1. Obama may have lied about conversations with convicted fraudster Tony Rezko

Blagojevich's lawyers allege that Rezko admitted breaking the law by contributing "a large sum of cash" to a public official. Blagojevich's attorneys say that public official is Obama. Obama said that Rezko never relayed a request from a lobbyist to hold a fundraiser in favor of favorable legislative action. But the point may be moot: regardless of Obama talking/not talking to Rezko, Blagojevich's attorneys say that Obama refused the request regardless.

Redacted portion: However, the defense has a good faith belief that Mr. Rezko, President Obama’s former friend, fund-raiser, and neighbor told the FBI and the United States Attorneys a different story about President Obama. In a recent in camera proceeding, the
government tendered a three paragraph letter indicating that Rezko “has stated in interviews with the government that he engaged in election law violations by personally contributing a large sum of cash to the campaign of a public official who is not Rod Blagojevich. … Further, the public official denies being aware of cash contributions to his campaign by Rezko or others and denies having
conversations with Rezko related to cash contributions. … Rezko has also stated in interviews with the government that he believed he transmitted a quid pro quo offer from a lobbyist to the public official, whereby the lobbyist would hold a fundraiser for the official in exchange for favorable official action, but that the public official rejected the offer. The public official denies any such conversation. In addition, Rezko has stated to the government that he and the public official had certain conversations about gaming legislation and administration, which the public official denies having had.

Redacted footnote: The defense has a good faith belief that this public official is Barack Obama.

2. Obama may have overtly recommended Valerie Jarret for his Senate seat
Blagojevich's defense team basically alleges that Obama told a certain labor union official that he (Obama) would support Valerie Jarrett's candidacy for the Senate seat. Jarrett, referred to as "Senate Candidate B", is now a senior advisor to the president.

Redacted portion: Yet, despite President Obama stating that no representatives of his had any part of any deals, labor union president told the FBI and the United States Attorneys that he spoke to labor union official on November 3, 2008 who received a phone message from Obama that evening. After labor union official listened to the message labor union official told labor union president “I’m the one”. Labor union president took that to mean that labor union official was to be the one to deliver the message on behalf of Obama that Senate Candidate B was his pick. (Labor union president 302, February 2, 2009, p. 7).

Labor union official told the FBI and the United States Attorneys “Obama expressed his belief that [Senate Candidate B] would be a good Senator for the people of Illinois and would be a candidate who could win re-election. [Labor union official] advised Obama that [labor union official] would reach out to Governor Blagojevich and advocate for [Senate Candidate B] ... [Labor union official] called [labor union president] and told [labor union president] that Obama was aware that [labor union official] would be reaching out to Blagojevich.” (Labor union official 302, February 3, 2009 p. 3).

3. A supporter of President Obama may have offered quid pro quo on a Jarrett senate appointment
Redacted portion: Supporter of Presidential Candidate Obama is mentioned in a phone call on November 3, 2008, having offered “fundraising” in exchange for Senate Candidate B for senator (Blagojevich Home Phone Call # 149).

4. Obama maintained a list of good Senate candidates
Redacted portion: President-elect Obama also suggested Senate Candidate A to Governor Blagojevich. John Harris told the FBI and the United States Attorneys that he spoke to President’s Chief of Staff on November 12, 2008. Harris took notes of the conversation and wrote that President’s Chief had previously worked as Blagojevich's press secretary. Obama agreed of Staff told Harris that Senate Candidate A was acceptable to Obama as a senate pick. (Harris handwritten notes, OOG1004463) President’s Chief of Staff told the FBI that “he could not say where but somewhere it was communicated to him that” Senate Candidate A was a suggested candidate viewed as one of the four “right” candidates “by the Obama transition team.”

5. Rahm Emanuel allegedly floated Cheryl Jackson's name for the Senate seat
Redacted portion: President’s Chief of Staff told the FBI that he had a conversation discussing the Senate seat with Obama on December 7, 2008 in Obama’s car. President’s Chief of Staff told the FBI “Obama expressed concern about Senate Candidate D being appointed as Senator.

[President’s Chief of Staff] suggested they might need an expanded list to possibly include names of African Americans that came out of the business world. [President’s Chief of Staff] thought he suggested Senate Candidate E who was the head of the Urban League and with President’s Chief of Staff’s suggestion.

