Clinton rejects PA settlements condition

Stopping construction in the settlements "has never been a precondition, it has always been an in issue within the negotiations," Clinton said at a joint press conference with Prime Minister Binyamin Netanyahu in Jerusalem.

In a strong show of support for Israel, she said she approved of Netanyahu's decision to issue a moratorium on new construction permits.

"What the prime minister has offered... a restraint on the policy of settlements, which he has just described, no new starts, for example, is unprecedented in the context of prior to negotiations," Clinton said, in advance of her meeting with the prime minister.

Assistant Secretary of State for Public Affairs Philip J. Crowley later clarified for The Jerusalem Post that the United States is still demanding that Israel freeze all settlement activity, but that it should not be a precondition for talks between Israelis and Palestinians.

Clinton arrived in Israel on Saturday evening for a brief visit as part of a regional trip, during which she hoped to restart the stalled Israeli-Palestinian peace talks. She met with Foreign Minister Avigdor Lieberman and Defense Minister Ehud Barak at the David Citadel Hotel before going on to the Prime Minister's Office for talks with Netanyahu.

Earlier in the day, Clinton met with Abbas in Abu Dhabi. He rejected Clinton's request to resume peace talks with Israel, saying this would not happen unless the Netanyahu government froze all construction in the settlements, chief PA negotiator Saeb Erekat said.

Israel has insisted that work must continue on the 3,000 homes now under construction in the settlements and says there are no limits on building in Jerusalem.

PA officials described the meeting with Clinton as "hard" and expressed deep disappointment over what they said was Washington's refusal to pressure Israel to halt construction in the settlements.

According to Erekat, Abbas turned down an offer by the US to resume the peace talks on final-status issues on the basis of "understandings" reached between Washington and Israel regarding settlement construction.

"President Abbas rejected the offer because the understandings are completely unacceptable," Erekat said.

In Jerusalem on Saturday night, in response to a press query, Clinton said, "It is a fact that for 40 years presidents of both parties have questioned the legitimacy of settlements."

She added, however, that "where we are right now is to try to get into the negotiations. The prime minister will be able to present his government's proposal about what they are doing regarding settlements, which I think when fully explained will be seen as being not only as unprecedented but in response to many of the concerns that have been expressed."

Clinton continued, "We hope that we will be able to move into the negotiations where all the issues" will be on the table.

Netanyahu said that Israel was willing to talk with the Palestinians without any conditions.

"We are prepared to start peace talks immediately," he said. "What we should do on the path to peace is to get on it and to get with it."

He said that in the past 16 years the Palestinians had never demanded that Israel freeze settlement activity as a precondition to talks and that their stance now was a change in policy.

It's a stance that Erekat said the Palestinians were insisting upon.

"The Palestinian Authority won't make any concessions on the issue of settlements," he said.

He claimed that the "understandings" reached between Israel and Washington did not include a full cessation of settlement construction, including inside Jerusalem.

Erekat said that halting settlement construction was the "only way to ensure the revival of the peace process."

He added that the gap between the Palestinians and Israel remained very wide - a factor that is hindering the resumption of the peace talks.

Asked about the outcome of his meeting with Clinton, Abbas told reporters: "There's nothing new. We reaffirmed that peace requires a complete cessation of settlement construction."

Abbas said that the "problem" with the Israeli government was that it was refusing to stop settlement construction in line with the peace process.

He said that his talks with Clinton focused on the situation in Jerusalem. "The city is in danger," he said. "The Arabs and Muslims must pay attention to this."

Nabil Abu Rudaineh, a spokesman for Abbas, blamed Israeli "intransigence" for the failure of US efforts to restart the peace talks.

But Channel 1 reported that Lieberman blamed Abbas and said it was "inconceivable" that the Palestinians were placing pre-conditions to negotiations with Israel.

Unlike Netanyahu, Lieberman said there should be pre-conditions for Israeli-Palestinian talks. He told Clinton that he even suggested to Netanyahu not to agree to resume peace talks before the Palestinian agree to both drop their pursuit of the Goldstone Report at the UN and to stop their push to sway the International Criminal Court at The Hague to prosecute individual Israelis.

