Obama Letter to Congress on Libya Sparks Protests

WASHINGTON-President Barack Obama Monday formally notified Congress the U.S. had begun military attacks on Libya, prompting complaints from lawmakers that the president waged war without congressional consent, appearing to contradict his own previous position.

In a letter to congressional leaders, the president said the U.S. had "commenced operations to assist an international effort authorized by the United Nations (U.N.) Security Council" and "to prevent a humanitarian catastrophe and address the threat posed to international peace and security by the crisis in Libya."

Presidents over the decades have conducted military operations without prior congressional approval, including Harry Truman in Korea, George H.W. Bush in Iraq and and President Bill Clinton in Serbia. Congress in 1991 approved the Iraq military action, five months after Mr. Bush deployed forces to the region in response to Iraq's invasion of Kuwait. The military action in Libya, which Congress wasn't asked to approve, irked lawmakers.

From OP’s article:

Quote
Sen. Jim Webb, (D., Va.,) said in an interview Monday with MSNBC, "We have not had a debate and I know that there was some justification put into place because of concern for civilian casualties, but this isn't the way that our system is supposed to work."

Quote
In 2007, Mr. Obama, then a presidential candidate, said, "The President does not have power under the Constitution to unilaterally authorize a military attack in a situation that does not involve stopping an actual or imminent threat to the nation."

Explanation….

Quote
“The White House said the president's actions don't contradict his earlier views, noting that the president met with a bipartisan group of lawmakers regarding Libya before any action took place.”
A senior administration official said that the 2007 comment envisioned "an invasion like we saw in Iraq. A mission of this kind, which is time-limited, well-defined, and discrete, clearly falls within the President's constitutional authority."
<snip>
The president, with his letter, appeared to meet the requirements of the 1973 War Powers Resolution, which says only that in cases where the president doesn't seek prior approval from lawmakers, the president must notify Congress within 48 hours of committing armed forces to military action and puts a 60 day deadline on such actions.

Mission accomplished!  CYA in 60 days when we rename it “the long war”

Quote
Mr. Obama's notification letter does not satisfy the constitutional requirement that Congress approve military action, says Lou Fisher, former researcher with the Congressional Research Service and an expert on war powers. Mr. Fisher also raised objections to Mr. Obama citing United Nations authorization in his letter.

"It's impossible for Congress to take its war powers and give it to the U.N.," Mr. Fisher said. "Other than defensive actions—and there's no defensive actions here—this has to be done by Congress."

Small, brief voice of sanity…

Quote
House Speaker John Boehner doesn't believe the president always needs congressional approval to go take military action, a spokesman for the Ohio Republican said. However, "members of Congress from both parties, as well as the American people, are demanding the administration do a better job answering some basic questions about the scope and purpose of our mission in Libya, America's role, and how it will be achieved," said the spokesman, Brendan Buck.

Kiss up all you want, John. Fact is, there’s limited time till your owners tell you …

Libyan bombing 'unconstitutional', Republicans warn Obama

US public opinion split as Republicans claim Obama's use of military force in Libya is 'an affront to our constitution'

**Congressman Roscoe Bartlett, a Republican on the House armed services committee, was among members who argued that military action in Libya was unconstitutional. He told the Hill magazine: "The United States does not have a King's army. President Obama's unilateral choice to use US military force in Libya is an affront to our constitution."

**Ileana Ros-Lehtinen, a Republican who chairs the House foreign affairs committee, called on the president to "clearly define for the American people what vital United States security interests he believes are currently at stake in Libya".

**The Republican House speaker, John Boehner, in a statement issued on Sunday, underlined the dilemma for Republicans. His statement was aimed primarily at criticising Obama for lack of consultation but he began by expressing support for intervention.

**Republicans such as Senator John McCain have criticised Obama for acting too late, suggesting the forces would have been more effective if deployed weeks ago.

US public opinion split...

No, it isn’t.  Well, on second thought, if they consider themselves “the public” then the split would be something like 99.997 vs .003 percent of the US population.

But since members of the Republican Party stand to make serious bank over this, I’m reminded of their official plans for the American people.

"Pornography and politics are two growth industries, and we don't think the nation can be too picky about where the jobs are coming from." -- Republican Caucus spokesman, Dec 2010

So why won't the brave members of Congress pass legislation that prohibits the President from taking military action without the consent of Congress?

He's commander of the military. Not the King. Oh but I forgot, he was illegally elected, so he's not really President.