6. Obama had a secret phone call with Blagojevich
Redacted portion: President-elect Obama also spoke to Governor Blagojevich on December 1, 2008 in Philadelphia. On Harris Cell Phone Call # 139, John Harris and Governor’s legal counsel discuss a conversation Blagojevich had with President-elect Obama. The government claims a conspiracy existed from October 22, 2008 continuing through December 9, 2008.6 That conversation is relevant to the defense of the government’s theory of an ongoing conspiracy. Only Rod Blagojevich and President Obama can testify to the contents of that conversation. The defense is allowed to present evidence that corroborates the defendant’s testimony.

Defense lawyers for ousted Illinois Gov. Rod Blagojevich want to see President Obama testify at the former governor's June trial and have moved to subpoena the president, CBS 2 Chicago reports.

Blagojevich pleaded not guilty to federal corruption charges that accuse him of scheming to get a lucrative job or cash in exchange for the Senate seat Mr. Obama left open when he assumed the presidency.

Mr. Obama has stated publicly that he was "confident that no representatives of mine would have any part of any deals related to this seat," a motion to issue the subpoena states. Yet the motion contends that "President Obama's public statements contradict other witness statements." It specifically cites statements from a labor union official whom Blagojevich met with and believed to be in contact with the president.

The labor union official is expected to be a prosecution witness, so Blagojevich's defense team wants Mr. Obama to act as a corroborating witness for the former governor, the Chicago Sun-Times reports.

The court papers made no allegations of any wrongdoing on Mr. Obama's part, the Associated Press adds.

The FBI and federal prosecutors interviewed Mr. Obama for two hours last year regarding the Blagojevich case, the motion states, but the defense team never received the documents from the interview that they requested.

A spokesperson for the White House declined to comment on the subpoena request, CBS News White House Correspondent Mark Knoller reports.

It was either pretty stupid or arrogant to drop the hammer on Blagovich the way they did, when they knew they were in this thing up to their necks.  Maybe, they were hoping he'd just lie down, or cut a deal.

Makes me wonder how they are going to get around this thing, especially headed into the midterm elections.

The Chicago way would be to make this guy disappear, I think.

Wow.

Goes to show how overboard with power these guys were (Barry, Rahm) before they'd even assumed office.  Not enough he was going to be President, he wanted to broker the next Senator to take his seat.  Gods in their spheres.

Blagojevich Evidence Stolen: Burglary At Lawyer's Offices

CHICAGO — Burglars broke into the offices occupied by two members of former Gov. Rod Blagojevich's legal defense team overnight and stole eight computers and a safe, police said Friday.

The break-in occurred at the South Side offices of veteran Chicago criminal defense lawyer Sam Adam and his son, Samuel E. Adam, police said. They are two of the three leading members of the team defending Blagojevich on charges that he schemed to sell or trade President Barack Obama's former U.S. Senate seat.
Chief of detectives Steve Peterson told a news conference that detectives don't know whether anything related to Blagojevich's federal fraud case was contained on the computers. But he said they are interviewing the attorneys.

Even if the computers contained sensitive material related to the federal case against Blagojevich, the lawyers had all of its material in backup files on a master server elsewhere in the offices that was untouched by the burglars, according to an individual with knowledge of the legal defense team.

A number of discs with material related to the case were around the office but not taken, said that person who spoke only on condition of anonymity.

Police said the burglars broke into the offices overnight and at some point tripped an alarm.

Several attorneys besides the Adamses work out of the offices.

The third key member of Blagojevich's legal defense team, Sheldon Sorosky, works out of his law firm's downtown offices.

Sam Adam is a veteran of 40 years of criminal law practice in Chicago and has handled numerous high-profile cases. His son gained the spotlight last year with shouting, whispering, table-pounding closing arguments at R. Kelly's trial on child pornography charges, which ended with the R&B singer's acquittal.

Sunday, two state representatives called for the National Guard to come in and help stabilize Chicago communities plagued by daily violence.

State Rep. John Fritchey, from the north side, and Rep Lashawn Ford, from the south side urged Gov Quinn to deploy the Guard in Chicago.

The state reps aren't talking about having National Guard troops with tanks in the street or taking over neighborhoods or walking around with machine guns. They say the Guard's presence alone will go a long way.

Superintendent Weiss, who served six years in the military, would rather see stricter gun laws and the street "code of silence" broken down. Although he said he is willing to discuss the possibility on the Guard's presence if Mayor Daley is willing to.