During his press conference with Clinton, Netanyahu blamed Palestinians for the recent clashes on the Temple Mount.

US House condemns 'biased' UN war report on Gaza

WASHINGTON — The US House of Representatives condemned Tuesday the UN Goldstone report as unfairly accusing Israel of committing war crimes in its 22-day war against Palestinian militants in Gaza.

By a margin of 344-36, lawmakers approved a non-binding resolution that calls the report "irredeemably biased and unworthy of further consideration or legitimacy."

The symbolic measure also urges President Barack Obama and Secretary of State Hillary Clinton "to strongly and unequivocally oppose" any discussion of the report or action on its findings in any international setting.

The Obama administration has already condemned the report, which was expected to go to the UN General Assembly on Wednesday, as unhelpful to its efforts to revive stalled Middle East peace talks.

"I think the UN report is unbalanced, and unfair, and inaccurate," said Democratic House Majority Leader Steny Hoyer.

"It's unfortunate that the United Nations deals with Israel, in my opinion, in a totally biased and unbalanced way. And it is the only country in the world, Israel, that has a special focus by the United Nations," he added.

"I have been to Gaza and I have read in its entirety the Goldstone report and I will tell you he says many things, that though unpleasant, are true, and must not be obstructed," countered Democratic Representative Brian Baird.

Baird bolstered his speech against the resolution with photographs of dead Palestinian children and Israeli children seeking shelter during a suspected Palestinian rocket attack.

The resolution, crafted by Republican Representative Ileana Ros-Lehtinen, expressed support for the Obama administration's condemnation of the report and urges opposition to its findings in any international forum.

"The Goldstone Report illustrates the anti-freedom, anti-Israel bias which deeply pervades the UN system, and it does not deserve consideration or legitimacy from responsible nations," she said after the vote.

"Even in the fog of war, it is clear that Israel took every reasonable measure to minimize the risk of civilian casualties. It is clear that Israel had every right and duty to defend its citizens from the onslaught of rocket and mortar attacks from Hamas and other militants in Gaza," she said.

Named after former South African judge Richard Goldstone, who headed the inquiry committee, the UN report accuses Israel and Hamas militants of war crimes during the 22-day conflict that flared up in late December 2008 and ended in January, leaving some 1,400 Palestinians and 13 Israelis dead.

Goldstone recommended that Israel and the Islamist movement Hamas -- which rules the tiny Palestinian coastal enclave -- face possible prosecution in The Hague if they fail to conduct credible investigations within six months.

Hoyer said rocket fire from Palestinian fighters in Gaza had placed Israel in "an unfortunate position" and stressed that Israel "is as careful a government as there is in terms of prosecuting its own defense" officials.

On Monday, Human Rights Watch urged lawmakers not to back the resolution, said the Goldstone report "presents an opportunity to pursue justice for the victims in Gaza and Israel."

"Instead of denouncing the report, the US Congress should urge Israel and Hamas to break the cycle of abuse and impunity, which for too long has fueled hatred and hindered efforts at peace," said Sarah Leah Whitson, Middle East and North Africa director at Human Rights Watch.

IAEA: We found 'nothing to worry about' at secret Iran nuke site


United Nations inspectors found "nothing to be worried about" in a first look at a previously secret uranium enrichment site in Iran last month, the International Atomic Energy chief said in remarks released Thursday.

Mohammed ElBaradei also told the New York Times that he was examining possible compromises to unblock a draft nuclear cooperation deal between Iran and three major powers that has floundered over Iranian objections.

The nuclear site, which Iran revealed in September three years after diplomats said Western spies first detected it, added to Western fears of covert Iranian efforts to develop atom bombs. Iran says it is enriching uranium only for electricity.
   
ElBaradei was quoted in a New York Times interview as saying his inspectors' initial findings at the fortified site beneath a desert mountain near the Shi'ite holy city of Qom were "nothing to be worried about."

"The idea was to use it as a bunker under the mountain to protect things," ElBaradei, alluding to Tehran's references to the site as a fallback for its nuclear program in case its larger Natanz enrichment plant were bombed by a foe like Israel.

