Lawyer: Amy Bishop Talked Into Plea Deal

HUNTSVILLE, Ala. (AP) -- A defense lawyer says a former Alabama college professor who pleaded guilty to shooting six people had to be talked into accepting a plea deal that took away the possibility of a death penalty.

An attorney for Amy Bishop told The Associated Press on Tuesday that the Massachusetts native was terrified of being sexual abused in Alabama's lone women's prison. Lawyer Roy Miller says she also didn't want to "live in a chicken coop the rest of her life."

Miller says the 47-year-old Bishop agreed to plead guilty and accept a life sentence only after talking with her parents.

Bishop is also charged with murder in the death of her teen-aged brother in Massachusetts in 1986. It's not clear whether she'll stand trial on the charge there.

A former college professor who killed three people and wounded three others during a faculty meeting wanted to go to death row and had to be convinced by her parents to accept a plea deal that spared her life, her lawyer said Tuesday.

Amy Bishop, 47, didn't want to live among other inmates because she was terrified of being sexually abused in Alabama's lone women's prison, defense attorney Roy Miller told The Associated Press.

"She wanted to die," he said. Bishop also didn't want to "live in a chicken coop the rest of her life," he said.

A judge sentenced Bishop, a Harvard-educated biologist, to life without parole Monday after jurors convicted her during an abbreviated trial. She pleaded guilty earlier this month, but state law required a trial because she admitted to a capital murder charge.

Authorities have said Bishop opened fire during a University of Alabama biology department meeting in Huntsville on Feb. 12, 2010, because she had been denied tenure.

Bishop, who had been held without bond in the Madison County jail since the shootings, was transferred to Julia Tutwiler, the women's prison, on Tuesday afternoon, a prison official said.

Bishop accepted a plea deal only after talking with her mother and father, Miller said.

"She was never inclined to plead guilty to life without parole," he said.

Bishop attempted suicide once in the county lockup by cutting her wrists, authorities said.


The Justice Department is reviewing allegations of rape, sexual assault and harassment by male guards at Tutwiler prison after a legal aid group filed a complaint in May. The Montgomery-based Equal Justice Initiative said it based the claims on interviews with more than 50 women at the maximum-security prison, located north of Montgomery.

Prison system spokesman Brian Corbett said Bishop would likely spend about a month in a cell by herself before moving into the prison's general population.

"I'm sure that every inmate entering the system has their own set of unique fears," Corbett said in an email. "I cannot address hers on an individual basis."

Bishop met at the jail Tuesday with a defense attorney representing her on a murder charge in her native Massachusetts, where she is accused of killing her brother with a shotgun blast in their home in Braintree in 1986. Authorities initially ruled the shooting accidental, based partly on claims by Bishop's mother, who said her daughter didn't mean to kill Seth Bishop, who was 18 at the time.

Authorities in Massachusetts said they would make a decision later this week on whether to pursue the case.

Madison County District Attorney Rob Broussard said a prosecutor from Massachusetts phoned him last week to ask about Bishop's plea.

"He wanted verification from me on the guilty plea and that life without (parole) really means life," Broussard said. "It does."

A spokesman for Norfolk District Attorney Michael Morrissey in Massachusetts declined comment.

Bishop could have been sentenced to death by lethal injection if she had gone to trial and been convicted of capital murder, but none of the victims were pushing for a death sentence and some actively opposed it, Broussard said.

"The settlement was a just outcome," he said.

Miller said Bishop would likely never face trial in Massachusetts because Alabama is unlikely to send her there.

"Based on my experience, I don't foresee her ever going up there to face that," he said. "Practically speaking, it would be a disaster if she escaped or something happened."

A police investigator testified that Bishop initially denied having anything to do with the rampage. And during the trial, Bishop shook her head anytime the judge or prosecutors described the killings as intentional.

Broussard doesn't believe Bishop's mental illness led to the UAH shooting. He said that while Bishop expressed confusion about the shootings during the police interview, comparing it to being in the film "The Matrix"

It seems to me the main goal of the lawyers in these cases is to convince his client to cop a plea, thereby saving himself from the death penalty.  Certainly they never seem to question in any way the basic assumptions of the crime.  In fact they seem to fall over themselves declaring the patsy to have done the killings, thereby demonizing their client in the public's mind.

It also appears that the amount of MONEY determines the outcome of court cases. They wanted us to see the OJ trial. Corporations skate. Government skates. Rich families skate. (the kind that can purchase countries) Individuals go to jail after liquidating any assets they might have. Sometimes poor people with nothing to steal get let go because it would cost somebody else money to deal with them.  Justice is not blind. It is greedy. The courtroom players are generally well-paid showmen that mask this process. Occasionally, there will be judges and lawyers who just want to do what’s right. But these types seem to be rapidly fading away.