Attorneys for former Illinois governor Rod Blagojevich submitted a motion to the court on April 22, 2010 to issue a subpoena (ad testificandum) to obtain Barack Obama’s testimony at his corruption trial scheduled to begin in June. Parts of the document have been redacted, presumably with the information that has been leaked. Not only is Blagojevich pressing for Obama to testify at the trial, but he also wants to force the release of “any and all reports generated during any and all interviews [prosecutors] had with…Barack Obama.”

In early December 2008, Blagojevich was arrested on criminal charges which included the attempted sale of the Senate seat vacated by Obama as well as conspiracy to commit wire and mail fraud and bribery.  The federal indictment against Blagojevich and his former chief of staff, John Harris, can be found here.

A footnote at the bottom of the first page of the subpoena of April 22, 2010 indicates that Blagojevich’s defense team preferred to have all “sealed” information made available to the public but acknowledges that “portions that contain sealed information provided by the government have been redacted.”

However, James B. Zagel, the presiding judge, scheduled an emergency evening meeting in his chambers on April 22, 2010 to ask attorneys to explain how redacted information showed up in a released defense filing. According to the judge, that information was to have remained sealed.

Blagojevich’s attorneys are requesting that Obama provide testimony “because he is a witness necessary to Rod Blagojevich’s Constitutional right to a fair trial” (p. 10).

An unredacted version of the subpoena can be found here which shows a total of 15 redactions.

The redacted information covered several issues and begs answers to many questions, among them:

1. Did Obama lie about his conversations and dealings with Tony Rezko, his former friend and fundraiser?

On page 2 of the subpoena, Blagojevich’s lawyers assert that they have requested documentation from the government on an interview between FBI agents and Obama in December 2008 but have received nothing.  Defense lawyers also claim that “… Obama has direct knowledge to allegations made in the indictment.  In addition,  …Obama’s public statements contradict other witness statements…”

A report from December 2009 states that Obama, Valerie Jarrett and Rahm Emanuel, Obama’s Chief of Staff, were interviewed by the FBI.

The judge has set a trial date for June 3, 2010.

A federal judge in Chicago has denied a request from lawyers for ousted former Illinois Gov. Rod Blagojevich to subpoena President Obama to testify in Blagojevich's upcoming corruption trial.

Zagel said he might be willing to reconsider the issue during the course of the trial — which is set to begin June 3 — if Blagojevich's lawyers submit more evidence that they need Obama's testimony. 

The ruling came on the sameday that Blagojevich's onetime chief of staff and running buddy Lon Monk pleaded guilty today for a second time to crimes tied to the Blagojevich administration.

Monk, 51, admitted to conspiring to solicit a bribe from a horse-racing businessman for a campaign contribution in exchange for getting a bill signed.

Monk is cooperating with investigators and pleaded guilty again after prosecutors filed new charges, crafted to deal with a possible future ruling from the U.S. Supreme Court that experts say could strike down of the federal "honest services" fraud statute.

Monk has agreed to serve 24 months in prison.

After Blagojevich's attorneys' court appearance, a reporter asked one of his lawyers, Sheldon Sorosky, what it would have done for the president's image if he had been made to testify.

"It would not hurt him at all,” Sorosky said. “It would help his image.”

Defense lawyers last week said they wanted Obama to testify about the sequence of events surrounding his vacant senate seat in 2008.

Blagojevich is accused of wide-ranging corruption, including an accusation that he tried to trade an appointment to fill the U.S. Senate seat left vacant by Obama in exchange for campaign cash or personal benefits, such as a cabinet appointment for himself.

The Blagojevich defense team also wanted Obama to testify about his relationship with corrupt businessman Tony Rezko, who has been cooperating with authorities since his 2008 conviction on corruption charges involving state business under the Blagojevich administration.

"He said he would revisit the issue, should we present more evidence," Sorosky said of the judge's decision. "A lot depends on whether Tony Rezko testifies."

The Chicago Sun-Times has reported that prosecutors have not reached a cooperation deal with Rezko, despite his cooperation.

Well, this just means Barry won't have to perjure himself. Some incriminating things could still come out at trial. I think they've got to find some other way to make this thing disappear at this point, and I wouldn't be surprised at any means used to accomplish that.