"It's a hole in a mountain," he said.

The IAEA has declined to comment on whether the inspectors came across anything surprising or were able to obtain all the documentation and on-site access they had wanted at the remote spot about 160 km (100 miles) south of Tehran.

Details are expected to be included in the next IAEA report on Iran's disputed nuclear activity due in mid-November.

The inspectors' goal was to compare engineering designs to be provided by Iran with the actual look of the facility, interview scientists and other employees, and take soil samples to check for any traces of activity oriented to making bombs.

Western diplomats and analysts say the site's capacity appears too small to fuel a nuclear power station but enough to yield fissile material for one or two nuclear warheads a year.

The Islamic Republic revealed the plant's existence to the Vienna-based UN nuclear watchdog on Sept. 21. It said the site, which remains under construction, would enrich uranium only to the low 5 percent purity suitable for power plant fuel.

Enrichment to the 90 percent threshold provides the fissile material that detonates nuclear weapons.

After talks with Iran and three world powers, ElBaradei drafted a plan for Iran to transfer most of its low-enriched uranium (LEU) to Russia and France to turn it into fuel for a Tehran reactor that makes isotopes for cancer treatment.

Russia, France and the United States, which would help modernize the reactor's safety equipment and instrumentation under the deal, see it as a way to reduce Iran's LEU stockpile below the threshold needed to produce material for a bomb.

But since the Oct. 19-21 talks, Iran has made clear it is loath to ship its own LEU abroad because of its strategic value, and would prefer buying the reactor fuel it needs from foreign suppliers. Iran has called for more talks.

Western diplomats say the three powers do not want more talks and that Iran's demands are a non-starter as they would do nothing to remove the risk of nuclear proliferation in Iran.

ElBaradei was quoted by the New York Times as saying the problem boiled down to "total distrust on the part of Iran ..."

"The issue is timing, whether the uranium goes out and then some time later they get the fuel, as we agreed [tentatively] in Geneva, or whether it only goes at the same time as the fuel is delivered," he said.

"There are a lot of ideas. One is to send [Iran's uranium] to a third country, which could be a friendly country to Iran, and it stays there. Park it in another state ...[for] something like a year..., then ... bring in the fuel. The issue is to get it out, and so create the time and space to start building trust."

Israel proposes work camps for illegal migrants

The government is considering establishing work camps in the south of the country, where illegal migrant workers will receive shelter, food and medical care, Army Radio reported Wednesday. In exchange, illegal migrants would perform manual labor outside the camps, but would not earn a salary.

They would stay at the camp until their asylum claims are decided, which could take months or years.

The proposal, part of the effort to address the problems posed by illegal migrants, would place asylum seekers at jobs in communities in the Negev and Arava. Their salaries would go to the state, in order to fund the camps.

The issue of illegal foreign migrants and refugees has made the headlines due to the efforts by human rights organizations to block the deportation of 1,200 foreign workers' children. One of the main arguments by deportation advocates, including Interior Minister Eli Yishai (Shas), is that allowing them to stay would bring hundreds of thousands more illegal migrants.

They would bring in "a range of diseases such as hepatitis, measles, tuberculosis and AIDS [as well as] drugs," said Yishai.

"I fear how far we have fallen," said MK Dov Khenin (Hadash) in reaction to the work camp proposal, adding that he thinks the plan would encourage many more asylum seekers to try to enter Israel.

"The plan [would] induce refugees to come to Israel. A bed is an incentive compared to where they come from. Israel has the right to close its borders, but when someone comes here, you cannot fight with him. This shows that we haven't learned a thing, as people living in a country established by refugees for refugees," Khenin added.

In addition to the opposition of human rights groups, communities in the south may also not respond favorably to the plan. In April 2008, during a court hearing on the government's policy of putting asylum seekers in the northern and southern peripheries, north of Hadera and south of Gedera, an affidavit was presented to the court on the migrants' employment prospects. In the document, Sigal Rosen of the Hotline for Migrant Workers declared that kibbutzim in the south had not shown an interest in hiring the migrants.

