New York courts have interpreted "proper cause" as having a "special need for self-protection" as compared to the general population.

"I hold that the state has an important government interest in promoting public safety and preventing crime," U.S. District Judge Cathy Seibel wrote in an order dismissing a class action challenging the regulation.

Alan Kachalsky, Christina Nikolov, Eric Detmer, Johnnie Nance and Anna Marcucci-Nance say their applications for full-carry permits were rejected, even though they had all been trained in firearms and had spotless criminal records.

Over Labor Day weekend, 48 people were shot in a city where the carriage of a firearm for self-defense is discouraged... and the mayor wants stricter gun control laws.

Up is down, down is up.  The People of NY need to lobby for a shall issue permit process.  It's the logical first step... obviously fighting the may issue system doesn't work when the judiciary sides with the executive despite the statistics.

What? Proper cause? Being a citizen of the US is proper cause! Besides, there is no such provision in the Constitution for "proper cause" to bear arms! That's absurd. The only proof they need to demonstrate is their right under the Constitution to bear arms. Period.

How insane is it that the very government tyranny that the Constitution protects it's citizens from under the 5th Amendment is the one that is trying to tell the citzenary they cannot bear arms unless the government says so?

It's like asking a criminal to judge and sentence their own trial. Simply insane.

Right on! That judge is an offense to the whole idea of America, so what qualifies her to sit on that bench if she doesn't even adhere to the basic principle of what he's supposed to uphold and protect?
