Reporting from Washington -- The Supreme Court said today that DNA possesses a unique ability to free the innocent and convict the guilty, but the justices nonetheless ruled that prisoners do not have a constitutional right to demand DNA testing of evidence that remains in police files.

In a 5-4 ruling, the court's conservative bloc agreed to stand back and allow states to work out the rules for new testing of old crime samples.

EL PASO, Texas -- It all started with a phone call. “Well, the school called me it was about nine, and told me that my son had an incident at school,” said Charity Walka, recalling a morning about a month ago.
But little did Walka know that her son’s trouble in class would hit her in the pocket. She said her son has a behavioral disorder and was on medication and couldn’t stay awake in class at Travis Elementary School.
"So he fell asleep again, and when they tried to wake him, he got angry,” Walka said.
She said her son then left the classroom after a teacher tried to restrain him. She said her son also made noise in the hall and he laid down on the floor and wouldn’t get up. For disrupting class, officers at El Paso Independent School District gave her 10-year-old son a ticket for $260 and it is a Class C Misdemeanor. She said her son did not hurt anyone.
"It was just devastating. I was just so angry. He doesn't understand," Walka told KFOX.
KFOX reporter Miri Marshall spoke with EPISD officials who said the ticket is legal under Texas law.
"The Texas Family Code does allow for a student who is 10 years of age or older to be cited under this type of offense," said Berenice Zubia, a spokesperson for
10 year old gets $260 fine and possible misdemeaner

El Paso Independent School District.
Marshall found a copy of the law on a legal Web site, showing it falls under Texas Education Code 37.124, although an age was not specified in a version KFOX found.
Zubia said it is rare that elementary school students get cited for disrupting class and the fines collected do not go to the school district. She said students can receive citations after a series of incidences of misbehavior. The tickets then go to a Justice Of The Peace for a final decision.
Law or not, Walka didn't take the ticket sitting down. She fought it and it was dismissed.
Papers show she was supposed to go to court on the matter on Tuesday. She said her son was going to have to enter a plea, but she said he would not understand what a plea is.
"I could see him getting a citation for drugs or weapons in the school, but disrupting the class, that just seems a bit much. I don't think the punishment fits the crime," Walka said.

Bank failures would have forced the government to cancel police leave and deploy troops as the breakdown of the financial payments system threatened the ability of utilities to provide essential services, said David Livingstone, a fellow at the Royal Institute for International Affairs in London, a former adviser to the government’s Cobra crisis response committee.

“You are talking about a situation with mass disorder and panic,” the former Royal Navy officer said in an interview. There would be “riots, pandemonium, everyone fending for themselves.”

Oct. 7 (Bloomberg) -- Investors should hold onto long positions in gold as bullion has “significant upside potential” to reach as high as $1,500 an ounce, Barclays Capital said, citing trading patterns.

“Having rallied ‘off the charts’, we are left to resort to projections and extrapolated trendlines to forecast where the move might stop,” Jordan Kotick, global head of technical analysis at Barclays Capital, wrote in a note e-mailed today.

So-called trendlines are used to determine momentum and are found by connecting an asset’s high prices and low prices over a given period to form a channel.

“Channel resistance currently is at $1,370; history suggests a run at $1,500,” Kotick wrote. “Taking it a step at a time, in the coming weeks, we view consolidation above $1,020 as extremely positive, targeting $1,050 initially, and $1,120,” he added.

Gold for immediate delivery gained as much as 2.6 percent to a record $1,043.78 an ounce yesterday, and traded at $1,038.46 at 10:35 a.m. in Singapore.

“We suspect the rally is wave 3 of 5, indicating an eventual push toward the $1,120 area and potentially beyond into year end,” wrote Kotick, referring to the Elliott Wave theory, which holds that market swings follow a predictable five-stage pattern of three steps forward, two steps back.

“Initial resistance is found in the $1,050 area but that is way too conservative given the springboard that a wide 18- month range provides,” he added.

Not Unstoppable

To be sure, when compared against the major currencies, it’s clear that the gold rally is “by no means unstoppable, as none of the charts show prices concurrently pressing against their respective all-time highs,” Kotick said.

Gold priced in euros, pounds, South African rand, Australia and New Zealand dollars hit records in February as investors turned to bullion as a hedge against weakening currencies. Gold reached a peak of 783.87 euros and 692.66 pounds on Feb. 18.

“Against sterling, gold is making great strides, and against the euro it is breaking higher out of range, but against the yen it is holding in a well-defined range,” said Kotick. “These charts speak volumes: as much about currency perceptions as the value of gold.”

I have a question about your personal convictions. How do reconcile the fact that you bring on and seem to endorse the viewpoints of guys like Jordan Maxwell, (who explains that the entire Bible is nothing but a coded story based on astrology worship) and Michael Tsarion yet you claim to agree with Christian beliefs.  I hear you talk a lot about the human "species" in a very worldly way as if this life on earth is all there is to existence. The Bible talks about storing up riches in heaven, not on earth and making fishers of men by telling others about salvation through a personal relationship with Jesus. The Bible explains the earth and our solar system as God designed it is destined to be completely destroyed and a new heaven and earth will be created by God for those who love him. I'm concerned about the message you are helping to put out by having these guys on your show who seem determined to mislead people about the Gospel. Oftentimes these types of people clothe there beliefs in Christian language but when you look further and study their information turns out be occult philosophy clothed in light. I am a regular listener and a fan of yours and agree with a lot of what you discuss ,but I would like you to please address this issue. Thanks.

Your web guys could setup http://donate.infowars.com as a URL frame or redirect in a few seconds, and that should make a big difference in donations.

Most people are fed up with limelight and it's prying into your computer (just run PeerGuardian and you'll see what I mean).

And GoDaddy sucks, imho, but that's another issue. I recommend Enom or one of its resellers.

Check the Infowars.com web site - partially broken?

A viewer is supposed to be able to manually go forward or backward in the list of stories on the top left side of the page (uses Flash Player) and it will loop through the entire list and start over.  But you cannot currently (as of Noon EDT 10/27 - it started last night) go past "Swine Flu Scam Reaches New Heights With Obama’s Emergency Declaration" nor backwards from the first story.  Obviously a minor programming glitch someone needs to look into.