"We contacted many kibbutzim in an effort to have Sudanese asylum seekers released for farm work," she said. "Despite the argument they desperately needed workers, most of the coordinators at the kibbutzim rejected my request after they learned they would have to pay the asylum seekers at least minimum wage, as provided by law, [and] could not make deductions from their salaries beyond what the law on foreign workers requires."

Rosen contacted hundreds of potential employers at kibbutzim and moshav cooperative farming communities, but very few were interested. In the end, only 14 moshavim and two kibbutzim agreed to hire Sudanese migrants as agricultural workers.

Amnesty International also criticized the proposal yesterday. The group's Israel director, Itay Epstein, said: "The crazy idea of housing refugees in work camps in the south by force is contrary to international law and to every international treaty to which Israel is a party."

He added, "Israel is obligated to grant refugees and asylum seekers who come knocking on its door a safe haven [as well as certain rights], which include the right to live in dignity and to work and earn a living. They certainly should not be employed by force, as we profit from the distress of survivors of genocide and persecution."

Goldstone, U.S. Policy and the Looming Veto: If the UN is so Irresponsible Why is Obama Its Biggest Cheerleader?

Now that the UN General Assembly has endorsed the Goldstone Report--a collection of Hamas propoaganda without any independent investigation--the ball is in the court of the Obama Administration. The non-courageous abstention of Britain and France highlights that fact. Despite all the current president's talk of partnership and multilateral cooperation, a great deal of European policy is based on the premise that the United States has to do most of the work, especially the dirty work.

President Barack Obama made a controversial decision in deciding to have the United States participate in the radical-run UN Human Rights Council, reversing Bush administration policy of boycotting the group. Moreover, the president has gone out of his way to talk about how useful the UN is as a force, sometimes it seems to be in his eyes the most important force, to keeping the world peaceful and making it more so.

The new administration argued that by participating it could moderate the course of a body that never defends human rights in a long list of dictatorships (many of which are members and even leaders of it) but just focuses on bashing Israel.

But now that the point about the Council’s function as a propaganda organ for extremist dictatorships is proven, what does the United States do? Its ambassador isn’t going to the discussion in the General Assembly that’s discussing using the ludicrous Goldstone report as a basis for punishing Israel.

If you need to know just one thing about the Goldstone report, here it is: the commission did not investigate anything. It heard a lot of Palestinian and some other anti-Israel witnesses; wrote down what they said; and put it into the report without verifying anything.

A couple of sidebars:

The U.S. Congress, over the opposition of the anti-Israel pretending to be pro-Israel J Street lobby, passed a resolution criticizing the report.

The EU position was presented by Sweden, a country whose government tried to destroy any Swedes who published the “Muhammad” cartoons but refused to condemn the publication of an article portraying Israel as murdering Palestinians to steal their organs. The Swedes, and hence the EU, said the report was serious and the accusations should be investigated further.

The last point sounds reasonable in the abstract but in context is helping the global anti-Israel haters get the report sent for action to the International Criminal Court in the Hague.

Will the United States veto the resolution in the Security Council? It will take some courage to do so because Obama’s popularity with everyone (including lots of countries generally considered anti-American and even more who want to wipe out Israel) is going to take a big hit as a result.

Or will the United States back down and settle for some easing of the resolution’s language which still makes it a disaster?

This is going to be a big test for Obama, and it is one he cannot avoid. It is also one more step in showing the unworkability of both his ideas and his strategy. Ultimately, his presidency's foreign policy will be judged on whether he and his colleagues can adjust to that factor, admit (at least to themselves) that they were wrong, and change course.

House Shames Itself on Goldstone Report

Shame on the House of Representatives, and on the Democratic leadership of the House, for pushing through a resolution once again blindly taking the side of Israeli aggression.

I’m referring to the vote on Tuesday, by a lopsided 344-to-36 margin*, to condemn the Goldstone report on Gaza.

That report, by South African jurist Richard Goldstone for the UN, showed that both Israel and Hamas had committed war crimes in the lead-up to and during Israel’s invasion of Gaza almost a year ago. (To read the executive summary, click here)

It noted that Israel deliberately attacked civilian targets, and did not take sufficient action to minimize civilian loss of life. For instance, it found that Israel even refused to allow the evacuation of the injured by ambulance.