Absolutely with regards to money.  If you got it, you buy the best lawyer money can buy.

I want to see more jury nullification!!

The mad mass killer always makes sure to leave extra ammo, guns, receipts, etc in his/her domicile and/or car to close the circle of guilt in the public's mind.


"Said Bishop left 3rd floor, went to ladies’ bathroom on 2nd floor. Washed gun, put it in trash basket. Put her jacket in trash basket."

So she makes sure to get rid of her fingerprints on the weapon, and then... puts her own bloody jacket right on top of the gun.  Uh-huh.....

She says she wasn't there, and there is remarkably little evidence that puts her in the conference room at the time.

The Unanswered Questions of this Case:


--0f the 12 people in the conference room at the time of the shooting, three are dead, two were seriously injured and might not remember much, which leaves seven witnesses.  0nly one of these, a Professor Moriarity, has been publicly interviewed and has identified Bishop as the shooter.  Where are the other interviews of survivors, and why haven't three of the unharmed witnesses even been identified?

--Why did Amy Bishop repeatedly say "It didn't happen. There's no way .... they are still alive" in the first interviews after her arrest?  What did she mean by that?

--In the first hours after the shooting, the local newspapers website posted a photo of another person being led away in handcuffs from the scene.  Who was this person, and why do commentators who did see this photo say it looked like a man wearing women's clothing?  Why was he/she carrying 'shells' in her/his pockets?  Where did they come from?  What caliber were they?  Did they smell like they had recently been fired?  Were all the expended shells from the shooting recovered at the crime scene?

--Is there any of the ubiquitous video evidence that is everywhere nowadays that places her at the scene?  None has been released.

--Was Gun Shot Residue evidence found on her hands?  Were her fingerprints found on the weapon recovered?  Did the recovered weapon smell like it had recently been fired?  Can all the slugs and expended shell cases be traced back to the weapon allegedly used?

--What was the motive?  They have implied that Amy Bishop was angry over being denied tenure, but officially speaking they did not posit any motive.  What did Amy herself have to say?

--Since her arrest, Amy Bishop was never given the opportunity to tell her side of the story.  Yet there are always two sides to any story.  Why haven't we heard hers?

--Why does the only witness to testify publicly on what happened in that conference room continue to say that she heard the weapon 'click' after it jammed, when any person who's ever tried to clear a jam in a semi-automatic knows you can't move the trigger, much less make it go 'click?'

--After dropping her weapon and jacket into a bathroom, Bishop is alleged to have walked into a lab class and asked to borrow a cell phone from a colleague.  Why is this person never identified, or ask if Bishop appeared nervous, excited, flushed, etc?  Is it just coincidence that the person arrested carrying 'shells' was described as a lab student of Amy Bishop?

You guys are great!  I applaud your critical thinking--it is so refreshing.  We need more people around like you to make other people, really, think.

I think the motive here is she had devised a machine that would cure ALS and possibly other neurological diseases.  Big Pharma cannot have that!

Amy Bishop Anderson says she is 'terribly sorry' for her victims and her own family in a hand-written court document which was filed earlier this month.

WAFF-TV reported the one-time educator included her first apology in her latest court filing challenging her conviction in the February 12, 2010, shooting.

'I am terribly sorry for the victims and their families, and my family,' she wrote in her plea to be relieved from her life sentence.

Bishop Anderson wrote the above note in her plea to be relieved from her life sentence

Bishop Anderson pleaded guilty in 2012 to capital murder and attempted murder after she stood up and began shooting those closest to her with a 9mm handgun during a faculty meeting attended by 12 people in a conference room at UAH.

Those killed in the tragic shooting were Gopi Podila, the biology department chairman, Dr Maria Ragland Davis, a biology professor, and Adriel D. Johnson, a senior biology professor.

At the time of the shooting, professor Debra Moriarty described it as a routine Friday afternoon that turned into a bloody scene of carnage with no warning.

She testified in 2012 that her colleague was sitting unusually quiet during the roughly hour-long meeting, before she opened fire around the crowded conference table.

The biologist waived her right to appeal with the guilty plea, but she has been challenging the conviction ever since.

In one appeal that she filed, Bishop Anderson claimed she was mentally ill and could not legally plead guilty.

Indeed.  It's nice that after three years she could keep that haircut too.  :o  She and her husband were on the cusp of finding a cure for Amyotrophic Lateral Sclerosis (ALS) as well.

The media first invoked Braintree on que. Case was closed. Statute of limitations was in effect. Cops there didn't know anything about it at the time. That tells me that someone wanted to make sure she was pigeonholed in case anything went wrong.

But alas, after extended in-jail treatment, she has confessed to killing Santa Claus.