Does that mean he's King?

As I no doubt imperfectly understand (from having been made to read Schlesinger on the subject), the brave members of Congress essentially handed their constitutional right to declare war to the President some time ago, under the auspices of “expediency,” of course:

The movie directors and financiers have always held the highest authority, not the paid actors. It becomes quite predictable when they have already given us the script.

According to a letter blasted to his email list, Kucinich plans to offer an amendment to the next spending bill to ensure no federal funds go to the bombing campaign in Libya.

The amendment would give Congress a more concrete opportunity than they’ve had to challenge President Barack Obama on Libya, a subject that has riled both sides of the aisle.

President Franklin Roosevelt signs the declaration of war against Japan on Dec. 8, 1941, following the bombing of Pearl Harbor.   After the war was over A declaration of peace was never signed
Denigration of formal declarations of war
In Classical times, Thucydides condemned the Thebans, allies of Sparta, for launching a surprise attack without a declaration of war against Plataea, Athens' ally - an event which touched off the Peloponnesian War.[11]

The utility of formal declarations of war has always been questioned, either as sentimental left overs from an age of chivalry or as imprudent warnings to the enemy. For example, writing in 1737, Cornelius van Bynkershoek judged that "nations and princes endowed with some pride are not generally willing to wage war without a previous declaration, for they wish by an open attack to render victory more honourable and glorious."[12] Writing in 1880, William Edward Hall judged that "any sort of previous declaration therefore is an empty formality unless the enemy must be given time and opportunity to put himself in a state of defence, and it is needless to say that no one asserts such a quixotism to be obligatory."[13]

In the United States, Congress which makes the rules for the military has the power under the Constitution to "declare War," however there is no prescribed legal format for what a War declaration will look like in the United States Constitution or by law. Declarations have the force of law and are intended to be executed by the President as Commander in Chief of the armed forces. The last time United States passed a bill with the title "Declaration of War" was in 1942, against Romania. Since then, the United States has used the term "Authorization to use Military Force" as in the case against Iraq in 2003. Sometimes decisions for military engagements were made by US presidents, without formal approval by Congress, based on UN Security Council resolutions that did not declare UN or its members at war. Other times, for example, part of the justification for the United States invasion of Panama was to capture Manuel Noriega (as a prisoner of war)[14] because he was declared a criminal rather than as belligerent

They are sending Qatari aircrafts to the air base in Corsica so they can participate to the attacks against Libya.
Where will this madness end?

Qatari fighters deployed to Solenzara, expected to begin flying for OdysseyDawn by the weekend

So why won't the brave members of Congress pass legislation that prohibits the President from taking military action without the consent of Congress?

He's commander of the military. Not the King. Oh but I forgot, he was illegally elected, so he's not really President.

Does that mean he's King?

That's already in the Constitution. No need for more and more "resolutions". That's just clutters up the place. But then that is part of their agaemplan, to literally swamp the public with resolutions and general information overload all the while completely ignoring the Constitution which already covers all of this.

King? Nay, just dictator by fraud.

Four Qatar Emiri AF Mirage 2000 Mk5 jets now at Solenzara, with plans to start operations within 48 hours.
(i.e. bombing Libya)

Why would the Emir of Qatar want to get into this when the UAE said they would only participate to humanitarian ops and would send no airplanes to bomb Libya?

Pure madness.

Rome plays a role.

They've got a role all right. After Napoleon abolished Papal civil power, the Vatican didn't just fade away. They've worked behind the scenes thru infiltration of governments and secret societies ever since via Masons and Jesuits.  If they ever regained civil power a new inquisition wouldn't be far behind.

Thanks for the heads up. Did a quick search and found like the who's who in American(NWO) government.

Don't want to hijack the thread, but it's all connected. The sad part to me is that the so-called Protestant Reformation was more of a rebellion. The daughters of the old whore didn't really reform the Greco-Roman-Babylonian Sun Worship foundation, and as a result never renounced Papal spiritual authority, according to Catholic hierarchy. In fact, I heard this with my own ears years ago when Robert Schuller(Reformed Dutch) was going on about how his Crystal Cathedral came to be. He said that he had the architectural plans approved by the Pope!

VOTKINSK, Russia (Reuters) - Russian Prime Minister Vladimir Putin Monday likened the U.N. Security Council resolution supporting military action in Libya to medieval calls for crusades.