The report also condemned Hamas for its rocket attacks into Israel, which the report said were designed to create terror.

Even as the U.N. was about to consider the report, the House measure called it “irredeemably biased and unworthy of further consideration or legitimacy.” And it urged the Obama Administration to “strongly and unequivocally oppose” any discussion of it at the UN.

This reflexive attitude that Israel can do no wrong is morally bankrupt and exceedingly unhelpful in resolving, in a just manner, the conflict between Israel and Palestinians.

Dennis Kucinich had it right when he denounced the House majority for going along with this. His statement is so powerful that I’m excerpting it at length here.

“Today we journey from Operation Cast Lead to Operation Cast Doubt,” he said on the House floor on Tuesday. “Almost as serious as committing war crimes is covering up war crimes, pretending that war crimes were never committed and did not exist.

“Because behind every such deception is the nullification of humanity, the destruction of human dignity, the annihilation of the human spirit, the triumph of Orwellian thinking, the eternal prison of the dark heart of the totalitarian.

“The resolution before us today, which would reject all attempts of the Goldstone Report to fix responsibility of all parties to war crimes, including both Hamas and Israel, may as well be called the ‘Down is Up, Night is Day, Wrong is Right: resolution.’ . . .

"How can we ever expect there to be peace in the Middle East if we tacitly approve of violations of international law and international human rights, if we look the other way, or if we close our eyes to the heartbreak of people on both sides by white-washing a legitimate investigation?

"How can we protect the people of Israel from existential threats if we hold no concern for the protection of the Palestinians, for their physical security, their right to land, their right to their own homes, their right to water, their right to sustenance, their right to freedom of movement, their right to human security of jobs, education and health care?

"We will have peace only when the plight of both Palestinians and Israelis is brought before this House and given equal consideration in recognition of that principle that all people on this planet have a right to survive and thrive, and it is our responsibility, our duty to see that no individual, no group, no people are barred from this humble human claim."

Until most members of Congress show some respect for international law and some humanity toward Palestinians, there’s no reason for Israel to.

Leverage Against Netanyahu

The Israeli government's clear intent to do nothing to jump-start peace negotiations - and to threaten to launch a war against Iran if Washington doesn't - leaves the US in a bind. How to push Israel to end all their settlement provocations and fundamentalist intransigence in Jerusalem and the West Bank? Obviously, in a rational environment, the US would look to the massive aid that American tax-payers send to Israel, especially the illegal military aid to a country secretly possessing nuclear weapons which it insists on denying to any regional neighbors. If you're trying to pressure an ally, aid is one of the obvious ways to do it.

Of course, the idea of using the lever of suspending aid has long been a non-starter in Washington so strong is Israel's support in the capital. But Tom Friedman today urged a policy of American withdrawal from the conflict altogether until the two/three parties show some minimal interest in moving forward:

    If the status quo is this tolerable for the parties, then I say, let them enjoy it. I just don’t want to subsidize it or anesthetize it anymore. We need to fix America.

That no-subsidies-for-Middle-East-intransigents line would have real traction for many Americans, sick of spending their money and risking the lives of their sons and daughters in religious conflicts far away. (It could be used against Egypt as well). More interestingly, as Greenwald notes, Joe Klein now thinks using aid as leverage is a good idea:

    It is in the best interests of the United States for the Israelis to make this deal. It is also in the best interests of the Israelis. The Neocon-Likudniks have neither Israel's nor our best interests at heart. Boot is right: The Obama Administration may have to be a bit less "grandiose" in dealing with Netanyahu's irredentist government. It should start by putting a hold on all economic and military aid to Israel; the aid should not be discontinued, just held, for a nice long review until the Netanyahu government comes to understand that Jerusalem must be the capital of both Israel and Palestine, and that if you actually want peace, you don't build illegal settlement colonies in the Palestinian capital.

Remember also that American tax-payers helped finance the Gaza assault. At some point, the US has a right to say: no mas.
