So, fight the law. The law is draconian, never questioned that part. But "gay" is only relevant to the story as that was the info that was dug up. It could just as easily been the officer's address or his preference of TV shows. The result would still be that of a draconian law.

If you are against this law - follow my instruction at the top to INVADE the NSW Police forum and expose to their minions the truth about Australia's first "gang" laws being misused by gay police. I had hoped that the Opposition would have analysed this bill and not have been conned again by a piece of law and order legislation. This bill could be used to run cover for a corrupt law enforcement officer. Before honourable members erupt, I ask them to contemplate proposed section 60C. This section could be used to prosecute a person seeking to collect and collate information on a corrupt police officer, or a person who was simply exercising his right to ask for an officer's badge number or name in order to make a complaint to the Ombudsman. That is why the Greens are opposing this legislation. The key problem lies in proposed section 60C and the prohibition on collecting information about a law enforcement officer with the intent of harming that officer. When one thinks about "harm" one might ask how the Greens can possibly oppose the bill. However, we need to examine the definition of "harm".

The Law Society advises by a letter dated 24 June from its president, Ms Kim Cull, that this prohibition could include the collecting of information with legitimate purposes, such as exposing corruption or alleging adverse behaviour. This is because the exposure of corrupt or adverse behaviour would harm the enforcement officer. Consequently, this bill would open the floodgates to corrupt or bullying officers, who would be able to intimidate members of the public who collected data with the intention of exposing the behaviour of those officers.

The level of corruption in the police force is periodically opened to the public's gaze with Police Integrity Commission inquiries and other investigations. Indeed, recently in the House I gave an example in which the actions of corrupt police officers had led to hardship for a number of individuals who are at their wits end trying to work out how to get justice after they have been charged or they have suffered in some way because of the actions of corrupt officers.

This is real, it does happen, and it is something that this House should address. We talk about victims of crime, but we should talk even more about victims of crimes that are perpetrated by corrupt police officers. This is not a law and order bill. It is not justice. It is at best incompetent, and at worst it would work to cover corruption in the police force or in other enforcement agencies. In many senses, it is a great leap backwards to the bad old days of endemic corruption and bullying behaviour by our police force.

The Greens will seek to amend this bill in Committee to ensure that proposed section 60C can never be used against individuals who are acting in the public interest or out of other legitimate motivations. I ask both the Government and the Opposition to consider this carefully. Our amendments propose only that individuals acting in the public interest be allowed to continue with that work and not be penalised by section 60C. Indeed, that would be the outcome if section 60C is allowed to go through unamended.

As the Council for Civil Liberties stated in its press release [NB: They now deny this press releases existence because they love special gay police], the bill undermines the right of ordinary citizens to monitor and comment on law enforcement officers. The bill needs to contain a public interest defence, and should deal only with actual demonstrated harm to law enforcement officers. One of the fears I have with the bill is that police and law enforcement officers will use it as a weapon when it is clearly intended as a shield. The Minister in his second reading speech said that harassment and intimidation of law enforcement officers has the potential to pervert the course of justice. I agree with that proposition. However, it also needs to be said that justice will be perverted if law enforcement officers use this legislation to avoid scrutiny and accountability. Police officers, corrective services officers and public watchdogs are not above the law. They perform a very important public duty that happens to involve law enforcement. Justice demands that the work of law enforcement officers is transparent, since abuse of the power of law enforcement is perhaps the most cynical and perverse of all abuses of power. I cannot imagine a greater injustice than to be imprisoned for a crime I did not commit.

    From the outset I would like to note that I am happy to discuss issues of concern to you but your attacks against gay and lesbian rights are not welcome. The Greens uphold and defend the dignity and humanity of lesbian, gay, bisexual, transgender and intersex (LGBTI) people. We will not tolerate a person being harassed, abused, vilified, stigmatised, discriminated against, disadvantaged or exploited because of their sexuality or gender. If you vilify gay or lesbian people in your emails or phone calls to us they will not be responded to.
     
    As far as asking your question in question time I do not think it is appropriate to use this place for unsubstantiated allegations. If you tell me the name and other details of the person you allege is being effected by these laws I am content to look into this further.
     
    The Greens are on the record as not supporting the gang laws or the bikie laws and we will continue to work to have them repealed.

It get's better and better. NSW Police DID NOT notify Aboriginal Legal Aid as is the law under the LEPRA Act that they had an aboriginal youth in custody and gave out the business card for one Tas Tasdemir (http://www.tasdemirlawyers.com.au) to poach the Federally funded Aboriginal Legal aid's case with corrupt NSW state funded legal aid. The Corrupt NSW Police are using Copy right infringement to censor them braking the law.
On that censored tape was Sargent Brill bragging about getting an 18 year old boy to confess to the rarest crime in Australia, and first "outlaw motorcycle gang law", that foreigners from Australia would call Australia's first domestic terrorism offenses that criminalizes the act of knowing any information that can be used against corrupt police.

Also my dad is being blocked from entering the courtroom with a pencil under threat of arrest by Police, not sheriffs who are meant to police the court room.

Ever seen artwork on the TV drawn in court? The police must be using this contempt of court threat to the media too so they can control what stories about crime get published and what don't.
This is dangerous misuse of selective enforcement to put fear of jail into the media for covering a not NSW Police media unit approved story.

The irony is the NSW Police media unit actually broke this story before they realized they worn't successful after all in censoring damaging content from the internet that showed the whole matter was about a black teenager calling a cop a "fag" after the boy was assaulted in a skate park because he was black teen.

Here is the police bragging about getting the boy to confess to the rarest thought crime in Australia, the crime of knowing the sexual preference of the police officer.

They are trying to change the matter now to make it a crime to know an officer's name, but when the law was introduced the Police minister promised the law wouldn't be used in this fashion.


My dad was just told after travelling 1500km to get to Port Macquarie for covering the pre-trial matter if he used a pencil in court he would be arrested for "contempt of court" for going to an open court session with a pencil just like the government approved journalists.

There is no law in Australia do distinguish between press and regular citizens in a court room watching a court case.

To think that back in the Roman days you could be asked if your preference was towards men or women to choose and sleep with, you wouldn't be punished for knowing that about him/her. Gee mom, we've come so far in our advanced understanding ever since those primitive days. I mean, back in those days it didn't matter if you were offered to sleep with a man or a woman. But if you know someone who prefers this nowadays, you're in a lot of trouble. And if you catch them in the act... Oh lord (no pun).
